70. Chapter
٧٠۔ كِتَابُ الْمُدَبَّرِ
[Machine] About Dubur, then her master died and she disputed with Uthman. He ruled that whatever she gave birth to before being mated with slaves, and whatever she gave birth to after being mated, they would be manumitted with her manumission.
عَنْ دُبُرٍ ثُمَّ تُوُفِّيَ سَيِّدُهَا فَخَاصَمَتْ إِلَى عُثْمَانَ ؓ فَقَضَى أَنَّ مَا وَلَدَتْ قَبْلَ أَنْ تُدَبَّرَ عَبِيدٌ وَمَا وَلَدَتْ بَعْدَ التَّدْبِيرِ يَعْتِقُونَ بِعِتْقِهَا
[Machine] He used to say, "The child of the slave woman is equal to her in status, they are freed by her freedom and ransomed by her ransom."
أَنَّهُ كَانَ يَقُولُ وَلَدُ الْمُدَبَّرَةِ بِمَنْزِلَتِهَا يَعْتِقُونَ بِعِتْقِهَا وَيُرَقُّونَ بِرِقِّهَا 21585
[Machine] He heard Jabir ibn Abdullah saying, "I only see the children of the backward (retreating) except in the position of their mother."
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ مَا أَرَى أَوْلَادَ الْمُدَبَّرَةِ إِلَّا بِمَنْزِلَةِ أُمِّهِمْ
[Machine] "From Ata', Tawus, Mujahid, and Sa'id ibn Jubayr, they said: The offspring of the 'Mudabbirah' are in the same rank as their mothers."
عَنْ عَطَاءٍ وَطَاوُسٍ وَمُجَاهِدٍ وَسَعِيدِ بْنِ جُبَيْرٍ أَنَّهُمْ قَالُوا وَلَدُ الْمُدَبَّرَةِ بِمَنْزِلَةِ أُمِّهِمْ
[Machine] From Sa'id bin Al-Musayyib, Abu Salamah bin Abdul Rahman, Al-Zuhri, and Al-Nakha'i, it is narrated.
عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَالزُّهْرِيِّ وَالنَّخَعِيِّ
[Machine] To sell it and not give it as a gift, and her offspring should be in her position.
أَنْ يَبِيعَهَا وَلَا يَهَبَهَا وَوَلَدُهَا بِمَنْزِلَتِهَا
هَذَا غَيْرُ وَاحِدٍ مِنْ أَهْلِ الْعِلْمِ
[Machine] Al-Shafi'i, may Allah have mercy on him, said, as narrated by someone other than Abu al-Sha'tha' from the people of knowledge.
الشَّافِعِيُّ رَحِمَهُ اللهُ وَقَالَهُ غَيْرُ أَبِي الشَّعْثَاءِ مِنْ أَهْلِ الْعِلْمِ
[Machine] That Abu al-Sha'tha used to say about the female camel: her offspring are like your wall, with which you offer charitable gifts when you die, her fruit will continue to benefit you as long as you live. And he used to say: like your female camel, with which you offer charitable gifts when you die, you will have her offspring and her milk will continue to benefit you as long as you live. And we have heard it was narrated from Makhooul.
أَنَّ أَبَا الشَّعْثَاءِ كَانَ يَقُولُ فِي الْمُدَبَّرَةِ وَلَدُهَا عَبِيدٌ كَحَائِطِكَ الَّذِي تَصَدَّقْتَ بِهِ إِذَا مُتَّ لَكَ ثَمَرُهُ مَا عِشْتَ وَكَانَ عَطَاءٌ يَقُولُ وَكَإِبِلِكَ تَصَدَّقْتَ بِهَا إِذَا مُتَّ فَلَكَ وَلَدُهَا وَلَبَنُهَا مَا عِشْتَ وَرُوِّينَاهُ عَنْ مَكْحُولٍ
[Machine] A man sells his children. The man donates with dates and eats from its fruits. Another person said a decisive statement in response to what his companion said. The woman says that her child will be in her position, and the man may influence the she-camel so it produces, and he will slaughter her child with her. Ikrima said, "So he got up and did not pass a judgment on them with anything." It has been narrated from Zaid ibn Thabit that he did not indicate this statement.
رَجُلٌ يُبَاعُ أَوْلَادُهَا فَإِنَّ الرَّجُلَ يَتَصَدَّقُ بِالنَّخْلِ فَيَأْكُلُ مِنْ ثَمَرِهَا وَقَالَ آخَرُ قَوْلًا نَقَضًا لِلَّذِي قَالَ صَاحِبُهُ قَالَ الْمُدَبَّرَةُ يَكُونُ وَلَدُهَا بِمَنْزِلَتِهَا قَدْ يَهْدِي الرَّجُلُ الْبَدَنَةَ فَتُنْتَجُ فَيَنْحَرُ وَلَدَهَا مَعَهَا قَالَ عِكْرِمَةُ فَقَامَ وَلَمْ يَقْضِ فِيهِمْ بِشَيْءٍ وَقَدْ رُوِيَ عَنْ زَيْدِ بْنِ ثَابِتٍ مَا دَلَّ عَلَى هَذَا الْقَوْلِ
[Machine] In order to take from her womb sustenance other than what is being offered, as long as she remains alive.
لِتَأْخُذْ مِنْ رَحِمِهَا زَادَ فِيهِ غَيْرُهُ مَا دَامَتْ حَيَّةً
[Machine] In the offspring of the executed, when the leader dies, we only see them as free people. Ataa said, the offspring of the executed are slaves unless they are owned. Abu al-Walid said, our companions said that this is Zaid bin Thabit who made her offspring an inheritance and Jabir confirmed this and Ataa and Jabir bin Zaid, the father of Shaathaa, declared it publicly.
فِي أَوْلَادِ الْمُدَبَّرَةِ إِذَا مَاتَ السَّيِّدُ فَلَا نَرَاهُمْ إِلَّا أَحْرَارًا قَالَ وَقَالَ عَطَاءٌ أَوْلَادُ الْمُدَبَّرَةِ عَبِيدٌ إِلَّا أَنْ تَكُونَ حُبْلَى يَوْمَ دُبِّرَتْ قَالَ أَبُو الْوَلِيدِ قَالَ أَصْحَابُنَا فَهَذَا زَيْدُ بْنُ ثَابِتٍ جَعَلَ وَلَدَهَا مِيرَاثًا وَعَلَّقَ الْقَوْلَ فِيهِ جَابِرٌ وَصَرَّحَ بِذَلِكَ عَطَاءٌ وَجَابِرُ بْنُ زَيْدٍ أَبُو الشَّعْثَاءِ
