41.1. Cutting off the Hands of a Thief
٤١.١۔ كِتَابُ قَطْعِ السَّارِقِ
[Machine] She heard the Messenger of Allah ﷺ saying, "The hand of the thief should not be cut off except for a quarter of a Dinar and more." Ahmad ibn Amr ibn Al-Sarh reported to us, Ibn Wahb reported to us, Abdul-Rahman ibn Salman narrated to me from Ibn Al-Had from Abu Bakr ibn Hazm from Amrah from Aisha from the Messenger of Allah ﷺ reciting it to us. I asked the Prophet ﷺ about it and he said to us that it means the same.
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ «لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا» [26] 7376 أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ قَالَ أَخْبَرَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ سَلْمَانَ عَنِ ابْنِ الْهَادِ عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ عَنْ رَسُولِ اللهِ ﷺ قَرَأَهُ عَلَيْنَا قُلْتُ لِلنَّبِيِّ ﷺ فِيهِ قَالَ لَنَا هُوَ يُرِيدُ مِثْلَ ذَلِكَ
"Aishah said: 'Cutting off (the hand of the thief) is for one-quarter of a Dinar or more."' (Using translation from Nasāʾī 4930)
قَالَتْ عَائِشَةُ «الْقَطْعُ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The Messenger of Allah said: 'The hand of the thief is to be cut off for the price of a shield, and the price of a shield is one-quarter of a Dinar." (Using translation from Nasāʾī 4931)
قَالَ رَسُولُ اللهِ ﷺ «تُقْطَعُ يَدُ السَّارِقِ فِي ثَمَنِ الْمِجَنِّ وَثَمَنُ الْمِجَنِّ رُبْعُ دِينَارٍ»
"The Messenger of Allah used to cut off the (thief's) hand for one-quarter of a Dinar or more." (Using translation from Nasāʾī 4932)
كَانَ رَسُولُ اللهِ ﷺ «يَقْطَعُ الْيَدَ فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"The Messenger of Allah said: 'The hand (of the thief) is not to be cut off except for one-quarter of a Dinar."' (Using translation from Nasāʾī 4933)
قَالَ رَسُولُ اللهِ ﷺ «لَا تُقْطَعُ الْيَدُ إِلَّا فِي رُبْعِ دِينَارٍ»
[Machine] The Messenger of Allah, ﷺ , said, "The hand is cut off in the crime of stealing." Abu Abdur Rahman said, "I do not know Abdur Rahman ibn Bahar nor Mubarak, this."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «تُقْطَعُ الْيَدُ فِي الْمِجَنِّ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْرِفُ عَبْدَ الرَّحْمَنِ بْنَ بَحْرٍ وَلَا مُبَارَكًا هَذَا
The Messenger of Allah said: 'The hand of the thief is not to be cut off for anything less than a shield."' It was said to 'Aishah: 'What is the price of a shield?" She said: "One-quarter of a Dinar." (Using translation from Nasāʾī 4935)
قَالَ رَسُولُ اللهِ ﷺ «لَا تُقْطَعُ يَدُ السَّارِقِ فِيمَا دُونَ الْمِجَنِّ» قِيلَ لِعَائِشَةَ مَا ثَمَنُ الْمِجَنِّ؟ قَالَتْ رُبْعُ دِينَارٍ
The hand of the thief may not be cut off but for a quarter of a dinar and upwards. (Using translation from Muslim 1684e)
أَنَّهَا سَمِعَتْ رَسُولَ اللهِ ﷺ يَقُولُ «لَا تُقْطَعُ يَدُ السَّارِقِ إِلَّا فِي رُبْعِ دِينَارٍ فَصَاعِدًا»
"I heard 'Uthman bin Abi AL-Walid, the freed slave of the Akhnasiyin, say: 'I heard 'Urwah bin Az-Zubair say;'Aishah used to narrated that the Prophet said: "The hand (of the htief) should notbe cut off for anything but a shield or its equivalent in value."' (Using translation from Nasāʾī 4937)
عَنِ نَبِيِّ اللهِ ﷺ تَقُولُ «لَا تُقْطَعُ الْيَدُ إِلَّا فِي الْمِجَنِّ أَوْ ثَمَنِهِ»
[Machine] "The hand is not to be cut off unless it is worth a significant amount or its equivalent." And it is claimed that Urwah said, "The significant amount is four dirhams."
