68. Divorce

68.9 There is no divorce before marriage

٦٨۔٩ بَابُ لاَ طَلاَقَ قَبْلَ النِّكَاحِ

[Machine] And the saying of Allah, exalted be He: "O you who have believed, when you marry believing women and then divorce them before you have touched them, then there is not for you any waiting period to count concerning them. So provide for them and give them a gracious release." And Ibn Abbas said: Allah made divorce permissible after marriage. It is narrated in this regard from Ali, Saeed ibn Musayyib, Urwah ibn Zubayr, Abu Bakr ibn Abdul Rahman, Ubaidullah ibn Abdullah ibn Utbah, Abaan ibn Uthman, Ali ibn Husayn, Shurayh ibn Ubayd, Saeed ibn Jubayr, Al-Qasim, Salim, Tawus, Al-Hasan, Ikrimah, Ata, Amr ibn Hareem, Ash-Shabi, that it is not divorced.

وَقَوْلُ اللَّهِ تَعَالَى: {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلاً}. وَقَالَ ابْنُ عَبَّاسٍ جَعَلَ اللَّهُ الطَّلاَقَ بَعْدَ النِّكَاحِ وَيُرْوَى فِي ذَلِكَ عَنْ عَلِيٍّ وَسَعِيدِ بْنِ الْمُسَيَّبِ وَعُرْوَةَ بْنِ الزُّبَيْرِ وَأَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ وَعُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ وَأَبَانَ بْنِ عُثْمَانَ وَعَلِيِّ بْنِ حُسَيْنٍ وَشُرَيْحٍ وَسَعِيدِ بْنِ جُبَيْرٍ وَالْقَاسِمِ وَسَالِمٍ وَطَاوُسٍ وَالْحَسَنِ وَعِكْرِمَةَ وَعَطَاءٍ وَعَامِرِ بْنِ سَعْدٍ وَجَابِرِ بْنِ زَيْدٍ وَنَافِعِ بْنِ جُبَيْرٍ وَمُحَمَّدِ بْنِ كَعْبٍ وَسُلَيْمَانَ بْنِ يَسَارٍ وَمُجَاهِدٍ وَالْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ وَعَمْرِو بْنِ هَرِمٍ وَالشَّعْبِيِّ أَنَّهَا لاَ تَطْلُقُ.
