41.1. Cutting off the Hands of a Thief (2/3)
٤١.١۔ كِتَابُ قَطْعِ السَّارِقِ ص ٢
'A'isha reported that Messenger of Allah ﷺ cut off the hand of a thief for a quarter of a dinar rid upwards. (Using translation from Muslim 1684a)
«يُقْطَعُ السَّارِقُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
The prophet ﷺ used to cut off a thief’s hand for a quarter of a dinar and upwards. (Using translation from Abū Dāʾūd 4383)
كَانَ رَسُولُ اللهِ ﷺ «يَقْطَعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The hand of the thief is to be cut off for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4918)
عَنِ النَّبِيِّ ﷺ بِمِثْلِ ذَلِكَ «تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
41.1.16 [Machine] The mention of differences regarding Yahya bin Sa'id in this hadith
٤١.١۔١٦ ذِكْرُ الِاخْتِلَافِ عَلَى يَحْيَى بْنِ سَعِيدٍ فِي هَذَا الْحَدِيثِ
[Machine] The Prophet ﷺ said, "The hand of the thief shall be cut off for a quarter of a dinar or more." Abu Abdur-Rahman said Ibn Uyaynah and Ibn al-Mubarak have narrated this.
أَنَّ النَّبِيَّ ﷺ قَالَ «تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَقْفَهُ ابْنُ عُيَيْنَةَ وَابْنُ الْمُبَارَكِ
The hand of the thief may not be cut off but for a quarter of a dinar and upwards. (Using translation from Muslim 1684e)
أَنَّهَا سَمِعَتْ عَائِشَةَ تَقُولُ «تُقْطَعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The hand of the thief is to be cut off for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4925)
«الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
أَنَّ الْحَدِيثَ مَرْفُوعٌ وَاللهُ أَعْلَمُ
[Machine] "It has not been long on me, and I have not forgotten the pieces in a quarter dinar upwards." Abu Abdul Rahman said, "This is the correct statement, and the hadith of Aban and Saeed is incorrect."
«مَا طَالَ عَلَيَّ وَلَا نَسِيتُ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الصَّوَابُ وَحَدِيثُ أَبَانَ وَسَعِيدٍ خَطَأٌ
41.1.17 [Machine] The mention of the disagreement between Abu Bakr ibn Muhammad and his son Abdullah ibn Abu Bakr about the umrah in it.
٤١.١۔١٧ ذِكْرُ اخْتِلَافِ أَبِي بَكْرِ بْنِ مُحَمَّدٍ، وَابْنِهِ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ، عَلَى عَمْرَةَ فِيهِ
[Machine] She heard the Messenger of Allah ﷺ saying, "The hand of the thief should not be cut off except for a quarter of a Dinar and more." Ahmad ibn Amr ibn Al-Sarh reported to us, Ibn Wahb reported to us, Abdul-Rahman ibn Salman narrated to me from Ibn Al-Had from Abu Bakr ibn Hazm from Amrah from Aisha from the Messenger of Allah ﷺ reciting it to us. I asked the Prophet ﷺ about it and he said to us that it means the same.
