[Machine] Because Umar ؓ certified the testimony of those who witnessed a man committing adultery, but they did not complete four testimonies, he said, "This is similar to the saying of two."  

البيهقي:٢١١٩٠أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ خِمَيْرَوَيْهِ أنبأ أَحْمَدُ بْنُ نَجْدَةَ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا هُشَيْمٌ أنبأ الشَّيْبَانِيُّ عَنْ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ الثَّقَفِيِّ أَنَّ عَمْرَو بْنَ حُرَيْثٍ كَانَ يُجِيزُ شَهَادَتَهُ وَيَقُولُ كَذَلِكُ يُفْعَلُ بِالْخَائِنِ وَالْفَاجِرِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَبِهَذَا نَقُولُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِيمَا حُكِيَ عَنْهُ

لِأَنَّ عُمَرَ ؓ أَجَازَ شَهَادَةَ الَّذِينَ رَصَدُوا رَجُلًا يَزْنِي وَلَكِنْ لَمْ يَتِمُّوا أَرْبَعَةً قَالَ وَهَذَا أَشْبَهُ الْقَوْلَيْنِ
