٧۔ كِتَابُ الْمُحَارَبَةِ ص ١
The Prophet [SAW] said: "I have been commanded to fight the idolators until they bear witness to La ilaha illallah (there is none worthy of worship except Allah) and that Muhammad is His slave and Messenger. If they bear witness to La ilaha illallah and that Muhammad is His slave and Messenger, and they pray as we pray and face our Qiblah, and eat our slaughtered animals, then their blood and wealth becomes forbidden to us except for a right that is due." (Using translation from Nasāʾī 3966)
عَنِ النَّبِيِّ ﷺ قَالَ «أُمِرْتُ أَنْ أُقَاتِلَ الْمُشْرِكِينَ حَتَّى يَشْهَدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ فَإِذَا شَهِدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ وَصَلَّوْا صَلَاتَنَا وَاسْتَقْبَلُوا قِبْلَتَنَا وَأَكَلُوا ذَبِيحَتَنَا فَقَدْ حَرُمَتْ عَلَيْنَا دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلَّا بِحَقِّهَا»
The Messenger of Allah [SAW] said: "I have been commanded to fight the idolators until they bear witness to La ilaha illallah (there is none worthy of worship except Allah) and that Muhammad is the Messenger of Allah [SAW]. If they bear witness to La ilaha illallah and that Muhammad is the Messenger of Allah [SAW], and they face our Qiblah, eat our slaughtered animals, and pray as we do, then their blood and wealth become forbidden except for a right that is due, and they will have the same rights and obligations as the Muslims." أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَشْهَدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ فَإِذَا شَهِدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ وَاسْتَقْبَلُوا قِبْلَتَنَا وَأَكَلُوا ذَبِيحَتَنَا وَصَلَّوْا صَلَاتَنَا فَقَدْ حَرُمَتْ عَلَيْنَا دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلَّا بِحَقِّهَا لَهُمْ مَا لِلْمُسْلِمِينَ وَعَلَيْهِمْ مَا عَلَيْهِمْ»
[Machine] "And that Muhammad is the messenger of Allah, and he faced our qiblah, and he performed our prayers, and he ate our slaughtered animals, so he is a Muslim, for him is what is for the Muslim, and upon him is what is upon the Muslim."
وَأَنَّ مُحَمَّدًا رَسُولُ اللهِ وَاسْتَقْبَلَ قِبْلَتَنَا وَصَلَّى صَلَاتَنَا وَأَكَلَ ذَبِيحَتَنَا فَهُوَ مُسْلِمٌ لَهُ مَا لِلْمُسْلِم وَعَلَيْهِ مَا عَلَى الْمُسْلِمِ»
"When the Messenger of Allah [SAW] died, the 'Arabs apostatized, so 'Umar said: 'O Abu Bakr, how can you fight the 'Arabs?' Abu Bakr said: 'The Messenger of Allah [SAW] said: "I have been commanded to fight the people until they bear witness to La ilaha illallah (there is none worthy of worship except Allah) and that I am the Messenger of Allah, and they establish Salah and pay Zakah." By Allah, if they withhold from me a young goat that they used to give to the Messenger of Allah [SAW], I will fight them for it.' 'Umar said: 'By Allah, as soon as I realized how certain Abu Bakr was, I knew that it was the truth.'" (Using translation from Nasāʾī 3969)
لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ ارْتَدَّتِ الْعَرَبُ قَالَ عُمَرُ يَا أَبَا بَكْرٍ كَيْفَ تُقَاتِلُ الْعَرَبَ فَقَالَ أَبُو بَكْرٍ إِنَّمَا قَالَ رَسُولُ اللهِ ﷺ أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ وَيُقِيمُوا الصَّلَاةَ وَيُؤْتُوا الزَّكَاةَ وَاللهِ لَو مَنَعُونِي عَنَاقًا مِمَّا كَانُوا يُعْطُونَ رَسُولَ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَيْهِ قَالَ عُمَرُ فَلَمَّا رَأَيْتُ رَأْيَ أَبِي بَكْرٍ قَدْ شُرِحَ عَلِمْتُ أَنَّهُ الْحَقُّ
When the Messenger of Allah ﷺ died and Abu Bakr ؓ became (caliph) after him, and some of the Arabs apostatized,ʻUmar ؓ said: O Abu Bakr, how can you fight the people when the Messenger of Allah ﷺ said: ʿI have been ordered to fight the people until they bear witness that there is no god except Allah. Whoever bears witness that there is no god except Allah has protected his wealth and his life from me, except in cases dictated by Islamic law, and their reckoning will be with Allahʿ? Abu Bakr ؓ said: by Allah I shall certainly fight the one who separates prayer and zakah, for zakah is what is due from wealth. By Allah, whoever withholds from me a goat that they used to give (in zakah) to the Messenger of Allah ﷺ, I shall fight them for withholding it. 'Umar said: By Allah, as soon as I realized that Allah had opened the heart of Abu Bakr to fighting, I realized that it was the right thing to do. (Using translation from Aḥmad 117)
لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ وَاسْتُخْلِفَ أَبُو بَكْرٍ وَكَفَرَ مَنْ كَفَرَ مِنَ الْعَرَبِ قَالَ عُمَرُ لِأَبِي بَكْرٍ كَيْفَ تُقَاتِلُ النَّاسَ وَقَدْ قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ عَصَمَ مِنِّي مَالَهُ وَنَفْسَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ» قَالَ أَبُو بَكْرٍ وَاللهِ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ فَإِنَّ الزَّكَاةَ حَقُّ الْمَالِ وَاللهِ لَو مَنَعُونِي عِقَالًا كَانُوا يُؤَدُّونَهُ إِلَى رَسُولِ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَى مَنْعِهِ قَالَ عُمَرُ فَمَا هُوَ إِلَّا أَنْ رَأَيْتُ اللهَ شَرَحَ صَدْرَ أَبِي بَكْرٍ لِلْقِتَالِ فَعَرَفْتُ أَنَّهُ الْحَقُّ
“I have been commanded to fight the people until they say La ilaha illallah, and if they say it then their blood and wealth are safe from me, except in cases dictated by sharee'ah, and their reckoning is with Allah.” When some people apostatized, ʼUmar said to Abu Bakr: Will you fight them when you heard the Messenger of Allah is say such and such? Abu Bakr said: By Allah, I will not separate prayer and zakah, and I shall certainly fight anyone who separates them. So we fought them alongside him and we realised that that was the right thing to do. (Using translation from Aḥmad 67)
قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوهَا عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ» فَلَمَّا كَانَتِ الرِّدَّةُ قَالَ عُمَرُ لِأَبِي بَكْرٍ أَتُقَاتِلُهُمْ وَقَدْ سَمِعْتَ رَسُولَ اللهِ ﷺ يَقُولُ كَذَا وَكَذَا فَقَالَ وَاللهِ لَا أُفَرِّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ وَلَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَهُمَا فَقَاتَلْنَا مَعَهُ فَرَأَيْنَا ذَلِكَ رُشْدًا
The Messenger of Allah [SAW] said: "I have been commanded to fight the people until they say La ilaha illallah (there is none worthy of worship but Allah). Whoever says La ilaha illallah, his wealth and his life are safe from me except for a right that is due, and his reckoning will be with Allah." (Using translation from Nasāʾī 3972)
أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ عَصَمَ مِنِّي مَالَهُ وَنَفْسَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ جَمَعَ شُعَيْبُ بْنُ أَبِي حَمْزَةَ الْحَدِيثَيْنِ جَمِيعًا

لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ وَكَانَ أَبُو بَكْرٍ بَعْدَهُ وَكَفَرَ مَنْ كَفَرَ مِنَ الْعَرَبِ قَالَ عُمَرُ يَا أَبَا بَكْرٍ كَيْفَ تُقَاتِلُ النَّاسَ وَقَدْ قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ فَقَدْ عَصَمَ مِنِّي مَالَهُ وَنَفْسَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ» قَالَ أَبُو بَكْرٍ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ فَوَاللهِ لَو مَنَعُونِي عَنَاقًا كَانُوا يُؤَدُّونَهَا إِلَى رَسُولِ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَى مَنْعِهَا قَالَ عُمَرُ فَوَاللهِ مَا هُوَ إِلَّا أَنْ رَأَيْتُ اللهَ شَرَحَ صَدْرَ أَبِي بَكْرٍ بِالْقِتَالِ فَعَرَفْتُ أَنَّهُ الْحَقُّ
"I have been commanded to fight the people until they say La ilaha illallah (there is non worthy or worship except Allah). Whoever says it, his life and his property are safe from me, except for its right, and his reckoning will be with Allah." (Using translation from Nasāʾī 3095)
أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَهَا فَقَدْ عَصَمَ مِنِّي نَفْسَهُ وَمَالَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ» خَالَفَهُ الْوَلِيدُ بْنُ مُسْلِمٍ
