١٦۔ كِتَابُ الْبُيُوعِ ص ٣
[Machine] I and Makhrama Al-Abdi brought some goat meat from Hajr or Al-Bahrain. When we were in Mina, the Messenger of Allah ﷺ came to us and bought pants, a cloak, and scales that weigh with stones. The Messenger of Allah ﷺ paid us the price and said, "Weigh and balance." This was narrated by Shu'bah from Samaak ibn Harb.
جَلَبْتُ أَنَا وَمَخْرَمَةُ الْعَبْدِيُّ بَزًّا مِنْ هَجَرَ أَوِ الْبَحْرَيْنَ فَلَمَّا كُنَّا بِمِنًى أَتَانَا رَسُولُ اللَّهِ ﷺ فَاشْتَرَى مِنَّا سَرَاوِيلَ وَقَبَاءً وَوَزَّانٌ يَزِنُ بِالْأُجْرَةِ فَدَفَعَ إِلَيْهِ رَسُولُ اللَّهِ ﷺ الثَّمَنَ فَقَالَ «زِنْ وَأَرْجِحْ» رَوَاهُ شُعْبَةُ عَنْ سِمَاكِ بْنِ حَرْبٍ
[Machine] I heard Abu Safwan say that I sent Sarawil, and he weighed them for me and they were the correct weight. Abu Safwan is the kunya of Suwaid bin Qais, who is one of my companions from the Ansar. And the hadith is authentic according to the conditions set by Muslim, and they did not exclude it.
سَمِعْتُ أَبَا صَفْوَانَ يَقُولُ بِعْتُ مِنَ النَّبِيِّ ﷺ سَرَاوِيلَ «فَوَزَنَ لِي فَأَرْجَحَ» أَبُو صَفْوَانَ كُنْيَةُ سُوَيْدِ بْنِ قَيْسٍ هُمَا وَاحِدٌ مِنْ صَحَابِيِّي الْأَنْصَارِ «وَالْحَدِيثُ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ»
That the Messenger of Allah ﷺ said to the people of weights and measures: "Indeed you have been entrusted with two matters that nations preceding you in the past were destroyed for." (Using translation from Tirmidhī 1217)
قَالَ رَسُولُ اللَّهِ ﷺ لِأَصْحَابِ الْكَيْلِ وَالْوَزْنِ «إِنَّكُمْ قَدْ وُلِّيتُمْ أَمْرًا فِيهِ هَلَكَةُ الْأُمَّةِ السَّالِفَةِ»
[Machine] The Messenger of Allah ﷺ prohibited breaking the path of the Muslims that is permissible to be taken between them, except in the case of harm, or if a silver coin is broken, it should be made into silver, or if a gold coin is broken, it should be made into gold. The Ansari did not mention his father Alqamah in his narration, and it was mentioned by Al-Mu'tamir. The Dhahabi remained silent about it in his summarization.
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ كَسْرِ سِكَّةِ الْمُسْلِمِينَ الْجَائِزَةِ بَيْنَهُمْ إِلَّا مِنْ بَأْسٍ أَوْ أَنْ يُكْسَرَ الدِّرْهَمُ فَيُجْعَلَ فِضَّةً وَيُكْسَرَ الدِّينَارُ فَيُجْعَلَ ذَهَبًا» وَلَمْ يَذْكُرِ الْأَنْصَارِيُّ فِي حَدِيثِهِ وَالِدَ عَلْقَمَةَ وَذَكَرَهُ الْمُعْتَمِرُ سكت عنه الذهبي في التلخيص
[Machine] I heard the Messenger of Allah ﷺ saying: "Gabriel came to me and said, 'O Muhammad, Allah has cursed alcohol and its drinker, its server, its squeezer, its carrier, the one to whom it is carried, its seller, its buyer, and its server.'"
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ أَتَانِي جِبْرِيلُ فَقَالَ يَا مُحَمَّدُ إِنَّ اللَّهَ لَعَنَ الْخَمْرَ وَعَاصِرَهَا وَمُعْتَصِرَهَا وَشَارِبَهَا وَحَامِلَهَا وَالْمَحْمُولَةَ إِلَيْهِ وَبَايِعَهَا وَسَاقِيَهَا وَمُسْقِيَهَا
The Prophet ﷺ said: Allah has cursed wine, its drinker, its server, its seller, its buyer, its presser, the one for whom it is pressed, the one who conveys it, and the one to whom it is conveyed. (Using translation from Abū Dāʾūd 3674)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَعَنِ اللَّهُ الْخَمْرَ وَلَعَنَ سَاقِيهَا وَشَارِبَهَا وَعَاصِرَهَا وَمُعْتَصِرَهَا وَحَامِلَهَا وَالْمَحْمُولَةَ إِلَيْهِ وَبَايِعِهَا وَمُبْتَاعَهَا وَآكِلَ ثَمَنِهَا»
[Machine] The Prophet ﷺ purchased a sheep from a Bedouin with dates. When he saw that the dates were not enough, with some being left with him and others not, he said, "Can you take some of your dates and some of them to the fields?" The Bedouin refused, so the Prophet ﷺ borrowed dates from him and returned them to him.
