[Machine] That the Messenger of Allah ﷺ said, "Reconciliation is permissible among Muslims."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ
[Machine] That the Messenger of Allah ﷺ said, "Reconciliation is permissible among Muslims."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ
[Machine] He demanded a debt from Ibn Abi Hadrad, which he owed to him in the mosque. Their voices became loud enough for the Messenger of Allah ﷺ to hear them. So he came out until he uncovered the curtain of his room and said, "O Ka'b, forgive some of your debt." He pointed towards it, which part, he said, "Yes." So he judged it.
أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ عَلَيْهِ فِي الْمَسْجِدِ فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهَا رَسُولُ اللهِ ﷺ فَخَرَجَ حَتَّى كَشَفَ سِتْرَ حُجْرَتِهِ فَقَالَ يَا كَعْبُ ضَعْ مِنْ دَيْنِكَ هَذَا وَأَشَارَ إِلَيْهِ أَيِ الشَّطْرَ قَالَ نَعَمْ فَقَضَاهُ
"Ka'b!" He said: "At your service, Messenger of Allah." Thereupon he made a gesture with is hand indicating: Remit half the debt due to you. Ka'b said: "I shall do so, Messenger of Allah." The Prophet ﷺ then said: "Get up and discharge" (Using translation from Abū Dāʾūd 3595)
أَخْبَرَهُ أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي الْمَسْجِدِ فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهَا رَسُولُ اللهِ ﷺ وَهُوَ فِي بَيْتِهِ فَخَرَجَ إِلَيْهِمَا رَسُولُ اللهِ ﷺ حَتَّى كَشَفَ سِتْرَ حُجْرَتِهِ وَنَادَى كَعْبَ بْنَ مَالِكٍ فَقَالَ يَا كَعْبُ قَالَ لَبَّيْكَ يَا رَسُولَ اللهِ فَأَشَارَ إِلَيْهِ بِيَدِهِ أَنْ ضَعِ الشَّطْرَ مِنْ دَيْنِكَ قَالَ كَعْبٌ قَدْ فَعَلْتُ يَا رَسُولَ اللهِ قَالَ رَسُولُ اللهِ ﷺ قُمْ فَاقْضِهِ
My father was martyred on the day (of the battle) of Uhud and his creditors demanded the debt back in a harsh manner. So I went to Messenger of Allah ﷺ and informed him of that, he asked them to accept the fruits of my garden and excuse my father, but they refused. So, Messenger of Allah ﷺ did not give them the fruits, nor did he cut them and distribute them among them, but said, "I will come to you tomorrow morning." So, he came to us the next morning and walked about in between the date-palms and invoked Allah to bless their fruits. I plucked the fruits and gave back all the rights of the creditors in full, and a lot of fruits were left for us. Then I went to Messenger of Allah ﷺ, who was sitting, and informed him about what happened. Messenger of Allah ﷺ told ʿUmar, who was sitting there, to listen to the story. ʿUmar said, "Don't we know that you are Messenger of Allah ﷺ? By Allah! you are Messenger of Allah ﷺ!" أَخْبَرَهُ أَنَّ أَبَاهُ قُتِلَ يَوْمَ أُحُدٍ شَهِيدًا وَعَلَيْهِ دَيْنٌ فَاشْتَدَّ الْغُرَمَاءُ فِي حُقُوقِهِمْ قَالَ جَابِرٌ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَكَلَّمْتُهُ فَسَأَلَهُمْ أَنْ يَقْبَلُوا ثَمَرَ حَائِطِي وَيُحَلِّلُوا أَبِي فَأَبَوْا فَلَمْ يُعْطِهِمْ رَسُولُ اللهِ ﷺ حَائِطِي وَلَمْ يَكْسِرْهُ لَهُمْ وَلَكِنْ قَالَ سَأَغْدُو عَلَيْكَ فَغَدَا عَلَيْنَا حِينَ أَصْبَحَ فَطَافَ فِي النَّخْلِ وَدَعَا فِي ثَمَرِهَا بِالْبَرَكَةِ قَالَ فَجَدَدْتُهَا فَقَضَيْتُهُمْ حُقُوقَهُمْ وَبَقِيَتْ لَنَا مِنْ ثَمَرِهَا بَقِيَّةٌ فَجِئْتُ رَسُولَ اللهِ ﷺ فَأَخْبَرْتُهُ بِذَلِكَ فَقَالَ رَسُولُ اللهِ ﷺ لِعُمَرَ وَهُوَ جَالِسٌ اسْمَعْ عُمَرُ مَا يَقُولُ قَالَ عُمَرُ ؓ أَلَا يَكُونُ قَدْ عَلِمْنَا أَنَّكَ رَسُولُ اللهِ فَوَاللهِ إِنَّكَ لَرَسُولُ اللهِ
[Machine] And he said to Abu Lubabah about an orphan who had a dispute with him over a palm tree, and he ruled in favor of Abu Lubabah. So the young boy cried, and the Messenger of Allah ﷺ said to Abu Lubabah, "Give him your palm tree." Abu Lubabah said, "No." The Messenger of Allah ﷺ said, "Give it to him and you will have a date palm in paradise." Abu Lubabah said, "No." Ibn al-Dahdah heard this and said to Abu Lubabah, "Will you sell your date palm in paradise for my garden?" He said, "Yes." Then the Messenger of Allah ﷺ came and said, "The palm tree that you asked for the orphan, if I give it to him, will I have a date palm in paradise?" The Messenger of Allah ﷺ said, "Yes." Then Ibn al-Dahdah was martyred on the Day of Uhud, and the Messenger of Allah ﷺ said, "Many a humble date palm for the son of al-Dahdah in paradise."
