70. Chapter
٧٠۔ كِتَابُ الْمُدَبَّرِ
[Machine] About a slave who had no money except for himself, so the prophet ﷺ was informed about this and he said, "Who will buy him?" Nuyam ibn Abdullah bought him for 800 dirhams and paid it to him. I heard Jabir saying that a Coptic slave died in the first year with the last words "Lafthu 'Arin" (meaning unclear). Abu Amr Muhammad ibn Abdullah al-Adib informed us, Abu Bakr al-Isma'ili informed me, Abu Ya'la informed me, and Abu ar-Rabi' al-Zahrani informed me, Hammad ibn Zaid mentioned it with its chain of narration except that he said, "He freed a slave from him from Dubur."
عَنْ دُبُرٍ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ مَنْ يَشْتَرِي ؟ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَدَفَعَهَا إِلَيْهِ سَمِعْتُ جَابِرًا يَقُولُ عَبْدًا قِبْطِيًّا مَاتَ عَامَ الْأَوَّلِ لَفْظُ عَارِمٍ 21532 وَأَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي أَبُو يَعْلَى ثنا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ ثنا حَمَّادُ بْنُ زَيْدٍ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ قَالَ أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ
[Machine] The messenger of Allah called for Dhubur and sold him. Jabir said, "The boy only died in the first year."
عَنْ دُبُرٍ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَبَاعَهُ قَالَ جَابِرٌ إِنَّمَا مَاتَ الْغُلَامُ عَامَ أَوَّلٍ
[Machine] Amr ibn Dinar heard Jabir ibn Abdullah saying that a man from the Ansar had a young servant boy who did not have any wealth other than him. So the Messenger of Allah ﷺ bought him. Jabir ibn Abdullah said that Ibn Nahham bought him as an Abyssinian slave and he died in the year of Ibn Zubayr.
سَمِعَ عَمْرُو بْنُ دِينَارٍ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ دَبَّرَ رَجُلٌ مِنَ الْأَنْصَارِ غُلَامًا لَهُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَاعَهُ رَسُولُ اللهِ ﷺ قَالَ جَابِرُ بْنُ عَبْدِ اللهِ اشْتَرَاهُ ابْنُ النَّحَّامِ عَبْدًا قِبْطِيًّا مَاتَ عَامَ ابْنِ الزُّبَيْرِ
[Machine] The Prophet ﷺ said, "Who will buy him from me?" So Nuaim bin Nahham bought him. 'Amr said that he heard Jabir saying, "A Coptic slave of ours died in the year of the first reign of Ibn Az-Zubair. Abul- Zubair At-Tamimi said to him, 'Was this slave of yours a free man?', 'Umar said (to Ibn Az-Zubair), 'If you wish, I will tell you about him. When 'Umar died, I came to Asim bin 'Umar and said, 'Umar executed a man from us and he was a Muslim.' Asim said, 'Who informed you?" I replied, 'Ibn 'Abbas.' Asim said, 'How did Ibn 'Abbas know about it And then I narrated the whole narration to him. When I left him, I met 'Abdullah bin 'Umar and informed him of the whole narration, whereupon 'Abdullah bin 'Umar said, 'Narrate it to me as you have narrated it to him (i.e., 'Asim).' So