أَنَّ النَّبِيَّ ﷺ ابْتَاعَ مِنْ أَعْرَابِيٍّ جَزُورًا بِتَمْرٍ وَكَانَ يَرَى أَنَّ التَّمْرَ عِنْدَهُ فَإِذَا بَعْضُهُ عِنْدَهُ وَبَعْضُهُ لَيْسَ عِنْدَهُ فَقَالَ «هَلْ لَكَ أَنْ تَأْخُذَ بَعْضَ تَمْرِكَ وَبَعْضُهُ إِلَى الْجُذَاذِ» فَأَبَى فَاسْتَسْلَفَ لَهُ النَّبِيُّ ﷺ تَمْرَهُ فَدَفَعَهُ إِلَيْهِ
[Machine] "That Zaid ibn Sa'na was one of the scribes of the Jews. He came to the Prophet ﷺ to get his due payment. The Prophet ﷺ pulled his garment from his right shoulder and said, 'O sons of Abd al-Muttalib, you are the heirs, and I am well acquainted with your rights.' Umar reproached him, so the Messenger of Allah ﷺ said to him, 'O Umar, both he and I were in need of something other than this. It would have been better if you had advised me to give him his due honorably and advised him to demand it honorably. Depart, O Umar, and fulfill his right. Indeed, he has three sa' left of his due, so give him an extra thirty sa' for your attempt to cheat him.'"
أَنَّ زَيْدَ بْنَ سَعْنَةَ كَانَ مِنْ أَحْبَارِ الْيَهُودِ أَتَى النَّبِيَّ ﷺ يَتَقَاضَاهُ فَجَبَذَ ثَوْبَهُ عَنْ مَنْكِبِهِ الْأَيْمَنِ ثُمَّ قَالَ إِنَّكُمْ يَا بَنِي عَبْدِ الْمُطَّلِبِ أَصْحَابُ مَطْلٍ وَإِنِّي بِكُمْ لَعَارِفٌ قَالَ فَانْتَهَرَهُ عُمَرُ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «يَا عُمَرُ أَنَا وَهُوَ كُنَّا إِلَى غَيْرِ هَذَا مِنْكَ أَحْوَجَ أَنْ تَأْمُرَنِي بِحُسْنِ الْقَضَاءِ وَتَأْمُرَهُ بِحُسْنِ التَّقَاضِي انْطَلِقْ يَا عُمَرُ أَوْفِهِ حَقَّهُ أَمَا إِنَّهُ قَدْ بَقِيَ مِنْ أَجَلِهِ ثَلَاثٌ فَزِدْهُ ثَلَاثِينَ صَاعًا لِتَزْوِيرِكَ عَلَيْهِ»
“Whoever demands his rights let him do so in a decent manner as much as he can.” (Using translation from Ibn Mājah 2421)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ طَلَبَ حَقًّا فَلْيَطْلُبْ فِي عَفَافٍ وَافٍ أَوْ غَيْرَ وَافٍ»
“Take your rights in a decent manner as much as he can.” (Using translation from Ibn Mājah 2422)
قَالَ رَسُولُ اللَّهِ ﷺ لِصَاحِبِ الْحَقِّ خُذْ حَقَّكَ فِي عَفَافٍ وَأَحْسِبُهُ قَالَ وَافٍ أَوْ غَيْرَ وَافٍ
[Machine] When the Messenger of Allah ﷺ arrived in Medina, they were people who cheated others in terms of measures. So Allah, the Blessed and Exalted, revealed, "Woe to those who give less [than due] measure" [Quran 99:1]. After that, they started to be honest in their measurements.
