41.1. Cutting off the Hands of a Thief (3/3)
٤١.١۔ كِتَابُ قَطْعِ السَّارِقِ ص ٣
the Messenger of Allah robber and pilferer is not to be cut off." (Sahih) Sufyan did not hear it from Abu Az-Zubair. (Using translation from Nasāʾī 4971)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «لَيْسَ عَلَى خَائِنٍ وَلَا مُخْتَلِسٍ قَطْعٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَمْ يَسْمَعْهُ سُفْيَانُ مِنْ أَبِي الزُّبَيْرِ
That the Prophet ﷺ said: "There is no cutting of the hand for the traitor, or the embezzler, nor the plunderer." (Using translation from Tirmidhī 1448)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى خَائِنٍ وَلَا مُنْتَهِبٍ وَلَا مُخْتَلِسٍ قَطْعٌ»
[Machine] "The Messenger of Allah ﷺ has removed the punishment from the person who commits theft, the person who misappropriates, and the person who betrays." Abu Abdur Rahman said to us, "I have not seen Ibn Juraij doing anything without him hearing it from Abu Zubair in our presence, and Allah knows best."
أَنَّ رَسُولَ اللهِ ﷺ «دَرَأَ عَنِ الْمُنْتَهِبِ وَالْمُخْتَلِسِ وَالْخَائِنِ الْقَطْعَ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ مَا عَمِلَ شَيْئًا ابْنُ جُرَيْجٍ لَمْ يَسْمَعْهُ مِنْ أَبِي الزُّبَيْرِ عِنْدَنَا وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ said: "There is no cutting on the prohibited path."
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْمُنْتَهِبِ قَطْعٌ»
“I heard the Messenger of Allah ﷺ say: 'The hand of the pilferer is not to be cut off”. (Using translation from Ibn Mājah 2592)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْمُخْتَلِسِ قَطْعٌ»
"The hands of the traitor is not to be cut off." (Sahih) Abu 'Abdur-Rahman (An-Nasai) said: This Hadith had been reported from Ibn Juraij by 'Isa bin Yunus, Al-Fadl bin Musa, Ibn Wahb, Muhammad bin Rabiah, Makhlad bin Yazid, and Salamah bin Saeed from Al-Basrah, who is trustworthy and Ibn Abi Safwan said: "He was the best of the people of his time" and not one of them said: "Abu Az-Zubair narrated to me" and I do not think that he heard it from Abu Az-Zubair, and Allah knows best. قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الْخَائِنِ قَطْعٌ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَقَدْ رَوَى هَذَا الْحَدِيثَ عَنِ ابْنِ جُرَيْجٍ عِيسَى بْنُ يُونُسَ وَالْفَضْلُ بْنُ مُوسَى وَابْنُ وَهْبٍ وَمُحَمَّدُ بْنُ رَبِيعَةَ وَمَخْلَدُ بْنُ يَزِيدَ وَسَلَمَةُ بْنُ سَعِيدٍ فَلَمْ يَقُلْ أَحَدٌ مِنْهُمْ فِيهِ حَدَّثَنِي أَبُو الزُّبَيْرِ وَلَا أَحْسَبُهُ سَمِعَهُ مِنْ أَبِي الزُّبَيْرِ وَاللهُ أَعْلَمُ
[Machine] On the authority of the Prophet ﷺ that he said: "There should be no cutting or injuring of a person who has committed an act of theft." Abu Abdur Rahman Al-Mughira bin Muslim said: "Abi Al-Zubair is not a strong person and he doesn't have any disparaged hadith with him."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «لَا قَطْعَ عَلَى مُخْتَلِسٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ الْمُغِيرَةُ بْنُ مُسْلِمٍ لَيْسَ بِالْقَوِيِّ فِي أَبِي الزُّبَيْرِ وَعِنْدَهُ غَيْرُ حَدِيثٍ مُنْكَرٍ
"The Messenger of Allah said: 'The hand of the pilferer, robber and traitor is not to be cut off."' (Using translation from Nasāʾī 4975)
قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى مُخْتَلِسٍ وَلَا مُنْتَهِبٍ وَلَا خَائِنٍ قَطْعٌ»
"The hand of the traitor is not to be cut off." (Sahih) Abu 'Abdur-Rahman (An-Nasai) said: Ashath bin Sawwar (one of its narrators) is weak. (Using translation from Nasāʾī 4976)
أَبُو عَبْدِ الرَّحْمَنِ أَشْعَثُ بْنُ سَوَّارٍ ضَعِيفٌ لَا يُحْتَجُّ بِحَدِيثِهِ
41.1.24 [Machine] The cutting off of the thief's leg after the hand.