I narrated it to him similarly. A man from us present here (i.e., Al-Qasim bin Muhammad) said, 'Was it 'Umar who executed your men while they were Muslims?' I replied, 'Yes.' He said, 'The Muslim people will remain unhappy with the 'Uthmanic management of affairs till a dog dies of thirst on the bank of the River Euphrates.'" The narrator added, "I said to Al-Qasim, "Will the people remain in that state?" He replied, "The people will remain in that state as long as tampering with the Divine Laws and the tradition of Allah's Messenger ﷺ will take place with those amongst them who abide by Allah's Laws and adhere to the tradition of Allah's Messenger ﷺ ." Then 'Abdullah bin 'Umar narrated the same narration I heard from him earlier from the Prophet. (Sahih Bukhari, Hadith 6587)
النَّبِيُّ ﷺ مَنْ يَشْتَرِيهِ مِنِّي ؟ فَاشْتَرَاهُ نُعَيْمٌ النَّحَّامُ قَالَ عَمْرٌو فَسَمِعْتُ جَابِرًا يَقُولُ عَبْدًا قِبْطِيًّا مَاتَ عَامَ أَوَّلٍ فِي إِمَارَةِ ابْنِ الزُّبَيْرِ وَزَادَ أَبُو الزُّبَيْرِ يُقَالُ لَهُ يَعْقُوبُ قَالَ الشَّافِعِيُّ هَكَذَا سَمِعْتُهُ مِنْهُ عَامَّةَ دَهْرِي ثُمَّ وَجَدْتُ فِي كِتَابِي دَبَّرَ رَجُلٌ مِنَّا غُلَامًا لَهُ فَمَاتَ فَإِمَّا أَنْ يَكُونَ خَطَأً مِنْ كِتَابِي أَوْ خَطَأً مِنْ سُفْيَانَ فَإِنْ كَانَ مِنْ سُفْيَانَ فَابْنُ جُرَيْجٍ أَحْفَظُ لِحَدِيثِ أَبِي الزُّبَيْرِ مِنْ سُفْيَانَ وَمَعَ ابْنِ جُرَيْجٍ حَدِيثُ اللَّيْثِ وَغَيْرِهِ وَأَبُو الزُّبَيْرِ يُحَدِّثُ الْحَدِيثَ تَحْدِيدًا يُخْبِرُ فِيهِ حَيَاةَ الَّذِي دَبَّرَهُ وَحَمَّادُ بْنُ زَيْدٍ مَعَ حَمَّادِ بْنِ سَلَمَةَ وَغَيْرِهِ أَحْفَظُ لِحَدِيثِ عَمْرٍو مِنْ سُفْيَانَ وَحْدَهُ وَقَدْ يُسْتَدَلُّ عَلَى حِفْظِ الْحَدِيثِ مِنْ خَطَئِهِ بِأَقَلَّ مِمَّا وَجَدْتُ فَقَدْ أَخْبَرَنِي غَيْرُ وَاحِدٍ مِمَّنْ لَقِيَ سُفْيَانَ بْنَ عُيَيْنَةَ قَدِيمًا أَنَّهُ لَمْ يَكُنْ يُدْخِلُ فِي حَدِيثِهِ مَاتَ وَعَجِبَ بَعْضُهُمْ حِينَ أَخْبَرْتُهُ أَنِّي وَجَدْتُ فِي كِتَابِي مَاتَ وَقَالَ لَعَلَّ هَذَا خَطَأٌ عَنْهُ أَوْ زَلَلٌ مِنْهُ حَفِظْتَهَا عَنْهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ أَمَّا حَدِيثُ حَمَّادِ بْنِ زَيْدٍ عَنْ عَمْرِو بْنِ دِينَارٍ فَقَدْ ذَكَرْنَاهُ وَمَعَهُ حَدِيثُ شُعْبَةَ عَنْ عَمْرٍو وَأَمَّا حَدِيثُ حَمَّادِ بْنِ سَلَمَةَ عَنْ عَمْرٍو 21536 فَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ يَحْيَى بْنُ حَسَّانَ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ نَحْوَ حَدِيثِ حَمَّادِ بْنِ زَيْدٍ عَنْ عَمْرٍو وَأَمَّا حَدِيثُ ابْنِ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ
[Machine] About this narration, the Prophet ﷺ heard about that slave, so he sold the slave and said, "If any of you is poor, let him start with himself. If he has any surplus, let him share it with his dependents. If he finds more surplus after that, let him give charity to others." As for the Hadith of Al-Layth ibn Sa'd from Abu Az-Zubair...