"When Abu Bakr mobilized to fight them, 'Umar said: 'O Abu Bakr, how can you fight the people when the Messenger of Allah ﷺ said: "I have been commanded to fight the people until they say La ilaha illallah (there is none worthy or worship except Allah). Whoever says La ilaha illallah, his life and his property are safe from me, except for its right, and his reckoning will be with Allah?'" Abu Bakr, may Allah be pleased with me him, said: 'By Allah, I will surely fight those who separate prayer and Zakah, for Zakah is what is due on wealth. By Allah, if they withhold from me a small she-goat that they used to give to the Messenger of Allah ﷺ I will fight them for withholding it.' ('Umar said) 'By Allah, when I realized that Allah, the Most High, had opened the chest of Abu Bakr to fighting them, then I knew that it was the truth.'" (Using translation from Nasāʾī 3093)
قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوهَا عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلَّا بِحَقِّهَا»؟ قَالَ أَبُو بَكْرٍ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ وَاللهِ لَو مَنَعُونِي عَنَاقًا كَانُوا يُؤَدُّونَهَا إِلَى رَسُولِ اللهِ ﷺ لَقَاتَلْتُهُمْ عَلَى مَنْعِهَا قَالَ عُمَرُ فَوَاللهِ مَا هُوَ إِلَّا أَنْ رَأَيْتُ أَنَّ اللهَ قَدْ شَرَحَ صَدْرَ أَبِي بَكْرٍ لِقِتَالِهِمْ فَعَرَفْتُ أَنَّهُ الْحَقُّ
“I have been commanded to fight the people until they say: La ilaha illallah. If they say it, then their blood and wealth are protected from me, except for a right that is due from it, and their reckoning will be with Allah.” (Using translation from Ibn Mājah 3927)
قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوهَا عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ»
Abu Hurairah reported the Apostle of Allaah ﷺ as saying “ I am commanded to fight with men till they testify that there is no god but Allaah, when they do that they will keep their life and property safe from me, except what is due to them. (i.e., life and property) and their reckoning will be at Allaah’s hands.” (Using translation from Abū Dāʾūd 2640)
قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوهَا مَنَعُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ»
The Messenger of Allah [SAW] said: "We will fight the people until they say La ilaha illallah. If they say La ilaha illallah then their blood and their wealth become forbidden to us, except for a right that is due, and their reckoning will be with Allah." (Using translation from Nasāʾī 3978)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «نُقَاتِلُ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوا لَا إِلَهَ إِلَّا اللهُ حَرُمَتْ عَلَيْنَا دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ»
[Machine] We were with the Prophet ﷺ and a man came and he walked away. He said, "kill him." Then he said, "Do you testify that there is no god but Allah?" He said, "Yes, but he says it as a form of seeking refuge." Prophet Muhammad ﷺ said: "Do not kill him, for I have been commanded to fight against people until they say there is no god but Allah. When they say it, they are protected by me in regard to their lives and wealth, except for what is due upon them. Their reckoning is with Allah." Abu Abdur-Rahman said: "This is a mistake. The correct narration is the one that comes after it." 3428 Abu Abdur-Rahman informed us: Ahmed ibn Sulaiman said: Ubaidullah informed us: Israel narrated to us from Samaak, from Nu'man ibn Salim, from a man who said: The Messenger of Allah ﷺ entered upon us while we were in a dome in the Masjid of Madinah and he said, "It has been revealed to me that I must fight against people until they say there is no god but Allah." Similar to that. [415] 3429 Ahmed ibn Sulaiman informed us: Al-Hassan ibn Muhammad ibn A'yan said: Zuhair narrated to us: Samaak narrated to us from Nu'man ibn Salim, who said: I heard Aws saying: The Messenger of Allah ﷺ entered upon us while we were in a dome and he narrated the hadith.
