41.1. Cutting off the Hands of a Thief
٤١.١۔ كِتَابُ قَطْعِ السَّارِقِ

عَنْ رَسُولِ اللهِ ﷺ قَالَ «لَيْسَ عَلَى خَائِنٍ وَلَا مُخْتَلِسٍ قَطْعٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَمْ يَسْمَعْهُ سُفْيَانُ مِنْ أَبِي الزُّبَيْرِ
That the Prophet ﷺ said: "There is no cutting of the hand for the traitor, or the embezzler, nor the plunderer." (Using translation from Tirmidhī 1448)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى خَائِنٍ وَلَا مُنْتَهِبٍ وَلَا مُخْتَلِسٍ قَطْعٌ»
[Machine] "The Messenger of Allah ﷺ has removed the punishment from the person who commits theft, the person who misappropriates, and the person who betrays." Abu Abdur Rahman said to us, "I have not seen Ibn Juraij doing anything without him hearing it from Abu Zubair in our presence, and Allah knows best."
أَنَّ رَسُولَ اللهِ ﷺ «دَرَأَ عَنِ الْمُنْتَهِبِ وَالْمُخْتَلِسِ وَالْخَائِنِ الْقَطْعَ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ مَا عَمِلَ شَيْئًا ابْنُ جُرَيْجٍ لَمْ يَسْمَعْهُ مِنْ أَبِي الزُّبَيْرِ عِنْدَنَا وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ said: "There is no cutting on the prohibited path."
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ»
“I heard the Messenger of Allah ﷺ say: 'The hand of the pilferer is not to be cut off”. (Using translation from Ibn Mājah 2592)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْمُخْتَلِسِ قَطْعٌ»
"The hands of the traitor is not to be cut off." (Sahih) Abu 'Abdur-Rahman (An-Nasai) said: This Hadith had been reported from Ibn Juraij by 'Isa bin Yunus, Al-Fadl bin Musa, Ibn Wahb, Muhammad bin Rabiah, Makhlad bin Yazid, and Salamah bin Saeed from Al-Basrah, who is trustworthy and Ibn Abi Safwan said: "He was the best of the people of his time" and not one of them said: "Abu Az-Zubair narrated to me" and I do not think that he heard it from Abu Az-Zubair, and Allah knows best. قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْخَائِنِ قَطْعٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَقَدْ رَوَى هَذَا الْحَدِيثَ عَنِ ابْنِ جُرَيْجٍ عِيسَى بْنُ يُونُسَ وَالْفَضْلُ بْنُ مُوسَى وَابْنُ وَهْبٍ وَمُحَمَّدُ بْنُ رَبِيعَةَ وَمَخْلَدُ بْنُ يَزِيدَ وَسَلَمَةُ بْنُ سَعِيدٍ فَلَمْ يَقُلْ أَحَدٌ مِنْهُمْ فِيهِ حَدَّثَنِي أَبُو الزُّبَيْرِ وَلَا أَحْسَبُهُ سَمِعَهُ مِنْ أَبِي الزُّبَيْرِ وَاللهُ أَعْلَمُ
[Machine] On the authority of the Prophet ﷺ that he said: "There should be no cutting or injuring of a person who has committed an act of theft." Abu Abdur Rahman Al-Mughira bin Muslim said: "Abi Al-Zubair is not a strong person and he doesn't have any disparaged hadith with him."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «لَا قَطْعَ عَلَى مُخْتَلِسٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ الْمُغِيرَةُ بْنُ مُسْلِمٍ لَيْسَ بِالْقَوِيِّ فِي أَبِي الزُّبَيْرِ وَعِنْدَهُ غَيْرُ حَدِيثٍ مُنْكَرٍ
"The Messenger of Allah said: 'The hand of the pilferer, robber and traitor is not to be cut off."' (Using translation from Nasāʾī 4975)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى مُخْتَلِسٍ وَلَا مُنْتَهِبٍ وَلَا خَائِنٍ قَطْعٌ»
"The hand of the traitor is not to be cut off." (Sahih) Abu 'Abdur-Rahman (An-Nasai) said: Ashath bin Sawwar (one of its narrators) is weak. (Using translation from Nasāʾī 4976)
أَبُو عَبْدِ الرَّحْمَنِ أَشْعَثُ بْنُ سَوَّارٍ ضَعِيفٌ لَا يُحْتَجُّ بِحَدِيثِهِ