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ «لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا» [26] 7376 أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ قَالَ أَخْبَرَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ سَلْمَانَ عَنِ ابْنِ الْهَادِ عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ عَنْ رَسُولِ اللهِ ﷺ قَرَأَهُ عَلَيْنَا قُلْتُ لِلنَّبِيِّ ﷺ فِيهِ قَالَ لَنَا هُوَ يُرِيدُ مِثْلَ ذَلِكَ
"Aishah said: 'Cutting off (the hand of the thief) is for one-quarter of a Dinar or more."' (Using translation from Nasāʾī 4930)
قَالَتْ عَائِشَةُ «الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The Messenger of Allah said: 'The hand of the thief is to be cut off for the price of a shield, and the price of a shield is one-quarter of a Dinar." (Using translation from Nasāʾī 4931)
قَالَ رَسُولُ اللهِ ﷺ «تُقْطَعُ يَدُ السَّارِقِ فِي ثَمَنِ الْمِجَنِّ وَثَمَنُ الْمِجَنِّ رُبْعُ دِينَارٍ»
"The Messenger of Allah used to cut off the (thief's) hand for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4932)
كَانَ رَسُولُ اللهِ ﷺ «يَقْطَعُ الْيَدَ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The Messenger of Allah said: 'The hand (of the thief) is not to be cut off except for one-quarter of a Dinar."' (Using translation from Nasāʾī 4933)
قَالَ رَسُولُ اللهِ ﷺ «لَا تُقْطَعُ الْيَدُ إِلَّا فِي رُبْعِ دِينَارٍ»
[Machine] The Messenger of Allah, ﷺ , said, "The hand is cut off in the crime of stealing." Abu Abdur Rahman said, "I do not know Abdur Rahman ibn Bahar nor Mubarak, this."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «تُقْطَعُ الْيَدُ فِي الْمِجَنِّ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْرِفُ عَبْدَ الرَّحْمَنِ بْنَ بَحْرٍ وَلَا مُبَارَكًا هَذَا
The Messenger of Allah said: 'The hand of the thief is not to be cut off for anything less than a shield."' It was said to 'Aishah: 'What is the price of a shield?" She said: "One-quarter of a Dinar." (Using translation from Nasāʾī 4935)
قَالَ رَسُولُ اللهِ ﷺ «لَا تُقْطَعُ يَدُ السَّارِقِ فِيمَا دُونَ الْمِجَنِّ» قِيلَ لِعَائِشَةَ مَا ثَمَنُ الْمِجَنِّ؟ قَالَتْ رُبْعُ دِينَارٍ
The hand of the thief may not be cut off but for a quarter of a dinar and upwards. (Using translation from Muslim 1684e)
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ «لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"I heard 'Uthman bin Abi AL-Walid, the freed slave of the Akhnasiyin, say: 'I heard 'Urwah bin Az-Zubair say;'Aishah used to narrated that the Prophet said: "The hand (of the htief) should notbe cut off for anything but a shield or its equivalent in value."' (Using translation from Nasāʾī 4937)
عَنِ نَبِيِّ اللهِ ﷺ تَقُولُ «لَا تُقْطَعُ الْيَدُ إِلَّا فِي الْمِجَنِّ أَوْ ثَمَنِهِ»
[Machine] "The hand is not to be cut off unless it is worth a significant amount or its equivalent." And it is claimed that Urwah said, "The significant amount is four dirhams."
«لَا تُقْطَعُ الْيَدُ إِلَّا فِي الْمِجَنِّ أَوْ ثَمَنِهِ» وَزَعَمَ أَنَّ عُرْوَةَ قَالَ الْمِجَنُّ أَرْبَعَةُ دَرَاهِمَ
[Machine] The five prayers cannot be divided except into five.
لَا تُقْطَعُ الْخَمْسُ إِلَّا فِي خَمْسٍ
"The hand of the thief should not be cut off for anything less than a Hajafah or a Turs (two kinds of shields)," each of which was worth a (decent) price. (Using translation from Nasāʾī 4941)
«لَمْ تُقْطَعْ يَدُ السَّارِقِ فِي أَدْنَى مِنْ حَجَفَةٍ أَوْ تُرْسٍ وَكُلُّ وَاحِدٍ مِنْهُمَا ذُو ثَمَنٍ»
the Prophet cut off (the thief's hand) for (something) that was worth five Dirhams. (Daif) (Using translation from Nasāʾī 4942)
«أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي قِيمَةِ خَمْسَةِ دَرَاهِمَ»
"The Prophet did not cut off the (hand of) the thief except for the value of a shield, and the value of a shield in those days was a Dinar." (Daif) (Using translation from Nasāʾī 4943)
لَمْ يَقْطَعِ النَّبِيُّ ﷺ السَّارِقَ إِلَّا فِي ثَمَنِ الْمِجَنِّ قَالَ وَثَمَنُ الْمِجَنِّ يَوْمَئِذٍ دِينَارٌ
[Machine] "The hand was not cut off during the time of the Messenger of Allah ﷺ except for the theft and its value at that time was a dinar." Abu Abdur Rahman said, "This is what I have and what I have from Mansur about Al-Hakam, meaning the hadith of Al-Firyyabi who said after this, Abu Abdur Rahman said, 'I do not know if it was me who memorized it or him.'"
