68.11 A divorce given in a state of anger, under compulsion or under the effect of intoxicants or insanity

٦٨۔١١ باب الطَّلاَقِ فِي الإِغْلاَقِ

[Machine] "And the compulsion, drunkenness, and madness and their decisions, and the mistake and forgetfulness in divorce, polytheism, and others, according to the saying of the Prophet ﷺ: 'Actions are judged by intentions, and each person will have what they intend.' And Sha'bi recited: 'Do not hold us accountable if we forget or make a mistake' and what is not permissible for a person influenced by whispers. The Prophet ﷺ said to the one who confirmed upon himself: 'Are you mad?' And Ali said to Hamza: 'You are just slaves of Abu,' so the Prophet ﷺ frowned at Hamza. Then, Hamza appeared with reddened eyes, obviously intoxicated. Hamza said: 'Are you nothing but slaves of Abu?' So the Prophet ﷺ realized that he was intoxicated, so he left and we left with him. Uthman said: 'Divorce is not valid for a mad or drunken person.' Ibn Abbas said: 'The divorce of a drunkard or a person under duress is not valid.' Uqbah ibn Amir said: 'Divorcing a person influenced by whispers is not permissible.' Ata' said: 'If someone specifies conditions for divorce, they must be followed.' Nafi' said: 'A man divorced his wife by saying the word 'batta' if she leaves, then Ibn Umar said: 'If she leaves, then he has divorced her, but if she does not leave, then it is nothing.' Al-Zuhri said: 'In the case when someone says 'I have no need for you,' the intention of divorce matters, and the divorce of every community is through their tongues.' Qatadah said: 'If he says 'if you become pregnant, then you are divorced' three times, it covers her during each period of cleanliness, and if her pregnancy becomes evident, then it is clear.' Al-Hasan said: 'If he says 'you are free from me,' the intention matters.' Ibn Abbas said: 'Divorce is related to the intention, and manumission is what pleases Allah.' Al-Zuhri said: 'If he says 'you are not my wife,' the intention matters, and if he intends divorce, then it is what he intends.' Ali said: 'Do you not know that the pen is lifted from three: the mad until they regain sanity, the child until they understand, and the sleeper until they wake up.' Ali also said: 'All types of divorce are permissible except for the abusive divorce.'"

