41.1. Cutting off the Hands of a Thief
٤١.١۔ كِتَابُ قَطْعِ السَّارِقِ
[Machine] The Prophet ﷺ said, "The hand of the thief shall be cut off for a quarter of a dinar or more." Abu Abdur-Rahman said Ibn Uyaynah and Ibn al-Mubarak have narrated this.
أَنَّ النَّبِيَّ ﷺ قَالَ «تُقْطَعُ يَدُ السَّارِقِ فِي رُبْعِ دِينَارٍ فَصَاعِدًا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَقْفَهُ ابْنُ عُيَيْنَةَ وَابْنُ الْمُبَارَكِ
The hand of the thief may not be cut off but for a quarter of a dinar and upwards. (Using translation from Muslim 1684e)
أَنَّهَا سَمِعَتْ عَائِشَةَ تَقُولُ «تُقْطَعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The hand of the thief is to be cut off for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4925)
«الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
أَنَّ الْحَدِيثَ مَرْفُوعٌ وَاللهُ أَعْلَمُ
[Machine] "It has not been long on me, and I have not forgotten the pieces in a quarter dinar upwards." Abu Abdul Rahman said, "This is the correct statement, and the hadith of Aban and Saeed is incorrect."
«مَا طَالَ عَلَيَّ وَلَا نَسِيتُ الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الصَّوَابُ وَحَدِيثُ أَبَانَ وَسَعِيدٍ خَطَأٌ
