[Machine] I have not seen anyone during the time of the Messenger of Allah ﷺ praying them (the two rak'ah after 'Asr) and giving permission for them. Abu Dawud said, "I heard Yahya ibn Ma'in saying, 'He (Shu'ayb) is Shu'bah and they are in his name.' The Shaykh (Abu Dawud) said, 'The saying in a similar matter is the saying of the one who witnessed it, not the one who did not witness it. And with Allah is the tawfiq (success).'"  

البيهقي:٤٥٠٥أنبأ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا ابْنُ بَشَّارٍ ثنا مُحَمَّدُ بْنُ جَعْفَرٍ ثنا شُعْبَةُ عَنْ أَبِي شُعَيْبٍ عَنْ طَاوُسٍ قَالَ سُئِلَ ابْنُ عُمَرَ ؓ عَنِ الرَّكْعَتَيْنِ قَبْلَ الْمَغْرِبِ فَقَالَ

مَا رَأَيْتُ أَحَدًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ يُصَلِّيهِمَا وَرَخَّصَ فِي الرَّكْعَتَيْنِ بَعْدَ الْعَصْرِ قَالَ أَبُو دَاوُدَ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ هُوَ شُعَيْبٌ وَهِمَ شُعْبَةُ فِي اسْمِهِ قَالَ الشَّيْخُ الْقَوْلُ فِي مِثْلِ هَذَا قَوْلُ مَنْ شَاهَدَ دُونَ مَنْ لَمْ يُشَاهِدْ وَبِاللهِ التَّوْفِيقُ