وَقَالَ لِأَبِي لُبَابَةَ فِي يَتِيمٍ لَهُ خَاصَمَهُ فِي نَخْلَةٍ فَقَضَى بِهَا لِأَبِي لُبَابَةَ فَبَكَى الْغُلَامُ فَقَالَ رَسُولُ اللهِ ﷺ لِأَبِي لُبَابَةَ أَعْطِهِ نَخْلَتَكَ فَقَالَ لَا فَقَالَ أَعْطِهِ إِيَّاهَا وَلَكَ عِذْقٌ فِي الْجَنَّةِ فَقَالَ لَا فَسَمِعَ بِذَلِكَ ابْنُ الدَّحْدَاحَةِ فَقَالَ لِأَبِي لُبَابَةَ أَتَبِيعُ عِذْقَكَ ذَلِكَ بِحَدِيقَتِي هَذِهِ؟ قَالَ نَعَمْ ثُمَّ جَاءَ رَسُولَ اللهِ ﷺ فَقَالَ النَّخْلَةُ الَّتِي سَأَلْتَ لِلْيَتِيمِ إِنْ أَعْطَيْتُهُ أَلِي بِهَا عِذْقٌ فِي الْجَنَّةِ؟ فَقَالَ رَسُولُ اللهِ ﷺ نَعَمْ ثُمَّ قُتِلَ ابْنُ الدَّحْدَاحَةِ شَهِيدًا يَوْمَ أُحُدٍ فَقَالَ رَسُولُ اللهِ ﷺ رُبَّ عِذْقٍ مُذَلَّلٍ لِابْنِ الدَّحْدَاحَةِ فِي الْجَنَّةِ
[Machine] To give him until he reaches five hundred, then he wrote the book on it and exonerated him, then he took it with five hundred, so they disagreed to a judge, and he said to the witnesses, did he place the five hundred in his hand? They said no, so he commanded and returned it to him. The sheikh said, and we also do not allow the deposit if it is conditional.
أَنْ يُعْطُوهُ حَتَّى حَطَّ الْخَمْسَمِائَةِ فَكَتَبَ عَلَيْهِ الْكِتَابَ وَأَبْرَأَهُ ثُمَّ أَخَذَهُ بِالْخَمْسِمِائَةِ فَاخْتَصَمُوا إِلَى شُرَيْحٍ فَقَالَ لِلشُّهُودِ هَلْ وَضَعَ الْخَمْسَمِائَةِ فِي كَفِّهِ؟ فَقَالُوا لَا فَأَمَرَ فَرُدَّ عَلَيْهِ قَالَ الشَّيْخُ وَنَحْنُ أَيْضًا لَا نُجِيزُ الْحَطَّ إِذَا كَانَ بِشَرْطٍ
[Machine] The Messenger of Allah, ﷺ , said: "Reconciliation is permissible among Muslims." And Abu Ali Al-Rawdhbari informed us that Abu Bakr ibn Dasa narrated to us, who narrated from Abu Dawood, who narrated from Ahmed ibn Abdul Wahid Al-Dimashqi, who narrated from Marwan ibn Muhammad, who narrated from Sulaiman ibn Bilal or Abdul Aziz ibn Muhammad, who doubted Abu Dawood in his narration, mentioned it in a similar manner, except that it says: "Except for reconciliation, which forbids what is halal or permits what is haram."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ 11351 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ عَبْدِ الْوَاحِدِ الدِّمَشْقِيُّ ثنا مَرْوَانُ بْنُ مُحَمَّدٍ ثنا سُلَيْمَانُ بْنُ بِلَالٍ أَوْ عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ شَكَّ أَبُو دَاوُدَ عَنْ كَثِيرِ بْنِ زَيْدٍ فَذَكَرَهُ بِنَحْوِهِ زَادَ إِلَّا صُلْحًا حَرَّمَ حَلَالًا أَوْ أَحَلَّ حَرَامًا
[Machine] The Prophet ﷺ said that reconciliation is permissible among Muslims except for a settlement that makes the prohibited lawful or the lawful prohibited, and likewise...
