" عَنْ مُعْمَرٍ، عَنْ مَطَرٍ الْوَرَّاقِ، عَنْ شَهْرِ بْنِ حَوْشِبٍ، عَنْ عَمْرو بْنِ خَارِجَةَ قَالَ: شِهَدْتُ مَعَ رَسُولِ الله ﷺ حَجَّتَهُ فَكنْتُ تَحْتَ جَرَانِ نَاقَةِ رسُولِ الله ﷺ وَإِنَّهَا لَتَقَصَعُ بِجَرَّتِهَا، وَإِنَّ لعابها لَيَسِيلُ عَلَى كَتِفِى، فَسَمِعْتُهُ يَقُولُ وَهُوَ يَخْطُبُ بِمِنىً: إِنَّ الله قَدْ أَعْطَى كُلَّ ذِى حَقٍّ حَقَّهُ، وَإِنَّهُ لَيْسَ لِوَارِثٍ وَصِيَّةٌ، ألا وَإِنَّ الْوَلَدَ لِلْفِرَاشِ، وَأَنَّ لِلْعَاهِرِ الْحَجَرَ، مَنِ ادَّعَى إِلَى غَيْرِ أَبِيه أَوِ انْتَمى إِلى غَير مَنْ أَنعَمَ بِهِ عَلَيْه، وَفِى لَفْظٍ: إِلَى غَيْرِ مَوَالِيهِ، فَعَلَيْهِ لَعْنَةُ الله وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ، لَا يُقْبَل مِنْهُ صَرْفٌ وَلَا عَدْلٌ".

I heard him saying: 'Indeed Allah, Most Blessed and Most High, has given the right due to everyone deserving a right. So there is no will for an heir, the child is for the bed, and for the fornicator is the stone.'"  

Abū ʿĪsá said that this Ḥadīth is Ḥasan-Ṣaḥīḥ.

“The Prophet ﷺ addressed them when he was on his camel. His camel was chewing its cud and its saliva was dripping between my shoulders. He said: 'Allah (SWT) has allocated for each heir his share of the inheritance, so it is not permissible (to make) a bequest for an heir. The child belong to the bed and the adulterer gets the stone. Whoever claims to belong to someone other than his father, or (a freed slave) who claims that his Wala is for other than his Mavali, upon him will be the curse of Allah, the angels and all the people, and no charge nor equitable exchange will be accepted from him.” Or he said: “No equitable exchange nor change.”

[Machine] The Messenger of Allah ﷺ delivered a sermon to us in Mina while he was on his mount, and it was stumbling with its reins. His saliva was flowing between his shoulders. He said, "Indeed, Allah has allotted each person his share of inheritance, so it is not permissible for an heir to make a bequest on behalf of his father, nor for the adulterer to inherit. Verily, the curse of Allah, the angels, and all the people is upon anyone who claims someone other than his father as his father or who supports other than his supporters out of preference for them." Ibn Ja'far said: Sa'id said: Ma'atir said, "No substitution or compensation is accepted from him." Yazid said in his narration: "No substitution and no compensation," or "compensation and no substitution." Yazid added in his narration: "Indeed, 'Amr ibn Kharijah reported to them that the Prophet ﷺ delivered a sermon to them while he was on his mount."

[Machine] I was leading the camel of the Messenger of Allah ﷺ while it was hobbling with its harness, and its saliva was dripping between its shoulders. He (the Messenger) said, "Indeed, Allah has given every rightful person his right, and there is no bequest for an heir. The child belongs to the bed, and the stone belongs to the adulterer, and whoever claims someone other than his father or belongs to someone other than his guardian then upon him is the curse of Allah, the angels, and all the people." 'Affan said, "And Hammad added to it with this chain of narration, and 'Abdul Rahman bin Ganm was not mentioned. Indeed, I was under the garment of his riding animal." And he added, "Justice and generosity are not accepted from him." And in the Hadith of Hammad, it is narrated that the Messenger of Allah ﷺ delivered a sermon and said, "Desire on their behalf."

