The first event of Qasama in the pre-lslamic period of ignorance was practiced by us (i.e. Banu Hashim). A man from Banu Hashim was employed by a Quraishi man from another branch-family. The (Hashimi) laborer set out with the Quraishi driving his camels. There passed by him another man from Banu Hashim. The leather rope of the latter's bag had broken so he said to the laborer, "Will you help me by giving me a rope in order to tie the handle of my bag lest the camels should run away from me?" The laborer gave him a rope and the latter tied his bag with it. When the caravan halted, all the camels' legs were tied with their fetters except one camel. The employer asked the laborer, "Why, from among all the camels has this camel not been fettered?" He replied, "There is no fetter for it." The Quraishi asked, "Where is its fetter?" and hit the laborer with a stick that caused his death (later on Just before his death) a man from Yemen passed by him. The laborer asked (him), "Will you go for the pilgrimage?" He replied, "I do not think I will attend it, but perhaps I will attend it." The (Hashimi) laborer said, "Will you please convey a message for me once in your life?" The other man said, "yes." The laborer wrote: 'When you attend the pilgrimage, call the family of Quraish, and if they respond to you, call the family of Banu Hashim, and if they respond to you, ask about Abu Talib and tell him that so-and-so has killed me for a fetter." Then the laborer expired. When the employer reached (Mecca), Abu Talib visited him and asked, "What has happened to our companion?" He said, "He became ill and I looked after him nicely (but he died) and I buried him." Then Abu Talib said, "The deceased deserved this from you." After some time, the messenger whom the laborer has asked to convey the message, reached during the pilgrimage season. He called, "O the family of Quraish!" The people replied, "This is Quraish." Then he called, "O the family of Banu Hashim!" Again the people replied, "This is Banu Hashim." He asked, "Who is Abu Talib?" The people replied, "This is Abu Talib." He said, "'So-and-so has asked me to convey a message to you that so-and-so has killed him for a fetter (of a camel)." Then Abu Talib went to the (Quraishi) killer and said to him, "Choose one of three alternatives: (i) If you wish, give us one-hundred camels because you have murdered our companion, (ii) or if you wish, fifty of your men should take an oath that you have not murdered our companion, and if you do not accept this, (iii) we will kill you in Qisas." The killer went to his people and they said, "We will take an oath." Then a woman from Banu Hashim who was married to one of them (i.e.the Quraishis) and had given birth to a child from him, came to Abu Talib and said, "O Abu Talib! I wish that my son from among the fifty men, should be excused from this oath, and that he should not take the oath where the oathtaking is carried on." Abu Talib excused him. Then another man from them came (to Abu Talib) and said, "O Abu Talib! You want fifty persons to take an oath instead of giving a hundred camels, and that means each man has to give two camels (in case he does not take an oath). So there are two camels I would like you to accept from me and excuse me from taking an oath where the oaths are taken. Abu Talib accepted them from him. Then 48 men came and took the oath. Ibn ʿAbbas further said:) By Him in Whose Hand my life is, before the end of that year, none of those 48 persons remained alive. (Using translation from Bukhārī 3845)

Ibn ʿAbbas said to us, "Shall I tell you the story of Abu Dhar's conversion to Islam?" We said, "Yes." He said, "Abu Dhar said: I was a man from the tribe of Ghifar. We heard that a man had appeared in Mecca, claiming to be a Prophet. ! said to my brother, 'Go to that man and talk to him and bring me his news.' He set out, met him and returned. I asked him, 'What is the news with you?' He said, 'By Allah, I saw a man enjoining what is good and forbidding what is evil.' I said to him, 'You have not satisfied me with this little information.' So, I took a waterskin and a stick and proceeded towards Mecca. Neither did I know him (i.e. the Prophet ﷺ ), nor did I like to ask anyone about him. I Kept on drinking Zam zam water and staying in the Mosque. Then ʿAli passed by me and said, 'It seems you are a stranger?' I said, 'Yes.' He proceeded to his house and I accompanied him. Neither did he ask me anything, nor did I tell him anything. Next morning I went to the Mosque to ask about the Prophet but no-one told me anything about him. ʿAli passed by me again and asked, 'Hasn't the man recognized his dwelling place yet' I said, 'No.' He said, 'Come along with me.' He asked me, 'What is your business? What has brought you to this town?' I said to him, 'If you keep my secret, I will tell you.' He said, 'I will do,' I said to him, 'We have heard that a person has appeared here, claiming to be a Prophet. I sent my brother to speak to him and when he returned, he did not bring a satisfactory report; so I thought of meeting him personally.' ʿAli said (to Abu Dhar), 'You have reached your goal; I am going to him just now, so follow me, and wherever I enter, enter after me. If I should see someone who may cause you trouble, I will stand near a wall pretending to mend my shoes (as a warning), and you should go away then.' ʿAli proceeded and I accompanied him till he entered a place, and I entered with him to the Prophet ﷺ to whom I said, 'Present (the principles of) Islam to me.' When he did, I embraced Islam 'immediately. He said to me, 'O Abu Dhar! Keep your conversion as a secret and return to your town; and when you hear of our victory, return to us. ' I said, 'By H him Who has sent you with the Truth, I will announce my conversion to Islam publicly amongst them (i.e. the infidels),' Abu Dhar went to the Mosque, where some people from Quraish were present, and said, 'O folk of Quraish ! I testify that None has the right to be worshipped except Allah, and I (also) testify that Muhammad is Allah's Slave and His Apostle.' (Hearing that) the Quraishi men said, 'Get at this Sabi (i.e. Muslim) !' They got up and beat me nearly to death. Al ʿAbbas saw me and threw himself over me to protect me. He then faced them and said, 'Woe to you! You want to kill a man from the tribe of Ghifar, although your trade and your communications are through the territory of Ghifar?' They therefore left me. The next morning I returned (to the Mosque) and said the same as I have said on the previous day. They again said, 'Get at this Sabi!' I was treated in the same way as on the previous day, and again Al-Abbas found me and threw himself over me to protect me and told them the same as he had said the day before.' So, that was the conversion of Abu Dhar (may Allah be Merciful to him) to Islam."

أَبُو ذَرٍّ كُنْتُ رَجُلاً مِنْ غِفَارٍ فَبَلَغَنَا أَنَّ رَجُلاً قَدْ خَرَجَ بِمَكَّةَ يَزْعُمُ أَنَّهُ نَبِيٌّ فَقُلْتُ لأَخِي انْطَلِقْ إِلَى هَذَا الرَّجُلِ كَلِّمْهُ وَأْتِنِي بِخَبَرِهِ فَانْطَلَقَ فَلَقِيَهُ ثُمَّ رَجَعَ فَقُلْتُ مَا عِنْدَكَ فَقَالَ وَاللَّهِ لَقَدْ رَأَيْتُ رَجُلاً يَأْمُرُ بِالْخَيْرِ وَيَنْهَى عَنِ الشَّرِّ فَقُلْتُ لَهُ لَمْ تَشْفِنِي مِنَ الْخَبَرِ فَأَخَذْتُ جِرَابًا وَعَصًا ثُمَّ أَقْبَلْتُ إِلَى مَكَّةَ فَجَعَلْتُ لاَ أَعْرِفُهُ وَأَكْرَهُ أَنْ أَسْأَلَ عَنْهُ وَأَشْرَبُ مِنْ مَاءِ زَمْزَمَ وَأَكُونُ فِي الْمَسْجِدِ قَالَ فَمَرَّ بِي عَلِيٌّ فَقَالَ كَأَنَّ الرَّجُلَ غَرِيبٌ قَالَ قُلْتُ نَعَمْ قَالَ فَانْطَلِقْ إِلَى الْمَنْزِلِ قَالَ فَانْطَلَقْتُ مَعَهُ لاَ يَسْأَلُنِي عَنْ شَىْءٍ وَلاَ أُخْبِرُهُ فَلَمَّا أَصْبَحْتُ غَدَوْتُ إِلَى الْمَسْجِدِ لأَسْأَلَ عَنْهُ وَلَيْسَ أَحَدٌ يُخْبِرُنِي عَنْهُ بِشَىْءٍ قَالَ فَمَرَّ بِي عَلِيٌّ فَقَالَ أَمَا نَالَ لِلرَّجُلِ يَعْرِفُ مَنْزِلَهُ بَعْدُ قَالَ قُلْتُ لاَ قَالَ انْطَلِقْ مَعِي قَالَ فَقَالَ مَا أَمْرُكَ وَمَا أَقْدَمَكَ هَذِهِ الْبَلْدَةَ قَالَ قُلْتُ لَهُ إِنْ كَتَمْتَ عَلَىَّ أَخْبَرْتُكَ قَالَ فَإِنِّي أَفْعَلُ قَالَ قُلْتُ لَهُ بَلَغَنَا أَنَّهُ قَدْ خَرَجَ هَا هُنَا رَجُلٌ يَزْعُمُ أَنَّهُ نَبِيٌّ فَأَرْسَلْتُ أَخِي لِيُكَلِّمَهُ فَرَجَعَ وَلَمْ يَشْفِنِي مِنَ الْخَبَرِ فَأَرَدْتُ أَنْ أَلْقَاهُ فَقَالَ لَهُ أَمَا إِنَّكَ قَدْ رَشَدْتَ هَذَا وَجْهِي إِلَيْهِ فَاتَّبِعْنِي ادْخُلْ حَيْثُ أَدْخُلُ فَإِنِّي إِنْ رَأَيْتُ أَحَدًا أَخَافُهُ عَلَيْكَ قُمْتُ إِلَى الْحَائِطِ كَأَنِّي أُصْلِحُ نَعْلِي وَامْضِ أَنْتَ فَمَضَى وَمَضَيْتُ مَعَهُ حَتَّى دَخَلَ وَدَخَلْتُ مَعَهُ عَلَى النَّبِيِّ ﷺ فَقُلْتُ لَهُ اعْرِضْ عَلَىَّ الإِسْلاَمَ فَعَرَضَهُ فَأَسْلَمْتُ مَكَانِي فَقَالَ لِي يَا أَبَا ذَرٍّ اكْتُمْ هَذَا الأَمْرَ وَارْجِعْ إِلَى بَلَدِكَ فَإِذَا بَلَغَكَ ظُهُورُنَا فَأَقْبِلْ فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ لأَصْرُخَنَّ بِهَا بَيْنَ أَظْهُرِهِمْ فَجَاءَ إِلَى الْمَسْجِدِ وَقُرَيْشٌ فِيهِ فَقَالَ يَا مَعْشَرَ قُرَيْشٍ إِنِّي أَشْهَدُ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ فَقَالُوا قُومُوا إِلَى هَذَا الصَّابِئِ فَقَامُوا فَضُرِبْتُ لأَمُوتَ فَأَدْرَكَنِي الْعَبَّاسُ فَأَكَبَّ عَلَىَّ ثُمَّ أَقْبَلَ عَلَيْهِمْ فَقَالَ وَيْلَكُمْ تَقْتُلُونَ رَجُلاً مِنْ غِفَارَ وَمَتْجَرُكُمْ وَمَمَرُّكُمْ عَلَى غِفَارَ فَأَقْلَعُوا عَنِّي فَلَمَّا أَنْ أَصْبَحْتُ الْغَدَ رَجَعْتُ فَقُلْتُ مِثْلَ مَا قُلْتُ بِالأَمْسِ فَقَالُوا قُومُوا إِلَى هَذَا الصَّابِئِ فَصُنِعَ {بِي} مِثْلَ مَا صُنِعَ بِالأَمْسِ وَأَدْرَكَنِي الْعَبَّاسُ فَأَكَبَّ عَلَىَّ وَقَالَ مِثْلَ مَقَالَتِهِ بِالأَمْسِ قَالَ فَكَانَ هَذَا أَوَّلَ إِسْلاَمِ أَبِي ذَرٍّ رَحِمَهُ اللَّهُ