أَنَّ النَّبِيَّ ﷺ قَالَ الصُّلْحُ جَائِزٌ بَيْنَ الْمُسْلِمِينَ إِلَّا صُلْحًا أَحَلَّ حَرَامًا أَوْ حَرَّمَ حَلَالًا وَكَذَلِكَ
[Machine] This is a book that Omar sent to Abu Musa mentioning in it that reconciliation is permissible among people except if it makes the forbidden lawful or makes the lawful forbidden.
هَذَا كِتَابُ عُمَرَ ؓ إِلَى أَبِي مُوسَى فَذَكَرَهُ وَفِيهِ وَالصُّلْحُ جَائِزٌ بَيْنَ النَّاسِ إِلَّا صُلْحًا أَحَلَّ حَرَامًا أَوْ حَرَّمَ حَلَالًا
[Machine] That he did not see any harm in disputing over inheritance.
أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالْمُخَارَجَةِ فِي الْمِيرَاثِ
[Machine] The woman of Abdurrahman received a quarter of her share for eighty thousand and this is interpreted as she knew the amount of her share, 11355, and it has been narrated by Ash-Sha'bi from Shurayh that he said, "Whatever woman receives her dowry but does not disclose what her husband left, then all that is suspicion."
صُولِحَتِ امْرَأَةُ عَبْدِ الرَّحْمَنِ مِنْ نَصِيبِهَا رُبُعَ الثَّمَنِ عَلَى ثَمَانِينَ أَلْفًا وَهَذَا مَحْمُولٌ عَلَى أَنَّهَا كَانَتْ عَارِفَةً بِمِقْدَارِ نَصِيبِهَا 11355 وَقَدْ رَوَى الشَّعْبِيُّ عَنْ شُرَيْحٍ أَنَّهُ قَالَ أَيُّمَا امْرَأَةٍ صُولِحَتْ مِنْ ثَمَنِهَا وَلَمْ تُخْبِرْ بِمَا تَرَكَ زَوْجُهَا فَتِلْكَ الرِّيبَةُ كُلُّهَا
[Machine] Abdullah ibn Umar, when a man had gold or silver, would ask him which of the two he preferred when spending it. Would you prefer to spend it by giving it to people or by spending it by yourself? If that person accepted, Abdullah ibn Umar would not be upset by it.
أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ كَانَ إِذَا كَانَ لِلرَّجُلِ عَلَيْهِ الذَّهَبُ أَوِ الْوَرِقُ خَيَّرَهُ حِينَ يَقْضِيهِ أِيُّ الصِّنْفَيْنِ أَحَبُّ إِلَيْكَ؟ ثُمَّ يَقْضِيهِ بِصَرْفِ النَّاسِ أَوْ يَصْرِفُ فَيَقْضِيهِ فَإِذَا قَبِلَ ذَلِكَ الرَّجُلُ لَمْ يَرَ بِهِ عَبْدُ اللهِ بَأْسًا
[Machine] "Take these coins to the market for my slave. When it reaches the price, give it to him with his dinars. And if he prefers to sell them with dinars, then sell them and give him his dinars."