كُنَّا مَعَ النَّبِيِّ ﷺ فَجَاءَ رَجُلٌ فَسَارَّهُ فَقَالَ «اقْتُلُوهُ» ثُمَّ قَالَ «أَتَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ؟» قَالَ نَعَمْ وَلَكِنَّهُ يَقُولُهَا تَعَوُّذًا فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلُوهُ فَإِنِّي إِنَّمَا أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوا عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ حَدِيثُ الْأَسْوَدِ بْنِ عَامِرٍ هَذَا خَطَأٌ وَالصَّوَابُ الَّذِي بَعْدَهُ 3428 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ قَالَ أَخْبَرَنَا إِسْرَائِيلُ عَنْ سِمَاكٍ عَنِ النُّعْمَانِ بْنِ سَالِمٍ عَنْ رَجُلٍ حَدَّثَهُ قَالَ دَخَلَ عَلَيْنَا رَسُولُ اللهِ ﷺ وَنَحْنُ فِي قُبَّةٍ فِي مَسْجِدِ الْمَدِينَةِ وَقَالَ فِيهِ «إِنَّهُ أُوحِيَ إِلَيَّ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ» نَحْوَهُ [415] 3429 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ أَعْيَنَ قَالَ حَدَّثَنَا زُهَيْرٌ قَالَ حَدَّثَنَا سِمَاكٌ عَنِ النُّعْمَانِ بْنِ سَالِمٍ قَالَ سَمِعْتُ أَوْسًا يَقُولُ دَخَلَ عَلَيْنَا رَسُولُ اللهِ ﷺ وَنَحْنُ فِي قُبَّةٍ وَسَاقَ الْحَدِيثَ
"I heard Aws say: 'I came to the Messenger of Allah [SAW] among the delegation of Thaqif and I was with him in a tent. Everyone in the tent had gone to sleep except him and I. A man came and whispered to him, and he said: Go and kill him. Then he said: Does he not bear witness to La ilaha illallah (there is none worthy of worship except Allah) and that I am the Messenger of Allah? He said: He does bear witness to that. The Messenger of Allah [SAW] said: Leave him alone. Then he said: I have been commanded to fight the people until they say La ilaha illallah. If they say it, then their blood and their wealth become forbidden to me, except for a right that is due. (One of the narrators) Muhammad said: I said to Shu'bah: 'Doesn't the Hadith contain: Does he not testify to La ilaha illallah (there is none worthy of worship except Allah) and that I am the Messenger of Allah?' He said: 'I think it is both, but I do not know.'" (Using translation from Nasāʾī 3982)
سَمِعْتُ أَوْسًا يَقُولُ أَتَيْتُ رَسُولَ اللهِ ﷺ فِي وَفْدِ ثَقِيفَ فَكُنْتُ مَعَهُ فِي قُبَّةٍ فَنَامَ مَنْ كَانَ فِي الْقُبَّةِ غَيْرِي وَغَيْرُهُ فَجَاءَ رَجُلٌ فَسَارَّهُ فَقَالَ «اذْهَبْ فَاقْتُلْهُ» فَقَالَ «أَلَيْسَ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ؟» قَالَ إِنَّهُ يَقُولُهَا تَعَوُّذًا فَقَالَ رَسُولُ اللهِ ﷺ وَذَكَرَ كَلِمَةً مَعْنَاهَا يَعْنِي ذَرْهُ ثُمَّ قَالَ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا قَالُوهَا حَرُمَتْ دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلَّا بِحَقِّهَا» قَالَ مُحَمَّدٌ فَقُلْتُ لِشُعْبَةَ أَلَيْسَ فِي الْحَدِيثِ ثُمَّ قَالَ أَلَيْسَ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ؟ قَالَ أَظُنُّهَا مَعَهَا وَلَا أَدْرِي
'Amr bin Aws told him that his father Aws said: "The Messenger of Allah [SAW] said: 'I have been commanded to fight the people until they bear witness to La ilaha illallah (there is none worthy of worship except Allah), then their blood and their wealth become forbidden to me, except for a right that is due." (Using translation from Nasāʾī 3983)
