البيهقي:١٧٨٥٢ – أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ أنبأ أَبُو حَامِدِ بْنُ بِلَالٍ ثنا يَحْيَى بْنُ الرَّبِيعِ ثنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ عَنْ يَزِيدَ بْنِ هُرْمُزَ قَالَ كَتَبَ نَجْدَةُ إِلَى ابْنِ عَبَّاسٍ ؓ يَسْأَلُهُ عَنِ

الْعَبْدِ وَالْمَرْأَةِ يَحْضُرَانِ الْمَغْنَمَ هَلْ لَهُمَا مِنَ الْمَغْنَمِ شَيْءٌ؟ قَالَ فَكَتَبَ إِلَيْهِ لَيْسَ لَهُمَا شَيْءٌ إِلَّا أَنْ يُحْذَيَا

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ عُيَيْنَةَ وَذَكَرَ أَبُو يُوسُفَ فِي هَذَا الْحَدِيثِ عَنْ إِسْمَاعِيلَ يَسْأَلُهُ عَنِ الصَّبِيِّ مَتَى يَخْرُجُ مِنَ الْيُتْمِ؟ وَمَتَى يُضْرَبُ لَهُ بِسَهْمِهِ؟ فَقَالَ إِنَّهُ يَخْرُجُ مِنَ الْيُتْمِ إِذَا احْتَلَمَ وَيُضْرَبُ لَهُ بِسَهْمٍ
