[Machine] "A camel entered a garden and caused damage in it. The Messenger of Allah ﷺ decreed that the owners of the gardens should protect them during the day, and that whoever causes damage to livestock at night should be held accountable by their owners."

Yahya related to me from Malik from Ibn Shihab from Haram ibn Sad ibn Muhayyisa that a female camel of al-Bara ibn Azib entered the garden of a man and it did some damage to it. The Messenger of Allah ﷺ gave a judgement that the people of the garden were responsible for guarding it in the day, and the owner of the animals was liable for what the animals destroyed at night.  

مالك:٣٦-٤٨حَدَّثَنِي يَحْيَى عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ حَرَامِ بْنِ سَعْدِ بْنِ مُحَيِّصَةَ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْ فِيهِ فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ وَأَنَّ مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا

Al-Bara' had a she-camel which was accustomed to graze the standing crop belonging to the people. She entered a garden and did damage to it. The Messenger of Allah ﷺ was informed about it. So he gave decision that the owners of gardens are responsible for guarding them by day, and the owners of the animals are responsible for guarding them by night. Any damage done by animals during the night is a responsibility lying on their owners. (Using translation from Abū Dāʾūd 3570)

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ عَلَى خِلَافٍ فِيهِ بَيْنَ مَعْمَرٍ وَالْأَوْزَاعِيِّ فَإِنَّ مَعْمَرًا قَالَ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ عَنْ أَبِيهِ صحيح على خلاف فيه بين معمر والأوزاعي

[Machine] The she-camel of Bara' bin 'Azib entered the wall of a man and caused damage in it. So the Messenger of Allah ﷺ decided that those responsible for the walls should take care of her during the day, and that whatever she damages at night, her owners will be held responsible for. We have mentioned the evidence for this in its appropriate place.