لِغُلَامِهِ اذْهَبْ بِهَذِهِ الدَّنَانِيرِ إِلَى السُّوقِ فَإِذَا قَامَتْ عَلَى ثَمَنٍ فَأَعْطِهَا إِيَّاهُ بِدَرَاهِمِهِ وَإِنْ أَحَبَّ أَنْ يَبِيعَهَا بِالدَّرَاهِمِ فَبِعْهَا وَأَعْطِهِ دَرَاهِمَهُ
Messenger of Allah ﷺ said, "Whoever has wronged his brother, should ask for his pardon (before his death), as (in the Hereafter) there will be neither a Dinar nor a Dirham. (He should secure pardon in this life) before some of his good deeds are taken and paid to his brother, or, if he has done no good deeds, some of the bad deeds of his brother are taken to be loaded on him (in the Hereafter). عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ كَانَتْ عِنْدَهُ مَظْلِمَةٌ لِأَخِيهِ فَلْيَتَحَلَّلْهُ مِنْهَا؛ فَإِنَّهُ لَيْسَتْ ثَمَّ دِينَارٌ وَلَا دِرْهَمٌ مِنْ قَبْلِ أَنْ يُؤْخَذَ لِأَخِيهِ مِنْ حَسَنَاتِهِ فَإِنْ لَمْ تَكُنْ لَهُ حَسَنَاتٌ أُخِذَتْ مِنْ سَيِّئَاتِ أَخِيهِ فَطُرِحَتْ عَلَيْهِ
[Machine] I was sitting with the Prophet ﷺ when two men from the Ansar came to him, arguing about things that had been studied and clarified. The Prophet ﷺ said, "I will settle the dispute between you based on what has not been revealed to me. Whoever I decide in favor of with a valid argument, should take it from his brother's property unjustly, then he is bringing a piece of burning coal to his neck on the Day of Judgment." The two men cried and each one of them said, "My right is with me, O Messenger of Allah, for which I demand." He ﷺ said, "No, but both of you should go and compromise, then ask me again and I will judge rightly between each one of you and his companion."
كُنْتُ عِنْدَ النَّبِيِّ ﷺ جَالِسَةً فَجَاءَهُ رَجُلَانِ مِنَ الْأَنْصَارِ يَخْتَصِمَانِ فِي أَشْيَاءَ قَدْ دُرِسَتْ وَبَادَتْ فَقَالَ النَّبِيُّ ﷺ إِنَّمَا أَقْضِي بَيْنَكُمَا فِيمَا لَمْ يَنْزِلْ عَلَيَّ فِيهِ شَيْءٌ فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ بِحُجَّةٍ أَرَاهَا فَاقْتَطَعَ بِهَا مِنْ مَالِ أَخِيهِ ظُلْمًا أَتَى بِهَا إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ فَبَكَى الرَّجُلَانِ وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا حَقِّي لَهُ يَا رَسُولَ اللهِ الَّذِي أَطْلُبُ قَالَ لَا وَلَكِنِ اذْهَبَا فَاسْتَهِمَا وَتَوَخَّيَا ثُمَّ لِيُحْلِلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ
[Machine] Umar said, "Reconcile with the opponents until they reach an agreement, for the decision of justice resolves disputes among people."
قَالَ عُمَرُ ؓ رُدُّوا الْخُصُومَ حَتَّى يَصْطَلِحُوا؛ فَإِنَّ فَصْلَ الْقَضَاءِ يُحْدِثُ بَيْنَ الْقَوْمِ الضَّغَائِنَ
[Machine] "That they reconcile; for indeed it is better for honesty and reduces animosities."
أَنْ يَصْطَلِحُوا؛ فَإِنَّهُ أَبْرَأُ لِلصِّدْقِ وَأَقَلُّ لِلْحِنَاتِ
[Machine] "About Umar (may Allah be pleased with him) it is uncertain, and Allah knows best."
عَنْ عُمَرَ ؓ مُنْقَطِعَةٌ وَاللهُ أَعْلَمُ
[Machine] "He went out on a Friday and it rained on him. So he ordered the umbrella for Al-Abbas, and he took it and said to Al-Abbas, 'You took my umbrella, I swear by Allah, no one should have it except the Messenger of Allah ﷺ .' Umar said, 'I swear by Allah, no one should have it except you.' Then Al-Abbas put his feet on Umar's shoulders and then returned it to where it was. It has been narrated from two other sources that Umar and Abbas did this. Abu Abdullah Al-Hafiz narrated to us, from Abu Ahmad Al-Hussein Ibn Ali Al-Tamimi, from Muhammad Ibn Al-Musayyib, from Abu Umayr Isa Ibn Muhammad Ibn Al-Nahhas, from Al-Walid Ibn Muslim, from Shuayb Al-Khurasani, from Ata Ibn Rabah, from Saeed Ibn Al-Musayyib, that when Umar Ibn Al-Khattab wanted to expand the Prophet's Mosque, his expansion encroached on the house of Al-Abbas Ibn Abd Al-Muttalib. He mentioned a story in which the umbrella was mentioned in meaning. It was also narrated by Abdul Rahman Ibn Zaid Ibn Aslam, from his father, from his grandfather, from Umar, in meaning. Ibn Uyaynah narrated the same Hadith from Abu Harun Al-Madani, it is disconnected and summarized with some meaning."