عَنْ دُبُرٍ مِنْهُ وَإِنَّ النَّبِيَّ ﷺ سَمِعَ بِذَلِكَ الْعَبْدِ فَبَاعَ الْعَبْدَ وَقَالَ إِذَا كَانَ أَحَدُكُمْ فَقِيرًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ لَهُ فَضْلٌ فَلْيَبْدَأْ مَعَ نَفْسِهِ بِمَنْ يَعُولُ ثُمَّ إِنْ وَجَدَ بَعْدَ ذَلِكَ فَضْلًا فَلْيَتَصَدَّقْ عَلَى غَيْرِهِمْ وَأَمَّا حَدِيثُ اللَّيْثِ بْنِ سَعْدٍ عَنْ أَبِي الزُّبَيْرِ
A person from the Banu 'Udhra set a slave free after his death. This news reached the Messenger of Allah (may peace be upon hhn). Upon this he said: Have you any property besides it? He said: No. Upon this he said: Who would buy (this slave) from me? Nulaim b. Abdullah bought it for eight hundred dirhams and (this amount was) brought to the Messenger of Allah ﷺ who returned it to him (the owner), and then said: Start with your own self and spend it on yourself, and if anything is left, it should be spent on your family, and if anything is left (after meeting the needs of the family) it should be spent on relatives, and if anything is left from the family, it should be spent like this, like this. And he was saying: In front of you, on your right and on your left. (Using translation from Muslim 997a)
عَنْ دُبُرٍ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ أَلَكَ مَالٌ غَيْرُهُ ؟ فَقَالَ لَا فَقَالَ مَنْ يَشْتَرِيهِ مِنِّي ؟ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ الْعَدَوِيُّ بِثَمَانِمِائَةِ دِرْهَمٍ فَجَاءَ بِهَا إِلَى رَسُولِ اللهِ ﷺ فَدَفَعَهَا إِلَيْهِ ثُمَّ قَالَ ابْدَأْ بِنَفْسِكَ فَتَصَدَّقْ عَلَيْهَا فَإِنْ فَضَلَ شَيْءٌ فَلِأَهْلِكَ فَإِنْ فَضَلَ عَنْ أَهْلِكَ شَيْءٌ فَلِذِي قَرَابَتِكَ فَإِنْ فَضَلَ عَنْ ذِي قَرَابَتِكَ فَهَكَذَا وَهَكَذَا يَقُولُ فَبَيْنَ يَدَيْكَ وَعَنْ يَمِينِكَ وَعَنْ شِمَالِكَ
[Machine] About a man who had no wealth other than himself, so the Messenger of Allah called for him and said, "Who will buy him?" Nuaim bin Abdullah bin Nahham bought him for 800 dirhams, and he gave them to the Messenger of Allah and said, "If any of you are poor, let him start with himself. If there is any surplus, it should go to his family. If there is still surplus, it should go to his relatives or kin. If there is still surplus, it should be distributed here and there." 21540. And Abu Abdullah Al-Hafiz informed us that Muhammad bin Ya'qub narrated to us, who narrated from Muhammad bin Ishaq bin Ibrahim, who narrated from Ya'qub and Ahmad bin Ibrahim Al-Durraqqi, who said that Ismail bin Ulayyah narrated from Ayyub, who mentioned it.
عَنْ دُبُرٍ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَقَالَ مَنْ يَشْتَرِيهِ ؟ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بْنِ النَّحَّامِ بِثَمَانِمِائَةِ دِرْهَمٍ فَدَفَعَهَا إِلَى رَسُولِ اللهِ ﷺ وَقَالَ إِذَا كَانَ أَحَدُكُمْ فَقِيرًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فِيهَا فَضْلٌ فَعَلَى عِيَالِهِ فَإِنْ كَانَ فَضْلٌ فَعَلَى ذِي قَرَابَتِهِ أَوْ ذِي رَحِمِهِ فَإِنْ كَانَ فَضْلٌ فَهُنَا وَهَاهُنَا 21540 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ إِبْرَاهِيمَ ثنا يَعْقُوبُ وَأَحْمَدُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ قَالَا ثنا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ عَنْ أَيُّوبَ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ asked, "Do you have anything other than him?" He replied, "No." The Messenger of Allah ﷺ then asked, "Who will buy him from me?" Nuaim ibn Abdullah bought him for 800 dirhams, which the Messenger of Allah ﷺ then gave to him. The Messenger of Allah ﷺ said, "Spend it on yourself, and if there is any surplus, spend it on your family, and if there is still a surplus, spend it on your relatives." This is the wording of the narration of Hajjaj, and in the narration of Abu Dawood, it is stated that a man freed his slave from the back, and this news reached the Prophet ﷺ , who said, "Do you have anything other than him?" The rest of the narration has the same meaning.