إِنَّ أَوَّلَ قَسَامَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ لَفِينَا بَنِي هَاشِمٍ كَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَهُ رَجُلٌ مِنْ قُرَيْشٍ مِنْ فَخِذٍ أُخْرَى فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ رَجُلٌ بِهِ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لاَ تَنْفِرُ الإِبِلُ فَأَعْطَاهُ عِقَالاً فَشَدَّ بِهِ عُرْوَةَ جُوَالِقِهِ فَلَمَّا نَزَلُوا عُقِلَتِ الإِبِلُ إِلاَّ بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الإِبِلِ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ قَالَ فَحَذَفَهُ بِعَصًا كَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ أَتَشْهَدُ الْمَوْسِمَ قَالَ مَا أَشْهَدُ وَرُبَّمَا شَهِدْتُهُ قَالَ هَلْ أَنْتَ مُبْلِغٌ عَنِّي رِسَالَةً مَرَّةً مِنَ الدَّهْرِ قَالَ نَعَمْ قَالَ فَكُنْتَ إِذَا أَنْتَ شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوكَ فَنَادِ يَا آلَ بَنِي هَاشِمٍ فَإِنْ أَجَابُوكَ فَسَلْ عَنْ أَبِي طَالِبٍ فَأَخْبِرْهُ أَنَّ فُلاَنًا قَتَلَنِي فِي عِقَالٍ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ فَوَلِيتُ دَفْنَهُ قَالَ قَدْ كَانَ أَهْلَ ذَاكَ مِنْكَ فَمَكُثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الَّذِي أَوْصَى إِلَيْهِ أَنْ يُبْلِغَ عَنْهُ وَافَى الْمَوْسِمَ فَقَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ قَالُوا هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلاَنٌ أَنْ أُبْلِغَكَ رِسَالَةً أَنَّ فُلاَنًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ لَهُ اخْتَرْ مِنَّا إِحْدَى ثَلاَثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنَ الإِبِلِ فَإِنَّكَ قَتَلْتَ صَاحِبَنَا وَإِنْ شِئْتَ حَلَفَ خَمْسُونَ مِنْ قَوْمِكَ أَنَّكَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاكَ بِهِ فَأَتَى قَوْمَهُ فَقَالُوا نَحْلِفُ فَأَتَتْهُ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا بِرَجُلٍ مِنَ الْخَمْسِينَ وَلاَ تَصْبُرْ يَمِينَهُ حَيْثُ تُصْبَرُ الأَيْمَانُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلاً أَنْ يَحْلِفُوا مَكَانَ مِائَةٍ مِنَ الإِبِلِ يُصِيبُ كُلَّ رَجُلٍ بَعِيرَانِ هَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلاَ تَصْبُرْ يَمِينِي حَيْثُ تُصْبِرُ الأَيْمَانُ فَقَبِلَهُمَا وَجَاءَ ثَمَانِيةٌ وَأَرْبَعُونَ فَحَلَفُوا قَالَ ابْنُ عَبَّاسٍ فَوَالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنَ الثَّمَانِيَةِ وَأَرْبَعِينَ عَيْنٌ تَطْرِفُ

Once ʿUmar bin ʿAbdul ʿAziz sat on his throne in the courtyard of his house so that the people might gather before him. Then he admitted them and (when they came in), he said, "What do you think of Al-Qasama?" They said, "We say that it is lawful to depend on Al-Qasama in Qisas, as the previous Muslim Caliphs carried out Qisas depending on it." Then he said to me, "O Abu Qilaba! What do you say about it?" He let me appear before the people and I said, "O Chief of the Believers! You have the chiefs of the army staff and the nobles of the Arabs. If fifty of them testified that a married man had committed illegal sexual intercourse in Damascus but they had not seen him (doing so), would you stone him?" He said, "No." I said, "If fifty of them testified that a man had committed theft in Hums, would you cut off his hand though they did not see him?" He replied, "No." I said, "By Allah, Messenger of Allah ﷺ never killed anyone except in one of the following three situations: (1) A person who killed somebody unjustly, was killed (in Qisas,) (2) a married person who committed illegal sexual intercourse and (3) a man who fought against Allah and His Apostle and deserted Islam and became an apostate." Then the people said, "Didn't Anas bin Malik narrate that Messenger of Allah ﷺ cut off the hands of the thieves, branded their eyes and then, threw them in the sun?" I said, "I shall tell you the narration of Anas. Anas said: "Eight persons from the tribe of ʿUkl came to Messenger of Allah ﷺ and gave the Pledge of allegiance for Islam (became Muslim). The climate of the place (Medina) did not suit them, so they became sick and complained about that to Messenger of Allah ﷺ. He said (to them ), "Won't you go out with the shepherd of our camels and drink of the camels' milk and urine (as medicine)?" They said, "Yes." So they went out and drank the camels' milk and urine, and after they became healthy, they killed the shepherd of Messenger of Allah ﷺ and took away all the camels. This news reached Messenger of Allah ﷺ , so he sent (men) to follow their traces and they were captured and brought (to the Prophet). He then ordered to cut their hands and feet, and their eyes were branded with heated pieces of iron, and then he threw them in the sun till they died." I said, "What can be worse than what those people did? They deserted Islam, committed murder and theft." Then 'Anbasa bin Saʿid said, "By Allah, I never heard a narration like this of today." I said, "O 'Anbasa! You deny my narration?" 'Anbasa said, "No, but you have related the narration in the way it should be related. By Allah, these people are in welfare as long as this Sheikh (Abu Qilaba) is among them." I added, "Indeed in this event there has been a tradition set by Messenger of Allah ﷺ. The narrator added: Some Ansari people came to the Prophet ﷺ and discussed some matters with him, a man from amongst them went out and was murdered. Those people went out after him, and behold, their companion was swimming in blood. They returned to Messenger of Allah ﷺ and said to him, "O Allah's Apostle, we have found our companion who had talked with us and gone out before us, swimming in blood (killed)." Messenger of Allah ﷺ went out and asked them, "Whom do you suspect or whom do you think has killed him?" They said, "We think that the Jews have killed him." The Prophet ﷺ sent for the Jews and asked them, "Did you kill this (person)?" They replied, "No." He asked the Al-Ansars, "Do you agree that I let fifty Jews take an oath that they have not killed him?" They said, "It matters little for the Jews to kill us all and then take false oaths." He said, "Then would you like to receive the Diya after fifty of you have taken an oath (that the Jews have killed your man)?" They said, "We will not take the oath." Then the Prophet ﷺ himself paid them the Diya (Blood-money)." The narrator added, "The tribe of Hudhail repudiated one of their men (for his evil conduct) in the Pre-lslamic period of Ignorance. Then, at a place called Al-Batha' (near Mecca), the man attacked a Yemenite family at night to steal from them, but a. man from the family noticed him and struck him with his sword and killed him. The tribe of Hudhail came and captured the Yemenite and brought him to ʿUmar during the Hajj season and said, "He has killed our companion." The Yemenite said, "But these people had repudiated him (i.e., their companion)." ʿUmar said, "Let fifty persons of Hudhail swear that they had not repudiated him." So forty-nine of them took the oath and then a person belonging to them, came from Sham and they requested him to swear similarly, but he paid one-thousand Dirhams instead of taking the oath. They called another man instead of him and the new man shook hands with the brother of the deceased. Some people said, "We and those fifty men who had taken false oaths (Al-Qasama) set out, and when they reached a place called Nakhlah, it started raining so they entered a cave in the mountain, and the cave collapsed on those fifty men who took the false oath, and all of them died except the two persons who had shaken hands with each other. They escaped death but a stone fell on the leg of the brother of the deceased and broke it, whereupon he survived for one year and then died." I further said, "ʿAbdul Malik bin Marwan sentenced a man to death in Qisas (equality in punishment) for murder, basing his judgment on Al-Qasama, but later on he regretted that judgment and ordered that the names of the fifty persons who had taken the oath (Al-Qasama), be erased from the register, and he exiled them in Sham."

أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ أَبْرَزَ سَرِيرَهُ يَوْمًا لِلنَّاسِ ثُمَّ أَذِنَ لَهُمْ فَدَخَلُوا فَقَالَ مَا تَقُولُونَ فِي الْقَسَامَةِ قَالَ نَقُولُ الْقَسَامَةُ الْقَوَدُ بِهَا حَقٌّ وَقَدْ أَقَادَتْ بِهَا الْخُلَفَاءُ قَالَ لِي مَا تَقُولُ يَا أَبَا قِلاَبَةَ وَنَصَبَنِي لِلنَّاسِ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ عِنْدَكَ رُءُوسُ الأَجْنَادِ وَأَشْرَافُ الْعَرَبِ أَرَأَيْتَ لَوْ أَنَّ خَمْسِينَ مِنْهُمْ شَهِدُوا عَلَى رَجُلٍ مُحْصَنٍ بِدِمَشْقَ أَنَّهُ قَدْ زَنَى لَمْ يَرَوْهُ أَكُنْتَ تَرْجُمُهُ قَالَ لاَ قُلْتُ أَرَأَيْتَ لَوْ أَنَّ خَمْسِينَ مِنْهُمْ شَهِدُوا عَلَى رَجُلٍ بِحِمْصَ أَنَّهُ سَرَقَ أَكُنْتَ تَقْطَعُهُ وَلَمْ يَرَوْهُ قَالَ لاَ قُلْتُ فَوَاللَّهِ مَا قَتَلَ رَسُولُ اللَّهِ ﷺ قَطُّ إِلاَّ فِي إِحْدَى ثَلاَثِ خِصَالٍ رَجُلٌ قَتَلَ بِجَرِيرَةِ نَفْسِهِ فَقُتِلَ أَوْ رَجُلٌ زَنَى بَعْدَ إِحْصَانٍ أَوْ رَجُلٌ حَارَبَ اللَّهَ وَرَسُولَهُ وَارْتَدَّ عَنِ الإِسْلاَمِ فَقَالَ الْقَوْمُ أَوَلَيْسَ قَدْ حَدَّثَ أَنَسُ بْنُ مَالِكٍ أَنَّ رَسُولَ اللَّهِ ﷺ قَطَعَ فِي السَّرَقِ وَسَمَرَ الأَعْيُنَ ثُمَّ نَبَذَهُمْ فِي الشَّمْسِ فَقُلْتُ أَنَا أُحَدِّثُكُمْ حَدِيثَ أَنَسٍ

