قَالَ قَالَ رَسُولُ اللَّهِ ﷺ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَهَذَا الْحَدِيثُ لَا نَعْلَمُ أَحَدًا قَالَ فِيهِ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ عَنْ عُمَرَ عَنِ النَّبِيِّ ﷺ إِلَّا سُفْيَانُ بْنُ حُسَيْنٍ وَأَخْطَأَ فِيهِ وَالْحُفَّاظُ يَرْوُونَهُ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَهُوَ الصَّوَابُ
Narrated 'Abdullah (ra) said, I heard the Messenger of Allah ﷺ say "If somebody buys date-palms after they have been pollinated, the fruits will belong to the seller unless the buyer stipulates the contrary. If somebody buys a slave having some property, the property will belong to the seller unless the buyer stipulate that it should belong to him."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ مَنِ ابْتَاعَ نَخْلاً بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَعَنْ مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ فِي الْعَبْدِ
"Whoever buys a date-palm tree after it has been pollinated, its fruits belong to the seller, unless the purchaser has stipulated otherwise. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser has stipulated otherwise. "(sahih)

The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision. [AI] The Messenger of Allah ﷺ said, "Whoever sells a slave and he possesses wealth, then the wealth belongs to the seller, unless the buyer stipulates otherwise. And whoever sells a palm tree that has been pollinated, then its fruit belongs to the seller, unless the buyer stipulates otherwise." [362] 11700 And from Hilal ibn Al-Ala' from his father from Muhammad ibn Salamah from Muhammad ibn Ishaq from Nafi' from Ibn Umar. This is a mistake, and the correct hadith is narrated by Layth ibn Sa'd and Ubaidullah and Ayyub.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَ فَثَمَرَتُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» [362] 11700 وَعَنْ هِلَالِ بْنِ الْعَلَاءِ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ سَلَمَةَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ بِهِ هَذَا خَطَأٌ وَالصَّوَابُ حَدِيثُ لَيْثِ بْنِ سَعْدٍ وَعُبَيْدِ اللهِ وَأَيُّوبَ
[AI] Narrated by Prophet Muhammad ﷺ , "Whichever man sells a palm tree that has been pollinated and its fruits have appeared, the first harvest will belong to its Lord (i.e., the palm tree will belong to the buyer for the subsequent harvests) unless the buyer specifies otherwise." Umar ibn Al-Khattab also ruled, "Whichever man sells a slave who owns wealth, his wealth will belong to his Lord (i.e., the slave's wealth will transfer to the buyer) unless the buyer specifies otherwise." This was also narrated by Salim ibn Abdullah from his father from Prophet Muhammad ﷺ regarding palm trees and slaves, and this is mentioned at its proper place, InshaAllah (if Allah wills).
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ قَالَ وَقَضَى عُمَرُ بْنُ الْخَطَّابِ ؓ أَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا لَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَرَوَاهُ سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ فِي النَّخْلِ وَالْعَبْدِ جَمِيعًا وَذَلِكَ يَرِدُ فِي مَوْضِعِهِ إِنْ شَاءَ اللهُ تَعَالَى
[AI] "The Prophet ﷺ said: 'Any man who sells a slave that he possesses, his wealth belongs to his Lord first, unless the buyer specifies otherwise. And any man who sells a palm tree that has been pollinated, its fruit belongs to its Lord first, unless the buyer specifies otherwise.' This hadith is narrated from Hisham al-Dastuwaai, from Qatadah, from Ikrimah ibn Khalid, from al-Zuhri, from Ibn Umar, from the Prophet ﷺ . It is also narrated from Jabir ibn Abdullah, from the Prophet ﷺ ."
أَنَّ النَّبِيَّ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا لَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَأَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَهَذَا مُنْقَطِعٌ وَقَدْ رُوِيَ عَنْ هِشَامٍ الدَّسْتُوَائِيِّ عَنْ قَتَادَةَ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ عَنِ الزُّهْرِيِّ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَكَأَنَّهُ أَرَادَ حَدِيثَ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ وَرُوِيَ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ عَنِ النَّبِيِّ ﷺ
[AI] "That the Messenger of Allah ﷺ said, and I (Abu Ahmad) said, and I (Hasan bin Sufyan) narrated from Abdul Rahman bin Ibrahim, who narrated from Al-Walid, who narrated from Abu Mu'ayid Hafs bin Ghaylan, who narrated from Sulaiman bin Musa, who narrated from Nafi', who narrated from Ibn Umar and Ata', who narrated from Jabir, that the Messenger of Allah ﷺ said: 'Whoever sells a slave and he has property, his property is for him and his debt is upon him, unless the seller stipulates otherwise. And whoever straightens a palm tree and then sells it after making it straight, he is entitled to its fruits unless the buyer stipulates otherwise."
أَنَّ رَسُولَ اللهِ ﷺ ح قَالَ وَأنا أَبُو أَحْمَدَ قَالَ وَأنا الْحَسَنُ بْنُ سُفْيَانَ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ثنا الْوَلِيدُ عَنْ أَبِي مُعَيْدٍ حَفْصِ بْنِ غَيْلَانَ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَطَاءٍ عَنْ جَابِرٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لَهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَ بَعْدَمَا يُؤَبِّرُهُ فَلَهُ ثَمَرَتُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
"مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلبَائِع، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ، إِلا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
"عَنْ عَلِيٍّ قَالَ: مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ، فَمَالُهُ لِلبَائِع إِلَّا أَنْ يَشْتَرط الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرتُهَا لِلْبَائِع إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، قَضَي بِذَلِكَ رَسُولُ الله ﷺ ".
"أَنْبَأَنَا إِسْرَائِيلُ عن عَبْدِ العَزِيزِ بْنِ رَفِيعٍ، عَنِ ابْنِ أَبِى مُلَيْكَةَ، وَعَطَاءِ ابْنِ أَبِى رَبَاحٍ قَالَا: قَالَ رَسُولُ اللَّهِ ﷺ مَن بَاعَ نَخْلًا مُؤبَّرًا فَثَمَرَتُهَا لِلبَائِعِ إِلَّا أَنْ يَشْتَرِطَ المُبْتَاعُ، وَمَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلبَائِع إِلَّا أَنْ يَشْتَرِطَ المُبْتَاعُ".