رَسُولُ اللهِ ﷺ هَلْ لَكَ شَيْءٌ غَيْرُهُ ؟ قَالَ لَا فَقَالَ رَسُولُ اللهِ ﷺ مَنْ يَشْتَرِيهِ مِنِّي ؟ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَدَفَعَهَا رَسُولُ اللهِ ﷺ إِلَيْهِ وَقَالَ أَنْفِقْ عَلَى نَفْسِكَ فَإِنْ فَضَلَ فَضْلٌ فَعَلَى أَهْلِكَ فَإِنْ فَضَلَ فَضْلٌ فَعَلَى قَرَابَتِكَ فَإِنْ فَضَلَ فَضْلٌ فَهَاهُنَا وَهَاهُنَا لَفْظُ حَدِيثِ حَجَّاجٍ وَفِي رِوَايَةِ أَبِي دَاوُدَ أَنَّ رَجُلًا أَعْتَقَ مَمْلُوكًا لَهُ عَنْ دُبُرٍ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ أَلَكَ شَيْءٌ غَيْرُهُ؟ وَالْبَاقِي بِمَعْنَاهُ قَالَ يُونُسُ وَأَشَارَ أَبُو دَاوُدَ بِيَدِهِ أَمَامَهُ وَعَنْ يَمِينِهِ وَعَنْ يَسَارِهِ وَكَذَلِكَ
[Machine] About Dubur, he passed away, so the Messenger of Allah ﷺ took him and said, "Who will buy him from me?" So Nuaim ibn Abdullah bought him for 800 dirhams and paid him its price, 21543. Abu Abdullah Al-Hafidh narrated to us, Abdullah ibn Muhammad Al-Ka'bi told us, Muhammad ibn Ayyub told us, Ali ibn Al-Hassan told us, Ibn Al-Mubarak told us, from Husayn ibn Al-Muktib, and Abu Al-Hasan Ali ibn Muhammad Al-Muqri narrated to us, Hassan ibn Muhammad ibn Ishaq told us, Yusuf ibn Ya'qub told us, Muhammad ibn Abi Bakr told us, Yahya ibn Sa'id told us, from Husayn Al-Mualim, and he mentioned the Hadith with a chain of narrators similar to that of Al-Khaffaf and its content.
عَنْ دُبُرٍ فَاحْتَاجَ فَأَخَذَهُ رَسُولُ اللهِ ﷺ فَقَالَ مَنْ يَشْتَرِيهِ مِنِّي ؟ فَاشْتَرَاهُ مِنْهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَدَفَعَ إِلَيْهِ ثَمَنَهُ 21543 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْكَعْبِيُّ ثنا مُحَمَّدُ بْنُ أَيُّوبَ أنبأ عَلِيُّ بْنُ الْحَسَنِ ثنا ابْنُ الْمُبَارَكِ عَنْ حُسَيْنِ بْنِ الْمُكْتِبِ ح وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا يَحْيَى بْنُ سَعِيدٍ عَنْ حُسَيْنٍ الْمُعَلِّمِ فَذَكَرَ الْحَدِيثَ بِمِثْلِ إِسْنَادِ الْخَفَّافِ وَمَتْنِهِ
[Machine] From the back and was in need, so he mentioned that to the Messenger of Allah. So he called him and said, "Did you free your slave?" He said, "Yes." So the Prophet, ﷺ , said, "You are more in need of him." Then he said, "Who will buy him?" He said, "Nuaim bin Abdullah, I will buy him." So the Prophet, ﷺ , took its price and handed it over to its owner.
عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا فَذَكَرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَدَعَاهُ فَقَالَ أَعْتَقْتَ غُلَامَكَ؟ فَقَالَ نَعَمْ فَقَالَ النَّبِيُّ ﷺ أَنْتَ أَحْوَجُ إِلَيْهِ ثُمَّ قَالَ مَنْ يَشْتَرِيهِ؟ فَقَالَ نُعَيْمُ بْنُ عَبْدِ اللهِ أَنَا فَاشْتَرَاهُ فَأَخَذَ النَّبِيُّ ﷺ ثَمَنَهُ فَدَفَعَهُ إِلَى صَاحِبِهِ
[Machine] A man from the companions of the Prophet ﷺ freed a slave without any other wealth except him. So the Messenger of Allah ﷺ bought him for eight hundred dirhams and paid it to his master.
