69. Chapter
٦٩۔ كِتَابُ الْوَلَاءِ
[Machine] Umar said, "If a free woman is under the ownership of a slave and she gives birth to a child, then the child is considered free as the mother is free, and the allegiance of the child belongs to the allies of the mother. But if the father sets the child free, then the allegiance goes to the allies of the father. This also applies if it is narrated that Umar said so."
قَالَ عُمَرُ ؓ إِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ فَوَلَدَتْ لَهُ وَلَدًا فَإِنَّهُ يَعْتِقُ بِعِتْقِ أُمِّهِ وَوَلَاؤُهُ لِمَوَالِي أُمِّهِ فَإِذَا أَعْتَقَ الْأَبُ جَرَّ الْوَلَاءَ إِلَى مَوَالِي أَبِيهِ هَذَا مُنْقَطِعٌ وَقَدْ رُوِيَ مَوْصُولًا عَنْ عُمَرَ ؓ
[Machine] If a free woman marries a male slave, and she gives birth, their children will be freed by her freedom, and their loyalty will be to their mother's master. But if the father is freed, the loyalty will follow him.
إِذَا تَزَوَّجَ الْمَمْلُوكُ الْحُرَّةَ فَوَلَدَتْ فَوَلَدُهَا يُعْتَقُونَ بِعِتْقِهَا وَيَكُونُ وَلَاؤُهُمْ لِمَوْلَى أُمِّهِمْ فَإِذَا أَعْتَقَ الْأَبُ جَرَّ الْوَلَاءَ
عُرْوَةَ
وَالزُّبَيْرِ ؓ مُرْسَلًا
عَنْ عُثْمَانَ ؓ مُنْقَطِعًا بِخِلَافِهِ
[Machine] Concerning the hadith of Uthman (may Allah be pleased with him), it is the most authentic with its witnesses and the narrations of Al-Zuhri are unreliable.
عَنْ عُثْمَانَ ؓ أَصَحُّ بِشَوَاهِدِهَا وَمَرَاسِيلُ الزُّهْرِيِّ رَدِيئَةٌ
[Machine] Ali decreed regarding a slave who had a free woman under him, and she gave birth to children, they were emancipated with the emancipation of their mother, and then their father was emancipated after their allegiance to the tribe of their father. Ibn Al-Mubarak reported that Mammar narrated from Yazid Ar-Rishk that Ali used to drag the allegiance. Ibn Al-Mubarak reported that Sufyan narrated from Jabir from Ash-Sha'bi from Al-Aswad ibn Yazid from Ibn Mas'ud who said, "The master drags the allegiance of his child when he emancipates him." Shurayh used to decree regarding the allegiance of his child, meaning the emancipated children of their mothers, until Al-Aswad informed him with the statement of Ibn Mas'ud, and then Shurayh issued the decree accordingly. Jabir Al-Ju'fi narrated from Ash-Sha'bi from Al-Aswad.
أَنَّ عَلِيًّا ؓ قَضَى فِي عَبْدٍ كَانَتْ تَحْتَهُ حُرَّةٌ فَوَلَدَتْ أَوْلَادًا فَعَتَقُوا بِعَتَاقَةِ أُمِّهِمْ ثُمَّ أُعْتِقَ أَبُوهُمْ بَعْدُ أَنَّ وَلَاءَهُمْ لِعَصَبَةِ أَبِيهِمْ 21523 قَالَ وَأنبأ ابْنُ الْمُبَارَكِ أنبأ مَعْمَرٌ عَنْ يَزِيدَ الرِّشْكِ أَنَّ عَلِيًّا ؓ كَانَ يَجُرُّ الْوَلَاءَ 21524 قَالَ وَأنبأ ابْنُ الْمُبَارَكِ أنبأ سُفْيَانُ عَنْ جَابِرٍ عَنِ الشَّعْبِيِّ عَنِ الْأَسْوَدِ بْنِ يَزِيدَ عَنِ ابْنِ مَسْعُودٍ قَالَ الْعَبْدُ يَجُرُّ وَلَاءَ وَلَدِهِ إِذَا أَعْتَقَ قَالَ وَكَانَ شُرَيْحٌ يَقْضِي بِوَلَاءِ وَلَدِهِ يَعْنِي لِمَوَالِي الْأُمِّ حَتَّى حَدَّثَهُ الْأَسْوَدُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَضَى بِهِ شُرَيْحٌ كَذَا قَالَ جَابِرٌ الْجُعْفِيُّ عَنِ الشَّعْبِيِّ عَنِ الْأَسْوَدِ
[Machine] He said that in the case of a slave woman, she would be under the authority of her master and she would give birth to children for him. Then, her father would be freed and their allegiance would transfer to the freed slave's master. Shurayh narrated this and it is an authentic chain. It is possible that Al-Aswad heard it from both Umar and Ibn Mas'ood, and Allah knows best.
أَنَّهُ قَالَ فِي الْحَرَّةِ تَكُونُ تَحْتَ الْعَبْدِ فَتَلِدُ لَهُ أَوْلَادًا ثُمَّ يُعْتَقُ أَبُوهُمْ أَنَّهُ يَصِيرُ وَلَاؤُهُمْ إِلَى مَوَالِي أَبِيهِمْ فَأَخَذَ بِهِ شُرَيْحٌ هَذَا إِسْنَادٌ صَحِيحٌ وَيُحْتَمَلُ أَنْ يَكُونَ الْأَسْوَدُ حَدَّثَهُ عَنْ عُمَرَ وَابْنِ مَسْعُودٍ جَمِيعًا وَاللهُ أَعْلَمُ
[Machine] Shurayh used to rule in favor of the slave when the free woman he married bore children for him, in terms of the loyalty to their mother. It was said to him, "Indeed, Umar decreed that when the father is freed, the loyalty should be severed." So Shurayh left that.
كَانَ شُرَيْحٌ يَقْضِي فِي الْعَبْدِ إِذَا تَزَوَّجَ الْحُرَّةَ فَوَلَدَتْ لَهُ أَوْلَادًا أَنَّ الْوَلَاءَ لِأُمِّهِمْ فَقِيلَ لَهُ إِنَّ عُمَرَ ؓ قَضَى أَنَّ الْأَبَ إِذَا أُعْتِقَ جَرَّ الْوَلَاءَ فَتَرَكَ شُرَيْحٌ ذَلِكَ
[Machine] That a free woman was under a servant and gave birth to children for him, then the servant was freed, and a contract was settled by mutual consent.
أَنَّ امْرَأَةً حُرَّةً كَانَتْ تَحْتَ عَبْدٍ فَوَلَدَتْ لَهُ أَوْلَادًا ثُمَّ أُعْتِقَ الْعَبْدُ فَقَضَى شُرَيْحٌ بِجَرِّ الْوَلَاءِ
[Machine] About a man, he has sons from a free woman, and the servant has a free father. so it was asked, who has guardianship over his child? he said, for the guardians of the grandfather.
عَنْ مَمْلُوكٍ لَهُ بَنُونَ مِنْ حُرَّةٍ وَلِلْعَبْدِ أَبٌ حُرٌّ فَقِيلَ لِمَنْ وَلَاءُ وَلَدِهِ؟ فَقَالَ لِمَوَالِي الْجَدِّ