قَالَ رَسُولُ اللهِ ﷺ «أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَشْهَدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ ثُمَّ تَحْرُمُ دِمَاؤُهُمْ وَأَمْوَالُهُمْ إِلَّا بِحَلِّهَا»
"I heard Mu'awiyah delivering the Khutbah, and he narrated a few Hadiths from the Messenger of Allah [SAW]." He said: "I heard him delivering a Khutbah and he said: 'I heard the Messenger of Allah [SAW] say: Every sin may be forgiven by Allah except a man who kills a believer deliberately, or a man who dies as a disbeliever.'" عَنْ رَسُولِ اللهِ ﷺ قَالَ سَمِعْتُهُ يَخْطُبُ وَيَقُولُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «كُلُّ ذَنْبٍ عَسَى اللهُ أَنْ يَغْفِرَهُ إِلَّا الرَّجُلُ يَقْتُلُ الْمُؤْمِنَ مُتَعَمِّدًا وَالرَّجُلُ يَمُوتُ كَافِرًا»
Messenger of Allah ﷺ said, "Whenever a person is murdered unjustly, there is a share from the burden of the crime on the first son of Adam for he was the first to start the tradition of murdering." (Using translation from Bukhārī 3335)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا تُقْتَلُ نَفْسٌ ظُلْمًا إِلَّا كَانَ عَلَى ابْنِ آدَمَ الْأَوَّلَ كِفْلٌ مِنْ دَمِهَا وَذَلِكَ أَنَّهُ أَوَّلُ مَنْ سَنَّ الْقَتْلَ»

٧۔٢ تَعْظِيمُ الدَّمِ

قَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَقَتْلُ مُؤْمِنٍ أَعْظَمُ عِنْدَ اللهِ مِنْ زَوَالِ الدُّنْيَا»
The Prophet [SAW] said: "The extinction of the whole world is less significant before Allah than killing a Muslim man." (Using translation from Nasāʾī 3987)

قَالَ رَسُولُ اللهِ ﷺ «أَوَّلُ مَا يُحَاسَبُ بِهِ الْعَبْدُ الصَّلَاةُ وَأَوَّلُ مَا يُقْضَى بَيْنَ النَّاسِ فِي الدِّمَاءِ»

«أَوَّلُ مَا يُقْضَى بَيْنَ النَّاسِ فِي الدِّمَاءِ»
The Prophet [SAW] said: "A man will come, holding another man's hand, and will say: 'O Lord, this man killed me.' Allah will say to him: 'Why did you kill him?' He will say: 'I killed him so that the glory would be to you.' He will say: 'It is to Me.' Then (another) man will come holding another man's hand, and will say: 'This man killed me.' Allah will say to him: 'Why did you kill him?' He will say: 'So that the glory would be to so and so.' He will say: 'It is not to so and so,' and the burden of sin will be upon him." عَنِ النَّبِيِّ ﷺ قَالَ يَجِيءُ الرَّجُلُ آخِذًا بِيَدِ الرَّجُلِ فَيَقُولُ يَا رَبِّ هَذَا قَتَلَنِي فَيَقُولُ اللهُ لَهُ لِمَ قَتَلْتَهُ؟ فَيَقُولُ قَتَلْتُهُ لِتَكُونَ الْعِزَّةُ لَكَ فَيَقُولُ فَإِنَّهَا لِي وَيَجِيءُ الرَّجُلُ آخِذًا بِيَدِ الرَّجُلِ فَيَقُولُ إِنَّ هَذَا قَتَلَنِي فَيَقُولُ اللهُ لَهُ لِمَ قَتَلْتَهُ؟ فَيَقُولُ قَتَلْتُهُ لِتَكُونَ الْعِزَّةُ لِفُلَانٍ فَيَقُولُ فَإِنَّهَا لَيْسَتْ لِفُلَانٍ فَيَبُوءُ بِإِثْمِهِ
"Jundab said: 'So and so told me that the Messenger of Allah [SAW] said: The slain will bring his killer on the Day of Resurrection and will say: Ask him why he killed me. He will say: I killed him defending the kingdom of so and so.'" Jundab said: "So be careful.'" (Using translation from Nasāʾī 3998)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَجِيءُ الْمَقْتُولُ بِقَاتِلِهِ يَوْمَ الْقِيَامَةِ فَيَقُولُ سَلْ هَذَا فِيمَ قَتَلَنِي؟ فَيَقُولُ قَتَلْتُهُ عَلَى مُلْكِ فُلَانٍ قَالَ جُنْدُبٌ فَاتَّقِهَا