٤١.١۔٢٤ قَطْعُ الرِّجْلِ مِنَ السَّارِقِ بَعْدَ الْيَدِ
"Kill him." They said: "O Messenger of Allah, he only stole (something)." He said: "Kill him." They said: "O Messenger of Allah, he only stole (something)." He said: "Cut off his hand." Then he stole again, and his foot was cut off. Then he stole at the time of Abu Bakr, untilo all his extremities had been cut off. Then he stole a fifth time, and Abu Bakr, may Allah be pleased with him, said: "The Messenger of Allah knew better about him when he said: 'Kill him."' Then he handed him over to some young men of Quraish to kill him, among whom was 'Abdullah bin Az-Zubair who liked to be in a position of leadership. He said: "Put me in charge of them," so they put him in charge of them and when he struck him, they would strike him, until they killed him. (Using translation from Nasāʾī 4977)
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِلِصٍّ فَقَالَ «اقْتُلُوهُ» فَقَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ ثُمَّ قَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوا يَدَهُ» قَالَ ثُمَّ سَرَقَ فَقُطِعَتْ رِجْلُهُ ثُمَّ سَرَقَ عَلَى عَهْدِ أَبِي بَكْرٍ حَتَّى قُطِعَتْ قَوَائِمُهُ كُلُّهَا ثُمَّ سَرَقَ أَيْضًا الْخَامِسَةَ فَقَالَ أَبُو بَكْرٍ كَانَ رَسُولُ اللهِ ﷺ أَعْلَمَ بِهَذَا حِينَ قَالَ «اقْتُلُوهُ» ثُمَّ دَفَعَهُ إِلَى فَتْيَةٍ مِنْ قُرَيْشٍ لِيَقْتُلُوهُ فِيهِمْ عَبْدُ اللهِ بْنُ الزُّبَيْرِ وَكَانَ يُحِبُّ الْإِمْرَةَ فَقَالَ أَمِّرُونِي عَلَيْكُمْ فَأَمَّرُوهُ عَلَيْهِمْ فَكَانَ إِذَا ضَرَبَ ضَرَبُوا حَتَّى قَتَلُوهُ
41.1.25 [Machine] Cutting off the hands and legs of the thief
٤١.١۔٢٥ قَطْعُ الْيَدَيْنِ وَالرِّجْلَيْنِ مِنَ السَّارِقِ
"A thief was brought to the Messenger of Allah and he said: 'Kill him.' They said: 'O Messenger of Allah, he only stole.' He said: 'Cut off (his hand).' So his hand was cut off. Then he was brought a second time and he said: 'Kill him.' They said; 'O Messenger of Allah, he only stole.' He said: 'Cut off (his foot).' So his foot was cut off. He was brought to him a third time and he said: 'Kill him.' They said: 'O Messenger of Allah, he only stole. He said: 'Cut off (his other hand).' Then he was brought to him a fourth time and he said: Kill him.' They said: 'O Messenger of Allah, he only stole.' He said: 'Cut off (his other foot).' He was brought to him a fifth time and he said: "So we took him to an animal pen and attacked him. He lay down on his back then waved his arms and legs (in the air), and the camels ran away. Then they attacked him a second time and he did the same thing, then they attacked him a third time, and we threw stones at him and killed him, then we threw him into a well and threw stones on top of him." (Hasan) Abu 'Abdur-Rahman (An-Nasai) said: This Hadith is Munkar, Musab bin Thabit is not strong in Hadith. (Using translation from Nasāʾī 4978)
