[Machine] The Messenger of Allah ﷺ decreed by means of an oath taken with a witness. Zaid ibn Hubab asked Malik ibn Anas about taking an oath with a witness, if it is permissible in divorce and manumission. Malik ibn Anas replied, "No, taking an oath with a witness is only permissible in buying and selling and similar matters."  

أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ قَالَ زَيْدُ بْنُ الْحُبَابِ سَأَلْتُ مَالِكَ بْنَ أَنَسٍ عَنِ الْيَمِينِ وَالشَّاهِدِ هَلْ يَجُوزُ فِي الطَّلَاقِ وَالْعَتَاقِ؟ فَقَالَ لَا إِنَّمَا هَذَا فِي الشِّرَاءِ وَالْبَيْعِ وَأَشْبَاهِهِ  

[Machine] I saw the Messenger of Allah ﷺ sitting on a grave, and in another place, Ziyad bin Nu'aym reported that Ibn Hazm (either 'Amr or 'Ammarah) said: "I saw the Messenger of Allah ﷺ while I was leaning against a grave. He said, 'Descend from the grave, do not harm the occupant of the grave, and do not let him harm you.'"  

رَآنِي رَسُولًُ اللهِ ﷺ جَالِسًا عَلَى قَبْرٍ وَقَالَ فِي مَوْضِعٍ آخَرَ زِيَادُ بْنُ نُعَيْمٍ أَنَّ ابْنَ حَزْمٍ إِمَّا عَمْرٌو وَإِمَّا عُمَارَةُ قَالَ رَآنِي رَسُولُ اللهِ ﷺ وَأَنَا مُتَّكِئٌ عَلَى قَبْرٍ فَقَالَ انْزِلْ مِنَ الْقَبْرِ لَا تُؤْذِي صَاحِبَ الْقَبْرِ وَلَا يُؤْذِيكَ