ؓ خَرَجَ فِي يَوْمِ جُمُعَةٍ فَقَطَرَ مِيزَابٌ عَلَيْهِ لِلْعَبَّاسِ فَأَمَرَ بِهِ فَقُلِعَ فَقَالَ الْعَبَّاسُ قَلَعْتَ مِيزَابِي وَاللهِ مَا وَضَعَهُ حَيْثُ كَانَ إِلَّا رَسُولُ اللهِ ﷺ بِيَدِهِ فَقَالَ عُمَرُ ؓ وَاللهِ لَا يَضَعُهُ إِلَّا أَنْتَ بِيَدِكَ ثُمَّ لَا يَكُونُ لَكَ سُلَّمٌ إِلَّا عُمَرَ قَالَ فَوَضَعَ الْعَبَّاسُ رِجْلَيْهِ عَلَى عَاتِقَيْ عُمَرَ ثُمَّ أَعَادَهُ حَيْثُ كَانَ وَقَدْ رُوِيَ مِنْ وَجْهَيْنِ آخَرَيْنِ عَنْ عُمَرَ وَعَبَّاسٍ ؓ 11364 حَدَّثَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو أَحْمَدَ الْحُسَيْنُ بْنُ عَلِيٍّ التَّمِيمِيُّ ثنا مُحَمَّدُ بْنُ الْمُسَيِّبِ ثنا أَبُو عُمَيْرٍ عِيسَى بْنُ مُحَمَّدِ بْنِ النَّحَّاسِ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ ثنا شُعَيْبٌ الْخُرَاسَانِيُّ عَنْ عَطَاءٍ الْخُرَاسَانِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ لَمَّا أَرَادَ أَنْ يَزِيدَ فِي مَسْجِدِ رَسُولِ اللهِ ﷺ وَقَعَتْ زِيَادَتُهُ عَلَى دَارِ الْعَبَّاسِ بْنِ عَبْدِ الْمُطَّلِبِ فَذَكَرَ قِصَّةً وَذَكَرَ فِيهَا قِصَّةَ الْمِيزَابِ بِمَعْنَاهُ وَرَوَاهُ أَيْضًا عَبْدُ الرَّحْمَنِ بْنُ زَيْدِ بْنِ أَسْلَمَ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ عُمَرَ بِمَعْنَاهُ وَرَوَاهُ ابْنُ عُيَيْنَةَ عَنْ أَبِي هَارُونَ الْمَدَنِيِّ مُنْقَطِعًا مُخْتَصَرًا بِبَعْضِ مَعْنَاهُ
Two men disputed about some property and brought the case to the Holy Prophet ﷺ, but neither of them could produce any proof. So the Holy Prophet ﷺ said: Cast lots about the oath whatever it may be, whether they like it or dislike it. (Using translation from Abū Dāʾūd 3616)
أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي مَتَاعٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَقَالَ النَّبِيُّ ﷺ اسْتَهِمَا عَلَى الْيَمِينِ مَا كَانَ أَحَبَّا ذَلِكَ أَوْ كَرِهَا
[Machine] Two men quarreled before the Messenger of Allah ﷺ about a matter that neither of them had clear evidence for. So the Messenger of Allah ﷺ judged between them by dividing it into two halves. 11367 Abu al-Hassan al-Muqri narrated to us, Hassan ibn Muhammad ibn Ishaq narrated to us, Yusuf ibn Ya'qub narrated to us, Muhammad ibn Abi Bakr narrated to us, Sa'id ibn 'Amir mentioned it in a similar way, except that he said: "So he divided it into two halves between them."
اخْتَصَمَ رَجُلَانِ إِلَى رَسُولِ اللهِ ﷺ فِي شَيْءٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَقَضَى بِهِ رَسُولُ اللهِ ﷺ بَيْنَهُمَا نِصْفَيْنِ 11367 أَخْبَرَنَا أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا سَعِيدُ بْنُ عَامِرٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ فَجَعَلَهُ بَيْنَهُمَا نِصْفَيْنِ
[Machine] "A group of people had a dispute over some enclosures among themselves, so the Messenger of Allah ﷺ sent me to settle the matter. I made a judgment based on what I found in accordance with the customs of the Qimṭ tribe. Then, I went to the Prophet ﷺ and informed him of the decision. He said, 'You have made the correct judgment based on the narration of Dahtham ibn Qurran al-Yamami, who is weak, and they (the scholars) differed about its chain of narrators. It was reported in this manner and also reported from two other chains of narrators.'"