جِيءَ بِسَارِقٍ إِلَى النَّبِيِّ ﷺ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَقُطِعَ ثُمَّ جِيءَ بِهِ الثَّانِيَةَ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الثَّالِثَةَ فَقَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الرَّابِعَةَ قَالَ «اقْتُلُوهُ» قَالُوا يَا رَسُولَ اللهِ إِنَّمَا سَرَقَ قَالَ «اقْطَعُوهُ» فَأُتِيَ بِهِ الْخَامِسَةَ فَقَالَ «اقْتُلُوهُ» قَالَ جَابِرٌ فَانْطَلَقْنَا بِهِ إِلَى مِرْبَدِ النَّعَمِ فَاسْتَلْقَى عَلَى ظَهْرِهِ ثُمَّ كَسَّ بِيَدِهِ وَرِجْلِهِ فَانْصَدَعَتِ الْإِبِلُ ثُمَّ حَمَلُوا عَلَيْهِ الثَّانِيَةَ فَفَعَلَ مِثْلَ ذَلِكَ ثُمَّ حَمَلُوا عَلَيْهِ الثَّالِثَةَ فَرَمَيْنَاهُ بِالْحِجَارَةِ فَقَتَلْنَاهُ ثُمَّ أَلْقَيْنَاهُ فِي بِئْرٍ ثُمَّ رَمَيْنَا عَلَيْهِ الْحِجَارَةَ قَالَ أَبُو عَبْدِ الرَّحْمَنِ مُصْعَبُ بْنُ ثَابِتٍ لَيْسَ بِالْقَوِيِّ وَيَحْيَى الْقَطَّانُ لَمْ يَتْرُكْهُ وَهَذَا الْحَدِيثُ لَيْسَ بِصَحِيحٍ وَلَا أَعْلَمُ فِي هَذَا الْبَابِ حَدِيثًا صَحِيحًا عَنِ النَّبِيِّ ﷺ
41.1.26 [Machine] Pieces in travel
٤١.١۔٢٦ الْقَطْعُ فِي السَّفَرِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Do not cut off hands while traveling." Abu 'Abd al-Rahman (a narrator of the Hadith) said, "This Hadith is not one that can be used as evidence."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا تُقْطَعُ الْأَيْدِي فِي السَّفَرِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَيْسَ هَذَا الْحَدِيثُ مِمَّا يُحْتَجُّ بِهِ
41.1.27 [Machine] What should be done to the slave if he steals?
٤١.١۔٢٧ مَا يُفْعَلُ بِالْمَمْلُوكِ إِذَا سَرَقَ
“If a slave steals, then sell him, even for half Price.' ” (Using translation from Ibn Mājah 2589)
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا سَرَقَ الْعَبْدُ فَبِعْهُ وَلَوْ بِنَشٍّ»
41.1.28 [Machine] The age of puberty and mentioning the age at which the punishment is imposed on a man and a woman
٤١.١۔٢٨ حَدُّ الْبُلُوغِ وَذِكْرُ السِّنِّ الَّتِي إِذَا بَلَغَهَا الرَّجُلُ وَالْمَرْأَةُ أُقِيمَ عَلَيْهِمَا الْحَدُّ
'I was among the prisoners of Quraizah; we were examined, and whoever had grown (pubic) hair was killed, and whoever had not grown hair, he was allowed to live and was not killed." (Using translation from Nasāʾī 4981)
أَنَّهُ أَخْبَرَهُ قَالَ «كُنْتُ فِي سَبْيِ قُرَيْظَةَ وَكَانَ يُنْظَرُ فَمَنْ خَرَجَ شِعْرَتُهُ قُتِلَ وَمَنْ لَمْ يَخْرُجِ اسْتُحْيِيَ وَلَمْ يُقْتَلْ»
41.1.29 [Machine] The hanging of the thief's hand around his neck.
٤١.١۔٢٩ تَعْلِيقُ يَدِ السَّارِقِ فِي عُنُقِهِ
'It is Sunnah. The Messenger of Allah cut off a thief's hand then hung it from his neck."'(Daif) (Using translation from Nasāʾī 4982)
«سُنَّةٌ؛ فَقَدْ قَطَعَ رَسُولُ اللهِ ﷺ يَدَ السَّارِقٍ وَعَلَّقَ يَدَهُ فِي عُنُقِهِ»
[Machine] Yes, the Messenger of Allah ﷺ was brought a thief, so he cut off his hand and hung it around his neck.
«نَعَمْ أُتِيَ رَسُولُ اللهِ ﷺ بِسَارِقٍ فَقَطَعَ يَدَهُ وَعَلَّقَهَا فِي عُنُقِهِ»
41.1.30 [Machine] The owner of the theft is not fined if the punishment is implemented on him.
٤١.١۔٣٠ بَابُ لَا يُغَرَّمُ صَاحِبُ سَرِقَةِ إِذَا أُقِيمَ عَلَيْهِ الْحَدُّ
[Machine] The Messenger of Allah ﷺ said: "The person who commits theft should not be fined if the prescribed punishment is carried out on him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يُغَرَّمُ صَاحِبُ سَرَقَةٍ إِذَا أُقِيمَ عَلَيْهِ الْحَدُّ»