حَدَّثَنِي أَنَسٌ أَنَّ نَفَرًا مِنْ عُكْلٍ ثَمَانِيَةً قَدِمُوا عَلَى رَسُولِ اللَّهِ ﷺ فَبَايَعُوهُ عَلَى الإِسْلاَمِ فَاسْتَوْخَمُوا الأَرْضَ فَسَقِمَتْ أَجْسَامُهُمْ فَشَكَوْا ذَلِكَ إِلَى رَسُولِ اللَّهِ ﷺ قَالَ أَفَلاَ تَخْرُجُونَ مَعَ رَاعِينَا فِي إِبِلِهِ فَتُصِيبُونَ مِنْ أَلْبَانِهَا وَأَبْوَالِهَا قَالُوا بَلَى فَخَرَجُوا فَشَرِبُوا مِنْ أَلْبَانِهَا وَأَبْوَالِهَا فَصَحُّوا فَقَتَلُوا رَاعِيَ رَسُولِ اللَّهِ ﷺ وَأَطْرَدُوا النَّعَمَ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَأَرْسَلَ فِي آثَارِهِمْ فَأُدْرِكُوا فَجِيءَ بِهِمْ فَأَمَرَ بِهِمْ فَقُطِّعَتْ أَيْدِيهِمْ وَأَرْجُلُهُمْ وَسَمَرَ أَعْيُنَهُمْ ثُمَّ نَبَذَهُمْ فِي الشَّمْسِ حَتَّى مَاتُوا قُلْتُ وَأَىُّ شَىْءٍ أَشَدُّ مِمَّا صَنَعَ هَؤُلاَءِ ارْتَدُّوا عَنِ الإِسْلاَمِ وَقَتَلُوا وَسَرَقُوا فَقَالَ عَنْبَسَةُ بْنُ سَعِيدٍ وَاللَّهِ إِنْ سَمِعْتُ كَالْيَوْمِ قَطُّ فَقُلْتُ أَتَرُدُّ عَلَىَّ حَدِيثِي يَا عَنْبَسَةُ قَالَ لاَ وَلَكِنْ جِئْتَ بِالْحَدِيثِ عَلَى وَجْهِهِ وَاللَّهِ لاَ يَزَالُ هَذَا الْجُنْدُ بِخَيْرٍ مَا عَاشَ هَذَا الشَّيْخُ بَيْنَ أَظْهُرِهِمْ قُلْتُ وَقَدْ كَانَ فِي هَذَا سُنَّةٌ مِنْ رَسُولِ اللَّهِ ﷺ دَخَلَ عَلَيْهِ نَفَرٌ مِنَ الأَنْصَارِ فَتَحَدَّثُوا عِنْدَهُ فَخَرَجَ رَجُلٌ مِنْهُمْ بَيْنَ أَيْدِيهِمْ فَقُتِلَ فَخَرَجُوا بَعْدَهُ فَإِذَا هُمْ بِصَاحِبِهِمْ يَتَشَحَّطُ فِي الدَّمِ فَرَجَعُوا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالُوا يَا رَسُولَ اللَّهِ صَاحِبُنَا كَانَ تَحَدَّثَ مَعَنَا فَخَرَجَ بَيْنَ أَيْدِينَا فَإِذَا نَحْنُ بِهِ يَتَشَحَّطُ فِي الدَّمِ فَخَرَجَ رَسُولُ اللَّهِ ﷺ فَقَالَ بِمَنْ تَظُنُّونَ أَوْ تَرَوْنَ قَتَلَهُ قَالُوا نَرَى أَنَّ الْيَهُودَ قَتَلَتْهُ فَأَرْسَلَ إِلَى الْيَهُودِ فَدَعَاهُمْ فَقَالَ آنْتُمْ قَتَلْتُمْ هَذَا قَالُوا لاَ قَالَ أَتَرْضَوْنَ نَفَلَ خَمْسِينَ مِنَ الْيَهُودِ مَا قَتَلُوهُ فَقَالُوا مَا يُبَالُونَ أَنْ يَقْتُلُونَا أَجْمَعِينَ ثُمَّ يَنْتَفِلُونَ قَالَ أَفَتَسْتَحِقُّونَ الدِّيَةَ بِأَيْمَانِ خَمْسِينَ مِنْكُمْ قَالُوا مَا كُنَّا لِنَحْلِفَ فَوَدَاهُ مِنْ عِنْدِهِ قُلْتُ وَقَدْ كَانَتْ هُذَيْلٌ خَلَعُوا خَلِيعًا لَهُمْ فِي الْجَاهِلِيَّةِ فَطَرَقَ أَهْلَ بَيْتٍ مِنَ الْيَمَنِ بِالْبَطْحَاءِ فَانْتَبَهَ لَهُ رَجُلٌ مِنْهُمْ فَحَذَفَهُ بِالسَّيْفِ فَقَتَلَهُ فَجَاءَتْ هُذَيْلٌ فَأَخَذُوا الْيَمَانِيَ فَرَفَعُوهُ إِلَى عُمَرَ بِالْمَوْسِمِ وَقَالُوا قَتَلَ صَاحِبَنَا فَقَالَ إِنَّهُمْ قَدْ خَلَعُوهُ فَقَالَ يُقْسِمُ خَمْسُونَ مِنْ هُذَيْلٍ مَا خَلَعُوهُ قَالَ فَأَقْسَمَ مِنْهُمْ تِسْعَةٌ وَأَرْبَعُونَ رَجُلاً وَقَدِمَ رَجُلٌ مِنْهُمْ مِنَ الشَّأْمِ فَسَأَلُوهُ أَنْ يُقْسِمَ فَافْتَدَى يَمِينَهُ مِنْهُمْ بِأَلْفِ دِرْهَمٍ فَأَدْخَلُوا مَكَانَهُ رَجُلاً آخَرَ فَدَفَعَهُ إِلَى أَخِي الْمَقْتُولِ فَقُرِنَتْ يَدُهُ بِيَدِهِ قَالُوا فَانْطَلَقَا وَالْخَمْسُونَ الَّذِينَ أَقْسَمُوا حَتَّى إِذَا كَانُوا بِنَخْلَةَ أَخَذَتْهُمُ السَّمَاءُ فَدَخَلُوا فِي غَارٍ فِي الْجَبَلِ فَانْهَجَمَ الْغَارُ عَلَى الْخَمْسِينَ الَّذِينَ أَقْسَمُوا فَمَاتُوا جَمِيعًا وَأَفْلَتَ الْقَرِينَانِ وَاتَّبَعَهُمَا حَجَرٌ فَكَسَرَ رِجْلَ أَخِي الْمَقْتُولِ فَعَاشَ حَوْلاً ثُمَّ مَاتَ قُلْتُ وَقَدْ كَانَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ أَقَادَ رَجُلاً بِالْقَسَامَةِ ثُمَّ نَدِمَ بَعْدَ مَا صَنَعَ فَأَمَرَ بِالْخَمْسِينَ الَّذِينَ أَقْسَمُوا فَمُحُوا مِنَ الدِّيوَانِ وَسَيَّرَهُمْ إِلَى الشَّأْمِ

"The first instance of Qasamah during the Jahiliyyah involved a man from Banu Hashim who was employed by a man from Quraish, from another branch of the tribe. He went out with him, driving his camels and another man from Banu Hashim passed by them. The leather rope of that man's bag broke, so he said (to the hired worker): 'Help me by giving me a rope with which to tie the handle of my bag, lest the camels run away from me. 'So he gave him a rope and he tied his gab with it. When they halted, all the camels' legs were hobbled except one camel. The one who had hired him said: 'Why is his camel, out of all of them, not hobbled? He said: 'There is no rope for it. He said: 'Where is its rope? He said: A man from Banu Hashim passed by and the leather rope of his bag had broken, and he asked me to help him; he said: "Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me, so I gave him a rope . " He struck him with a stick, which led to his death.Then a man from Yemen passed by him (the man from Banu Hashim, (the man from Banu Hashim, just before he died) and he (the Hashimi man) said: 'Are you going to attend the Pilgrimage? He said: 'I do not think I will attend it, but perhaps I will attend it.' He said: 'Will you convey a message from me once in your lifetime? He said: 'Yes. 'He said: 'If you attend the pilgrimage, then call out, O family of Quraish! If they respond, then call out, O family of Hashim! If they respond, then ask for Abu Talib, and tell him that so and so killed me for a rope.' Then the hired worker died. When the one who had hired him cam, Abu Talib went to him and said: 'What happened to our companion? He said: 'He fell sick and I took good care of him, but he died, so I stopped and buried him.' He said: 'He deserved that from you. 'Some time passed, then the Yemeni man who had been asked to convey the message arrived at the time of the pilgrimage. He said: 'O family of Quraish! And they said: 'Here is Quraish.' He said: 'O family of Banu Hashim! They said: 'Here is Banu Hashim.' He said" 'Where is Abu Talib? He said: 'Here is Abu Talib.' He said: 'so and so asked me to convey a message to you, that so and so killed him for a camel's rope.' Abu Talib went to him and said" 'Choose one of three alternatives that we are offering you. If you wish, you may give us one hundred camels, because you killed our companion by mistake: or if you wish, fifty of your men may swear an oath that you did not kill him; or if you wish, we will kill you in retaliation. 'He went to his people and told them about that, and they said: 'We will swear the oath.' Then a woman from Banu Hashim, who was married to one of their men and had born him a child, came to Abu Talib and said:' O Abu Talib, I wish that my son, who is one of these fifty men, should be excused from having to take the oath., So the excused him. Then one of the men came to him and said: 'O Abu Talib, you want fifty men to take the oath in lieu of one hundred camels, which means that each man may give two camels instead, so here are two camels; take them from me, and do not make me take the oath.' So he accepted them, and did not make him take the oath. Then forty-eight men came and took the oath." Ibn 'Abbas said: "By the One in Whose hand is my soul, by the time a year has passed, none of those forty-eight men remained alive."  

النسائي:٤٧٠٦أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَى قَالَ حَدَّثَنَا أَبُو مَعْمَرٍ قَالَ حَدَّثَنَا عَبْدُ الْوَارِثِ قَالَ حَدَّثَنَا قَطَنٌ أَبُو الْهَيْثَمِ قَالَ حَدَّثَنَا أَبُو يَزِيدَ الْمَدَنِيُّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ

أَوَّلُ قَسَامَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ كَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَ رَجُلاً مِنْ قُرَيْشٍ مِنْ فَخِذِ أَحَدِهِمْ قَالَ فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ بِهِ رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لاَ تَنْفِرُ الإِبِلُ فَأَعْطَاهُ عِقَالاً يَشُدُّ بِهِ عُرْوَةَ جُوَالِقِهِ فَلَمَّا نَزَلُوا وَعُقِلَتِ الإِبِلُ إِلاَّ بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الإِبِلِ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ قَالَ مَرَّ بِي رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةَ جُوَالِقِهِ فَاسْتَغَاثَنِي فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لاَ تَنْفِرُ الإِبِلُ فَأَعْطَيْتُهُ عِقَالاً فَحَذَفَهُ بِعَصًا كَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ أَتَشْهَدُ الْمَوْسِمَ قَالَ مَا أَشْهَدُ وَرُبَّمَا شَهِدْتُ قَالَ هَلْ أَنْتَ مُبَلِّغٌ عَنِّي رِسَالَةً مَرَّةً مِنَ الدَّهْرِ قَالَ نَعَمْ قَالَ إِذَا شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوكَ فَنَادِ يَا آلَ هَاشِمٍ فَإِذَا أَجَابُوكَ فَسَلْ عَنْ أَبِي طَالِبٍ فَأَخْبِرْهُ أَنَّ فُلاَنًا قَتَلَنِي فِي عِقَالٍ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ ثُمَّ مَاتَ فَنَزَلْتُ فَدَفَنْتُهُ فَقَالَ كَانَ ذَا أَهْلَ ذَاكَ مِنْكَ فَمَكُثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الْيَمَانِيَّ الَّذِي كَانَ أَوْصَى إِلَيْهِ أَنْ يُبَلِّغَ عَنْهُ وَافَى الْمَوْسِمَ قَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ قَالَ هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلاَنٌ أَنْ أُبَلِّغَكَ رِسَالَةً أَنَّ فُلاَنًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ اخْتَرْ مِنَّا إِحْدَى ثَلاَثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنَ الإِبِلِ فَإِنَّكَ قَتَلْتَ صَاحِبَنَا خَطَأً وَإِنْ شِئْتَ يَحْلِفُ خَمْسُونَ مِنْ قَوْمِكَ أَنَّكَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاكَ بِهِ فَأَتَى قَوْمَهُ فَذَكَرَ ذَلِكَ لَهُمْ فَقَالُوا نَحْلِفُ فَأَتَتْهُ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا بِرَجُلٍ مِنَ الْخَمْسِينَ وَلاَ تُصْبِرْ يَمِينَهُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلاً أَنْ يَحْلِفُوا مَكَانَ مِائَةٍ مِنَ الإِبِلِ يُصِيبُ كُلُّ رَجُلٍ بَعِيرَانِ فَهَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلاَ تُصْبِرْ يَمِينِي حَيْثُ تُصْبَرُ الأَيْمَانُ فَقَبِلَهُمَا وَجَاءَ ثَمَانِيَةٌ وَأَرْبَعُونَ رَجُلاً حَلَفُوا قَالَ ابْنُ عَبَّاسٍ فَوَالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنَ الثَّمَانِيَةِ وَالأَرْبَعِينَ عَيْنٌ تَطْرِفُ

Abu Bakr bought a saddle from ‘Azib for thirteen dirhams, then Abu Bakr said to 'Azib. Tell al-Bara to carry it to my house. He said: No, not until you tell us what happened when the Messenger of Allah ﷺ went out and you were with him. Abu Bakr said: We started our journey at the beginning of the night and we hastened for one day and one night, until it was midday. I looked into the distance to see whether there was anywhere to seek shade, and I saw a rock, so I went to it and it had a little shade. I smoothed the ground for the Messenger of Allah ﷺ and spread a garment of camel hair for him, and said: Lie down and rest, O Messenger of Allah. So he lay down, and I went out to see if I could spot anyone looking for us. Then I saw a shepherd and I said: Who do you belong to, O boy? He said: To a man of Quraish. He mentioned his name and I recognised it. I said: Is there any milk in your sheep? He said: Yes | said: Will you milk some for me? He said: Yes. I told him to do that, so he caught a sheep, then I told him to brush the dust from its teat, then to brush the dust off his hands. I had a small vessel with me on the neck of which was a cloth. He milked a little bit of milk for me and I poured it into the vessel until it cooled down. Then I came to the Messenger of Allah ﷺ. When I reached him, he had already woken up. I said: Drink, O Messenger of Allah. He drank until I was pleased, then I said: Is it time to move on? So we moved on and the people were coming after us but none of them caught up with us except Suraqah bin Malik bin Ju'shum, who was riding a horse of his, I said: O Messenger of Allah, someone has caught up with us. He said: ʿDo not be afraid, for Allah is with us.ʿ When he got close to us, and there was no more between us and him then the length of a spear or two or three spears, I said: O Messenger of Allah, this pursuer has caught up with us, and I wept. He said: ʿWhy are you weeping?ʿ I said: I am not weeping for myself; rather I am weeping for you. The Messenger of Allah ﷺ prayed against him [the pursuer] and said: “O Allah, protect us from him by whatever means You will.” Then his horse's legs sank into the solid ground up to its belly, and he fell off it. He said: O Muhammad, I know that this is because of you; pray to Allah to save me from my predicament, and by Allah I shall divert away from you any one who is behind me of those who are seeking you. Here is my quiver, take one arrow. You are going to pass by some camels and sheep of mine in such and such a place, take whatever you need from thern. The Messenger of Allah ﷺ said: ʿI have no need of it.“ The Messenger of Allah ﷺ prayed for him and he was released, and he went back to his companions. The Messenger of Allah ﷺ and I continued on our way until we came to Madinah, where the people met him. They came out on the road and on the roofs, and a lot of servants and children crowded the road saying: Allahu Akbar, the Messenger of Allah ﷺ has come, Muhammad has come. The people disputed as to who he would stay with. The Messenger of Allah ﷺ said: ʿTonight I will stay with Banun-Najjar, the maternal uncles of 'Abdul-Muttalib, to honour them thereby.” The next morning, he went where he was instructed. Al-Bara' bin 'Azib said: The first of the Muhajireen to come to us was Mus'ab bin 'Umair, the brother of Banu 'Abdud-Dar. Then Ibn Umm Maktoom, the blind man and brother of Banu Fihr, came to us. Then 'Umar bin al-Khattab, came to us with twenty riders and we said: What happened to the Messenger of Allah ﷺ? He said: He is behind me. Then the Messenger of Allah ﷺ came and Abu Bakr was with him. Al-Bara said: the Messenger of Allah ﷺ did not come until I had read some soorahs from al-Mufassal [Al-Mufassal is that portion of the Qur'an which goes from Qaf to an-Nas]. Isra'eel said: al-Bara' was one of the Ansar from Banu Harithah.  