لَمَّا قَدِمَ رَسُولُ اللَّهِ ﷺ الْمَدِينَةَ كَانُوا مِنْ أَبْخَسِ النَّاسِ كَيْلًا فَأَنْزَلَ اللَّهُ تَبَارَكَ وَتَعَالَى {وَيْلٌ لِلْمُطَفِّفِينَ} [المطففين 1] فَأَحْسَنُوا الْكَيْلَ بَعْدَ ذَلِكَ
[Machine] When the Messenger of Allah ﷺ went to Khaybar, he appointed Siba' bin 'Urfuta Al-Ghifari as a deputy. We arrived and witnessed the Fajr prayer with him. In the first rak'ah, he recited {Kaf Ha Ya 'Ain Sad} [Maryam 1], and in the second rak'ah, {Woe to those who give insufficient measure} [Al-Mutaffifin 1]. I said to myself, "Woe to Abu Fulan! He has two measures, and he fulfills with one and takes away with the other." We went to Siba' bin 'Urfuta and prepared a complaint. Then we went to the Messenger of Allah ﷺ either the day before or after the conquest."
لَمَّا خَرَجَ رَسُولُ اللَّهِ ﷺ إِلَى خَيْبَرَ اسْتَخْلَفَ سِبَاعَ بْنَ عُرْفُطَةَ الْغِفَارِيَّ فَقَدِمْنَا فَشَهِدْنَا مَعَهُ صَلَاةَ الصُّبْحِ فَقَرَأَ فِي أَوَّلِ رَكْعَةٍ {كهيعص} [مريم 1] وَفِي الثَّانِيَةِ {وَيْلٌ لِلْمُطَفِّفِينَ} [المطففين 1] فَقُلْتُ فِي نَفْسِي وَيْلٌ لِأَبِي فُلَانٍ لَهُ مَكِيلَانِ يَسْتَوْفِيَ بِوَاحِدٍ وَيَبْخَسُ بِآخَرَ فَأَتَيْنَا سِبَاعَ بْنَ عُرْفُطَةَ فَجَهَّزَنَا «فَأَتَيْنَا رَسُولَ اللَّهِ ﷺ قَبْلَ الْفَتْحِ بِيَوْمٍ أَوْ بَعْدَهُ بِيَوْمٍ؟»
[Machine] From the Prophet ﷺ, he said, "There is no dowry for the adulteress, nor the price of a dog is permissible."
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَحِلُّ مَهْرٌ لِزَانِيَةٍ وَلَا ثَمَنُ الْكَلْبِ»
"The Messenger of Allah forbade the price of a dog, the gift of a female fornicator and the fees of a fortuneteller."( Sahih) (Using translation from Nasāʾī 4292)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَأَجْرِ الْكَاهِنِ وَكَسْبِ الْحَجَّامِ»
[Machine] "The Messenger of Allah ﷺ prohibited the selling of dogs and monkeys." It was followed by Isa ibn Yunus, narrated from Al-A'mash, on the condition of Muslim.
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَالسِّنَّوْرِ» تَابَعَهُ عِيسَى بْنُ يُونُسَ عَنِ الْأَعْمَشِعلى شرط مسلم
[Machine] Abdullah ibn Muslimah al-Qa'nabi narrated that Isa ibn Yunus narrated from al-Amash, from Abu Sufyan, from Jabir who said: "The Messenger of Allah ﷺ forbade the selling of dogs and wild animals." Abu Zubair also narrated this from Jabir.
ثنا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ ثنا عِيسَى بْنُ يُونُسَ عَنِ الْأَعْمَشِ عَنْ أَبِي سُفْيَانَ عَنْ جَابِرٍ قَالَ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَالسِّنَّوْرِ» تَابَعَهُ أَبُو الزُّبَيْرِ عَنْ جَابِرٍ
[Machine] "The Messenger of Allah ﷺ forbade eating cats and eating their price." This is a hadith narrated by Al-A'mash from Abu Sufyan. It is authentic according to the conditions of Imam Muslim, but he did not include it in his compilation.
