68.41 The story of Fatima bint Qais

٦٨۔٤١ باب قِصَّةِ فَاطِمَةَ بِنْتِ قَيْسٍ

[Machine] And His saying: "And fear Allah, your Lord, and do not expel them from their houses, nor should they leave, unless they commit a clear immorality. And these are the limits set by Allah. And whoever transgresses the limits of Allah has certainly wronged himself. You do not know; perhaps Allah will cause something to happen after this. And live with them in kindness. And if you dislike them - perhaps you dislike a thing and Allah makes therein much good."

وَقَوْلِهِ: {وَاتَّقُوا اللَّهَ رَبَّكُمْ لاَ تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلاَ يَخْرُجْنَ إِلاَّ أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ وَتِلْكَ حُدُودُ اللَّهِ وَمَنْ يَتَعَدَّ حُدُودَ اللَّهِ فَقَدْ ظَلَمَ نَفْسَهُ لاَ تَدْرِي لَعَلَّ اللَّهَ يُحْدِثُ بَعْدَ ذَلِكَ أَمْرًا}، {أَسْكِنُوهُنَّ مِنْ حَيْثُ سَكَنْتُمْ مِنْ وُجْدِكُمْ وَلاَ تُضَارُّوهُنَّ لِتُضَيِّقُوا عَلَيْهِنَّ وَإِنْ كُنَّ أُولاَتِ حَمْلٍ فَأَنْفِقُوا عَلَيْهِنَّ حَتَّى يَضَعْنَ حَمْلَهُنَّ} إِلَى قَوْلِهِ: {بَعْدَ عُسْرٍ يُسْرًا}.

that Yahya bin Saʿid bin Al-ʿAs divorced the daughter of ʿAbdur-Rahman bin Al-Hakarn. ʿAbdur- Rahman took her to his house. On that ʿAisha sent a message to Marwan bin Al-Hakam who was the ruler of Medina, saying, "Fear Allah, and urge your brother) to return her to her house." Marwan (in Sulaiman's version) said, "Abdur-Rahman bin Al-Hakam did not obey me (or had a convincing argument)." (In Al-Qasim's versions Marwan said, "Have you not heard of the case of Fatima bint Qais?" Aisha said, "The case of Fatima bint Qais is not in your favor.' Marwan bin Al-Hakam said to ʿAisha, "The reason that made Fatima bint Qais go to her father's house is just applicable to the daughter of ʿAbdur-Rahman."  

البخاري:٥٣٢١حَدَّثَنَا إِسْمَاعِيلُ حَدَّثَنَا مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ أَنَّهُ سَمِعَهُ يَذْكُرُ أَنَّ يَحْيَى بْنَ سَعِيدِ بْنِ الْعَاصِ طَلَّقَ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ فَانْتَقَلَهَا عَبْدُ الرَّحْمَنِ فَأَرْسَلَتْ عَائِشَةُ أُمُّ الْمُؤْمِنِينَ إِلَى مَرْوَانَ وَهْوَ أَمِيرُ الْمَدِينَةِ اتَّقِ اللَّهَ وَارْدُدْهَا إِلَى بَيْتِهَا قَالَ مَرْوَانُ فِي حَدِيثِ سُلَيْمَانَ إِنَّ عَبْدَ الرَّحْمَنِ بْنَ الْحَكَمِ غَلَبَنِي وَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ أَوَمَا بَلَغَكِ شَأْنُ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ لاَ يَضُرُّكَ أَنْ لاَ تَذْكُرَ حَدِيثَ فَاطِمَةَ فَقَالَ

مَرْوَانُ بْنُ الْحَكَمِ إِنْ كَانَ بِكِ شَرٌّ فَحَسْبُكِ مَا بَيْنَ هَذَيْنِ مِنَ الشَّرِّ

Aisha said, "What is wrong with Fatima? Why doesn't she fear Allah?" by saying that a divorced lady is not entitled to be provided with residence and sustenance (by her husband).  

البخاري:٥٣٢٣حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا غُنْدَرٌ حَدَّثَنَا شُعْبَةُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ عَنْ عَائِشَةَ

أَنَّهَا قَالَتْ مَا لِفَاطِمَةَ أَلاَ تَتَّقِي اللَّهَ يَعْنِي فِي قَوْلِهَا لاَ سُكْنَى وَلاَ نَفَقَةَ

Urwa said to Aisha, "Do you know so-and-so, the daughter of Al-Hakam? Her husband divorced her irrevocably and she left (her husband's house)." ʿAisha said, "What a bad thing she has done!" 'Urwa said (to ʿAisha), "Haven't you heard the statement of Fatima?" ʿAisha replied, "It is not in her favor to mention."  

'Urwa added, ʿAisha reproached (Fatima) severely and said, "Fatima was in a lonely place, and she was prone to danger, so the Prophet ﷺ allowed her (to go out of her husband's house).
البخاري:٥٣٢٥حَدَّثَنَا عَمْرُو بْنُ عَبَّاسٍ حَدَّثَنَا ابْنُ مَهْدِيٍّ حَدَّثَنَا سُفْيَانُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ قَالَ

عُرْوَةُ بْنُ الزُّبَيْرِ لِعَائِشَةَ أَلَمْ تَرَيْنَ إِلَى فُلاَنَةَ بِنْتِ الْحَكَمِ طَلَّقَهَا زَوْجُهَا الْبَتَّةَ فَخَرَجَتْ فَقَالَتْ بِئْسَ مَا صَنَعَتْ قَالَ أَلَمْ تَسْمَعِي فِي قَوْلِ فَاطِمَةَ قَالَتْ أَمَا إِنَّهُ لَيْسَ لَهَا خَيْرٌ فِي ذِكْرِ هَذَا الْحَدِيثِ  

وَزَادَ ابْنُ أَبِي الزِّنَادِ عَنْ هِشَامٍ عَنْ أَبِيهِ عَابَتْ عَائِشَةُ أَشَدَّ الْعَيْبِ وَقَالَتْ إِنَّ فَاطِمَةَ كَانَتْ فِي مَكَانٍ وَحِشٍ فَخِيفَ عَلَى نَاحِيَتِهَا فَلِذَلِكَ أَرْخَصَ لَهَا النَّبِيُّ ﷺ