أحمد:٣حَدَّثَنَا عَمْرُو بْنُ مُحَمَّدٍ أَبُو سَعِيدٍ يَعْنِي الْعَنْقَزِيَّ قَالَ حَدَّثَنَا إِسْرَائِيلُ عَنْ أَبِي إِسْحَاقَعَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ

اشْتَرَى أَبُو بَكْرٍ مِنْ عَازِبٍ سَرْجًا بِثَلاثَةَ عَشَرَ دِرْهَمًا قَالَ فَقَالَ أَبُو بَكْرٍ لِعَازِبٍ مُرِ الْبَرَاءَ فَلْيَحْمِلْهُ إِلَى مَنْزِلِي فَقَالَ لَا حَتَّى تُحَدِّثَنَا كَيْفَ صَنَعْتَ حِينَ خَرَجَ رَسُولُ اللهِ ﷺ وَأَنْتَ مَعَهُ؟قَالَ فَقَالَ أَبُو بَكْرٍ خَرَجْنَا فَأَدْلَجْنَا فَأَحْثَثْنَا يَوْمَنَا وَلَيْلَتَنَا حَتَّى أَظْهَرْنَا وَقَامَ قَائِمُ الظَّهِيرَةِ فَضَرَبْتُ بِبَصَرِي هَلْ أَرَى ظِلًّا نَأْوِي إِلَيْهِ؟ فَإِذَا أَنَا بِصَخْرَةٍ فَأَهْوَيْتُ إِلَيْهَا فَإِذَا بَقِيَّةُ ظِلِّهَا فَسَوَّيْتُهُ لِرَسُولِ اللهِ ﷺ وَفَرَشْتُ لَهُ فَرْوَةً وَقُلْتُ اضْطَجِعْ يَا رَسُولَ اللهِ فَاضْطَجَعَ ثُمَّ خَرَجْتُ أَنْظُرُ هَلْ أَرَى أَحَدًا مِنَ الطَّلَبِ؟ فَإِذَا أَنَا بِرَاعِي غَنَمٍ فَقُلْتُ لِمَنْ أَنْتَ يَا غُلامُ؟ فَقَالَ لِرَجُلٍ مِنْ قُرَيْشٍ فَسَمَّاهُ فَعَرَفْتُهُ فَقُلْتُ هَلْ فِي غَنَمِكَ مِنْ لَبَنٍ؟ قَالَ نَعَمْ قَالَ قُلْتُ هَلْ أَنْتَ حَالِبٌ لِي؟ قَالَ نَعَمْ قَالَ فَأَمَرْتُهُ فَاعْتَقَلَ شَاةً مِنْهَا ثُمَّ أَمَرْتُهُ فَنَفَضَ ضَرْعَهَا مِنَ الْغُبَارِ ثُمَّ أَمَرْتُهُ فَنَفَضَ كَفَّيْهِ مِنَ الْغُبَارِ وَمَعِي إِدَاوَةٌ عَلَى فَمِهَا خِرْقَةٌ فَحَلَبَ لِي كُثْبَةً مِنَ اللَّبَنِ فَصَبَبْتُ عَلَى الْقَدَحِ حَتَّى بَرَدَ أَسْفَلُهُ ثُمَّ أَتَيْتُ رَسُولَ اللهِ ﷺفَوَافَيْتُهُ وَقَدِ اسْتَيْقَظَ فَقُلْتُ اشْرَبْ يَا رَسُولَ اللهِ فَشَرِبَ حَتَّى رَضِيتُ ثُمَّ قُلْتُ هَلْ أَنَى الرَّحِيلُ قَالَ فَارْتَحَلْنَا وَالْقَوْمُ يَطْلُبُونَا فَلَمْ يُدْرِكْنَا أَحَدٌ مِنْهُمْ إِلَّا سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ عَلَى فَرَسٍ لَهُ فَقُلْتُ يَا رَسُولَ اللهِ هَذَا الطَّلَبُ قَدْ لَحِقَنَا فَقَالَ لَا تَحْزَنْ إِنَّ اللهَ مَعَنَا حَتَّى إِذَا دَنَا مِنَّا فَكَانَ بَيْنَنَا وَبَيْنَهُ قَدْرُ رُمْحٍ أَوْ رُمْحَيْنِ أَوْ ثَلاثَةٍ قَالَ قُلْتُ يَا رَسُولَ اللهِ هَذَا الطَّلَبُ قَدْ لَحِقَنَا وَبَكَيْتُ قَالَ لِمَ تَبْكِي؟ قَالَ قُلْتُ أَمَا وَاللهِ مَا عَلَى نَفْسِي أَبْكِي وَلَكِنْ أَبْكِي عَلَيْكَ قَالَ فَدَعَا عَلَيْهِ رَسُولُ اللهِ ﷺ فَقَالَ اللهُمَّ اكْفِنَاهُ بِمَا شِئْتَ فَسَاخَتْ قَوَائِمُ فَرَسِهِ إِلَى بَطْنِهَا فِي أَرْضٍ صَلْدٍ وَوَثَبَ عَنْهَا وَقَالَ يَا مُحَمَّدُ قَدْ عَلِمْتُ أَنَّ هَذَا عَمَلُكَ فَادْعُ اللهَ أَنْ يُنْجِّيَنِي مِمَّا أَنَا فِيهِ فَوَاللهِ لَأُعَمِّيَنَّ عَلَى مَنْ وَرَائِي مِنَ الطَّلَبِ وَهَذِهِ كِنَانَتِي فَخُذْ مِنْهَا سَهْمًا فَإِنَّكَ سَتَمُرُّ بِإِبِلِي وَغَنَمِي فِي مَوْضِعِ كَذَا وَكَذَا فَخُذْ مِنْهَا حَاجَتَكَ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ لَا حَاجَةَ لِي فِيهَا قَالَ وَدَعَا لَهُ رَسُولُ اللهِ ﷺ فَأُطْلِقَ فَرَجَعَ إِلَى أَصْحَابِهِوَمَضَى رَسُولُ اللهِ ﷺ وَأَنَا مَعَهُ حَتَّى قَدِمْنَا الْمَدِينَةَ فَتَلَقَّاهُ النَّاسُ فَخَرَجُوا فِي الطَّرِيقِ وَعَلَى الْأَجَاجِيرِ فَاشْتَدَّ الْخَدَمُ وَالصِّبْيَانُ فِي الطَّرِيقِ يَقُولُونَ اللهُ أَكْبَرُ جَاءَ رَسُولُ اللهِ ﷺ جَاءَ مُحَمَّدٌ قَالَ وَتَنَازَعَالْقَوْمُ أَيُّهُمْ يَنْزِلُ عَلَيْهِ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ أَنْزِلُ اللَّيْلَةَ عَلَى بَنِي النَّجَّارِ أَخْوَالِ عَبْدِ الْمُطَّلِبِ لِأُكْرِمَهُمْ بِذَلِكَ فَلَمَّا أَصْبَحَ غَدَا حَيْثُ أُمِرَقَالَ الْبَرَاءُ بْنُ عَازِبٍ أَوَّلُ مَنْ كَانَ قَدِمَ عَلَيْنَا مِنَ الْمُهَاجِرِينَ مُصْعَبُ بْنُ عُمَيْرٍ أَخُو بَنِي عَبْدِ الدَّارِ ثُمَّ قَدِمَ عَلَيْنَا ابْنُ أُمِّ مَكْتُومٍ الْأَعْمَى أَخُو بَنِي فِهْرٍ ثُمَّ قَدِمَ عَلَيْنَا عُمَرُ بْنُ الْخَطَّابِ فِي عِشْرِينَ رَاكِبًا فَقُلْنَا مَا فَعَلَ رَسُولُ اللهِ ﷺ؟ فَقَالَ هُوَ عَلَى أَثَرِي ثُمَّ قَدِمَ رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ مَعَهُقَالَ الْبَرَاءُ وَلَمْ يَقْدَمْ رَسُولُ اللهِ ﷺ حَتَّى قَرَأْتُ سُوَرًا مِنَ الْمُفَصَّلِ قَالَ إِسْرَائِيلُ وَكَانَ الْبَرَاءُ مِنَ الْأَنْصَارِ مِنْ بَنِي حَارِثَةَ