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَعْتَقَ عَبْدًا عَنْ دُبُرٍ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَاعَهُ رَسُولُ اللهِ ﷺ بِثَمِانِمِائَةِ دِرْهَمٍ وَدَفَعَهُ إِلَى مَوْلَاهُ
A man declared that his slave would be free after his death, but he had no other property. So the Prophet ﷺ ordered (to sell him). He was then sold for seven hundred or nine hundred (dirhams). (Using translation from Abū Dāʾūd 3955)
عَنْ دُبُرٍ مِنْهُ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَأَمَرَ رَسُولُ اللهِ ﷺ فَبِيعَ بِتِسْعِمِائَةِ دِرْهَمٍ أَوْ بِسَبْعِمِائَةِ دِرْهَمٍ هَذَا هُوَ الصَّحِيحُ
[Machine] A man died and left behind an estate and a debt, so the Prophet ﷺ commanded them to sell it to pay off the debt. They sold it for eight hundred. Abu Bakr ibn al-Harith al-Asbahani informed us that Ali ibn Umar al-Hafiz narrated to us, who was informed by Abu Bakr al-Naysaburi, who was informed by Ahmad ibn Yusuf al-Sulami, who was informed by Abbas ibn Muhammad and Ibrahim ibn Hanai, who said that Abu Nuaim narrated to them on the authority of Shareek, who mentioned it. Abu Bakr al-Naysaburi said that Shareek said, "The statement of Shareek is incorrect because in the hadith of al-Amash from Salamah ibn Kuhayl, he paid the price and said, 'Settle your debt.' And so it was."
أَنَّ رَجُلًا مَاتَ وَتَرَكَ مُدَبَّرًا وَدَيْنًا فَأَمَرَهُمْ رَسُولُ اللهِ ﷺ أَنْ يَبِيعُوهُ فِي دَيْنِهِ فَبَاعُوهُ بِثَمَانِمِائَةٍ أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ثنا أَحْمَدُ بْنُ يُوسُفَ السُّلَمِيُّ وَالْعَبَّاسُ بْنُ مُحَمَّدٍ وَإِبْرَاهِيمُ بْنُ هَانِئٍ قَالُوا ثنا أَبُو نُعَيْمٍ ثنا شَرِيكٌ فَذَكَرَهُ قَالَ أَبُو بَكْرٍ النَّيْسَابُورِيُّ قَوْلُ شَرِيكٍ إِنَّ رَجُلًا مَاتَ خَطَأٌ مِنْهُ لِأَنَّ فِي حَدِيثِ الْأَعْمَشِ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ وَدَفَعَ ثَمَنَهُ إِلَيْهِ وَقَالَ اقْضِ دَيْنَكَ وَكَذَلِكَ
[Machine] There was a man from the Ansar who freed his slave. If anything happened to him and he died, the Prophet ﷺ called for him. He was bought by Nu'aim ibn Abdullah, one of the sons of Adi ibn Ka'b.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ مَمْلُوكَهُ إِنْ حَدَثَ بِهِ حَدَثٌ فَمَاتَ فَدَعَا بِهِ النَّبِيُّ ﷺ فَبَاعَهُ مِنْ نُعَيْمِ بْنِ عَبْدِ اللهِ أَحَدِ بَنِي عَدِيِّ بْنِ كَعْبٍ
[Machine] I heard Jabir ibn Abdullah say that a man made his slave's emancipation a condition after his death, so the Messenger of Allah ﷺ bought him and then gave him his price, and said to him, "You are more deserving of this price than him, and by Allah, the price is not any burden on him, he is wealthy, thus."
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ جَعَلَ رَجُلٌ لِغُلَامِهِ الْعِتْقَ مِنْ بَعْدِهِ فَبَاعَهُ رَسُولُ اللهِ ﷺ ثُمَّ دَفَعَ إِلَيْهِ ثَمَنَهُ وَقَالَ أَنْتَ إِلَى ثَمَنِهِ أَحْوَجُ وَاللهُ عَنْهُ غَنِيٌّ وَكَذَلِكَ
[Machine] A man freed a slave of his, and he didn't have any money other than him, so the Messenger of Allah ﷺ sold him and gave him its price and said, "You are in greater need of its price, and Allah is sufficient without it."
21550 Abu Abdullah Al-Hafiz, Abu Bakr Al-Qadi, and Abu Abdullah Al-Susi narrated to us, they said: Abu Al-Abbas informed us, Anbas informed me, as if Al-Awzai's statement "he didn't have any money other than him" fell on him, so they reported it from Abu Ammar from Ata.
