68.12 Al-Khul' and how a divorce is given according to it
٦٨۔١٢ باب الْخُلْعِ وَكَيْفَ الطَّلاَقُ فِيهِ
[Machine] And the saying of Allah the Most High: "And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep within the limits set by Allah" until His saying: "the wrongdoers". Umar allowed khul' (divorce by the wife) without the presence of the ruler, and Uthman allowed khul' without seeking permission from her guardian. Tawus said: "Except if they fear that they will not establish the limits set by Allah" in what is obligatory for each of them towards their companion in terms of rights and companionship, and he did not say the saying of the foolish that it is not permissible until you say "I will not perform ghusl for you from janaba".
وَقَوْلِ اللَّهِ تَعَالَى: {وَلاَ يَحِلُّ لَكُمْ أَنْ تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا} إِلَى قَوْلِهِ: {الظَّالِمُونَ} وَأَجَازَ عُمَرُ الْخُلْعَ دُونَ السُّلْطَانِ، وَأَجَازَ عُثْمَانُ الْخُلْعَ دُونَ عِقَاصِ رَأْسِهَا. وَقَالَ طَاوُسٌ: {إِلاَّ أَنْ يَخَافَا أَنْ لاَ يُقِيمَا حُدُودَ اللَّهِ} فِيمَا افْتَرَضَ لِكُلِّ وَاحِدٍ مِنْهُمَا عَلَى صَاحِبِهِ فِي الْعِشْرَةِ وَالصُّحْبَةِ، وَلَمْ يَقُلْ قَوْلَ السُّفَهَاءِ لاَ يَحِلُّ. حَتَّى تَقُولَ لاَ أَغْتَسِلُ لَكَ مِنْ جَنَابَةٍ.