I met Bilal, the Mu'adhdhin of the Messenger of Allah ﷺ at Aleppo, and said: Bilal, tell me, what was the financial position of the Messenger of Allah ﷺ? He said: He had nothing. It was I who managed it on his behalf since the day Allah made him Prophet of Allah ﷺ until he died. When a Muslim man came to him and he found him naked, he ordered me (to clothe him). I would go, borrow (some money), and purchase a cloak for him. I would then clothe him and feed him. A man from the polytheists met me and said: I am well off, Bilal. Do not borrow money from anyone except me. So I did accordingly. One day when I performed ablution and stood up to make call to prayer, the same polytheist came along with a body of merchants. When he saw me, he said: O Abyssinian. I said: I am at your service. He met me with unpleasant looks and said harsh words to me. He asked me: Do you know how many days remain in the completion of this month? I replied: The time is near. He said: Only four days remain in the completion of this month. I shall then take that which is due from you (i.e. loan), and then shall return you to tend the sheep as you did before. I began to think in my mind what people think in their minds (on such occasions). When I offered the night prayer, the Messenger of Allah ﷺ returned to his family. I sought permission from him and he gave me permission. I said: Messenger of Allah, may my parents be sacrificed for you, the polytheist from whom I used to borrow money said to me such-and-such. Neither you nor I have anything to pay him for me, and he will disgrace me. So give me permission to run away to some of those tribes who have recently embraced Islam until Allah gives His Apostle ﷺ something with which he can pay (the debt) for me. So I came out and reached my house. I placed my sword, waterskin (or sheath), shoes and shield near my head. When dawn broke, I intended to be on my way. All of a sudden I saw a man running towards me and calling: Bilal, return to the Messenger of Allah ﷺ. So I went till I reached him. I found four mounts kneeling on the ground with loads on them. I sought permission. The Messenger of Allah ﷺ said to me: Be glad, Allah has made arrangements for the payment (of your debt). He then asked: Have you not seen the four mounts kneeling on the ground? I replied: Yes. He said: You may have these mounts and what they have on them. There are clothes and food on them, presented to me by the ruler of Fadak. Take them away and pay off your debt. I did so. He then mentioned the rest of the tradition. I then went to the mosque and found that the Messenger of Allah ﷺ was sitting there. I greeted him. He asked: What benefit did you have from your property? I replied: Allah Most High paid everything which was due from the Messenger of Allah ﷺ. Nothing remains now. He asked: Did anything remain (from that property)? I said: Yes. He said: Look, if you can give me some comfort from it, for I shall not visit any member of my family until you give me some comfort from it. When the Messenger of Allah ﷺ offered the night prayer, he called me and said: What is the position of that which you had with you (i.e. property)? I said: I still have it, no one came to me. The Messenger of Allah ﷺ passed the night in the mosque. He then narrated the rest of the tradition. Next day when he offered the night prayer, he called me and asked: What is the position of that which you had (i.e. the rest of the property)? I replied: Allah has given you comfort from it, Messenger of Allah. He said: Allah is Most Great, and praised Allah, fearing lest he should die while it was with him. I then followed him until he came to his wives and greeted each one of them and finally he came to his place where he had to pass the night. This is all for which you asked me. لَقِيتُ بِلَالًا مُؤَذِّنَ النَّبِيِّ ﷺ بِحَلَبَ فَقُلْتُ يَا بِلَالُ حَدِّثْنِي كَيْفَ كَانَتْ نَفَقَةُ النَّبِيِّ ﷺ؟ فَقَالَ مَا كَانَ لَهُ شَيْءٌ إِلَّا أَنَا الَّذِي كُنْتُ أَلِي ذَلِكَ مِنْهُ مُنْذُ بَعَثَهُ اللهُ إِلَى أَنْ تُوُفِّيَ فَكَانَ إِذَا أَتَاهُ الْإِنْسَانُ الْمُسْلِمُ فَرَآهُ عَارِيًا يَأْمُرُنِي فَأَنْطَلِقُ فَأَسْتَقْرِضُ فَأَشْتَرِيَ الْبُرْدَةَ وَالشَّيْءَ فَأَكْسُوَهُ وَأُطْعِمَهُ حَتَّى اعْتَرَضَنِي رَجُلٌ مِنَ الْمُشْرِكِينَ فَقَالَ يَا بِلَالُ إِنَّ عِنْدِي سَعَةً فَلَا تَسْتَقْرِضْ مِنْ أَحَدٍ إِلَّا مِنِّي فَفَعَلْتُ فَلَمَّا كَانَ ذَاتَ يَوْمٍ تَوَضَّأْتُ ثُمَّ قُمْتُ لِأُؤَذِّنَ بِالصَّلَاةِ فَإِذَا الْمُشْرِكُ فِي عِصَابَةٍ مِنَ التُّجَّارِ فَلَمَّا رَآنِي قَالَ يَا حَبَشِيُّ قَالَ قُلْتُ يَا لَبَيَّهِ فَتَجَهَّمَنِي وَقَالَ قَوْلًا غَلِيظًا فَقَالَ أَتَدْرِي كَمْ بَيْنَكَ وَبَيْنَ الشَّهْرِ؟ قَالَ قُلْتُ قَرِيبٌ قَالَ إِنَّمَا بَيْنَكَ وَبَيْنَهُ أَرْبَعُ لَيَالٍ فَآخُذُكَ بِالَّذِي لِي عَلَيْكَ فَإِنِّي لَمْ أُعْطِكَ الَّذِي أَعْطَيْتُكَ مِنْ كَرَامَتِكَ وَلَا مِنْ كَرَامَةِ صَاحِبِكَ وَلَكِنْ أَعْطَيْتُكَ لِتَجِبَ لِي عَبْدًا؛ فَأَرُدُّكَ تَرْعَى الْغَنَمَ كَمَا كُنْتَ قَبْلَ ذَلِكَ فَأَخَذَ فِي نَفْسِي مَا يَأْخُذُ فِي أَنْفُسِ النَّاسِ فَانْطَلَقْتُ ثُمَّ أَذَّنْتُ بِالصَّلَاةِ حَتَّى إِذَا صَلَّيْتُ الْعَتَمَةَ رَجَعَ النَّبِيُّ ﷺ إِلَى أَهْلِهِ فَاسْتَأْذَنْتُ عَلَيْهِ فَأَذِنَ لِي فَقُلْتُ يَا رَسُولَ اللهِ بِأَبِي أَنْتَ وَأُمِّي إِنَّ الْمُشْرِكَ الَّذِي ذَكَرْتُ لَكَ أَنِّي كُنْتُ أَتَدَيَّنُ مِنْهُ قَدْ قَالَ كَذَا وَكَذَا وَلَيْسَ عِنْدَكَ مَا تَقْضِي عَنِّي وَلَا عِنْدِي وَهُوَ فَاضِحِي فَأَذِنَ لِي أَنْ آتِيَ إِلَى بَعْضِ هَؤُلَاءِ الْأَحْيَاءِ الَّذِينَ قَدْ أَسْلَمُوا حَتَّى يَرْزُقَ اللهُ رَسُولَهُ ﷺ مَا يَقْضِي عَنِّي فَخَرَجْتُ حَتَّى أَتَيْتُ مَنْزِلِي فَجَعَلْتُ سَيْفِي وَجِرَابِي وَرُمْحِي وَنَعْلِي عِنْدَ رَأْسِي وَاسْتَقْبَلْتُ بِوَجْهِيَ الْأُفُقَ فَكُلَّمَا نِمْتُ انْتَبَهْتُ فَإِذَا رَأَيْتُ عَلَيَّ لَيْلًا نِمْتُ حَتَّى انْشَقَّ عَمُودُ الصُّبْحِ الْأَوَّلِ فَأَرَدْتُ أَنْ أَنْطَلِقَ فَإِذَا إِنْسَانٌ يَسْعَى يَدْعُو يَا بِلَالُ أَجِبْ رَسُولَ اللهِ ﷺ فَانْطَلَقْتُ حَتَّى أَتَيْتُهُ فَإِذَا أَرْبَعُ رَكَائِبَ عَلَيْهِنَّ أَحْمَالُهُنَّ فَأَتَيْتُ النَّبِيَّ ﷺ فَاسْتَأْذَنْتُ فَقَالَ لِيَ النَّبِيُّ ﷺ أَبْشِرْ؛ فَقَدْ جَاءَكَ اللهُ بِقَضَائِكَ فَحَمِدْتُ اللهَ وَقَالَ أَلَمْ تَمُرَّ عَلَى الرَّكَائِبِ الْمُنَاخَاتِ الْأَرْبَعِ؟ قَالَ فَقُلْتُ بَلَى قَالَ فَإِنَّ لَكَ رِقَابَهُنَّ وَمَا عَلَيْهِنَّ وَإِذَا عَلَيْهِنَّ كِسْوَةٌ وَطَعَامٌ أَهْدَاهُنَّ لَهُ عَظِيمُ فَدَكٍ فَاقْبِضْهُنَّ إِلَيْكَ ثُمَّ اقْضِ دَيْنَكَ قَالَ فَفَعَلْتُ فَحَطَطْتُ عَنْهُنَّ أَحْمَالَهُنَّ ثُمَّ عَقَلْتُهُنَّ ثُمَّ عَمَدْتُ إِلَى تَأْذِينِ صَلَاةِ الصُّبْحِ حَتَّى إِذَا صَلَّى رَسُولُ اللهِ ﷺ خَرَجْتُ إِلَى الْبَقِيعِ فَجَعَلْتُ أُصْبُعِي فِي أُذُنِي فَنَادَيْتُ وَقُلْتُ مَنْ كَانَ يَطْلُبُ رَسُولَ اللهِ ﷺ دَيْنًا فَلْيَحْضُرْ فَمَا زِلْتُ أَبِيعُ وَأَقْضِي وَأَعْرِضُ وَأَقْضِي حَتَّى لَمْ يَبْقَ عَلَى رَسُولِ اللهِ ﷺ دَيْنٌ فِي الْأَرْضِ حَتَّى فَضُلَ عِنْدِي أُوقِيَّتَانِ أَوْ أُوقِيَّةٌ وَنِصْفٌ ثُمَّ انْطَلَقْتُ إِلَى الْمَسْجِدِ وَقَدْ ذَهَبَ عَامَّةُ النَّهَارِ فَإِذَا رَسُولُ اللهِ ﷺ قَاعِدٌ فِي الْمَسْجِدِ وَحْدَهُ فَسَلَّمْتُ عَلَيْهِ فَقَالَ لِي مَا فَعَلَ مَا قِبَلَكَ؟ قَالَ قُلْتُ قَدْ قَضَى اللهُ كُلَّ شَيْءٍ كَانَ عَلَى رَسُولِ اللهِ ﷺ فَلَمْ يَبْقَ شَيْءٌ فَقَالَ فَضُلَ شَيْءٌ؟ قُلْتُ نَعَمْ دِينَارَانِ قَالَ انْظُرْ أَنْ تُرِيحَنِي مِنْهُمَا فَلَسْتُ بِدَاخِلٍ عَلَى أَحَدٍ مِنْ أَهْلِي حَتَّى تُرِيحَنِي مِنْهُمَا فَلَمْ يَأْتِنَا فَبَاتَ فِي الْمَسْجِدِ حَتَّى أَصْبَحَ وَظَلَّ فِي الْمَسْجِدِ الْيَوْمَ الثَّانِي حَتَّى كَانَ فِي آخِرِ النَّهَارِ جَاءَ رَاكِبَانِ فَانْطَلَقْتُ بِهِمَا فَكَسَوْتُهُمَا وَأَطْعَمْتُهُمَا حَتَّى إِذَا صَلَّى الْعَتَمَةَ دَعَانِي فَقَالَ مَا فَعَلَ الَّذِي قِبَلَكَ؟ قُلْتُ قَدْ أَرَاحَكَ اللهُ مِنْهُ فَكَبَّرَ وَحَمِدَ اللهَ شَفَقًا مِنْ أَنْ يُدْرِكَهُ الْمَوْتُ وَعِنْدَهُ ذَلِكَ ثُمَّ اتَّبَعْتُهُ حَتَّى جَاءَ أَزْوَاجَهُ فَسَلَّمَ عَلَى امْرَأَةٍ امْرَأَةٍ حَتَّى أَتَى فِي مَبِيتِهِ فَهَذَا الَّذِي سَأَلْتَنِي عَنْهُ