«لَا تُقْطَعُ الْيَدُ إِلَّا فِي الْمِجَنِّ أَوْ ثَمَنِهِ» وَزَعَمَ أَنَّ عُرْوَةَ قَالَ الْمِجَنُّ أَرْبَعَةُ دَرَاهِمَ
[Machine] The five prayers cannot be divided except into five.
لَا تُقْطَعُ الْخَمْسُ إِلَّا فِي خَمْسٍ
"The hand of the thief should not be cut off for anything less than a Hajafah or a Turs (two kinds of shields)," each of which was worth a (decent) price. (Using translation from Nasāʾī 4941)
«لَمْ تُقْطَعْ يَدُ السَّارِقِ فِي أَدْنَى مِنْ حَجَفَةٍ أَوْ تُرْسٍ وَكُلُّ وَاحِدٍ مِنْهُمَا ذُو ثَمَنٍ»
the Prophet cut off (the thief's hand) for (something) that was worth five Dirhams. (Daif) (Using translation from Nasāʾī 4942)
«أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي قِيمَةِ خَمْسَةِ دَرَاهِمَ»
"The Prophet did not cut off the (hand of) the thief except for the value of a shield, and the value of a shield in those days was a Dinar." (Daif) (Using translation from Nasāʾī 4943)
لَمْ يَقْطَعِ النَّبِيُّ ﷺ السَّارِقَ إِلَّا فِي ثَمَنِ الْمِجَنِّ قَالَ وَثَمَنُ الْمِجَنِّ يَوْمَئِذٍ دِينَارٌ
[Machine] "The hand was not cut off during the time of the Messenger of Allah ﷺ except for the theft and its value at that time was a dinar." Abu Abdur Rahman said, "This is what I have and what I have from Mansur about Al-Hakam, meaning the hadith of Al-Firyyabi who said after this, Abu Abdur Rahman said, 'I do not know if it was me who memorized it or him.'"
«لَمْ تَكُنْ تُقْطَعُ الْيَدُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَقِيمَتُهُ يَوْمَئِذٍ دِينَارٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ كَذَا وَقَعَ عِنْدِي وَعِنْدَي مَنْصُورٌ عَنِ الْحَكَمِ يَعْنِي حَدِيثَ الْفِرْيَابِيِّ الَّذِي بَعْدَ هَذَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ فَلَا أَدْرِي أَحَفِظْتُ أَنَا أَوْ هُوَ
[Machine] "The hand of the thief was not cut off during the time of the Messenger of Allah except for the value of a hundred dinars, and the value of the hundred dinars at that time was a dinar." This was narrated by Ali ibn Salih, who said it was narrated by Mujahid and Ata.
«لَمْ تُقْطَعْ يَدُ السَّارِقِ فِي زَمَنِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَالْمِجَنُّ قِيمَتُهُ يَوْمَئِذٍ دِينَارٌ» رَوَاهُ عَلِيُّ بْنُ صَالِحٍ فَقَالَ عَنْ مُجَاهِدٍ وَعَطَاءٍ
"The hand of a thief was not be cut off during the time of the Messenger of Allah except for the price of a shield, which in those days was a Dinar." (Daif) (Using translation from Nasāʾī 4946)
«لَمْ تُقْطَعِ الْيَدُ فِي عَهْدِ رَسُولِ اللهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَثَمَنُهُ يَوْمَئِذٍ دِينَارٌ»
[Machine] "The hand of the thief is cut off as the price of theft, and the price of theft during the time of the Messenger of Allah ﷺ was a dinar or ten dirhams." It was followed by a discussion about charity and jihad, but the ruling was not mentioned.
«تُقْطَعُ يَدُ السَّارِقِ فِي ثَمَنِ الْمِجَنِّ وَكَانَ ثَمَنُ الْمِجَنِّ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ دِينَارًا أَوْ عَشْرَةَ دَرَاهِمَ» تَابَعَهُ شَرِيكٌ عَلَى عَطَاءٍ وَمُجَاهِدٍ وَلَمْ يَذْكُرِ الْحَكَمَ
"The (hand of) a thief is not to be cut off except for the price of a shield, and in those days the price of a shield was a Dinar." (Using translation from Nasāʾī 4948)
لَا قَطْعَ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَثَمَنُهُ يَوْمَئِذٍ دِينَارٌ وَقَفَهُ جَرِيرٌ
“The hand of the thief is to be cut off for the price of a shield. (Using translation from Ibn Mājah 2586)
«لَا تُقْطَعُ يَدُ السَّارِقِ فِي أَقَلَّ مِنْ ثَمَنِ الْمِجَنِّ»