Ibn 'Abbas was asked about someone who killed a believer deliberately, then he repented, believed and did righteous deeds, and followed true guidance. Ibn 'Abbas said: "There is no way the repentance could avail him! I heard the Prophet [SAW] say: 'He (the victim) will come hanging onto his killer, with his jugular veins flowing with blood and saying: O Lord, ask him why he killed me. Then he said: By Allah, Allah revealed it and never abrogated anything of it.'" (Using translation from Nasāʾī 3999)
سَمِعْتُ نَبِيَّكُمْ ﷺ يَقُولُ يَجِيءُ مُتَعَلِّقًا بِالْقَاتِلِ تَشْخَبُ أَوْدَاجُهُ دَمًا فَيَقُولُ أَيْ رَبِّ سَلْ هَذَا فِيمَ قَتَلَنِي؟ ثُمَّ قَالَ وَاللهِ لَقَدْ أَنْزَلَهَا اللهُ ثُمَّ مَا نَسَخَهَا
"The people of Al-Kufah differed concerning this Verse: "And whoever kills a believer intentionally." So I went to Ibn 'Abbas and asked him, and he said: 'It was revealed among the last of what was revealed, and nothing of it was abrogated after that.'" (Using translation from Nasāʾī 4000)
لَقَدْ نَزَلَتْ فِي آخِرِ مَا أُنْزِلَ ثُمَّ مَا نَسَخَهَا شَيْءٌ
"I said to Ibn 'Abbas: 'Can a person, who killed a believer intentionally, repent?' He said: 'No.' I recited the Verse from Al-Furqan to him: 'And those who invoke not any other ilah (god) along with Allah, or kill such person as Allah has forbidden, except by right,' he said: 'This Verse was revealed in Makkah and was abrogated by a Verse that was revealed in Al-Madinah: 'And whoever kills a believer intentionally, his recompense is Hell.'" قُلْتُ لِابْنِ عَبَّاسٍ هَلْ لِمَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا مِنْ تَوْبَةٍ؟ قَالَ لَا وَقَرَأْتُ عَلَيْهِ الْآيَةَ الَّتِي فِي الْفُرْقَانِ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ} [الفرقان 68] قَالَ هَذِهِ آيَةٌ مَكِّيَّةٌ نَسَخَتْهَا آيَةٌ مَدَنِيَّةٌ {وَمَنْ يُقْتَلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ} [النساء 93]
'Abd al Rahman b. Abzi commanded me that I should ask Ibn 'Abbas about these two verses:" He who slays a believer intentionally his requital shall be Hell where he would abide for ever" (iv. 92). So, I asked him and he said: Nothing has abrogated it. And as for this verse:" And they who call not upon another god with Allah and slay not the soul which Allah has forbidden, except in the cause of justice" (xxv. 68), he (Ibn Abbas) said: This has been revealed in regard to the polytheists." عَنْ هَاتَيْنِ الْآيَتَيْنِ {وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا} [النساء 93] فَسَأَلْتُهُ فَقَالَ لَمْ يَنْسَخْهَا شَيْءٌ وَعَنْ هَذِهِ الْآيَةِ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ} [الفرقان 68] قَالَ نَزَلَتْ فِي أَهْلِ الشِّرْكِ
Some people used to kill, and they did a great deal of it, and they used to commit adultery and they did a great deal of it, and they committed violations. They came to the Prophet [SAW] and said: "O Muhammad, what you say and call people to is good, if only you could tell us that there is any expiation for what we have done." Then Allah, the Mighty and Sublime, revealed: "And those who invoke not any other ilah (god) along with Allah up to for those, Allah will change their sins into good deeds," he said: "So Allah will change their Shirk into faith, and their adultery into chastity. And the Verse: "Say: O 'Ibadi (My slaves) who have transgressed against themselves (by committing evil deeds and sins)" was revealed. (Using translation from Nasāʾī 4003)