Once ʿUmar bin ʿAbdul ʿAziz sat on his throne in the courtyard of his house so that the people might gather before him. Then he admitted them and (when they came in), he said, "What do you think of Al-Qasama?" They said, "We say that it is lawful to depend on Al-Qasama in Qisas, as the previous Muslim Caliphs carried out Qisas depending on it." Then he said to me, "O Abu Qilaba! What do you say about it?" He let me appear before the people and I said, "O Chief of the Believers! You have the chiefs of the army staff and the nobles of the Arabs. If fifty of them testified that a married man had committed illegal sexual intercourse in Damascus but they had not seen him (doing so), would you stone him?" He said, "No." I said, "If fifty of them testified that a man had committed theft in Hums, would you cut off his hand though they did not see him?" He replied, "No." I said, "By Allah, Messenger of Allah ﷺ never killed anyone except in one of the following three situations: (1) A person who killed somebody unjustly, was killed (in Qisas,) (2) a married person who committed illegal sexual intercourse and (3) a man who fought against Allah and His Apostle and deserted Islam and became an apostate." Then the people said, "Didn't Anas bin Malik narrate that Messenger of Allah ﷺ cut off the hands of the thieves, branded their eyes and then, threw them in the sun?" I said, "I shall tell you the narration of Anas. Anas said: "Eight persons from the tribe of ʿUkl came to Messenger of Allah ﷺ and gave the Pledge of allegiance for Islam (became Muslim). The climate of the place (Medina) did not suit them, so they became sick and complained about that to Messenger of Allah ﷺ. He said (to them ), "Won't you go out with the shepherd of our camels and drink of the camels' milk and urine (as medicine)?" They said, "Yes." So they went out and drank the camels' milk and urine, and after they became healthy, they killed the shepherd of Messenger of Allah ﷺ and took away all the camels. This news reached Messenger of Allah ﷺ , so he sent (men) to follow their traces and they were captured and brought (to the Prophet). He then ordered to cut their hands and feet, and their eyes were branded with heated pieces of iron, and then he threw them in the sun till they died." I said, "What can be worse than what those people did? They deserted Islam, committed murder and theft." Then 'Anbasa bin Saʿid said, "By Allah, I never heard a narration like this of today." I said, "O 'Anbasa! You deny my narration?" 'Anbasa said, "No, but you have related the narration in the way it should be related. By Allah, these people are in welfare as long as this Sheikh (Abu Qilaba) is among them." I added, "Indeed in this event there has been a tradition set by Messenger of Allah ﷺ. The narrator added: Some Ansari people came to the Prophet ﷺ and discussed some matters with him, a man from amongst them went out and was murdered. Those people went out after him, and behold, their companion was swimming in blood. They returned to Messenger of Allah ﷺ and said to him, "O Allah's Apostle, we have found our companion who had talked with us and gone out before us, swimming in blood (killed)." Messenger of Allah ﷺ went out and asked them, "Whom do you suspect or whom do you think has killed him?" They said, "We think that the Jews have killed him." The Prophet ﷺ sent for the Jews and asked them, "Did you kill this (person)?" They replied, "No." He asked the Al-Ansars, "Do you agree that I let fifty Jews take an oath that they have not killed him?" They said, "It matters little for the Jews to kill us all and then take false oaths." He said, "Then would you like to receive the Diya after fifty of you have taken an oath (that the Jews have killed your man)?" They said, "We will not take the oath." Then the Prophet ﷺ himself paid them the Diya (Blood-money)." The narrator added, "The tribe of Hudhail repudiated one of their men (for his evil conduct) in the Pre-lslamic period of Ignorance. Then, at a place called Al-Batha' (near Mecca), the man attacked a Yemenite family at night to steal from them, but a. man from the family noticed him and struck him with his sword and killed him. The tribe of Hudhail came and captured the Yemenite and brought him to ʿUmar during the Hajj season and said, "He has killed our companion." The Yemenite said, "But these people had repudiated him (i.e., their companion)." ʿUmar said, "Let fifty persons of Hudhail swear that they had not repudiated him." So forty-nine of them took the oath and then a person belonging to them, came from Sham and they requested him to swear similarly, but he paid one-thousand Dirhams instead of taking the oath. They called another man instead of him and the new man shook hands with the brother of the deceased. Some people said, "We and those fifty men who had taken false oaths (Al-Qasama) set out, and when they reached a place called Nakhlah, it started raining so they entered a cave in the mountain, and the cave collapsed on those fifty men who took the false oath, and all of them died except the two persons who had shaken hands with each other. They escaped death but a stone fell on the leg of the brother of the deceased and broke it, whereupon he survived for one year and then died." I further said, "ʿAbdul Malik bin Marwan sentenced a man to death in Qisas (equality in punishment) for murder, basing his judgment on Al-Qasama, but later on he regretted that judgment and ordered that the names of the fifty persons who had taken the oath (Al-Qasama), be erased from the register, and he exiled them in Sham." مَا تَقُولُ يَا أَبَا قِلَابَةَ؟ وَنَصَبَنِي لِلنَّاسِ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ عِنْدَكَ رُءُوسُ الْأَجْنَادِ وَأَشْرَافُ الْعَرَبِ أَرَأَيْتَ لَوْ أَنَّ خَمْسِينَ مِنْهُمْ شَهِدُوا عَلَى رَجُلٍ بِدِمَشْقَ مُحْصَنٍ أَنَّهُ قَدْ زَنَى لَمْ يَرَوْهُ أَكُنْتَ تَرْجُمُهُ؟ قَالَ لَا قُلْتُ أفَرَأَيْتَ لَوْ أَنَّ خَمْسِينَ مِنْهُمْ شَهِدُوا عَلَى رَجُلٍ بِحِمْصَ أَنَّهُ سَرَقَ لَمْ يَرَوْهُ أَكُنْتَ تَقْطَعُهُ؟ قَالَ لَا قُلْتُ فَوَاللهِ مَا قَتَلَ رَسُولُ اللهِ ﷺ أَحَدًا قَطُّ إِلَّا فِي إِحْدَى ثَلَاثِ خِصَالٍ رَجُلٌ قَتَلَ بِجَرِيرَةِ نَفْسِهِ يُقْتَلُ أَوْ رَجُلٌ زَنَى بَعْدَ إِحْصَانٍ أَوْ رَجُلٌ حَارَبَ اللهَ وَرَسُولَهُ وَارْتَدَّ عَنِ الْإِسْلَامِ قَالَ فَقَالَ الْقَوْمُ أَوَلَيْسَ قَدْ حَدَّثَ أَنَسُ بْنُ مَالِكٍ أَنَّ رَسُولَ اللهِ ﷺ قَطَعَ فِي السَّرَقِ وَسَمَرَ الْأَعْيُنَ وَنَبَذَهُمْ فِي الشَّمْسِ حَتَّى مَاتُوا؟ فَقُلْتُ أَنَا أُحَدِّثُكُمْ حَدِيثَ أَنَسِ بْنِ مَالِكٍ إِيَّايَ حَدَّثَ أَنَسُ بْنُ مَالِكٍ أَنَّ نَفَرًا مِنْ عُكْلٍ ثَمَانِيَةً قَدِمُوا عَلَى رَسُولِ اللهِ ﷺ فَبَايَعُوهُ عَلَى الْإِسْلَامِ وَاسْتَوْخَمُوا الْأَرْضَ وَسَقَمَتْ أَجْسَادُهُمْ فَشَكَوْا ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَلَا تَخْرُجُونَ مَعَ رَاعِينَا فِي إِبِلِهِ فَتُصِيبُونَ مِنْ أَبْوَالِهَا وَأَلْبَانِهَا؟ قَالُوا بَلَى فَخَرَجُوا فَشَرِبُوا مِنْ أَبْوَالِهَا وَأَلْبَانِهَا فَصَحُّوا وَقَتَلُوا الرَّاعِيَ وَاطَّرَدُوا النَّعَمَ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَبَعَثَ فِي آثَارِهِمْ فَأُدْرِكُوا فَجِيءَ بِهِمْ فَأَمَرَ بِهِمْ فَقُطِعَتْ أَيْدِيهِمْ وَأَرْجُلُهُمْ وَسُمِرَتْ أَعْيُنُهُمْ وَنُبِذُوا فِي الشَّمْسِ حَتَّى مَاتُوا قُلْتُ وَأِيُّ شَيْءٍ أَشَدُّ مِمَّا صَنَعَ هَؤُلَاءِ ارْتَدُّوا عَنِ الْإِسْلَامِ وَقَتَلُوا وَسَرَقُوا فَقَالَ عَنْبَسَةُ بْنُ سَعِيدٍ وَاللهِ إِنْ سَمِعْتُ كَالْيَوْمِ قَطُّ قُلْتُ تَرُدُّ عَلَيَّ حَدِيثِي يَا عَنْبَسَةُ؟ فَقَالَ لَا وَلَكِنْ جِئْتَ بِالْحَدِيثِ عَلَى وَجْهِهِ وَاللهِ لَا يَزَالُ هَذَا الْجُنْدُ بِخَيْرٍ مَا عَاشَ هَذَا الشَّيْخُ بَيْنَ أَظْهُرِهِمْ قُلْتُ وَقَدْ كَانَ فِي هَذَا سُنَّةٌ مِنْ رَسُولِ اللهِ ﷺ دَخَلَ عَلَيْهِ نَفَرٌ مِنَ الْأَنْصَارِ فَتَحَدَّثُوا عِنْدَهُ فَخَرَجَ رَجُلٌ مِنْهُمْ بَيْنَ أَيْدِيهِمْ فَقُتِلَ فَخَرَجُوا بَعْدَهُ فَإِذَا هُمْ بِصَاحِبِهِمْ يَتَشَحَّطُ فِي الدَّمِ فَرَجَعُوا إِلَى رَسُولِ اللهِ ﷺ فَقَالُوا يَا رَسُولَ اللهِ صَاحِبُنَا كَانَ يَتَحَدَّثُ مَعَنَا فَخَرَجَ بَيْنَ أَيْدِينَا فَإِذَا نَحْنُ بِهِ يَتَشَحَّطُ فِي الدَّمِ فَخَرَجَ رَسُولُ اللهِ ﷺ فَقَالَ بِمَنْ تَظُنُّونَ أَوْ مَنْ تَرَوْنَ قَتَلَهُ؟ قَالُوا نَرَى أَنَّ الْيَهُودَ قَتَلَتْهُ فَأَرْسَلَ إِلَى الْيَهُودِ فَدَعَاهُمْ فَقَالَ أَنْتُمْ قَتَلْتُمْ هَذَا؟ قَالُوا لَا قَالَ أَتَرْضَوْنَ نَفْلَ خَمْسِينَ مِنَ الْيَهُودِ مَا قَتَلُوهُ؟ فَقَالُوا مَا يُبَالُونَ أَنْ يَقْتُلُونَا أَجْمَعِينَ ثُمَّ يَنْفُلُونَ قَالَ أَفَتَسْتَحِقُّونَ الدِّيَةِ بِأَيْمَانِ خَمْسِينَ مِنْكُمْ؟ قَالُوا مَا كُنَّا لِنَحْلِفَ فَوَدَاهُ مِنْ عِنْدِهِ قُلْتُ وَقَدْ كَانَتْ هُذَيْلٌ خَلَعُوا خَلِيعًا لَهُمْ فِي الْجَاهِلِيَّةِ فَطَرَقَ أَهْلَ بَيْتٍ مِنَ الْيَمَنِ بِالْبَطْحَاءِ فَانْتَبَهَ لَهُ رَجُلٌ مِنْهُمْ فَحَذَفَهُ بِالسَّيْفِ فَقَتَلَهُ فَجَاءَتْ هُذَيْلٌ فَأَخَذُوا الْيَمَانِيَّ فَرَفَعُوهُ إِلَى عُمَرَ ؓ بِالْمَوْسِمِ وَقَالُوا قَتَلَ صَاحِبَنَا فَقَالَ إِنَّهُمْ قَدْ خَلَعُوهُ فَقَالَ يُقْسِمُ خَمْسُونَ مِنْ هُذَيْلٍ مَا خَلَعُوا قَالَ فَأَقْسَمَ مِنْهُمْ تِسْعَةٌ وَأَرْبَعُونَ رَجُلًا وَقَدِمَ رَجُلٌ مِنْهُمْ مِنَ الشَّامِ فَسَأَلُوهُ أَنْ يُقْسِمَ فَافْتَدَى يَمِينَهُ مِنْهُمْ بِأَلْفِ دِرْهَمٍ فَأَدْخَلُوا مَكَانَهُ رَجُلًا آخَرَ فَدَفَعَهُ إِلَى أَخِي الْمَقْتُولِ فَقُرِنَتْ يَدُهُ بِيَدِهِ قَالَ فَانْطَلَقَا وَالْخَمْسُونَ الَّذِينَ أَقْسَمُوا حَتَّى إِذَا كَانُوا بِنَخْلَةٍ أَخَذَتْهُمُ السَّمَاءُ فَدَخَلُوا فِي غَارٍ فِي الْجَبَلِ فَانْهَجَمَ الْغَارُ عَلَى الْخَمْسِينَ الَّذِينَ أَقْسَمُوا فَمَاتُوا جَمِيعًا وَأَفْلَتَ الْقَرِينَانِ وَاتَّبَعَهُمَا حَجَرٌ فَكَسَرَ رِجْلَ أَخِي الْمَقْتُولِ فَعَاشَ حَوْلًا ثُمَّ مَاتَ قُلْتُ وَقَدْ كَانَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ أَقَادَ رَجُلًا بِالْقَسَامَةِ ثُمَّ نَدِمَ بَعْدَمَا صَنَعَ فَأَمَرَ بِالْخَمْسِينَ الَّذِينَ أَقْسَمُوا فَمُحُوا مِنَ الدِّيوَانِ وَسَيَّرَهُمْ إِلَى الشَّامِ

The first event of Qasama in the pre-lslamic period of ignorance was practiced by us (i.e. Banu Hashim). A man from Banu Hashim was employed by a Quraishi man from another branch-family. The (Hashimi) laborer set out with the Quraishi driving his camels. There passed by him another man from Banu Hashim. The leather rope of the latter's bag had broken so he said to the laborer, "Will you help me by giving me a rope in order to tie the handle of my bag lest the camels should run away from me?" The laborer gave him a rope and the latter tied his bag with it. When the caravan halted, all the camels' legs were tied with their fetters except one camel. The employer asked the laborer, "Why, from among all the camels has this camel not been fettered?" He replied, "There is no fetter for it." The Quraishi asked, "Where is its fetter?" and hit the laborer with a stick that caused his death (later on Just before his death) a man from Yemen passed by him. The laborer asked (him), "Will you go for the pilgrimage?" He replied, "I do not think I will attend it, but perhaps I will attend it." The (Hashimi) laborer said, "Will you please convey a message for me once in your life?" The other man said, "yes." The laborer wrote: 'When you attend the pilgrimage, call the family of Quraish, and if they respond to you, call the family of Banu Hashim, and if they respond to you, ask about Abu Talib and tell him that so-and-so has killed me for a fetter." Then the laborer expired. When the employer reached (Mecca), Abu Talib visited him and asked, "What has happened to our companion?" He said, "He became ill and I looked after him nicely (but he died) and I buried him." Then Abu Talib said, "The deceased deserved this from you." After some time, the messenger whom the laborer has asked to convey the message, reached during the pilgrimage season. He called, "O the family of Quraish!" The people replied, "This is Quraish." Then he called, "O the family of Banu Hashim!" Again the people replied, "This is Banu Hashim." He asked, "Who is Abu Talib?" The people replied, "This is Abu Talib." He said, "'So-and-so has asked me to convey a message to you that so-and-so has killed him for a fetter (of a camel)." Then Abu Talib went to the (Quraishi) killer and said to him, "Choose one of three alternatives: (i) If you wish, give us one-hundred camels because you have murdered our companion, (ii) or if you wish, fifty of your men should take an oath that you have not murdered our companion, and if you do not accept this, (iii) we will kill you in Qisas." The killer went to his people and they said, "We will take an oath." Then a woman from Banu Hashim who was married to one of them (i.e.the Quraishis) and had given birth to a child from him, came to Abu Talib and said, "O Abu Talib! I wish that my son from among the fifty men, should be excused from this oath, and that he should not take the oath where the oathtaking is carried on." Abu Talib excused him. Then another man from them came (to Abu Talib) and said, "O Abu Talib! You want fifty persons to take an oath instead of giving a hundred camels, and that means each man has to give two camels (in case he does not take an oath). So there are two camels I would like you to accept from me and excuse me from taking an oath where the oaths are taken. Abu Talib accepted them from him. Then 48 men came and took the oath. Ibn ʿAbbas further said:) By Him in Whose Hand my life is, before the end of that year, none of those 48 persons remained alive. (Using translation from Bukhārī 3845)

