"عَنْ عُمَرَ قَالَ: إذَا أنَكَحَ العَبْدُ بِغَيْرِ إِذْنِ مَوَالِيهِ فَنِكَاحُهُ حَرَامٌ؛ وَإِذَا نَكَحَ بِإِذْنِ مَوَالِيهِ فَالطَّلَاقُ بِيَدِ مَنْ يَسْتَحِلَّ الْفَرْجَ".