«لَمْ تَكُنْ تُقْطَعُ الْيَدُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَقِيمَتُهُ يَوْمَئِذٍ دِينَارٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ كَذَا وَقَعَ عِنْدِي وَعِنْدَي مَنْصُورٌ عَنِ الْحَكَمِ يَعْنِي حَدِيثَ الْفِرْيَابِيِّ الَّذِي بَعْدَ هَذَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ فَلَا أَدْرِي أَحَفِظْتُ أَنَا أَوْ هُوَ
[Machine] "The hand of the thief was not cut off during the time of the Messenger of Allah except for the value of a hundred dinars, and the value of the hundred dinars at that time was a dinar." This was narrated by Ali ibn Salih, who said it was narrated by Mujahid and Ata.
«لَمْ تُقْطَعْ يَدُ السَّارِقِ فِي زَمَنِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَالْمِجَنُّ قِيمَتُهُ يَوْمَئِذٍ دِينَارٌ» رَوَاهُ عَلِيُّ بْنُ صَالِحٍ فَقَالَ عَنْ مُجَاهِدٍ وَعَطَاءٍ
"The hand of a thief was not be cut off during the time of the Messenger of Allah except for the price of a shield, which in those days was a Dinar." (Daif) (Using translation from Nasāʾī 4946)
«لَمْ تُقْطَعِ الْيَدُ فِي عَهْدِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَثَمَنُهُ يَوْمَئِذٍ دِينَارٌ»
[Machine] "The hand of the thief is cut off as the price of theft, and the price of theft during the time of the Messenger of Allah ﷺ was a dinar or ten dirhams." It was followed by a discussion about charity and jihad, but the ruling was not mentioned.
«تُقْطَعُ يَدُ السَّارِقِ فِي ثَمَنِ الْمِجَنِّ وَكَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ دِينَارًا أَوْ عَشْرَةَ دَرَاهِمَ» تَابَعَهُ شَرِيكٌ عَلَى عَطَاءٍ وَمُجَاهِدٍ وَلَمْ يَذْكُرِ الْحَكَمَ
"The (hand of) a thief is not to be cut off except for the price of a shield, and in those days the price of a shield was a Dinar." (Using translation from Nasāʾī 4948)
لَا قَطْعَ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَثَمَنُهُ يَوْمَئِذٍ دِينَارٌ وَقَفَهُ جَرِيرٌ
“The hand of the thief is to be cut off for the price of a shield. (Using translation from Ibn Mājah 2586)
«لَا تُقْطَعُ يَدُ السَّارِقِ فِي أَقَلَّ مِنْ ثَمَنِ الْمِجَنِّ»
41.1.18 [Machine] The Mention of Disagreement about Ibn Ishaq in this Hadith
٤١.١۔١٨ ذِكْرُ الِاخْتِلَافِ عَلَى ابْنِ إِسْحَاقَ فِي هَذَا الْحَدِيثِ
عَنْ عَطَاءٍ
[Machine] Narrated Ibn 'Abbas: "The price of a young camel during the time of the Messenger of Allah ﷺ was ten Dirhams." [Al-Bukhari]
عَنِ ابْنِ عَبَّاسٍ مِثْلَهُ «كَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ يُقَوَّمُ عَشَرَةَ دَرَاهِمَ» 7398 أَخْبَرَنَا مُحَمَّدُ بْنُ وَهْبٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ قَالَ حَدَّثَنِي ابْنُ إِسْحَاقَ عَنْ أَيُّوبَ بْنِ مُوسَى عَنْ عَطَاءٍ مُرْسَلٌ رَوَاهُ عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ بْنِ عَطَاءٍ قَوْلَهَ