إِنَّ أَوَّلَ قَسَامَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ لَفِينَا بَنِي هَاشِمٍ كَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَ رَجُلًا مِنْ قُرَيْشٍ مِنْ فَخِذٍ أُخْرَى فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ بِهِ رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَعِنِّي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرِ الْإِبِلُ قَالَ فَأَعْطَاهُ عِقَالًا فَشَدَّ بِهِ عُرْوَةَ جُوَالِقِهِ لَمَّا نَزَلُوا عُقِلَتِ الْإِبِلُ إِلَّا بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الْإِبِلِ؟ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ؟ قَالَ مَرَّ بِي رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدِ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَاسْتَعَانَنِي فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرِ الْإِبِلُ فَأَعْطَيْتُهُ عِقَالَهُ قَالَ فَحَذَفَهُ بِعَصًا كَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ قَالَ أَتَشْهَدُ الْمَوْسِمَ؟ قَالَ لَا أَشْهَدُ وَرُبَّمَا شَهِدْتُ قَالَ هَلْ أَنْتَ مُبَلِّغٌ عَنِّي رِسَالَةً مَرَّةً مِنَ الدُّهُورِ؟ قَالَ نَعَمْ قَالَ فَكَتَبَ إِذَا أَنْتَ شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوكَ فَنَادِ يَا آلَ بَنِي هَاشِمٍ فَإِذَا أَجَابُوكَ فَسَلْ عَنْ أَبِي طَالِبٍ فَأَخْبِرْهُ أَنَّ فُلَانًا قَتَلَنِي فِي عِقَالٍ قَالَ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا؟ قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ ثُمَّ مَاتَ فَوَلِيتُ دَفْنَهُ فَقَالَ كَانَ أَهْلَ ذَاكَ مِنْكَ فَمَكَثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الْيَمَانِيَّ الَّذِي كَانَ أَوْصَى إِلَيْهِ أَنْ يُبَلِّغَ عَنْهُ وَافَى الْمَوْسِمَ فَقَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ؟ قَالُوا هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلَانٌ أَنْ أُبَلِّغَكَ رِسَالَةً أَنَّ فُلَانًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ اخْتَرْ مِنَّا إِحْدَى ثَلَاثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنَ الْإِبِلِ فَإِنَّكَ قَتَلْتَ صَاحِبَنَا بِخَطَأٍ وَإِنْ شِئْتَ حَلَفَ خَمْسُونَ مِنْ قَوْمِكَ أَنَّكَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاكَ بِهِ قَالَ فَأَتَى قَوْمَهُ فَذَكَرَ ذَلِكَ لَهُمْ فَقَالُوا نَحْلِفُ فَأَتَتِ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ كَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا بِرَجُلٍ مِنَ الْخَمْسِينَ وَلَا تُصْبِرَ يَمِينَهُ حَيْثُ تُصْبَرُ الْأَيْمَانُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلًا أَنْ يَحْلِفُوا مَكَانَ مِائَةٍ مِنَ الْإِبِلِ نَصِيبُ كُلِّ رَجُلٍ بَعِيرَانِ فَهَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلَا تَصْبِرْ يَمِينِي حَيْثُ تُصْبَرُ الْأَيْمَانُ قَالَ فَقَبِلَهُمَا وَجَاءَ ثَمَانِيَةٌ وَأَرْبَعُونَ رَجُلًا فَحَلَفُوا فَقَالَ ابْنُ عَبَّاسٍ فَوالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنَ الثَّمَانِيَةِ وَالْأَرْبَعِينَ عَيْنٌ تَطْرِفُ

[Machine] I heard someone speaking and I liked him, so I introduced him to my companions and said, "Do you know a man who used to sit with us like this and this?" A man from the people said, "Yes, I know him, he is Uwais al-Qarni." He said, "Do you know where he lives?" He said, "Yes." He said, "So I went with him until I reached his house. I said to him, 'O brother, what keeps you away from us?' He said, 'Poverty.' And his companions used to mock him and hurt him. He said, 'Take this garment and wear it.' He said, 'No, don't do that, for if they see it on me, they will hurt me.' So I continued with him until he wore it and came out to them. They said, 'Who do you see has deceived him from his garment?' He said, 'So he came and put it down.' He said, 'Do you see?' He said, 'Yes.' He said, 'I came to the gathering and said, 'What do you want from this man? You have hurt him.' He used to borrow a garment from me once and wear it once.' Umar said, 'Did anyone from the Qaranis come here?' Uwais said, 'So that man came.' He said, 'Where are you from?' He said, 'From Yemen.' He said, 'What is your name?' He said, 'Uwais.' He said, 'Who did you leave behind in Yemen?' He said, 'My mother.' He said, 'Was there any whiteness in you that you invoked Allah to remove from you?' He said, 'Yes.' He said, 'Did you ask Allah to remove it from you?' He said, 'Yes.' He said, 'Then seek forgiveness for me.' He said, 'Would Uwais seek forgiveness for someone like me, O Amir al-Mu'minin?' He said, 'So he sought forgiveness for him.' He said, 'I said to him, 'You, O brother, do not leave me.' He said, 'So he became smooth towards me.' He said, 'I was informed that Uwais has come to you in Kufa.' He said, 'So that man who used to mock him humiliated him and said, 'What is this among us and we do not know him?' Umar said, 'Indeed.' The man said, 'There is a man among us named Uwais who is mocked.' He said, 'Find him and bring him to me.' He said, 'So that man came to him and said, 'Indeed, the Messenger of Allah, ﷺ , said, 'A man will come to you from Yemen whose name is Uwais, he will not leave Yemen except for the sake of his mother, and he had a white spot on him, so he invoked Allah and He removed it except for the size of a dirham or a dinar. So whoever among you meets him, ask him to seek forgiveness for you.'" He said, 'So he came to us.' He said, 'I said to him, 'From where are you?' He said, 'From Yemen.' I said, 'What is your name?' He said, 'Uwais.' I said, 'Who did you leave in Yemen?' He said, 'My mother.' I said, 'Was there any whiteness in you that you invoked Allah to remove from you?' He said, 'Yes.' I said, 'Did you ask Allah to remove it from you?' He said, 'Yes.' I said, 'Seek forgiveness for me.' He said, 'Would Uwais seek forgiveness for someone like me, O Amir al-Mu'minin?' He said, 'I heard Umar saying such and such about you, so seek forgiveness for me, O Uwais.' He said, 'I will not do that until you promise me that you will not mock me anymore and that you will not mention to anyone what you heard from Umar.' He said, 'So he sought forgiveness for him.' He said, 'He became smooth towards me.' He said, 'I was then informed that he had come to Kufa.'  

الزهد لأحمد:٢٠٠٨حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي أَبِي حَدَّثَنَا هِشَامُ بْنُ الْقَاسِمِ حَدَّثَنَا سُلَيْمَانُ يَعْنِي ابْنَ الْمُغِيرَةِ حَدَّثَنِي سَعِيدٌ الْجُرَيْرِيُّ عَنْ أَبِي نَضْرَةَ عَنْ أُسَيْرِ بْنِ جَابِرٍ قَالَ كَانَ يُحَدِّثُ بِالْكُوفَةِ فَيُحَدِّثُنَا فَإِذَا فَرَغَ مِنْ حَدِيثِهِ قَالَ تَفَرَّقُوا وَيَبْقَى رَهْطُهُ فِيهِمْ رَجُلٌ يَتَكَلَّمُ بِكَلَامٍ لَا

أَسْمَعُ أَحَدًا يَتَكَلَّمُ كَلَامَهُ فَأَحْبَبْتُهُ فَقَدَّمْتُهُ فَقُلْتُ لِأَصْحَابِي هَلْ تَعْرِفُونَ رَجُلًا كَانَ يُجَالِسُنَا كَذَا وَكَذَا؟ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ نَعَمْ أَنَا أَعْرِفُهُ ذَاكَ أُوَيْسٌ الْقَرَنِيُّ قَالَ فَتَعْلَمُ مَنْزِلَهُ؟ قَالَ نَعَمْ قَالَ فَانْطَلَقْتُ مَعَهُ حَتَّى ضَرَبْتُ فَخَرَجَ إِلَيَّ قَالَ قُلْتُ يَا أَخِي مَا يَحْبِسُكَ عَنَّا؟ قَالَ الْعُرْيُ وَكَانَ أَصْحَابُهُ يَسْخَرُونَ بِهِ ويُؤْذُونَهُ قَالَ قُلْتُ خُذْ هَذَا الْبُرْدَ فَالْبَسْهُ قَالَ لَا تَفْعَلْ فَإِنَّهُمْ إِذًا يُؤْذُونَنِي إِنْ رَأَوْهُ عَلَيَّ فَلَمْ أَزَلْ بِهِ حَتَّى لَبِسَهُ فَخَرَجَ عَلَيْهِمْ فَقَالُوا مَنْ تَرَوْنَ خُدِعَ عَنْ بُرْدِهِ هَذَا؟ قَالَ فَجَاءَ فَوَضَعَهُ قَالَ أَتَرَى؟ قَالَ أُسَيْرٌ فَأَتَيْتُ الْمَجْلِسَ فَقُلْتُ مَا تُرِيدُونَ مِنْ هَذَا الرَّجُلِ قَدْ آذَيْتُمُوهُ؟ الرَّجُلُ يَعْرَى مَرَّةً وَيُكْسَى مَرَّةً قَالَ فَأَخَذْتُهُمْ بِلِسَانِي أَخْذًا شَدِيدًا قَالَ فَقَضَى أَنَّ أَهْلَ الْكُوفَةِ وَفَدُوا إِلَى عُمَرَ رَضِيَ فَوَفَدَ رَجُلٌ مِمَّنْ كَانَ يَسْخَرُ بِهِ قَالَ عُمَرُ هَلْ هَاهُنَا أَحَدٌ مِنَ الْقَرَنِيِّينَ؟ قَالَ فَجَاءَ ذَلِكَ الرَّجُلُ قَالَ فَقَالَ إِنَّ رَسُولَ اللَّهِ ﷺ قَدْ قَالَ «إِنَّ رَجُلًا يَأْتِيكُمْ مِنَ الْيَمَنِ يُقَالُ لَهُ أُوَيْسٌ لَا يَدَعُ بِالْيَمَنِ غَيْرَ أُمٍّ لَهُ وَقَدْ كَانَ بِهِ بَيَاضٌ فَدَعَا اللَّهَ فَأَذْهَبَهُ إِلَّا مِثْلَ مَوْضِعِ الدِّينَارِ أَوِ الدِّرْهَمِ فَمَنْ لَقِيَهُ مِنْكُمْ فَأْمُرُوهُ فَلْيَسْتَغْفِرْ لَكُمْ» قَالَ فَقَدِمَ عَلَيْنَا قَالَ قُلْتُ مِنْ أَيْنَ؟ قَالَ مِنَ الْيَمَنِ قَالَ قُلْتُ مَا اسْمُكَ؟ قَالَ أُوَيْسٌ قَالَ فَمَنْ تَرَكْتَ بِالْيَمَنِ؟ قَالَ أُمًّا لِي قَالَ أَكَانَ بِكَ بَيَاضٌ فَدَعَوْتَ اللَّهَ فَأَذْهَبَهُ عَنْكَ؟ قَالَ نَعَمْ قَالَ اسْتَغْفِرْ لِي قَالَ أَوَيَسْتَغْفِرُ مِثْلِي لِمِثْلِكَ يَا أَمِيرَ الْمُؤْمِنِينَ؟ قَالَ فَاسْتَغْفَرَ لَهُ قَالَ قُلْتُ أَنْتَ يَا أَخِي لَا تُفَارِقُنِي قَالَ فَأَمْلَسَ مِنِّي قَالَ فَأُنْبِئْتُ أَنَّهُ قَدِمَ عَلَيْكُمُ الْكُوفَةَ قَالَ فَجَعَلَ ذَلِكَ الرَّجُلُ الَّذِي يَسْخَرُ بِهِ يُحَقِّرُهُ قَالَ يَقُولُ مَا هَذَا فِينَا وَلَا نَعْرِفُهُ فَقَالَ عُمَرُ بَلَى فَقَالَ الرَّجُلُ إِنَّهُ رَجُلٌ كَأَنَّهُ يَضُعُ شَأْنَهُ فَقَالَ فِينَا يَا أَمِيرَ الْمُؤْمِنِينَ رَجُلٌ يُقَالُ لَهُ أُوَيْسٌ نَسْخَرُ بِهِ قَالَ أَدْرِكْ وَلَا أَرَاكَ تُدْرِكُ قَالَ فَأَقْبَلَ ذَلِكَ الرَّجُلُ حَتَّى دَخَلَ عَلَيْهِ قَبْلَ أَنْ يَأْتِيَ أَهْلَهُ فَقَالَ لَهُ أُوَيْسٌ مَا هَذِهِ [278] بِعَادَتِكَ فَمَا بَدَا لَكَ؟ قَالَ سَمِعْتُ عُمَرَ يَقُولُ فِيكَ كَذَا فَاسْتَغْفِرْ لِي يَا أُوَيْسُ قَالَ لَا أَفْعَلُ حَتَّى تَجْعَلَ لِي عَلَيْكَ أَنْ لَا تَسْخَرَ بِي فِيمَا بَعْدُ وَأَنْ لَا تَذْكُرَ الَّذِي سَمِعْتَهُ مِنْ عُمَرَ إِلَى أَحَدٍ قَالَ فَاسْتَغْفَرَ لَهُ قَالَ أُسَيْرٌ فَأَتَيْتُهُ فَدَخَلْتُ عَلَيْهِ لَيْلَةً فَقُلْتُ يَا أَخِي أَرَاكَ تَغِيبُ وَنَحْنُ لَا نَشْعُرُ قَالَ مَا كَانَ فِي هَذَا مَا أَتَبَلَّغُ بِهِ فِي النَّاسِ وَمَا يُجْزَى كُلُّ عَبْدٍ إِلَّا بِعَمَلِهِ قَالَ ثُمَّ أَمْلَسَ مِنْهُمْ فَذَهَبَ