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ أَكْلِ الْهِرَّةِ وَأَكْلِ ثَمَنِهَا» حَدِيثُ الْأَعْمَشِ عَنْ أَبِي سُفْيَانَ «صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ» عمر بن زيد واه
"The Messenger of Allah forbade (eating) animals that had been taken as targets, the milk of Al-Jallalah (animals that eat dung), and drinking directly from water skins." (Using translation from Nasāʾī 4448)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ لَبَنِ الْجَلَّالَةِ وَعَنْ أَكْلِ الْمُجَثَّمَةِ وَعَنِ الشُّرْبِ مِنْ فِي السِّقَاءِ»
16.6 [Machine] As for the narration of Ibn Umar
١٦۔٦ أَمَّا حَدِيثُ ابْنِ عُمَرَ
The Messenger of Allah ﷺ prohibited eating the animal which feeds on filth and drinking its milk. (Using translation from Abū Dāʾūd 3785)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ أَكْلِ الْجَلَّالَةِ وَأَلْبَانِهَا»
The Messenger of Allah ﷺ prohibited to ride a camel which eats dung. (Using translation from Abū Dāʾūd 2558)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْجَلَّالَةِ يَعْنِي الْإِبِلَ أَنْ يُرْكَبَ عَلَيْهَا أَوْ أَنْ يُشْرَبَ مِنْ أَلْبَانِهَا»
16.7 [Machine] As for the saying of Abu Hurayrah
١٦۔٧ وَأَمَّا حَدِيثُ أَبِي هُرَيْرَةَ
"The Messenger of Allah forbade (eating) animals that had been taken as targets, the milk of Al-Jallalah (animals that eat dung), and drinking directly from water skins." (Using translation from Nasāʾī 4448)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْمُجَثَّمَةِ وَالْجَلَّالَةِ»
[Machine] "The Prophet, peace be upon him, prohibited selling sheep by its meat."
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ الشَّاةِ بِاللَّحْمِ»
The Prophet ﷺ forbade selling animals for animals when payment was to be made at a later date. (Using translation from Abū Dāʾūd 3356)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ اللَّحْمِ بِالْحَيَوَانِ»
[Machine] Narrated by the Prophet, peace be upon him, "Whoever buys stolen goods, knowing that they are stolen, he has shared in its shame and sin." This is Shurahbil, the son of Sa'd al-Ansari, who was reported by Malik ibn Anas after he had a negative opinion about him. The hadith is authentic and they did not exclude it.
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «مَنِ اشْتَرَى سَرِقَةً وَهُوَ يَعْلَمُ أَنَّهَا سَرِقَةٌ فَقَدْ شُرِكَ فِي عَارِهَا وَإِثْمِهَا» شُرَحْبِيلُ هَذَا هُوَ ابْنُ سَعْدٍ الْأَنْصَارِيُّ قَدْ رَوَى عَنْهُ مَالِكُ بْنُ أَنَسٍ بَعْدَ أَنْ كَانَ سَيِّئَ الرَّأْيِ فِيهِ وَالْحَدِيثُ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ
The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. (Using translation from Abū Dāʾūd 2088)
أَّنَّ النَّبِيَّ ﷺ قَالَ «أَيُّمَا رَجُلٍ بَاعَ بَيْعًا مِنْ رَجُلٍ أَوْ رَجُلَيْنِ فَهُوَ الْأَوَّلُ مِنْهُمَا وَأَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا»
[Machine] Kaataba Muawiya ila Marwan: "If a man steals and his theft is found, he is entitled to it wherever it is found." Fa qataba ilayya bi dhalika Marwan wa ana 'ala al-yamamah. Fa katabtu ila Marwan anna Nabiyya Allah (sallallahu 'alayhi wa sallam) qada 'itha kana 'inda al-rajul ghayr al-mutaham, fa in shaa'a sayyiduha akhadhaha bil-thaman wa in shaa'a ittaba'a saariqahu. Thumma qada bi dhalika ba'dahu Abu Bakrin wa 'Umaru wa 'Uthman. Qala fa kataba Marwanu ila Muawiyyah bi kitabihi. Fa kataba Muawiyyatu ila Marwana, innaka lasta anta wala usayidun taqdiyana 'alayya fi ma wullita wa lakinni aqdi 'alaykuma, fanfudh lima amartuka bihi. Wa ba'atha Marwanu bi kitabi Muawiyyata ilayhi fa qala wallahi la aqdi bihi abadan.