أَنَّ قَوْمًا كَانُوا قَتَلُوا فَأَكْثَرُوا وَزَنَوْا فَأَكْثَرُوا وَانْتَهَكُوا فَأَتَوُا النَّبِيَّ ﷺ فَقَالُوا يَا مُحَمَّدُ إِنَّ الَّذِي تَقُولُ وَتَدَعُو إِلَيْهِ لَحَقٌّ لَو تُخْبِرُنَا أَنَّ لِمَا عَمِلْنَاهُ كَفَّارَةً فَأَنْزَلَ اللهُ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَلَا يَزْنُونَ} [الفرقان 68] إِلَى {فَأُولَئِكَ يُبَدِّلُ اللهُ سَيِّئَاتِهِمْ حَسَنَاتٍ وَكَانَ اللهُ غَفُورًا رَحِيمًا} [الفرقان 70] قَالَ يُبَدَّلُ اللهُ بِشِرْكِهِمْ إِيمَانًا وَبِزِنَاهُمْ إِحْصَانًا وَنَزَلَتْ {قُلْ يَا عَبَّادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ} [الزمر 53] الْآيَةَ
Some pagans who committed murders in great number and committed illegal sexual intercourse excessively, came to Muhammad and said, "O Muhammad! Whatever you say and invite people to, is good: but we wish if you could inform us whether we can make an expiration for our (past evil) deeds." So the Divine Verses came: 'Those who invoke not with Allah any other god, not kill such life as Allah has forbidden except for just cause, nor commit illegal sexual intercourse.' (25.68) And there was also revealed:-- 'Say: O My slaves who have transgressed against their souls! Despair not of the Mercy of Allah.' (39.53) (Using translation from Bukhārī 4810)
أَنَّ نَاسًا مِنْ أَهْلِ الشِّرْكِ أَتَوْا مُحَمَّدًا فَقَالُوا إِنَّ الَّذِي تَقُولُ وَتَدَعُو إِلَيْهِ لَخَيْرٌ لَو تُخْبِرَنَا أَنَّ لِمَا عَمِلْنَا كَفَّارَةً فَأُنْزِلَتْ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ} [الفرقان 68] وَنَزَلَتْ {قُلْ يَا عَبَّادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ} [الزمر 53]
The Prophet [SAW] said: "The slain will bring his killer on the Day of Resurrection with his forelock and his head in his hand, and with his jugular veins flowing with blood, and will say: 'O Lord, he killed me,' until he draws near to the Throne." They mentioned repentance to Ibn 'Abbas and he recited this Verse: "And whoever kills a believer intentionally, his recompense is Hell" He said: "It has not been abrogated since it was revealed; there is no way he could repent." عَنِ النَّبِيِّ ﷺ قَالَ يَجِيءُ الْمَقْتُولُ بِالْقَاتِلِ يَوْمَ الْقِيَامَةِ نَاصِيَتُهُ وَرَأْسُهُ فِي يَدِهِ وَأَوْدَاجُهُ تَشْخَبُ دَمًا يَقُولُ يَا رَبِّ قَتَلَنِي حَتَّى يُدْنِيَهُ مِنَ الْعَرْشِ قَالَ فَذَكَرُوا لِابْنِ عَبَّاسٍ التَّوْبَةَ فَتَلَا هَذِهِ الْآيَةَ {وَمَنْ يُقْتَلْ مُؤْمِنًا مُتَعَمِّدًا} [النساء 93] قَالَ مَا نُسِخَتْ مُنْذُ أُنْزِلَتْ وَأَنَّى لَهُ بِالتَّوْبَةِ
"This Verse - 'And whoever kills a believer intentionally, his recompense is Hell' - was revealed six months after the Verse which was revealed in Surat Al-Furqan." (Using translation from Nasāʾī 4006)