اخْتَصَمَ قَوْمٌ فِي حَظَائِرَ بَيْنَهُمْ فَبَعَثَنِي رَسُولُ اللهِ ﷺ فَقَضَيْتُ لِلَّذِي وَجَدْتُ مَعَاقِدَ الْقِمْطِ تَلِيهِ فَأَتَيْتُ النَّبِيَّ ﷺ فَأَخْبَرْتُهُ فَقَالَ أَصَبْتَ تَفَرَّدَ بِهَذَا الْحَدِيثِ دَهْثَمُ بْنُ قُرَّانَ الْيَمَامِيُّ وَهُوَ ضَعِيفٌ وَاخْتَلَفُوا عَلَيْهِ فِي إِسْنَادِهِ فَرُوِيَ هَكَذَا وَرُوِيَ مِنْ وَجْهَيْنِ آخَرَيْنِ
[Machine] There was once a house between two brothers, and they divided it equally. Then, both of them died and each one left behind an heir. Each heir claimed that the house belonged to them alone, without the other's partner. They then brought their dispute to the Prophet Muhammad ﷺ , who sent Hudhayfah ibn al-Yaman to settle the matter. He ruled in favor of the one who found the written contract. Hudhayfah then returned and informed the Prophet Muhammad ﷺ , who said, "You have judged correctly." This narration is attributed to Dawud ibn Rushayd.
أَنَّ دَارًا كَانَتْ بَيْنَ أَخَوَيْنِ فَحَظَرَا فِي وَسَطِهَا حِظَارًا ثُمَّ هَلَكَا وَتَرَكَ كُلُّ وَاحِدٍ مِنْهُمَا عَقِبًا فَادَّعَى عَقِبُ كُلِّ وَاحِدٍ مِنْهُمَا أَنَّ الْحِظَارَ لَهُ مِنْ دُونِ صَاحِبِهِ فَاخْتَصَمَ عَقِبَاهُمَا إِلَى النَّبِيِّ ﷺ فَأَرْسَلَ حُذَيْفَةَ بْنَ الْيَمَانِ ؓ يَقْضِي بَيْنَهُمَا فَقَضَى بِالْحِظَارِ لِمَنْ وَجَدَ مَعَاقِدَ الْقِمْطِ تَلِيهِ ثُمَّ رَجَعَ فَأَخْبَرَ النَّبِيَّ ﷺ فَقَالَ النَّبِيُّ ﷺ أَصَبْتَ قَالَ دَهْثَمٌ أَوْ قَالَ أَحْسَنْتَ لَفْظُ حَدِيثِ دَاوُدَ بْنِ رُشَيْدٍ
[Machine] A group of people came to the Prophet ﷺ disputing about a matter of khuss (special privilege). So he sent Hudhaifa with them, and he ruled in favor of whoever was wearing a certain type of garment. The Prophet ﷺ said to him, "You have done well, and this is how it is."
جَاءَ قَوْمٌ يَخْتَصِمُونَ إِلَى النَّبِيِّ ﷺ فِي خُصٍّ فَبَعَثَ مَعَهُمْ حُذَيْفَةَ فَقَضَى بِالْخُصِّ لِمَنْ تَلِيهِ الْقِمْطُ فَقَالَ لَهُ النَّبِيُّ ﷺ أَحْسَنْتَ وَهَكَذَا
[Machine] that a group of people were disputing about a share that they had, so they presented their case to Ali and he ruled that they should see which one of them was closer to a cloth, and that person would receive the share.
أَنَّ قَوْمًا اخْتَصَمُوا فِي خُصٍّ لَهُمْ إِلَى عَلِيٍّ فَقَضَى بَيْنَهُمْ أَنْ يُنْظَرَ أَيُّهُمْ كَانَ أَقْرَبَ مِنَ الْقِمَاطِ فَهُوَ أَحَقُّ بِهِ وَهَذَا مُنْقَطِعٌ وَقَدْ
[Machine] "The Messenger of Allah ﷺ said: 'Let none of you prevent his neighbor from driving a nail in his wall and then say: By Allah, I did not see you doing it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَمْنَعُ أَحَدُكُمْ جَارَهُ أَنْ يَغْرِزَ خَشَبَةً فِي جِدَارِهِ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ مَا لِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ؟ وَاللهِ لَأَرْمِيَنَّهَا بَيْنَ أَكْتَافِكُمْ
[Machine] The Prophet ﷺ said, "Let not anyone prevent his neighbor from placing a wooden plank on his wall, then Abu Hurairah said, 'Why do I not see you interested in it? By Allah, I will throw it between your shoulders.'"