قَالَ كَتَبَ مُعَاوِيَةُ إِلَى مَرْوَانَ إِذَا سَرَقَ الرَّجُلُ فَوَجَدَ سَرِقَتَهُ فَهُوَ أَحَقُّ بِهَا حَيْثُ وَجَدَهَا قَالَ فَكَتَبَ إِلَيَّ بِذَلِكَ مَرْوَانُ وَأَنَا عَلَى الْيَمَامَةَ فَكَتَبْتُ إِلَى مَرْوَانَ أَنَّ نَبِيَّ اللَّهِ ﷺ «قَضَى إِذَا كَانَ عِنْدَ الرَّجُلِ غَيْرِ الْمُتَّهَمِ فَإِنْ شَاءَ سَيِّدُهَا أَخَذَهَا بِالثَّمَنِ وَإِنْ شَاءَ اتَّبَعَ سَارِقَهُ» ثُمَّ قَضَى بِذَلِكَ بَعْدَهُ أَبُو بَكْرٍ وَعُمَرُ وَعُثْمَانُ قَالَ فَكَتَبَ مَرْوَانُ إِلَى مُعَاوِيَةَ بِكِتَابِي فَكَتَبَ مُعَاوِيَةُ إِلَى مَرْوَانَ إِنَّكَ لَسْتَ أَنْتَ وَلَا أُسَيْدٌ تَقْضِيَانِ عَلَيَّ فِيمَا وُلِّيتَ وَلَكِنِّي أَقْضِي عَلَيْكُمَا فَانْفُذْ لِمَا أَمَرْتُكَ بِهِ وَبَعَثَ مَرْوَانُ بِكِتَابِ مُعَاوِيَةَ إِلَيْهِ فَقَالَ وَاللَّهِ لَا أَقْضِي بِهِ أَبَدًا
The Messenger of Allah ﷺ as saying: If you were to sell dried dates to your brother and they were smitten by blight, it will not be allowable for you to take your brother's property unjustly. (Using translation from Abū Dāʾūd 3470)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنْ بِعْتَ أَخَاكَ تَمَرَاتٍ فَأَصَابَتْهُ جَائِحَةٌ فَلَا يَحِلُّ لَكَ أَنْ تَأْخُذَ مِنْهُ شَيْئًا أَوْ تَأْخُذَ مَالَ أَخِيكَ بِغَيْرِ إِذْنِهِ»
[Machine] The Prophet Muhammad ﷺ said, "By what means does anyone of you allow himself to take his brother's wealth if a calamity from the sky befalls him?"
قَالَ رَسُولُ اللَّهِ ﷺ «بِمَ يَسْتَحِلُّ أَحَدُكُمْ مَالَ أَخِيهِ إِنْ أَصَابَتْهُ جَائِحَةٌ مِنَ السَّمَاءِ؟»
[Machine] The translation of the given Arabic sentence into English is: "The Messenger of Allah ﷺ said, 'What would you think if Allah were to forbid the dates, so how then would anyone of you be allowed to consume the wealth of his brother?'"
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَرَأَيْتَ إِنْ مَنَعَ اللَّهُ التَّمْرَةَ فَبِمَ يَسْتَحِلُّ أَحَدُكُمْ مَالَ أَخِيهِ؟»
[Machine] From the Prophet ﷺ, he said: "Usury (interest) has seventy-three doors, the easiest of which is equivalent to a man marrying his own mother, and indeed the greatest form of usury is the violation of a Muslim man's honor."
عَنِ النَّبِيِّ ﷺ قَالَ «الرِّبَا ثَلَاثَةٌ وَسَبْعُونَ بَابًا أَيْسَرُهَا مِثْلُ أَنْ يَنْكِحَ الرَّجُلُ أُمَّهُ وَإِنَّ أَرْبَى الرِّبَا عِرْضُ الرَّجُلِ الْمُسْلِمِ»
[Machine] The Messenger of Allah ﷺ said, "There are four individuals who have no right to enter Paradise and will not taste its blessings: the habitual drinker, the one who consumes interest, the one who unjustly consumes the wealth of orphans, and the one who disobeys and mistreats their parents."
قَالَ رَسُولُ اللَّهِ ﷺ أَرْبَعَةٌ حَقٌّ عَلَى اللَّهِ أَنْ لَا يُدْخِلَهُمُ الْجَنَّةَ وَلَا يُذِيقَهُمْ نَعِيمَهَا مُدْمِنُ الْخَمْرِ وَآكِلُ الرِّبَا وَآكِلُ مَالِ الْيَتِيمِ بِغَيْرِ حَقٍّ وَالْعَاقُّ لِوَالِدَيْهِ
[Machine] The Messenger of Allah (pbuh) forbade buying fruits until they are ripe. He also said, "When fornication and usury appear in a town, then they have brought upon themselves the punishment of Allah."
نَهَى رَسُولُ اللَّهِ ﷺ أَنْ تُشْتَرَى الثَّمَرَةُ حَتَّى تُطْعِمَ وَقَالَ إِذَا ظَهَرَ الزِّنَا وَالرِّبَا فِي قَرْيَةٍ فَقَدْ أَحَلُّوا بِأَنْفُسِهِمْ عَذَابَ اللَّهِ
[Machine] From the Prophet ﷺ, he said, "Even if interest (usury) increases, its outcome becomes less."
