"عَنِ ابْنِ عَبَّاسٍ أَنَّ امْرَأَةً مَجْنُونَةً أَصَابَتْ فَاحِشَةً فَأَمَرَ عُمَرُ بِرَجْمِهَا، فَقَالَ عَلِىٌّ: أَمَا عَلِمْتَ أَنَّ الْقَلَم مَرْفُوعٌ عَن ثَلاثَةٍ: عَنِ النَّائِم حَتَّى يَسْتَيقِظَ، وَعَنِ الْمُبْتَلَى حَتَّى يَبْرَأَ، وعَنِ الصَّبِىِّ حَتَّى يَحْتَلِمَ؟ قَالَ: بَلَى، قَالَ: فَمَا بَالُ هَذِهِ؟ فَخَلَّى سَبِيلَهَا".
[Machine] "What is this?" they said. 'Umar ordered that it be translated. He returned it and went with it to 'Umar and said, "Do you not know that the pen is raised from a madman until he becomes reasonable, from a patient until he recovers, from a sleeper until he wakes up, and from a child until he reaches the age of discernment."
«مَا هَذِهِ؟» قَالُوا أَمَرَ بِهَا عُمَرُ أَنْ تُرْجَمَ قَالَ فَرَدَّهَا وَذَهَبَ مَعَهَا إِلَى عُمَرَ وَقَالَ «أَلَمْ تَعْلَمْ أَنَّ الْقَلَمَ رُفِعَ عَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَعَنِ الْمُبْتَلَى حَتَّى يُفِيقَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ»
[Machine] Umar brought a madwoman who had committed adultery and he wanted to stone her. Ali said to him, "Do you not know that the pen has been lifted from three: the insane person until he regains his sanity, the child until he reaches the age of puberty, and the sleeper until he wakes up?" So, he left her. This hadith has been narrated with a sound chain of transmission from Ali, from the Prophet Muhammad ﷺ .
أُتِيَ عُمَرُ بِامْرَأَةٍ مَجْنُونَةٍ حُبْلَى فَأَرَادَ أَنْ يَرْجُمَهَا فَقَالَ لَهُ عَلِيٌّ أَوَمَا عَلِمْتَ أَنَّ الْقَلَمَ قَدْ رُفِعَ عَنْ ثَلَاثٍ عَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ «فَخَلَّى عَنْهَا» وَقَدْ رُوِيَ هَذَا الْحَدِيثُ بِإِسْنَادٍ صَحِيحٍ عَنْ عَلِيٍّ عَنِ النَّبِيِّ ﷺ مُسْنَدًا صحيح فيه إرسال
[Machine] And he said to Umar, "O Commander of the believers, did you order the stoning of this person?" Umar replied, "Yes." He said, "Don't you remember that the Messenger of Allah ﷺ said, 'The pen has been lifted from three: the insane person until he comes to his senses, the sleeper until he wakes up, and the child until he reaches puberty.'" Umar said, "You are correct," and he decided not to carry out the punishment. Abu Abdullah said, "Regarding stoning the insane man or woman, there is a difference of opinion among the scholars that I am not knowledgeable about."
وَقَالَ لِعُمَرَ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَرْتَ بِرَجْمِ هَذِهِ؟ قَالَ نَعَمْ قَالَ أَمَا تَذْكُرُ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثٍ عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ قَالَ صَدَقْتَ فَخَلَّى عَنْهَا قَالَ أَبُو عَبْدِ اللَّهِ «بِالْحَجْرِ عَلَى الْمَجْنُونِ وَالْمَجْنُونَةِ مِمَّا لَا أَعْلَمُ فِيهِ خِلَافًا بَيْنَ الْعُلَمَاءِ»
Ibn Abbas said: A lunatic woman passed by Ali ibn AbuTalib. He then mentioned the rest of the tradition to the same effect as Uthman mentioned. This version has: Do you not remember that the Messenger of Allah ﷺ has said: There are three whose actions are not recorded: a lunatic whose mind is deranged till he is restored to consciousness, a sleeper till he awakes, and a boy till he reaches puberty? (Using translation from Abū Dāʾūd 4401)

ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ

[Machine] Umar brought a woman who had committed adultery, and with her was her child. Ali passed by and let her go, saying, "This is a trial from the children of so-and-so." Then he said, "By Allah, I knew that the Messenger of Allah ﷺ said, 'The pen has been lifted from three: from the sleeper until he wakes up, from the one who is insane until he comes to his senses, and from the child until he reaches puberty.'"
أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ زَنَتْ وَمَعَهَا وَلَدُهَا فَمَرَّ عَلِيٌّ فَخَلَّى سَبِيلَهَا وَقَالَ هَذِهِ مُبْتَلَاةُ بَنِي فُلَانٍ ثُمَّ قَالَ وَاللهِ لَقَدْ عَلُمْتُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمُبْتَلَى حَتَّى يَعْقِلَ وَعَنِ الصَّغِيرِ حَتَّى يَبْلُغَ يُكْبُرَ»