أَعْتَقَ رَجُلٌ غُلَامًا لَهُ وَلَيْسَ لَهُ مَالٌ غَيْرُهُ فَبَاعَهُ رَسُولُ اللهِ ﷺ ثُمَّ دَفَعَ إِلَيْهِ ثَمَنَهُ وَقَالَ أَنْتَ إِلَى ثَمَنِهِ أَحْوَجُ وَاللهُ غَنِيٌّ عَنْهُ 21550 أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ الْقَاضِي وَأَبُو عَبْدِ اللهِ السُّوسِيُّ قَالُوا ثنا أَبُو الْعَبَّاسِ أنبأ الْعَبَّاسُ أَخْبَرَنِي أَبِي فَذَكَرَهُ وَكَأَنَّ الْأَوْزَاعِيَّ سَقَطَ عَلَيْهِ قَوْلُهُ لَيْسَ لَهُ مَالٌ غَيْرُهُ فَرَوَاهُ عَنْ أَبِي عَمَّارٍ عَنْ عَطَاءٍ
[Machine] The Messenger of Allah ﷺ said, "There is no harm in selling the service of a supervisor if he is needed." Abu Abdullah Al-Hafiz informed us that Abu Al-Walid narrated to us that Abu Ja'far Muhammad bin Dharih Al-Ukbary narrated to us that Muhammad bin Tareef narrated to us that Muhammad bin Fudayl narrated to us that Abdul Malik said, "This is a mistake from Ibn Tareef, narrating from Abu Bakr bin Al-Harith Al-Faqih, narrating from Abu Al-Hasan Ad-Daraqutni, who said, "This report is mistaken from Ibn Tareef, and the correct narration is from Abdul Malik, narrating from Abu Ja'far as a Mursal narration." The Sheikh, may Allah have mercy on him, Muhammad bin Tareef, may Allah have mercy on him and us, a Hadith was mentioned to him within a Hadith, because the trustworthy narrators only narrated from Abdul Malik bin Abi Suleiman, narrating from Ata, narrating from Jabir that a man freed a slave for the sake of Allah, and he did not have any other money except that. So the Messenger of Allah ﷺ commanded that he be sold for nine hundred or seven hundred (currency), and Abdul Malik bin Abi Suleiman narrated from Abu Ja'far, who said that the Messenger of Allah ﷺ sold the service of the supervisor. Abu Al-Hasan bin Abdan informed us that Ahmad bin Ubaid narrated to us that Ziyad bin Al-Khalil narrated to us that Musaddad narrated to us that Hushaym narrated to us from Abdul Malik, narrating from Ata, and he mentioned the Hadith in the same way.
قَالَ رَسُولُ اللهِ ﷺ لَا بَأْسَ بِبَيْعِ خِدْمَةِ الْمُدَبَّرِ إِذَا احْتَاجَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ أَبُو الْوَلِيدِ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ ذَرِيحٍ الْعُكْبَرِيُّ ثنا مُحَمَّدُ بْنُ طَرِيفٍ ثنا مُحَمَّدُ بْنُ فُضَيْلٍ ثنا عَبْدُ الْمَلِكِ وَهَذَا خَطَأٌ مِنِ ابْنِ طَرِيفٍ 21552 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أَنْبَأَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ قَالَ عُقَيْبَ هَذَا الْحَدِيثِ هَذَا خَطَأٌ مِنِ ابْنِ طَرِيفٍ وَالصَّوَابُ عَنْ عَبْدِ الْمَلِكِ عَنْ أَبِي جَعْفَرٍ مُرْسَلًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ مُحَمَّدُ بْنُ طَرِيفٍ رَحِمَنَا اللهُ وَإِيَّاهُ دَخَلَ لَهُ حَدِيثٌ فِي حَدِيثٍ لِأَنَّ الثِّقَاتِ إِنَّمَا رَوَوْا عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ عَنْ عَطَاءٍ عَنْ جَابِرٍ أَنَّ رَجُلًا أَعْتَقَ غُلَامًا عَنْ دُبُرٍ مِنْهُ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ فَبِيعَ بِتِسْعِمِائَةٍ أَوْ بِسَبْعِمِائَةٍ 21552 وَعَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ عَنْ أَبِي جَعْفَرٍ قَالَ بَاعَ رَسُولُ اللهِ ﷺ خِدْمَةَ الْمُدَبَّرِ أَخْبَرَنَاهُ أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا زِيَادُ بْنُ الْخَلِيلِ ثنا مُسَدَّدٌ ثنا هُشَيْمٌ عَنْ عَبْدِ الْمَلِكِ عَنْ عَطَاءٍ فَذَكَرَ الْحَدِيثَ وَكَذَلِكَ
[Machine] About the Prophet ﷺ , he only sold the service of the administrator and its meaning.