عَنِ النَّبِيِّ ﷺ قَالَ «الرِّبَا وَإِنْ كَثُرَ فَإِنَّ عَاقِبَتَهُ تَصِيرُ إِلَى قَلٍّ»
"The Messenger of Allah forbade selling a heap of dried dates whose volume is unknown for known volume of dried dates," (Using translation from Nasāʾī 4547)
قَالَ سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الصُّبْرَةِ مِنَ التَّمْرِ لَا يَعْلَمُ مَكِيلَهَا بِالْكَيْلِ الْمُسَمَّى مِنَ التَّمْرِ»
[Machine] I heard the Messenger of Allah ﷺ being asked about fresh dates and he asked those around him, "Does it decrease when it becomes dry?" They replied, "Yes." He then said, "Then no." Abu al-Walid said, "I heard Malik ibn Anas saying on another occasion that he disliked this wording of the hadith of Abu al-Walid." Isma'il ibn Umayyah narrated it from Abdullah ibn Yazid, a servant of Aswad ibn Sufyan. Malik narrated it once and disliked it.
سَمِعْتُ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ الرُّطَبِ بِالتَّمْرِ فَسَأَلَ مَنْ حَوْلَهُ «أَيَنْقُصُ إِذَا جَفَّ؟» قَالُوا نَعَمْ قَالَ «فَلَا إِذًا» قَالَ أبو الْوَلِيدُ وَسَمِعْتُ مَالِكَ بْنَ أَنَسٍ مَرَّةً أُخْرَى قَالَ فَكَرِهَهُ هَذَا لَفْظُ حَدِيثِ أَبِي الْوَلِيدِ تَابَعَهُ إِسْمَاعِيلُ بْنُ أُمَيَّةَ عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَرواه مالك مرة فكرهه
[Machine] Two men made a contract during the time of the Messenger of Allah ﷺ, regarding fresh dates and dried dates. The Messenger of Allah ﷺ asked, "Does the dried date decrease in weight when it becomes dry?" They replied, "Yes." He then said, "Then it is not permissible." This was narrated by Sufyan Ath-Thawri from Ismail bin Umayyah.
تَبَايَعَ رَجُلَانِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ بِبُسْرٍ وَرُطَبٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «هَلْ يَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟» قَالُوا نَعَمْ قَالَ «فَلَا إِذًا» وَهَكَذَا رَوَاهُ سُفْيَانُ الثَّوْرِيُّ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ
[Machine] The Messenger of Allah, peace be upon him, was asked about eating dried dates, and he said, "Will it cause any decrease if it dries?" They said, "Yes." He said, "Then refrain from it." This ruling was also confirmed by Yahya ibn Abi Kathir in his narration from Abdullah ibn Yazid.
سُئِلَ رَسُولُ اللَّهِ ﷺ عَنِ الرُّطَبِ بِالتَّمْرِ فَقَالَ «أَيَنْقُصُ إِذَا يَبِسَ؟» قَالُوا نَعَمْ قَالَ «فَنَهَى عَنْهُ» وَقَدْ تَابَعَهُمَا يَحْيَى بْنُ أَبِي كَثِيرٍ عَلَى رِوَايَتِهِ عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ
[Machine] He informed him that he heard Saad ibn Abi Waqqas saying, "The Messenger of Allah ﷺ forbade selling fresh dates for dried dates, as it is detrimental."
أَخْبَرَهُ أَنَّهُ سَمِعَ سَعْدَ بْنَ أَبِي وَقَّاصٍ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الرُّطَبِ بِالتَّمْرِ نَسِيئَةً»
[Machine] The Prophet ﷺ said, "A man will be presented with a scroll on the Day of Judgment until he sees that he has been saved. The injustices of the children of Adam will continue to follow him until he has no good deeds left, and his sins will be added to him."
I (or Asim, according to another narration) asked him, "From whom, O Abu Uthman?" He said, "From Salman, Sa'd, Ibn Mas'ud, and two other men who were not named." Shu'bah said, "So I asked Asim about this hadith, and he narrated it to me from Abu Uthman, who narrated it from Salman and the companions of the Messenger of Allah ﷺ and his family."