وَالْكُرْهِ وَالسَّكْرَانِ وَالْمَجْنُونِ وَأَمْرِهِمَا، وَالْغَلَطِ وَالنِّسْيَانِ فِي الطَّلاَقِ وَالشِّرْكِ وَغَيْرِهِ، لِقَوْلِ النَّبِيِّ ﷺ: «الأَعْمَالُ بِالنِّيَّةِ وَلِكُلِّ امْرِئٍ مَا نَوَى». وَتَلاَ الشَّعْبِيُّ: {لاَ تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا} وَمَا لاَ يَجُوزُ مَنْ إِقْرَارِ الْمُوَسْوِسِ. وَقَالَ النَّبِيُّ ﷺ لِلَّذِي أَقَرَّ عَلَى نَفْسِهِ: «أَبِكَ جُنُونٌ». وَقَالَ عَلِيٌّ بَقَرَ حَمْزَةُ خَوَاصِرَ شَارِفَيَّ، فَطَفِقَ النَّبِيُّ ﷺ يَلُومُ حَمْزَةَ، فَإِذَا حَمْزَةُ قَدْ ثَمِلَ مُحْمَرَّةٌ عَيْنَاهُ، ثُمَّ قَالَ حَمْزَةُ هَلْ أَنْتُمْ إِلاَّ عَبِيدٌ لأَبِي فَعَرَفَ النَّبِيُّ ﷺ أَنَّهُ قَدْ ثَمِلَ، فَخَرَجَ وَخَرَجْنَا مَعَهُ، وَقَالَ عُثْمَانُ لَيْسَ لِمَجْنُونٍ وَلاَ لِسَكْرَانَ طَلاَقٌ. وَقَالَ ابْنُ عَبَّاسٍ طَلاَقُ السَّكْرَانِ وَالْمُسْتَكْرَهِ لَيْسَ بِجَائِزٍ. وَقَالَ عُقْبَةُ بْنُ عَامِرٍ لاَ يَجُوزُ طَلاَقُ الْمُوَسْوِسِ. وَقَالَ عَطَاءٌ إِذَا بَدَا بِالطَّلاَقِ فَلَهُ شَرْطُهُ. وَقَالَ نَافِعٌ طَلَّقَ رَجُلٌ امْرَأَتَهُ الْبَتَّةَ إِنْ خَرَجَتْ، فَقَالَ ابْنُ عُمَرَ إِنْ خَرَجَتْ فَقَدْ بُتَّتْ مِنْهُ، وَإِنْ لَمْ تَخْرُجْ فَلَيْسَ بِشَيْءٍ. وَقَالَ الزُّهْرِيُّ فِيمَنْ قَالَ إِنْ لَمْ أَفْعَلْ كَذَا وَكَذَا فَامْرَأَتِي طَالِقٌ ثَلاَثًا يُسْئَلُ عَمَّا قَالَ، وَعَقَدَ عَلَيْهِ قَلْبُهُ، حِينَ حَلَفَ بِتِلْكَ الْيَمِينِ، فَإِنْ سَمَّى أَجَلاً أَرَادَهُ وَعَقَدَ عَلَيْهِ قَلْبُهُ حِينَ حَلَفَ، جُعِلَ ذَلِكَ فِي دِينِهِ وَأَمَانَتِهِ. وَقَالَ إِبْرَاهِيمُ إِنْ قَالَ لاَ حَاجَةَ لِي فِيكِ. نِيَّتُهُ، وَطَلاَقُ كُلِّ قَوْمٍ بِلِسَانِهِمْ. وَقَالَ قَتَادَةُ إِذَا قَالَ إِذَا حَمَلْتِ فَأَنْتِ طَالِقٌ. ثَلاَثًا، يَغْشَاهَا عِنْدَ كُلِّ طُهْرٍ مَرَّةً، فَإِنِ اسْتَبَانَ حَمْلُهَا فَقَدْ بَانَتْ. وَقَالَ الْحَسَنُ إِذَا قَالَ الْحَقِي بِأَهْلِكِ. نِيَّتُهُ. وَقَالَ ابْنُ عَبَّاسٍ الطَّلاَقُ عَنْ وَطَرٍ، وَالْعَتَاقُ مَا أُرِيدَ بِهِ وَجْهُ اللَّهِ. وَقَالَ الزُّهْرِيُّ إِنْ قَالَ مَا أَنْتِ بِامْرَأَتِي. نِيَّتُهُ، وَإِنْ نَوَى طَلاَقًا فَهْوَ مَا نَوَى. وَقَالَ عَلِيٌّ أَلَمْ تَعْلَمْ أَنَّ الْقَلَمَ رُفِعَ عَنْ ثَلاَثَةٍ عَنِ الْمَجْنُونِ حَتَّى يُفِيقَ، وَعَنِ الصَّبِيِّ حَتَّى يُدْرِكَ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ. وَقَالَ عَلِيٌّ وَكُلُّ الطَّلاَقِ جَائِزٌ إِلاَّ طَلاَقَ الْمَعْتُوهِ.

The Prophet ﷺ said, "Allah has forgiven my followers the evil thoughts that occur to their minds, as long as such thoughts are not put into action or uttered."  

And Qatada said, "If someone divorces his wife just in his mind, such an unuttered divorce has no effect.:
البخاري:٥٢٦٩حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا هِشَامٌ حَدَّثَنَا قَتَادَةُ عَنْ زُرَارَةَ بْنِ أَوْفَى عَنْ أَبِي هُرَيْرَةَ ؓ

عَنِ النَّبِيِّ ﷺ قَالَ إِنَّ اللَّهَ تَجَاوَزَ عَنْ أُمَّتِي مَا حَدَّثَتْ بِهِ أَنْفُسَهَا مَا لَمْ تَعْمَلْ أَوْ تَتَكَلَّمْ  