عَنِ النَّبِيِّ ﷺ إِنَّمَا بَاعَ خِدْمَةَ الْمُدَبَّرِ وَبِمَعْنَاهُ
[Machine] "The Prophet ﷺ sold the service of a housekeeper, and it was narrated by Jabir al-Ju'fi from Abu Ja'far in a similar manner, and it was mentioned by al-Shafi'i in his works from Hajjaj, meaning Ibn Artat, from Abu Ja'far. He responded to it in his later works with what..."
بَاعَ النَّبِيُّ ﷺ خِدْمَةَ الْمُدَبَّرِ وَرَوَاهُ أَيْضًا جَابِرٌ الْجُعْفِيُّ عَنْ أَبِي جَعْفَرٍ هَكَذَا مُرْسَلًا وَذَكَرَهُ الشَّافِعِيُّ فِي الْقَدِيمِ عَنْ حَجَّاجٍ يَعْنِي ابْنَ أَرْطَاةَ عَنْ أَبِي جَعْفَرٍ وَأَجَابَ عَنْهُ فِي الْجَدِيدِ بِمَا
[Machine] "The Prophet ﷺ indeed sold the services of the Muddabbir. So I said to him, 'What is the narration of this from Abu Ja'far, as far as I know, is there anyone who can confirm his hadith even if it is...'"
أَنَّ النَّبِيَّ ﷺ إِنَّمَا بَاعَ خِدْمَةَ الْمُدَبَّرِ فَقُلْتُ لَهُ مَا رَوَى هَذَا عَنْ أَبِي جَعْفَرٍ فِيمَا عَلِمْتُ أَحَدٌ يَثْبُتُ حَدِيثُهُ وَلَوْ
[Machine] In the mosque of the Messenger of Allah ﷺ, there was a man from the Banu 'Udhrah tribe known as Abu al-Mathkur. He had a Coptic slave whom he emancipated for a ransom. Then, he experienced some financial difficulty, so the Messenger of Allah ﷺ said to him, "If any of you is in need, let him start with himself." He then sold him to Nu'aym ibn 'Abdullah, the brother of Banu 'Adi ibn Ka'b, for eight hundred dinars. He benefited from this wealth and became one of the mujahideen and the knowledgeable people of the people of Makkah who sought guidance in their affairs and acted according to the advice of its owner in the best manner as long as Allah willed, and he spent from it as he pleased.
كَانَ فِي مَسْجِدِ رَسُولِ اللهِ ﷺ رَجُلٌ مِنْ بَنِي عُذْرَةَ يُقَالُ لَهُ أَبُو الْمَذْكُورِ وَكَانَ لَهُ عَبْدٌ قِبْطِيٌّ فَأَعْتَقَهُ عَنْ دُبُرٍ مِنْهُ ثُمَّ احْتَاجَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ إِذَا كَانَ أَحَدُكُمْ ذَا حَاجَةٍ فَلْيَبْدَأْ بِنَفْسِهِ قَالَ فَبَاعَهُ مِنْ نُعَيْمِ بْنِ عَبْدِ اللهِ أَخِي بَنِي عَدِيِّ بْنِ كَعْبٍ بِثَمَانِمِائَةٍ فَانْتَفَعَ بِهَا فَكَانَ مُجَاهِدٌ وَفُقَهَاءُ أَهْلِ مَكَّةَ يَرَوْنَ التَّدْبِيرَ وَصِيَّةً صَاحِبُهَا فِيهَا بِالْخِيَارِ مَا عَاشَ يُمْضِي فِيهَا مَا شَاءَ وَيَرُدُّ مِنْهَا مَا شَاءَ
A man manumitted a slave and he had no other property than that, so the Prophet ﷺ canceled the manumission (and sold the slave for him). Nu'aim bin Al-Nahham bought the slave from him. (Using translation from Bukhārī 2415)
أَنَّ رَجُلًا أَعْتَقَ عَبْدًا لَهُ لَيْسَ لَهُ مَالٌ غَيْرُهُ فَرَدَّهُ عَلَيْهِ النَّبِيُّ ﷺ فَابْتَاعَهُ نُعَيْمُ بْنُ النَّحَّامِ
[Machine] Abu Amr Al-Adibi informed us that Abu Bakr Al-Isma'ili informed us that Abu Hafs narrated to us, on the authority of 'Uqbah ibn Mukram, who narrated on the authority of Salim ibn Qutaybah, who narrated on the authority of Ibn Abi Dhi'b, from Muhammad ibn Al-Munkadir, from Jabir, that a man had a slave and the Prophet ﷺ ordered him to sell him, so he sold him to a man named Nu'aim.
وَأَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أنبأ أَبُو حَفْصٍ ثنا عُقْبَةُ بْنُ مُكْرَمٍ ثنا سَلْمُ بْنُ قُتَيْبَةَ ثنا ابْنُ أَبِي ذِئْبٍ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ أَنَّ رَجُلًا دَبَّرَ عَبْدًا لَهُ فَأَمَرَ النَّبِيُّ ﷺ بِبَيْعِهِ فَابْتَاعَهُ رَجُلٌ يُقَالُ لَهُ نُعَيْمٌ
[Machine] That a man had freed a slave whom he did not have any wealth except him, so the Prophet ﷺ returned him to slavery and then sold him and gave him its price. These three narrations, when combined, constitute the complete hadith.
أَنَّ رَجُلًا أَعْتَقَ عَبْدًا لَهُ لَيْسَ لَهُ مَالٌ غَيْرُهُ فَرَدَّهُ النَّبِيُّ ﷺ فِي الرِّقِّ ثُمَّ بَاعَهُ وَأَعْطَاهُ ثَمَنَهُ هَذِهِ الرِّوَايَاتُ الثَّلَاثَةُ بِمَجْمُوعِهِنَّ يُؤَدِّينَ تَمَامَ الْحَدِيثِ
[Machine] The Prophet ﷺ sold a domestic worker when his owner needed its price.
بَاعَ النَّبِيُّ ﷺ مُدَبَّرًا احْتَاجَ صَاحِبُهُ إِلَى ثَمَنِهِ
[Machine] She managed to tame it and she bewitched it, so it admitted to being bewitched. Aisha ordered it to be sold to the Bedouins who would mistreat her kingdom, so it was sold.
دَبَّرَتْ جَارِيَةً لَهَا فَسَحَرَتْهَا فَاعْتَرَفَتْ بِالسِّحْرِ فَأَمَرَتْ بِهَا عَائِشَةُ ؓ أَنْ تُبَاعَ مِنَ الْأَعْرَابِ مِمَّنْ يُسِيءُ مَمْلَكَتَهَا فَبِيعَتْ
[Machine] "The executor is a testament in which its owner may return whenever he wishes."
الْمُدَبَّرُ وَصِيَّةٌ يَرْجِعُ فِيهِ صَاحِبُهُ مَتَى شَاءَ
[Machine] That Umar ibn Abd al-Aziz sold a trustee in the debt of his companion.
أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ بَاعَ مُدَبَّرًا فِي دَيْنِ صَاحِبِهِ
يَعُودُ الرَّجُلُ فِي مُدَبَّرِهِ
[Machine] The son of the disbeliever sells him if he doesn't need him.
ابْنُ الْمُنْكَدِرِ وَيَبِيعَهُ إِنْ لَمْ يَحْتَجْ
[Machine] Umar said, "Whatever a man frees from his slaves during his illness is a bequest, and if he wishes, he can revoke it."
قَالَ عُمَرُ ؓ مَا أَعْتَقَ الرَّجُلُ مِنْ رَقِيقِهِ فِي مَرَضِهِ فَهِيَ وَصِيَّةٌ إِنْ شَاءَ رَجَعَ فِيهَا
أَنْ يَعُودَ الرَّجُلُ فِي عَتَاقِهِ
[Machine] If a man gives a bequest, then he can change his bequest as he wishes. What about those who have been set free (from slavery)? He said, "Those who have been set free and those who have not been set free."
إِذَا أَوْصَى الرَّجُلُ فَإِنَّهُ يُغَيِّرُ وَصِيَّتَهُ بِمَا شَاءَ فَقِيلَ الْعَتَاقَةُ؟ قَالَ الْعَتَاقَةُ وَغَيْرُ الْعَتَاقَةِ