أَنَّ النَّبِيَّ ﷺ قَالَ «تُرْفَعُ لِلرَّجُلِ صَحِيفَةٌ يَوْمَ الْقِيَامَةِ حَتَّى يَرَى أَنَّهُ نَاجٍ فَمَا تَزَالُ مَظَالِمُ بَنِي آدَمَ تَتْبَعُهُ حَتَّى مَا تَبْقَى لَهُ حَسَنَةٌ وَيُزَادُ عَلَيْهِ مِنْ سَيِّئَاتِهِمْ» قَالَ فَقُلْتُ لَهُ أَوْ قَالَ لَهُ عَاصِمٌ عَمَّنْ يَا أَبَا عُثْمَانَ؟ قَالَ عَنْ سَلْمَانَ وَسَعْدٍ وَابْنِ مَسْعُودٍ وَرَجُلَيْنِ آخَرَيْنَ لَمْ يَحْفَظْهُمَا قَالَ شُعْبَةُ فَسَأَلْتُ عَاصِمًا عَنْ هَذَا الْحَدِيثِ فَحَدَّثَنِيهِ عَنْ أَبِي عُثْمَانَ عَنْ سَلْمَانَ وَأَخْبَرَنِي عُثْمَانُ بْنُ غِيَاثٍ أَنَّهُ سَمِعَ أَبَا عُثْمَانَ يُحَدِّثُ بِهَذَا عَنْ سَلْمَانَ وَأَصْحَابِ رَسُولِ اللَّهِ ﷺ وَآلِهِ وَسَلَّمَ
[Machine] The Prophet ﷺ prohibited eating the flesh and drinking the milk of the sacrificial animals (for Hajj or Udhiyah) and people riding on them, until they are grazed for forty nights.
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْجَلَّالَةِ أَنْ يُؤْكَلَ لَحْمُهَا وَيُشْرَبَ لَبَنُهَا وَلَا يُحْمَلَ عَلَيْهَا الْأَدَمُ وَلَا يَرْكَبَهَا النَّاسُ حَتَّى تُعْلَفَ أَرْبَعِينَ لَيْلَةً»
[Machine] On the authority of the Messenger of Allah ﷺ, it is narrated that he said, "It is prohibited to sell goods where they are bought until the buyer has taken possession of them, even if it requires carrying them to his ride. And if he needs to send men to carry them, then they should be entrusted to that duty."
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ «نَهَى أَنْ تُبَاعَ السِّلَعُ حَيْثُ تُشْتَرَى حَتَّى يَحُوزَهَا الَّذِي اشْتَرَاهَا إِلَى رَحْلِهِ وَإِنْ كَانَ لِيَبْعَثُ رِجَالًا فَيَضْرِبُونَا عَلَى ذَلِكَ»
I bought olive oil in the market. When I became its owner, a man met me and offered good profit for it. I intended to settle the bargain with him, but a man caught hold of my hand from behind. When I turned I found that he was Zayd ibn Thabit. He said: Do not sell it on the spot where you have bought it until you take it to your house, for the Messenger of Allah ﷺ forbade to sell the goods where they are bought until the tradesmen take them to their houses. ابْتَعْتُ زَيْتًا فِي السُّوقِ فَلَمَّا اسْتَوْجَبْتُهُ لَقِيَنِي رَجُلٌ فَأَعْطَانِي بِهِ رِبْحًا حَسَنًا فَأَرَدْتُ أَنْ أَضْرِبَ عَلَى يَدَيْهِ فَأَخَذَ رَجُلٌ مِنْ خَلْفِي بِذِرَاعِي فَالْتَفَتُّ إِلَيْهِ فَإِذَا زَيْدُ بْنُ ثَابِتٍ فَقَالَ لَا تَبِعْهُ حَيْثُ ابْتَعْتَهُ حَتَّى تَحُوزَهُ إِلَى رَحْلِكَ فَإِنَّ رَسُولَ اللَّهِ ﷺ «نَهَى أَنْ تُبَاعَ السِّلَعُ حَيْثُ تُبْتَاعُ حَتَّى يَحُوزَهَا التُّجَّارُ إِلَى رِحَالِهِمْ»
[Machine] The Messenger of Allah ﷺ prohibited killing any animal with fangs from among the predatory animals, killing children, and purchasing stolen goods until they are divided.
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ وَعَنْ قَتْلِ الْوِلْدَانِ وَعَنْ شَرْيِ الْمَغْنَمِ حَتَّى يُقْسَمَ»
[Machine] The Prophet ﷺ prohibited the selling of spoils of war until they are divided. Sahih.
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْمَغَانِمِ حَتَّى تُقْسَمَ» صحيح
[Machine] The Messenger of Allah, peace be upon him, "placed the pandemics." Ali bin Al-Madini said, and Sufyan informed us about Abu Zubair, who narrated from Jabir, who narrated from the Prophet, peace be upon him, that he "placed the pandemics."
