68.23 Az-Zihar
٦٨۔٢٣ بَابُ الظِّهَارِ
[Machine] And the saying of Allah, the Most High: "Indeed, Allah has heard the statement of her that disputes with you concerning her husband" until His saying: "But whoever cannot find [or afford] it - then a fast of three days [is required]." And Isma'il narrated to me that Malik asked Ibn Shihaab about the uncovered parts of the slave. He said, "It is like the uncovered parts of a free man." Malik said, "And fasting by the slave is two months." And Al-Hasan ibn Al-Hur said, "The uncovered parts of a free man and a slave, male or female, are the same." And Ikrimah said, "If it is uncovered from his slave, then there is no harm, as the uncovering is only from women." And in the Arabic language, when they say "ay" it means "what they said," and in some of what they said, and this is more appropriate, because Allah did not support the prohibited and the saying of falsehood.
وَقَوْلِ اللَّهِ تَعَالَى: {قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا} إِلَى قَوْلِهِ: {فَمَنْ لَمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا}. وَقَالَ لِي إِسْمَاعِيلُ حَدَّثَنِي مَالِكٌ أَنَّهُ سَأَلَ ابْنَ شِهَابٍ عَنْ ظِهَارِ الْعَبْدِ فَقَالَ نَحْوَ ظِهَارِ الْحُرِّ. قَالَ مَالِكٌ وَصِيَامُ الْعَبْدِ شَهْرَانِ. وَقَالَ الْحَسَنُ بْنُ الْحُرِّ ظِهَارُ الْحُرِّ وَالْعَبْدِ مِنَ الْحُرَّةِ وَالأَمَةِ سَوَاءٌ. وَقَالَ عِكْرِمَةُ إِنْ ظَاهَرَ مِنْ أَمَتِهِ فَلَيْسَ بِشَيْءٍ إِنَّمَا الظِّهَارُ مِنَ النِّسَاءِ، وَفِي الْعَرَبِيَّةِ لِمَا قَالُوا أَيْ فِيمَا قَالُوا، وَفِي بَعْضِ مَا قَالُوا، وَهَذَا أَوْلَى، لأَنَّ اللَّهَ لَمْ يَدُلَّ عَلَى الْمُنْكَرِ وَقَوْلِ الزُّورِ.
