68. Divorce

٦٨۔ كتاب الطلاق

68.6 If a man says (to his wife): "I have parted with you," or "I have released you"

٦٨۔٦ بَابُ إِذَا قَالَ فَارَقْتُكِ أَوْ سَرَّحْتُكِ

[Machine] "Or the cell, or the barrenness or what was intended for divorce, he is on his intention. And the saying of Allah Almighty: 'And release them in a good manner' and He also said: 'And I shall release you beautifully' and He said: 'Either retain them with goodness or release them in a good manner' and He said: 'Or separate them in goodness'. Aisha said, the Prophet ﷺ knew that my parents did not command me to separate from him."

أَوِ الْخَلِيَّةُ أَوِ الْبَرِيَّةُ أَوْ مَا عُنِيَ بِهِ الطَّلاَقُ، فَهُوَ عَلَى نِيَّتِهِ، وَقَوْلُ اللَّهِ ﷻ: {وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلاً} وَقَالَ: {وَأُسَرِّحْكُنَّ سَرَاحًا جَمِيلاً} وَقَالَ: {فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} وَقَالَ: {أَوْ فَارِقُوهُنَّ بِمَعْرُوفٍ}. وَقَالَتْ عَائِشَةُ قَدْ عَلِمَ النَّبِيُّ ﷺ أَنَّ أَبَوَيَّ لَمْ يَكُونَا يَأْمُرَانِي بِفِرَاقِهِ.