قَالَ قَتَادَةُ إِذَا طَلَّقَ فِي نَفْسِهِ فَلَيْسَ بِشَىْءٍ

A man from the tribe of Bani Aslam came to the Prophet ﷺ while he was in the mosque and said, "I have committed illegal sexual intercourse." The Prophet ﷺ turned his face to the other side. The man turned towards the side towards which the Prophet ﷺ had turned his face, and gave four witnesses against himself. On that the Prophet ﷺ called him and said, "Are you insane?" (He added), "Are you married?" The man said, 'Yes." On that the Prophet ﷺ ordered him to be stoned to the death in the Musalla (a praying place). When the stones hit him with their sharp edges and he fled, but he was caught at Al- Harra and then killed  

البخاري:٥٢٧٠حَدَّثَنَا أَصْبَغُ أَخْبَرَنَا ابْنُ وَهْبٍ عَنْ يُونُسَ عَنِ ابْنِ شِهَابٍ قَالَ أَخْبَرَنِي أَبُو سَلَمَةَ عَنْ جَابِرٍ

أَنَّ رَجُلاً مِنْ أَسْلَمَ أَتَى النَّبِيَّ ﷺ وَهْوَ فِي الْمَسْجِدِ فَقَالَ إِنَّهُ قَدْ زَنَى فَأَعْرَضَ عَنْهُ فَتَنَحَّى لِشِقِّهِ الَّذِي أَعْرَضَ فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ فَدَعَاهُ فَقَالَ هَلْ بِكَ جُنُونٌ هَلْ أُحْصِنْتَ قَالَ نَعَمْ فَأَمَرَ بِهِ أَنْ يُرْجَمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ جَمَزَ حَتَّى أُدْرِكَ بِالْحَرَّةِ فَقُتِلَ

A man from Bani Aslam came to Messenger of Allah ﷺ while he was in the mosque and called (the Prophet ﷺ ) saying, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." On that the Prophet ﷺ turned his face from him to the other side, whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and said, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." The Prophet turned his face (from him) to the other side whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and repeated his statement. The Prophet ﷺ turned his face (from him) to the other side again. The man moved again (and repeated his statement) for the fourth time. So when the man had given witness four times against himself, the Prophet ﷺ called him and said, "Are you insane?" He replied, "No." The Prophet ﷺ then said (to his companions), "Go and stone him to death." The man was a married one. Jabir bin ʿAbdullah Al-Ansari said: I was one of those who stoned him. We stoned him at the Musalla (ʿId praying place) in Medina. When the stones hit him with their sharp edges, he fled, but we caught him at Al-Harra and stoned him till he died.  

البخاري:٥٢٧١حَدَّثَنَا أَبُو الْيَمَانِ أَخْبَرَنَا شُعَيْبٌ عَنِ الزُّهْرِيِّ قَالَ أَخْبَرَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ وَسَعِيدُ بْنُ الْمُسَيَّبِ أَنَّ أَبَا هُرَيْرَةَ قَالَ

أَتَى رَجُلٌ مِنْ أَسْلَمَ رَسُولَ اللَّهِ ﷺ وَهْوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الأَخِرَ قَدْ زَنَى يَعْنِي نَفْسَهُ فَأَعْرَضَ عَنْهُ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الأَخِرَ قَدْ زَنَى فَأَعْرَضَ عَنْهُ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ لَهُ ذَلِكَ فَأَعْرَضَ عَنْهُ فَتَنَحَّى لَهُ الرَّابِعَةَ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ فَقَالَ هَلْ بِكَ جُنُونٌ قَالَ لاَ فَقَالَ النَّبِيُّ ﷺ اذْهَبُوا بِهِ فَارْجُمُوهُ وَكَانَ قَدْ أُحْصِنَ وَعَنِ الزُّهْرِيِّ قَالَ أَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ الأَنْصَارِيَّ قَالَ كُنْتُ فِيمَنْ رَجَمَهُ فَرَجَمْنَاهُ بِالْمُصَلَّى بِالْمَدِينَةِ فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ جَمَزَ حَتَّى أَدْرَكْنَاهُ بِالْحَرَّةِ فَرَجَمْنَاهُ حَتَّى مَاتَ