Whoever claims someone other than his father as his own, or belongs to someone other than his guardian, then upon him is the curse of Allah, the angels, and all the people. His expenditure and testimony will not be accepted."

I was sitting under the shade of his camel while it was drooling and its saliva was dripping between my shoulders. He said, "Allah has divided for every person his share of inheritance, and it is not permissible for an inheritor to prevent a will. Verily, the child belongs to the bed, and the stone belongs to the adulterer. And whoever claims to belong to someone other than his father, or supports someone other than his legal guardians, out of allegiance to them, then upon him is the curse of Allah, His angels, and all people." Sa'id said, "Matir narrated to us, from Shahar, from 'Abdur-Rahman bin Ghanim, from 'Amr bin Kharijah, from the Prophet ﷺ with the same narration. Matir added something to the narration, and it is not accepted from him."

He said, 'Verily, Allah has given every rightful person his right, and there is no will for an inheritor. The child belongs to the bed, and the offspring of an adulteress belongs to the stone. And whoever alleges to someone other than his father or joins a group other than his own people, then upon him is the curse of Allah, the angels, and all the people.' Affan said, and Hammam added to this chain, but did not mention Abdul Rahman bin Ghannam. I was under the saddle of his riding animal.' And he added, 'No justice or fairness is accepted from him.' In a hadith of Hammam, it is mentioned that the Messenger of Allah gave a speech and said, 'Out of their own will.'

[Machine] The Messenger of Allah ﷺ delivered a sermon while he was on his camel, and I was beneath the camel's saddle. It was shaking off its saddlebag and its saliva was flowing between my shoulders. He said, "Indeed, Allah has given every rightful person his right, and there is no will for an heir. A child belongs to the marriage bed, and the stone is for the adulterer. And whoever claims to be someone other than his father, or affiliates himself with someone other than his guardians, the curse of Allah, the angels, and all people is upon him. No exchange or justice will be accepted from him."  

أحمد:١٨٠٨٣حَدَّثَنَا عَفَّانُ حَدَّثَنَا حَمَّادُ عَنْ قَتَادَةَ عَنْ شَهْرِ بْنِ حَوْشَبٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ عَنْ عَمْرِو بْنِ خَارِجَةَ قَالَ

خَطَبَ رَسُولُ اللهِ ﷺ وَهُوَ عَلَى نَاقَتِهِ وَأَنَا تَحْتَ جِرَانِهَا وَهِيَ تَقْصَعُ بِجِرَّتِهَا وَلُعَابُهَا يَسِيلُ بَيْنَ كَتِفَيَّ فَقَالَ إِنَّ اللهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ وَلَا وَصِيَّةَ لِوَارِثٍ وَالْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَمَنْ ادَّعَى إِلَى غَيْرِأَبِيهِ أَوْ انْتَمَى إِلَى غَيْرِ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ

“The Prophet ﷺ addressed them when he was on his camel. His camel was chewing its cud and its saliva was dripping between my shoulders. He said: 'Allah (SWT) has allocated for each heir his share of the inheritance, so it is not permissible (to make) a bequest for an heir. The child belong to the bed and the adulterer gets the stone. Whoever claims to belong to someone other than his father, or (a freed slave) who claims that his Wala is for other than his Mavali, upon him will be the curse of Allah, the angels and all the people, and no charge nor equitable exchange will be accepted from him.” Or he said: “No equitable exchange nor change.” (Using translation from Ibn Mājah 2712)

