69. Chapter
٦٩۔ كِتَابُ الْوَلَاءِ
[Machine] His son said, "I have obtained what my father obtained in terms of wealth and loyalty of the supporters." His brother said, "Not so, you have only obtained the wealth, but as for the loyalty of the supporters, have you not considered that if my brother were to die today, would I not inherit it?" So they took their dispute to Uthman ibn Affan, and he ruled in favor of his brother regarding the loyalty of the supporters.
ابْنُهُ قَدْ أَحْرَزْتُ مَا كَانَ أَبِي أَحْرَزَ مِنَ الْمَالِ وَوَلَاءَ الْمَوَالِي وَقَالَ أَخُوهُ لَيْسَ كَذَلِكَ إِنَّمَا أَحْرَزْتَ الْمَالَ فَأَمَّا وَلَاءُ الْمَوَالِي فَلَا أَرَأَيْتَ لَوْ هَلَكَ أَخِي الْيَوْمَ أَلَسْتُ أَرِثُهُ أَنَا؟ فَاخْتَصَمَا إِلَى عُثْمَانَ بْنِ عَفَّانَ ؓ فَقَضَى لِأَخِيهِ بِوَلَاءِ الْمَوَالِي
[Machine] And Uthman said, "Authority belongs to the elder ones."
وَعُثْمَانَ ؓ قَالَا الْوَلَاءُ لِلْكُبْرِ
[Machine] "And I consider him to be Abdullah's son, but they say loyalty belongs to the oldest. He means by the oldest, the closest to a father."
وَأَحْسِبُهُ ذَكَرَ عَبْدَ اللهِ ؓ يَقُولُونَ الْوَلَاءُ لِلْأَكْبَرِ قَالَ يَعْنِي بِالْأَكْبَرِ أَقْرَبَهُمْ بِأَبٍ
[Machine] Allah and Zaid. Al-Walaa is for Al-Kubr 21496. It was narrated that Yazid narrated that Shu'bah ibn al-Hajjaj narrated from Al-Mughirah from Ibrahim that Ali, Abdullah, and Zaid said, "Al-Walaa is for Al-Kubr." And it was narrated from Zaid ibn Wahb from Ali, Abdullah, and Zaid as well.
اللهِ وَزَيْدٌ ُؓ الْوَلَاءُ لِلْكُبْرِ 21496 قَالَ وَأنبأ يَزِيدُ أنبأ شُعْبَةُ بْنُ الْحَجَّاجِ عَنِ الْمُغِيرَةِ عَنْ إِبْرَاهِيمَ أَنَّ عَلِيًّا وَعَبْدَ اللهِ وَزَيْدًا ؓ قَالُوا الْوَلَاءُ لِلْكُبْرِ وَرُوِيَ عَنْ زَيْدِ بْنِ وَهْبٍ عَنْ عَلِيٍّ وَعَبْدِ اللهِ وَزَيْدٍ ؓ
[Machine] And Zaid said concerning a man who left a brother for his father and mother, and a half-brother for his father: They made the guardianship for his brother for his father and mother. If the brother dies from the father's side, the guardianship returns to the brother's children from the father and mother.
وَزَيْدًا ؓ قَالَا فِي رَجُلٍ تَرَكَ أَخًا لِأَبِيهِ وَأُمِّهِ وَأَخًا لِأَبِيهِ فَجَعَلَا الْوَلَاءَ لِأَخِيهِ لِأَبِيهِ وَأُمِّهِ فَإِنْ مَاتَ الْأَخُ مِنْ أَبٍ رَجَعَ الْوَلَاءُ إِلَى بَنِي الْأَخِ لِلْأَبِ وَالْأُمِّ
[Machine] If a woman were to free a male or female slave, and she were to leave behind a male child, then the ownership of that slave would belong to her child, regardless of whether they were male or female. However, if there were no male heirs, then the ownership would return to the woman's guardians. Shurayh said, "The ownership is passed down just like inheritance, but ownership cannot be inherited by a female, except for what she has freed."
إِذَا أَعْتَقَتِ الْمَرْأَةُ عَبْدًا أَوْ أَمَةً فَهَلَكَتْ وَتَرَكَتْ وَلَدًا ذَكَرًا فَوَلَاءُ ذَلِكَ الْمَوْلَى لِوَلَدِهَا مَا كَانُوا ذُكُورًا فَإِذَا انْقَطَعَتِ الذُّكُورُ رَجَعَ الْوَلَاءُ إِلَى أَوْلِيَائِهَا وَقَالَ شُرَيْحٌ يَمْضِي الْوَلَاءُ عَلَى وَجْهِهِ كَمَا يَمْضِي الْمِيرَاثُ وَلَكِنْ لَا يُورَّثُ الْوَلَاءَ أُنْثَى إِلَّا شَيْئًا أَعْتَقَتْهُ
[Machine] The inheritance of her son has been passed on to us, the loyalty of the clients. Her son had preserved it. The Juhayniyyun said it is not so, rather they are the clients of our mistress. So when her son dies, their loyalty belongs to us and we inherit them. Aban ibn Uthman ruled in favor of the Juhayniyyun concerning the loyalty of the clients.
وَرَثَةُ ابْنِهَا لَنَا وَلَاءُ الْمَوَالِي قَدْ كَانَ ابْنُهَا أَحْرَزَهُ قَالَ الْجُهَنِيُّونَ لَيْسَ كَذَلِكَ إِنَّمَا هُمْ مَوَالِي صَاحِبَتِنَا فَإِذَا مَاتَ وَلَدُهَا فَلَنَا وَلَاؤُهُمْ وَنَحْنُ نَرِثُهُمْ فَقَضَى أَبَانُ بْنُ عُثْمَانَ لِلْجُهَنِيِّينَ بِوَلَاءِ الْمَوَالِي
[Machine] There was a man who died and left behind three sons. He also left behind some slaves, whom he had freed. Then, two of his sons died and left behind a child each. Sa'id said, "The remaining slaves will inherit from the three." And when he dies, his sons and the sons of his brothers will inherit from the slaves equally, based on the law. And it has been narrated in a transmitted hadith that confirms what has been mentioned in the previous narrations.
فِي رَجُلٍ هَلَكَ وَتَرَكَ بَنِينَ ثَلَاثَةً وَتَرَكَ مَوَالِيَ أَعْتَقَهُمْ هُوَ عَتَاقَةً ثُمَّ إِنَّ رَجُلَيْنِ مِنْ بَنِيهِ هَلَكَا وَتَرَكَا وَلَدًا قَالَ سَعِيدٌ يَرِثُ الْمَوَالِي الْبَاقِيَ مِنَ الثَّلَاثَةِ فَإِذَا هَلَكَ فَوَلَدُهُ وَوَلَدَا إِخْوَتِهِ فِي الْمَوَالِي شَرْعًا سَوَاءٌ وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مُرْسَلٌ يُؤَكِّدُ مَا مَضَى مِنَ الْآثَارِ
[Machine] The Messenger of Allah ﷺ said: "The master is a brother in religion and a favor, and the most deserving of people to inherit from him is the closest one of them to him in emancipation."
قَالَ رَسُولُ اللهِ ﷺ الْمَوْلَى أَخٌ فِي الدِّينِ وَنِعْمَةٌ وَأَحَقُّ النَّاسِ بِمِيرَاثِهِ أَقْرَبُهُمْ مِنَ الْمُعْتِقِ