"The least for which the hand of a thief is to be cut off is the price of a shield. And the price of a shield in those days was ten Dirhams." (Hasan) Abu 'Abdur-Rahman (An-Nasai) said: Ayman, the one whose narrations preceded, I do not think he was a Companion, and another Hadith has been related from him which proves what we have said: (Using translation from Nasāʾī 4953)
أَدْنَى مَا يُقْطَعُ فِيهِ ثَمَنُ الْمِجَنِّ «وَثَمَنُ الْمِجَنِّ عَشَرَةُ دَرَاهِمَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَيْمَنُ الَّذِي تَقَدَّمَ ذِكْرُنَا لِحَدِيثِهِ قَدْ رَوَى عَنْهُ عَطَاءٌ حَدِيثًا آخَرَ وَلَا أَحْسَبُ أَنَّ لَهُ صُحْبَةً وَالْحَدِيثُ الْآخَرُ
"Whoever performs wudu and performs wudu, well, then prays ('Abdur-Rahman said: and prays Isha), then prays after that four Rakahs and does them well (Sawwar said: and understands what he is reciting (Sawwar said: and recites therein), they will be equivalent to (praying) Lailat Al-Qadr for him". وَقَالَ سَوَّارٌ ثُمَّ صَلَّى الْعِشَاءَ الْآخِرَةَ ثُمَّ صَلَّى بَعْدَهَا أَرْبَعَ رَكَعَاتٍ فَأَتَمَّ وَقَالَ سَوَّارٌ يُتِمُّ رُكُوعَهُنَّ وَسُجُودَهُنَّ وَيَعْلَمُ مَا يَقْرَأُ وَقَالَ سَوَّارٌ يَقُولُ فِيهِنَّ كُنَّ لَهُ بِمَنْزِلَةِ لَيْلَةِ الْقَدْرِ
"Whoever performs Wudu and performs Wudu well, then attends Isha prayer in congregation, then prays four similar Rakahs after that, reciting therein and bowing and prostrating perfectly, that will bring him a reward like that of (praying) Lailat Al-Qadar." «مَنْ تَوَضَّأَ فَأَحْسَنَ وُضُوءَهُ ثُمَّ شَهِدَ صَلَاةَ الْعَتْمَةِ فِي جَمَاعَةٍ ثُمَّ صَلَّى إِلَيْهَا أَرْبَعًا مِثْلَهَا يَقْرَأُ فِيهَا وَيُتِمُّ رُكُوعَهَا وَسُجُودَهَا كَانَ لَهُ مِنَ الْأَجْرِ مِثْلُ لَيْلَةِ الْقَدْرِ»
"The price of a shield at the time of the Messenger of Allah was ten Dirhams." (Using translation from Nasāʾī 4956)
«كَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ عَشَرَةَ دَرَاهِمَ»
41.1.19 [Machine] The Suspended Fruit is Stolen
٤١.١۔١٩ الثَّمَرُ الْمُعَلَّقُ يُسْرَقُ
"The Messenger of Allah was asked: 'For how much is the hand (of the thief) to be cut off?' He said: 'The hand (of the thief) is not to be cut off for (stealing) fruit on the tree, but if (the fruit) has been taken to the place where it is stored to dry, then the (thief's) hand is to be cut off (if what is stolen is equivalent to) the price of a shield. The (thief's) hand is not to be cut off for a sheep (stolen) from the grazing land, but if it had been put in the pen, then the (thief's) hand is to be cut off (if what is stolen is equivalent to) the price of a shield."' سُئِلَ رَسُولُ اللهِ ﷺ فِي كَمْ تُقْطَعُ الْيَدُ؟ فَقَالَ «لَا تُقْطَعُ الْيَدُ فِي ثَمَرٍ مُعَلَّقٍ فَإِذَا ضُمَّهُ الْجَرِينَ قُطِعَتْ فِي ثَمَنِ الْمِجَنِّ وَلَا يُقْطَعُ فِي حَرِيسَةِ الْجَبَلِ فَإِذَا آوَاهُ الْمُرَاحُ قُطِعَتْ فِي ثَمَنِ الْمِجَنِّ»
41.1.20 [Machine] The fruit is stolen after it is sheltered by the vine.