"عن أسَيرِ بن جابر قال: كان مُحدثٌ بالكُوفةِ يحدِّثُنا فَإِذا فرغَ من حديثهِ تَفَرقوا ويبقى رهطٌ فيهم رجلٌ يتكلمُ بكلامٍ لا أسمعُ أحدًا يتكلمُ كلامَه، فأحبَبته فَفَقَدْتُه؛ فقلتُ لأصحابى: هل تعرفونَ رجلًا كان يجالسُنا كذا وكذا؟ فقال رجلٌ من القومِ: نعم أنا أَعْرفه، ذلك أويسٌ القَرَنِىُّ، قلت: فتعلمُ منزله؟ قال: نعم، فانطلقتُ معه حتى ضَرَبْتُ حجرته، فخرج إلىَّ، قلت: يا أخى، ما حَبَسك عنا؟ قال: الْعُرْىُ، وكان أصحابُهُ يسخرونَ به ويُؤْذُونه، قلت: خُذْ هذا البُرْد فَالْبَسْه، (قال: لا تفعل؛ فإنهم إذن يؤذوننى إن رَأَوْه علىَّ، فلم أزل به حتى لبسه)، فخرج عليهم، فقالوا: (خُدِعَ عن برده

هذا؟ قال: فجاء فوضعه وقال: ألا ترى؟ قال أسير: فأتيت المجلس فقلت: ما تريدون من هذا الرجل؟ قد آذيتموه! ! الرجل يعرى مرة، ويكتسى مرة، فأخذتهم بلسانى أخذًا شديدًا، فقُضى أن أهل الكوفة وَفَدوا إلى عمر، فوفد رجلٌ ممن كان يَسْخرُ به، فقال عمر: هل ههنا أحد من القَرَنِيِّين؟ فجاء بذلك الرجل، فقال (إن رسول اللَّه ﷺ قد قال: إن رجلا يأتيكم من اليمن يقال) له أويسٌ، لا يدع باليمن غير أَمٍّ له، وقد كان به بياضٌ فدعا اللَّه فأذهَبَه عنه إلا مثلَ موضع الدرهم، فمن لقيه منكم فمروه فليستغفرْ لكم، قال: فقدم علينا، قلتُ: من أين؟ قال: من اليمن، قلت: ما اسمك؟ قال: أويس، قلت: فمن تركت باليمن؟ قال: أُما لى، قلت: أكان بك بياضٌ فدعوت اللَّه فأذهبه عنك؟ قال: نعم، قلتُ: استغفرْ لى، قال: أو يستغفر مثلى لمِثْلِك يَا أمير المؤمنين؟ قال: فاستغفر، قلت له: أنت أخى لا تفارقنى، فامَّلس منى، فَأُنْبِئْتُ أنه قدم عليكم الكوفة، قال: فجعل ذلك الرجل (الذى) كان يسخر به ويحقره يقول: (ما) هذا فينا وما نعرفه؟ فقال عمر: بلى، إنه رجل كذا، كأنه يضعُ من شأنِه، قال: فينا يا أمير المؤمنين رجل يقال له أويس نَسْخَر به، قال: أَدْرِك ولا أرَاكَ تُدرك، فَأقبلَ ذلك الرجل حتى دخل عليه قبلَ أن يأتى أهله، فقال له أويس: ما هذه بعادتك فما بدا لك؟ قال: سمعت عمر يقولُ فيك: كذا وكذا فاستغفرْ لى يا أُويس، قال: لا أفعلُ حتى تجعلَ لى عليك أن لا تسخر بى فيما بعد، ولا تذكر الذى سمعته من عمر إلى أحد؛ فاستغفر له، قال أُسير: فما لبثنا أن فشا أمره في الكوفة؟ فأتَيْتُه فدخلت عليه فقلت: يا أخى ألا أول العجب ونحن لا نشعر؟ قال: ما كان في هذا ما أتَبلَّغُ به في النَّاسِ، وما يُجزى كل عبدٍ إلا بعمله، ثم امَّلس منهم فذهب".

"عَنْ سَلْمَانَ قَالَ: كُنْتُ فِى أَهْلى بَرَامَهُرْمُز، وكُنْتُ أَخْتَلِفُ إِلَى مُعَلِّمى الْكِتابِ، وَكَانَ فِى الطَّرِيق رَاهِبٌ، فَكُنْتُ إِذَا مَرَرْتُ جَلَسْتُ عِنْدَهُ فَيُخْبِرُنِى مِنْ خَبرِ السَّمَواتِ وَالأَرْضِ، وَنَحْو مِنْ ذَلِكَ، حَتَّى اشْتَغَلْتُ عَنْ كِتَابَتِى وَلَزمْتُهُ فَأَخْبَرَ أَهْلِى الْمُعَلِّمُ، وَقَالَ لَهُمْ: إِنَّ هَذَا الرَّاهِبَ قَدْ أَفْسَدَ ابْنَكُمْ فَأَخْرِجُوهُ، فَاسْتَخْفَيْتُ مِنْهُمْ، فَخَرَجْتُ مَعَهُ، حَتَّى جِئْنَا الْمَوْصِلَ فَوَجَدْنَا فِيها أَرْبَعِينَ رَاهِبًا، فَكَانَ بِهِمْ مِنَ التَّعْظِيم لِلرَّاهِب الَّذى جِئْتُ مَعَهُ شَىْءٌ عَظِيمٌ، فَمَكَثْتُ مَعَهُمْ أَشْهُرًا، فَمَرِضْتُ، فَقَالَ رَاهبٌ مَنْهُمْ: إِنِّى ذَاهِبٌ

إِلَى بَيْتِ الْمَقْدِسِ فَأُصَلِّى فِيهِ، فَفَرِحْتُ بِذَلِكَ فَقُلْتُ: أَنَا مَعَكَ، فَخَرَجْنا فَما رَأَيْتُ أَحَدًا كَانَ أَصْبَرَ عَلى مَشْى مِنْهُ، كَانَ يَمْشِى فَإِذَا رآنِى أَعْيَيْتُ، قَالَ: ارْقُد، وَقَامَ يُصَلِّى، فَكَانَ كَذَلِكَ، لَمْ يَطْعَمْ يَوْمًا، حَتَّى جِئْنا بَيْتَ الْمَقْدسِ، فَلَمَّا قَدِمْنَا بِهَا رَقَدَ، وَقَالَ لِى: إذا رَأَيْتَ الظِّلَّ هُنا فَأَيْقظْنِى، فَلَمَّا بَلَغَ الظِّلُ ذَلِكَ الْمَكانَ، أَرَدْتُ أَنْ أُوقِظَهُ، ثُمَّ قُلْتُ: سَهِرَ وَلَمْ يَرْقُدْ، وَاللهِ لأَدعنَّهُ قَليلًا فَتَرَكْتُهُ سَاعَةً فَاسْتَيْقَظَ (*)، فَرَأَى الظِّلَّ قَدْ جَاوَزَ ذَلِكَ الْمَكانَ، فَقالَ: أَلَمْ أَقُلْ لَكَ أَنْ تُوقِظَنِى، قُلْتُ: كُنْتَ لَمْ تَنَمْ، فَأَحَبَبْتُ أَنْ أَدَعَكَ تَنَامُ قَليلًا، قالَ: إِنِّى لَا أُحِبُّ أَنْ يَأتِى عَلىَّ سَاعَةٌ إِلَّا وَأَنَا أَذْكُرُ اللهَ فِيهَا، ثُمَّ دَخَلْنَا بَيْتَ الْمَقْدِسِ فَإِذَا سَائِلٌ مُقْعَدٌ يَسْأَلُ فَسَأَلَهُ، فَلَا أَدْرِى مَا قَالَ لَهُ، فَقالَ لَهُ الْمُقْعدُ: دَخَلْتَ وَلَمْ تُعْطِنِى شَيئًا (* *) قَالَ: هَلْ تُحبُّ أَنْ تَقُومَ، قَالَ: نَعَمْ، فَدَعا لَهُ، فَقَامَ، فَجَعَلْتُ أَتَعَجَّبُ وَأتَّبِعُهُ، فَسَهَوْتُ، فَذَهَبَ الرَّاهِبُ، ثُمَّ خَرَجْتُ أَتَّبِعُهُ، وَأَسْأَلُ (* * *) عَنْهُ. فَلَقِيتُ رَكْبًا مِنَ الأَنْصَارِ، فَسَأَلْتُهُمْ عَنْهُ، فَقُلْتُ: أَرَأَيْتُمْ رَجُلًا، كذَا وَكَذَا؟ فَقالُوا: هَذَا عَبْدٌ آبقٌ، فَأَخَذُونِى فَأَرْدَفونِى خَلْفَ رَجُلٍ مِنْهُمْ، حَتَّى قَدِمُوا بِى الْمَدِينَةَ، فَجَعَلُونِى فِى حَائطٍ لَهُمْ، فَكُنْتُ أَعْمَلُ هَذَا الْخَوصَ (* * * *)، وَقَدْ كَانَ الرَّاهِبُ قَالَ إِنَّ اللهَ لَمْ يُعْطِ الْعَرَبَ مِنَ الأَنْبِياءِ أَحَدًا، وَإِنَّهُ سَيخْرُجُ مِنْهُمْ نَبِىٌّ، فَإِنْ أَدْرَكتَهُ فَصَدِّقهُ وآمِنْ بهِ، وَإِنَّ آيَتَهُ أَنْ يَقْبَلَ الْهَدِيَّةَ وَلَا يَأكُلُ الصَّدَقَةَ، وَإِنَّ فِى ظَهْرِهِ خَاتَمَ النُّبُوَّةِ، فَمَكَثْتُ مَا مَكَثْتُ، ثُمَّ قَالوا جَاءَ النَّبِىُّ ﷺ إِلَى الْمَدِينَةِ فَخَرَجْتُ مَعِى بِتَمْرٍ جِئْتُ بِهِ إِلَيْهِ، فَقالَ: مَا هَذَا؟ قُلْتُ: صَدَقَةٌ، قَالَ: لَا نَأكُلُ الصَّدَقَةَ، فَأَخَذْتُهُ، ثُمَّ أَتَيْتُهُ بِتَمْرٍ، فَوَضَعْتُهُ بَيْنَ يَدَيْهِ، فَقالَ: مَا هَذَا؟ قُلْتُ: هَدِيَّةٌ، فَأَكَلَه، وَأَكَل مَنْ عِنْدَهُ، ثُمَّ قُمْتُ وَرَاءَ ظَهْرِهِ لأَنْظُرَ إِلَى الْخَاتَمِ، فَفَطِنَ بِى، فَأَلْقَى رِدَاءَهُ عَنْ مَنْكَبِيْهِ، فَأَبْصَرْتُهُ فآمَنْتُ بِهِ وَصدَّقْتُهُ، فَكَاتَبْتُ عَلَى مِائَةِ نَخْلَةٍ، فَغَرَسَهَا رَسُولُ اللهِ ﷺ بِيَدِهِ، فَلَمْ يَحُلِ الْحَوْلُ حَتَّى بَلَغَتْ وَأَكَلَ مِنْها".
