17. Chapter
١٧۔ كِتَابُ الصُّلْحِ
Messenger of Allah ﷺ said, "Whoever has wronged his brother, should ask for his pardon (before his death), as (in the Hereafter) there will be neither a Dinar nor a Dirham. (He should secure pardon in this life) before some of his good deeds are taken and paid to his brother, or, if he has done no good deeds, some of the bad deeds of his brother are taken to be loaded on him (in the Hereafter). عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ كَانَتْ عِنْدَهُ مَظْلِمَةٌ لِأَخِيهِ فَلْيَتَحَلَّلْهُ مِنْهَا؛ فَإِنَّهُ لَيْسَتْ ثَمَّ دِينَارٌ وَلَا دِرْهَمٌ مِنْ قَبْلِ أَنْ يُؤْخَذَ لِأَخِيهِ مِنْ حَسَنَاتِهِ فَإِنْ لَمْ تَكُنْ لَهُ حَسَنَاتٌ أُخِذَتْ مِنْ سَيِّئَاتِ أَخِيهِ فَطُرِحَتْ عَلَيْهِ
[Machine] I was sitting with the Prophet ﷺ when two men from the Ansar came to him, arguing about things that had been studied and clarified. The Prophet ﷺ said, "I will settle the dispute between you based on what has not been revealed to me. Whoever I decide in favor of with a valid argument, should take it from his brother's property unjustly, then he is bringing a piece of burning coal to his neck on the Day of Judgment." The two men cried and each one of them said, "My right is with me, O Messenger of Allah, for which I demand." He ﷺ said, "No, but both of you should go and compromise, then ask me again and I will judge rightly between each one of you and his companion."
كُنْتُ عِنْدَ النَّبِيِّ ﷺ جَالِسَةً فَجَاءَهُ رَجُلَانِ مِنَ الْأَنْصَارِ يَخْتَصِمَانِ فِي أَشْيَاءَ قَدْ دُرِسَتْ وَبَادَتْ فَقَالَ النَّبِيُّ ﷺ إِنَّمَا أَقْضِي بَيْنَكُمَا فِيمَا لَمْ يَنْزِلْ عَلَيَّ فِيهِ شَيْءٌ فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ بِحُجَّةٍ أَرَاهَا فَاقْتَطَعَ بِهَا مِنْ مَالِ أَخِيهِ ظُلْمًا أَتَى بِهَا إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ فَبَكَى الرَّجُلَانِ وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا حَقِّي لَهُ يَا رَسُولَ اللهِ الَّذِي أَطْلُبُ قَالَ لَا وَلَكِنِ اذْهَبَا فَاسْتَهِمَا وَتَوَخَّيَا ثُمَّ لِيُحْلِلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ
[Machine] Umar RA said, "Send the disputing parties back until they reconcile, for passing judgment creates enmity among the people."
قَالَ عُمَرُ ؓ رُدُّوا الْخُصُومَ حَتَّى يَصْطَلِحُوا؛ فَإِنَّ فَصْلَ الْقَضَاءِ يُحْدِثُ بَيْنَ الْقَوْمِ الضَّغَائِنَ
[Machine] Umar ibn Al-Khattab RA said: "Send the disputing parties back, perhaps they might reconcile; for that is more conducive to honesty and reduces grudges."
قَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ رُدُّوا الْخُصُومَ لَعَلَّهُمْ أَنْ يَصْطَلِحُوا؛ فَإِنَّهُ أَبْرَأُ لِلصِّدْقِ وَأَقَلُّ لِلْحِنَاتِ
[Machine] Umar ibn Al-Khattab said, "Send back the disputing parties if there is kinship between them, for adjudication may create enmity between them."
قَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ رُدُّوا الْخُصُومَ إِذَا كَانَ بَيْنَهُمْ قَرَابَةٌ؛ فَإِنَّ فَصْلَ الْقَضَاءِ يُوَرِّثُ بَيْنَهُمُ الشَّنَآنَ