أَنَّ رَسُولَ اللَّهِ ﷺ «وَضَعَ الْجَوَائِحَ» قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ وَقَدْ كَانَ سُفْيَانُ حَدَّثَنَا عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ أَنَّهُ «وَضَعَ الْجَوَائِحَ»
In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. (Using translation from Abū Dāʾūd 3469)
أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقُوا عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ» فَقَالَ رَسُولُ اللَّهِ ﷺ «خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ»
Rafi' had cultivated a land. The Prophet ﷺ passed him when he was watering it. So he asked him: To whom does the crop belong, and to whom does the land belong? He replied: The crop is mine for my seed and labour. The half (of the crop) is mine and the half for so-and-so. He said: You conducted usurious transaction. Return the land to its owner and take your wages and cost. (Using translation from Abū Dāʾūd 3402)
أَنَّهُ زَرَعَ أَرْضًا فَمَرَّ بِهِ النَّبِيُّ ﷺ وَهُوَ يَسْقِيهَا فَسَأَلَهُ «لِمَنِ الزَّرْعُ وَلِمَنِ الْأَرْضُ؟» فَقَالَ زَرْعِي بِبَذْرِي وَعَمَلِي لِيَ الشَّطْرُ وَلِبَنِي فُلَانٍ الشَّطْرُ فَقَالَ «أَرْبَيْتُمَا فَرُدَّ الْأَرْضَ عَلَى أَهْلِهَا وَخُذْ نَفَقَتَكَ»
I taught some persons of the people of Suffah writing and the Qur'an. A man of them presented to me a bow. I said: It cannot be reckoned property; may I shoot with it in Allah's path? I must come to the Apostle of of Allah ﷺ and ask him (about it). So I came to him and said : Messenger of Allah ﷺ, one of those whom I have been teaching writing and the Qur'an has presented me a bow, and as it cannot be reckoned property, may I shoot with it in Allah's path? He said: If you want to have a necklace of fire on you, accept it. (Using translation from Abū Dāʾūd 3416)
عَلَّمْتُ نَاسًا مِنْ أَهْلِ الصُّفَّةِ الْكِتَابَةَ وَالْقُرْآنَ وَأَهْدَى إِلَيَّ رَجُلٌ مِنْهُمْ قَوْسًا فَقُلْتُ لَيْسَتْ بِمَالٍ وَأَرْمِي عَلَيْهَا فِي سَبِيلِ اللَّهِ لَآتِيَنَّ رَسُولَ اللَّهِ ﷺ فَلَأَسْأَلَنَّهُ فَأَتَيْتُهُ فَقُلْتُ يَا رَسُولَ اللَّهِ رَجُلٌ أَهْدَى إِلَيَّ قَوْسًا مِمَّنْ كُنْتُ أُعَلِّمُهُ الْكِتَابَةَ وَالْقُرْآنَ وَلَيْسَتْ بِمَالٍ وَأَرْمِي عَلَيْهَا فِي سَبِيلِ اللَّهِ قَالَ «إِنْ كُنْتَ تُحِبُّ أَنْ تُطَوَّقَ طَوْقًا مِنْ نَارٍ فَاقْبَلْهَا»
The Prophet ﷺ said: The earnings of a cupper are impure, the price paid for a dog is impure, and the hire paid to a prostitute is impure. (Using translation from Abū Dāʾūd 3421)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «كَسْبُ الْحَجَّامِ خَبِيثٌ وَثَمَنُ الْكَلْبِ خَبِيثٌ وَمَهْرُ الْبَغِيِّ خَبِيثٌ»
Rafi' ibn Rifa'ah came to a meeting of the Ansar and said: The Prophet of Allah ﷺ forbade us (from some things) today, and he mentioned some things. He forbade the earning of a slave-girl except what she earned with her hand. He indicated (some things) with his fingers such as baking, spinning, and ginning. (Using translation from Abū Dāʾūd 3426)
لَقَدْ نَهَانَا رَسُولُ اللَّهِ ﷺ الْيَوْمَ فَذَكَرَ أَشْيَاءَ وَقَالَ «نَهَانَا عَنْ كَسْبِ الْأَمَةِ إِلَّا مَا عَمِلَتْ بِيَدِهَا وَقَالَ هَكَذَا بِأُصْبُعِهِ نَحْوَ الْغَزْلِ وَالْخُبْزِ وَالنَّفْشِ»