قَالَ رَسُولُ اللهِ ﷺ لَا يَمْنَعَنَّ أَحَدُكُمْ جَارَهُ أَنْ يَضَعَ خَشَبَةً عَلَى جِدَارِهِ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ مَا لِي أَرَاكُمْ مُعْرِضِينَ عَنْهَا؟ وَاللهِ لَأَرْمِيَنَّ بِهَا بَيْنَ أَكْتَافِكُمْ
“The Prophet ﷺ: 'When anyone of you asks his neighbor for permission to fix a piece of wood to his wall, he should not refuse him. 'When Abu Hurairah told them this, they lowered their heads, and when he saw them he said: 'Why do I see you turning away from it? By Allah, I will force you to accept it.' ” (Using translation from Ibn Mājah 2335)
قَالَ رَسُولُ اللهِ ﷺ إِذَا اسْتَأْذَنَ أَحَدُكُمْ جَارَهُ أَنْ يَغْرِزَ خَشَبَتَهُ فِي جِدَارِهِ فَلَا يَمْنَعْهُ فَلَمَّا حَدَّثَهُمْ طَأْطَئُوا رُءُوسَهُمْ فَقَالَ مَا لِي أَجِدُكُمْ مُعْرِضِينَ؟ وَاللهِ لَأَرْمِيَنَّ بِهَا بَيْنَ أَكْتَافِكُمْ
[Machine] The Messenger of Allah ﷺ said: "Let none of you prevent his neighbor from placing a piece of wood in his wall, and then say, 'Abu Hurairah, why do I see you turning away from it?' By Allah, I will throw it among your chests, with a strong and authentic chain of narrators."
قَالَ رَسُولُ اللهِ ﷺ لَا يَمْنَعَنَّ أَحَدُكُمْ جَارَهُ مَوْضِعَ خَشَبَةٍ أَنْ يَجْعَلَهَا فِي جِدَارِهِ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ مَا لِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ؟ وَاللهِ لَأَرْمِيَنَّ بِهَا بَيْنَ أَظْهُرِكُمْ إِسْنَادٌ صَحِيحٌ
[Machine] The Prophet ﷺ forbade drinking from a water container and preventing one's neighbor from placing a piece of wood on his wall.
أَنَّ النَّبِيَّ ﷺ نَهَى أَنْ يُشْرَبَ مِنْ فِي السِّقَاءِ وَأَنْ يَمْنَعَ أَحَدُكُمْ جَارَهُ أَنْ يَضَعَ خَشَبَهُ عَلَى حَائِطِهِ
[Machine] The Messenger of Allah, ﷺ , said: "It is not permissible for a neighbor to prevent his neighbor from placing his sticks in his own wall." This is a hadith with a valid chain of narration, and likewise.
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْجَارِ أَنْ يَمْنَعَ جَارَهُ أَنْ يَضَعَ أَعْوَادَهُ فِي حَائِطِهِ هَذَا إِسْنَادٌ صَحِيحٌ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "If any of you ask his neighbor to support the branches against his wall, he should not refuse him."
قَالَ رَسُولُ اللهِ ﷺ إِذَا سَأَلَ أَحَدَكُمْ جَارُهُ أَنْ يَدْعَمَ جُذُوعَهُ عَلَى حَائِطِهِ فَلَا يَمْنَعْهُ
[Machine] The Messenger of Allah ﷺ said: "When you dispute in a matter, make it (the path of disagreement) seven arms lengths and whoever builds a structure should support it with the wall of his neighbor."
قَالَ رَسُولُ اللهِ ﷺ إِذَا اخْتَلَفْتُمْ فِي الطَّرِيقِ فَاجْعَلُوهُ سَبْعَةَ أَذْرُعٍ وَمَنْ بَنَى بِنَاءً فَلْيَدْعَمْهُ بِحَائِطِ جَارِهِ
[Machine] The Prophet Muhammad ﷺ said, "One of you should not prevent his neighbor from placing his wall plank on his wall. And if you differ in the measurement of the pathway, make it seven cubits." This was also narrated by Ibn Lahi'ah from Abu Al-Aswad from Ikrimah from Ibn Abbas regarding the elbow, and it was also narrated by Ibrahim ibn Ismail from Dawud ibn Al-Husayn from Ikrimah from Ibn Abbas regarding them, and the narration of Ayub and Khalid and Al-Zubair is the most correct, and Allah knows best.