أَنَّ النَّبِيَّ ﷺ خَطَبَهُمْعَلَى رَاحِلَتِهِ وَإِنَّ رَاحِلَتَهُ لَتَقْصَعُ بِجِرَّتِهَا وَإِنَّ لُعَابَهَا يَسِيلُ بَيْنَ كَتِفَيَّ فَقَالَ إِنَّ اللهَ قَدْ قَسَمَ لِكُلِّ إِنْسَانٍ نَصِيبَهُ مِنَ الْمِيرَاثِ فَلَا تَجُوزُ وَصِيَّةٌ لِوَارِثٍ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ أَلَا وَمَنْ ادَّعَى إِلَى غَيْرِ أَبِيهِ أَوْ تَوَلَّى غَيْرَ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ اللهُ مِنْهُ صَرْفًا وَلَا عَدْلًا أَوْ عَدْلًا وَلَا صَرْفًا

[Machine] The Messenger of Allah ﷺ delivered a sermon while he was in Mina, riding on his camel. I was sitting beneath the saddle of his camel, and it was grazing with its nose-rein. Its saliva was flowing between my shoulders. He said, "Verily, Allah has allotted to every person their share of inheritance, and it is not permissible for an heir to make a bequest in favor of someone else. Indeed, a child belongs to their bed [biological father], and the stone [of punishment] is for the one who commits adultery. And whoever claims someone other than their father, or turns their back on their guardians, out of aversion for them, then upon them is the curse of Allah, the angels, and all people." Sa'id said: Matr narrated to us from Shahr bin Hawsab, from 'Abdul-Rahman bin Ghinm, from 'Amr bin Kharijah, from the Prophet ﷺ , with similar wording. Matr added in the Hadith: "And it is not accepted from him [the heir] to transfer it [inheritance] or to act justly."

[Machine] I was under the Prophet's camel while it was stumbling with its harness, and its saliva was resting between my shoulders. I heard him saying, "Verily, Allah has given every rightful person their right, and it is not permissible for an heir to have a will, and a child is for the bed [i.e., the biological father], and the stone [i.e., the child conceived out of wedlock] is for the adulterer. And whoever claims to belong to someone other than his father or claims to belong to someone other than his guardians obediently, then upon him is the curse of Allah, the angels, and all people. His testament or adjustment will not be accepted."  

الطبراني:١٤١٨٩حَدَّثَنَا أَبُو مُسْلِمٍ الْكَشِّيُّ ثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ ثَنَا هِشَامُ الدَّسْتُوَائِيُّ عَنْ قَتَادَةَ عَنْ شَهْرِ بْنِ حَوْشَبٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ عَنْ عَمْرِو بْنِ خَارِجَةَ قَالَ

كُنْتُ تَحْتَ نَاقَةِ النَّبِيِّ ﷺ وَهِيَ تَقْصَعُ بِجِرَّتِهَا وَلُعَابُهَا يَتَوَسَّدُ بَيْنَ كَتِفَيَّ فَسَمِعْتُهُ يَقُولُ «إِنَّ اللهَ ﷻ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ وَلَا يَجُوزُ لِوَارِثٍ وَصِيَّةٌ وَالْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَمَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ أَوِ انْتَمَى إِلَى غَيْرِ مَوَالِيهِ رَغْبَةً عَنْهُمْ فَعَلَيْهُ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ»

He said, "Verily, Allah has given every person what is due to him, and there is no will for an heir. A child belongs to the bed and the stone (a term used here for a prostitute) is for the adulteress. Whoever claims to belong to someone other than his father or attributes himself to someone other than his guardians, upon him is the curse of Allah, the angels, and all the people. No change or adjustment will be accepted from him."  