٤١.١۔٢٠ الثَّمَرُ يُسْرَقُ بَعْدَ أَنْ يُؤْوِيهِ الْجَرِينُ
The Messenger of Allah ﷺ was asked about fruit which was bung up and said: If a needy person takes some with his mouth and does not take a supply away in his garment, there is nothing on him, but he who carries any of it is to be fined twice the value and punished, and he who steals any of it after it has been put in the place where dates are dried to have his hand cut off if their value reaches the value of a shield. If he steals a thing less in value than it, he is to be find twice the value and punished. Abu Dawud said: Jarin means the place where dates are dried. (Using translation from Abū Dāʾūd 4390)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ سُئِلَ عَنِ الثَّمَرِ الْمُعَلَّقِ فَقَالَ «مَنْ أَصَابَ مِنْهُ مِنْ ذِي حَاجَةٍ غَيْرَ مُتَّخِذٍ خُبْنَةً فَلَا شَيْءَ عَلَيْهِ وَمَنْ خَرَجَ بِشَيْءٍ مِنْهُ فَعَلَيْهِ غَرَامَةُ مِثْلَيْهِ وَالْعُقُوبَةُ وَمَنْ سَرَقَ شَيْئًا مِنْهُ بَعْدَ أَنْ يُؤْوِيَهُ الْجَرِينُ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ وَمَنْ سَرَقَ دُونَ ذَلِكَ فَعَلَيْهِ غَرَامَةُ مِثْلَيْهِ وَالْعُقُوبَةُ»
41.1.21 [Machine] The pieces in the theft of the cattle stolen by the smugglers
٤١.١۔٢١ الْقَطْعُ فِي سَرِقَةِ مَا آوَاهُ الْمُرَاحُ مِنَ الْمَوَاشِي
'O Messenger of Allah, what do you think about a sheep stolen from the pasture?" He said: "(The thief must pay) double and be punished. There is no cutting off of the hand for (stealing) livestock, except what which has been put in the pen, if its value is equal to that of a shield, in which case the (thief's) hand is to be cut off. If its value is not equal to that of a shield, then he should pay a penalty of twice its value and be flogged as a punishment." He said: "O Messenger of Allah! What do you think about fruit on the tree?" He said: "(The thief must pay) double and be punished. There is no cutting off of the hand for (stealing) fruit on the tree, except for that which has been stored properly if its value is equal to that of a shield, in which case the (thief's) hand is not equal to that of a shield, then he should pay a penalty of twice its value and be flogged as a punishment." أَنَّ رَجُلًا مِنْ مُزَيْنَةَ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ؟ فَقَالَ «هِيَ وَمِثْلُهَا وَالنَّكَالُ وَلَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلَّا فِيمَا آوَاهُ الْمُرَاحُ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ قَطْعُ الْيَدِ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ» قَالَ يَا رَسُولَ اللهِ كَيْفَ تَرَى فِي الثَّمَرِ الْمُعَلَّقِ؟ قَالَ «هُوَ وَمِثْلُهُ مَعَهَ وَالنَّكَالُ وَلَيْسَ فِي شَيْءٍ مِنَ الثَّمَرِ الْمُعَلَّقِ قَطْعٌ إِلَّا فِيمَا آوَاهُ الْجَرِينُ فَمَا أُخِذَ مِنَ الْجَرِينِ فَبَلَغَ ثَمَنَ الْمِجَنِّ فِيهِ الْقَطْعُ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتُ نَكَالٍ»
41.1.22 [Machine] What has no break, unless sheltered by greenery?

"I heard the Messenger of Allah say: 'The hand is not to be cut off for (stealing) produce or the spadix of palm trees."' (Using translation from Nasāʾī 4960)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثْرٍ»
"I heard the Messenger of Allah say: 'The hand is not to be cut off for (stealing) produce or the spadix of palm trees."' (Using translation from Nasāʾī 4960)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثْرٍ»

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثْرٍ»

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثْرٍ وَالْكَثْرُ الْجُمَّارُ»
[Machine] The Messenger of Allah ﷺ said, "There should be no cutting in fruit or excessive eating." Abu Abdur-Rahman said, "This is a mistake, it was narrated by Abu Usamah from a man of his people."