قَالَ رَسُولُ اللهِ ﷺ لَا يَمْنَعَنَّ أَحَدُكُمْ جَارَهُ أَنْ يَضَعَ خَشَبَتَهُ عَلَى حَائِطِهِ وَإِذَا اخْتَلَفْتُمْ فِي الطَّرِيقِ الْمِئْتَاءِ فَاجْعَلُوهَا سَبْعَةَ أَذْرُعٍ وَرَوَاهُ أَيْضًا ابْنُ لَهِيعَةَ عَنْ أَبِي الْأَسْوَدِ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ فِي الْمِرْفَقِ وَرَوَاهُ إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ فِيهِمَا وَرِوَايَةُ أَيُّوبَ وَخَالِدٍ وَالزُّبَيْرِ أَصَحُّ وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ commanded that a neighbor should not prevent his neighbor from hammering a nail into his own wall. Then, the neighbor who had taken an oath said, "O my brother, I know that you have a right to be upset with me, and I have taken an oath, so please place a piece of pottery under my wall." So, the other neighbor hammered the nail into the piece of pottery. Ibn Jurayj said, "Umru reported to me, and I witnessed it for myself."
أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ أَنْ لَا يَمْنَعَ جَارٌ جَارًا أَنْ يَغْرِزَ خَشَبًا فِي جِدَارِهِ فَقَالَ الْحَالِفُ أَيْ أَخِي قَدْ عَلِمْتُ أَنَّكَ مَقْضِيٌّ لَكَ عَلَيَّ وَقَدْ حَلَفْتُ فَاجْعَلْ أُسْطُوَانَةً دُونَ جُدُرِي فَفَعَلَ الْآخَرُ فَغَرَزَ فِي الْأُسْطُوَانَةِ خَشَبَهُ فَقَالَ ابْنُ جُرَيْجٍ قَالَ عَمْرٌو وَأَنَا نَظَرْتُ إِلَى ذَلِكَ وَقَدْ
[Machine] To place his board on the wall of its owner without his permission, and if someone prevents him, then hear from the Ansar that they narrate from the Messenger of Allah ﷺ that he forbade preventing him, so he was compelled to do so.
أَنْ يَضَعَ خَشَبَتَهُ عَلَى جِدَارِ صَاحِبِهِ بِغَيْرِ إِذْنِهِ فَمَنَعَهُ فَإِذَا مَنْ شِئْتَ مِنَ الْأَنْصَارِ يُحَدِّثُونَ عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ نَهَاهُ أَنْ يَمْنَعَهُ فَجُبِرَ عَلَى ذَلِكَ
[Machine] "The Messenger of Allah, ﷺ , said: There should be no harm inflicted or reciprocated. Whoever inflicts harm, Allah will inflict harm upon him. And whoever makes things difficult, Allah will make things difficult for him. Uthman ibn Muhammad narrated this from Ad-Darawardi."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا ضَرَرَ وَلَا ضِرَارَ مَنْ ضَارَّ ضَرَّهُ اللهُ وَمَنْ شَاقَّ شَقَّ اللهُ عَلَيْهِ تَفَرَّدَ بِهِ عُثْمَانُ بْنُ مُحَمَّدٍ عَنِ الدَّرَاوَرْدِيِّ
[Machine] The Messenger of Allah ﷺ said, "There shall be no causing harm or reciprocating harm." This was narrated to us by Abu Ahmad al-Mihrajani, who reported from Abu Bakr ibn Ja'far, who reported from Muhammad ibn Ibrahim, who reported from Ibn Bukair, who reported from Malik, who mentioned it.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا ضَرَرَ وَلَا ضِرَارَ مُرْسَلًا أَخْبَرَنَاهُ أَبُوأَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ أنبأ ابْنُ بُكَيْرٍ أنبأ مَالِكٌ فَذَكَرَهُ
“Whoever harms others, Allah (SWT) will harm him; and whoever causes hardship to other Allah will cause hardship to him.” (Using translation from Ibn Mājah 2342)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ ضَارَّ ضَارَّ اللهُ بِهِ وَمَنْ شَقَّ شَقَّ اللهُ عَلَيْهِ
