68.22 The regulations concerning the property and family of a lost person
٦٨۔٢٢ باب حُكْمِ الْمَفْقُودِ فِي أَهْلِهِ وَمَالِهِ
[Machine] "And Ibn Al-Musayyib said: If one loses his wife in battle, he should wait for a year. And Ibn Mas'oud bought a slave girl and searched for her owner for a year but couldn't find him, so he started giving away money and said: O Allah, bestow it upon so and so (the owner) and upon me. And he said: This is how you should deal with a lost item. And Al-Zuhri said regarding a captive: If his whereabouts are unknown, do not marry his wife and do not divide his wealth. And if his news is cut off, his Sunnah (way) becomes the Sunnah of the missing."
وَقَالَ ابْنُ الْمُسَيَّبِ إِذَا فُقِدَ فِي الصَّفِّ عِنْدَ الْقِتَالِ تَرَبَّصُ امْرَأَتُهُ سَنَةً. وَاشْتَرَى ابْنُ مَسْعُودٍ جَارِيَةً وَالْتَمَسَ صَاحِبَهَا سَنَةً فَلَمْ يَجِدْهُ وَفُقِدَ، فَأَخَذَ يُعْطِي الدِّرْهَمَ وَالدِّرْهَمَيْنِ وَقَالَ اللَّهُمَّ عَنْ فُلاَنٍ وَعَلَيَّ. وَقَالَ هَكَذَا فَافْعَلُوا بِاللُّقَطَةِ. وَقَالَ الزُّهْرِيُّ فِي الأَسِيرِ يُعْلَمُ مَكَانُهُ لاَ تَتَزَوَّجُ امْرَأَتُهُ، وَلاَ يُقْسَمُ مَالُهُ فَإِذَا انْقَطَعَ خَبَرُهُ فَسُنَّتُهُ سُنَّةُ الْمَفْقُودِ.