الطبراني:١٤١٩٠حَدَّثَنَا مُحَمَّدُ بْنُ النَّضْرِ الْأَزْدِيُّ ثَنَا خَالِدُ بْنُ خِدَاشٍ ح وَحَدَّثَنَا أَبُو خَلِيفَةَ ثَنَا عَبْدُ اللهُ بْنُ عَبْدِ الْوَهَّابِ الْحَجَبِيُّ قَالَا ثَنَا أَبُو عَوَانَةَ عَنْ قَتَادَةَ عَنْ شَهْرِ بْنِ حَوْشَبٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ عَنْ عَمْرِو بْنِ خَارِجَةَ قَالَ

خَطَبَنَا رَسُولُ اللهِ ﷺ وَهُوَ عَلَى نَاقَتِهِ الْجَدْعَاءِ وَأَنَا آخِذٌ بِجِرَانِهَا وَهِيَ تَقْصَعُ بِجِرَّتِهَا فَقَالَ «إِنَّ اللهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ لَا وَصِيَّةَ لِوَارِثٍ وَالْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ مَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ وانْتَمَى إِلَى غَيْرِ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ»

[Machine] I witnessed the pilgrimage of the Messenger of Allah, ﷺ , and I was among the neighbors of the camel of the Messenger of Allah, ﷺ , as it was grazing with its rope and its saliva was flowing between its shoulders. So I heard him saying, "Verily, Allah has given every rightful person his right. Verily, it is not permissible for a bequest to be made for an heir to the bed or for the prostitute. And whoever claims to belong to someone other than his father or attributes himself to someone other than his guardians, then upon him is the curse of Allah, the angels, and all people. His word does not hold the power to change or amend anything."

[Machine] I was holding the reins of the Messenger of Allah's camel, while it was staggering with its saddle blanket, and its saliva was dripping between its shoulders. Then I heard him say, "Indeed, Allah has given every rightful person their right. Verily, it is not permissible for a bequest to be made for an heir, and the child belongs to the bed. And whoever claims to be from someone other than his father and joins himself to other than his guardians, then upon him is the curse of Allah, the angels, and all people. His expenditure and testimony will not be accepted from him."

كُنْتُ آخُذُ بِزِمَامِ نَاقَةِ رَسُولِ اللهِ ﷺ وَهِيَ تَقْصَعُ بِجِرَّتِهَا وَلُعَابُهَا يَسِيلُ بَيْنَ كَتِفَيَّ فَسَمِعْتُهُ يَقُولُ «أَلَا إِنَّ اللهَ ﷻ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ أَلَا إِنَّهُ لَا تَجُوزُ وَصِيَّةٌ لِوَارِثٍ وَالْوَلَدُ لِلْفِرَاشِ وَمَنِ ادَّعَى إِلَى غَيْرِ أَبِيهِ وَانْتَمَى إِلَى غَيْرِ مَوَالِيهِ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يُقْبَلُ مِنْهُ صَرْفٌ وَلَا عَدْلٌ»

"عَنْ أَبِي أُمَامَةَ: سَمِعْتُ رسُولَ الله ﷺ يَقُولُ في خطبَتِهِ عَامَ حَجَّةِ الوَدَاع: ألَا إِنَّ الله قَد أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلَا وَصِيَّةَ لِوَارِثٍ، الْوَلَدُ لِلفِرَاشِ وَلِلعَاهِرِ الْحَجْرُ، وَحَسابُهُمْ عَلَى الله، مَنْ ادَّعَى إِلَى غَير أَبِيهِ أَوِ انْتَهى إِلَى غَيْرِ مَوَالِيهِ، فَعَلْيهِ لَعْنَةُ الله التَّابِعَةُ إِلَى يَوْمِ الْقِيَامَةِ لَا يَقْبلُ الله مِنْه صَرْفًا وَلَا عدلًا، لَا تُنْفِقُ امْرأَةٌ مِنْ بَيْتِهَا إلَّا بِإِذْنِ زَوَجِهَا، فَقِيل: يَا رَسُولَ الله: وَلَا الطَّعَامَ؟ قَالَ: ذَلِكَ أَفْضَلُ أموَالِنَا، ثُمَّ قَالَ: إِنَّ الْعَارِيَةَ مُؤَدَّاةٌ، وَالْمَنِيَحةَ مَرْدُودَةٌ، والدَّيْنَ مَقْضِّي، والزَّعِيمَ غَارِمٌ".