نَزَلَتْ هَذِهِ الْآيَةُ {وَمَنْ يُقْتَلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا} [النساء 93] الْآيَةُ كُلُّهَا بَعْدَ الْآيَةِ الَّتِي أُنْزِلَتْ فِي الْفُرْقَانِ بِسِتَّةِ أَشْهُرٍ قَالَ أَبُو عَبْدِ الرَّحْمَنِ مُحَمَّدُ بْنُ عَمْرٍو لَمْ يَسْمَعْهُ مِنْ أَبِي الزِّنَادِ
"And whoever kills a believer intentionally, his recompense is Hell" that he said: "This Verse was revealed eight months after the Verse that is in Tabark Al-Furqan: "And those who invoke not any other ilah (god) along with Allah, or kill such person as Allah has forbidden, except by right." عَنْ زَيْدٍ فِي قَوْلِهِ {وَمَنْ يُقْتَلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا} [النساء 93] قَالَ نَزَلَتْ هَذِهِ الْآيَةُ بَعْدَ الَّتِي فِي تَبَارَكَ بِثَمَانِيَةِ أَشْهُرٍ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ} [الفرقان 68] قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَدْخَلَ أَبُو الزِّنَادِ بَيْنَهُ وَبَيْنَ خَارِجَةَ مُجَالِدَ بْنَ عَوْفٍ
"I heard Kharijah bin Zaid bin Thabit narrate that his father said: (The Verse) 'And whoever kills a believer intentionally, his recompense is Hell' was revealed and we became worried about it. Then the Verse in Al-Furqan 'And those who invoke not any other ilah (god) along with Allah, or kill such person as Allah has forbidden, except by right.' was revealed." نَزَلَتْ {وَمَنْ يُقْتَلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ خَالِدًا فِيهَا} [النساء 93] أَشْفَقْنَا مِنْهَا فَنَزَلَتِ الْآيَةُ الَّتِي فِي الْفُرْقَانِ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ} [الفرقان 68]
7.3 [Machine] The mention of major sins
٧۔٣ ذِكْرُ الْكَبَائِرِ
The Messenger of Allah [SAW] said: "Whoever comes worshipping Allah and not associating anything with Him, establishing Salah, paying Zakah and avoiding major sins, Paradise will be his." They asked him about major sins and he said: "Associating others with Allah, killing a Muslim soul, and fleeing (from the battlefield) on the day of the march." (Using translation from Nasāʾī 4009)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ جَاءَ يَعْبُدُ اللهَ لَا يُشْرِكُ بِهِ شَيْئًا وَيُقِيمُ الصَّلَاةَ وَيُؤْتِي الزَّكَاةَ وَيَجْتَنِبُ الْكَبَائِرَ كَانَ لَهُ الْجَنَّةُ» فَسَأَلُوهُ عَنْ الْكَبَائِرِ فَقَالَ «الْإِشْرَاكُ بِاللهِ وَقَتْلُ النَّفْسِ الْمُسْلِمَةِ وَالْفِرَارُ يَوْمَ الزَّحْفِ»
"I heard Anas say: 'The Messenger of Allah [SAW] said: The major sins are: Associating others with Allah (Shirk), disobeying one's parents, killing a soul (murder) and speaking falsely.'" (Using translation from Nasāʾī 4010)
عَنِ النَّبِيِّ ﷺ وَأَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا النَّضْرُ بْنُ شُمَيْلٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ عُبَيْدِ اللهِ بْنِ أَبِي بَكْرٍ قَالَ سَمِعْتُ أَنَسًا يَقُولُ قَالَ رَسُولُ اللهِ ﷺ «الْكَبَائِرُ الشِّرْكُ بِاللهِ وَعُقُوقُ الْوَالِدَيْنِ وَقَتْلُ النَّفْسِ وَقَوْلُ الزُّورِ»
The Prophet ﷺ said, "The biggest sins are: To join others in worship with Allah; to be undutiful to one's parents; to kill somebody unlawfully; and to take an oath Al-Ghamus. (Using translation from Bukhārī 6675)
عَنِ النَّبِيِّ ﷺ قَالَ «الْكَبَائِرُ الْإِشْرَاكُ بِاللهِ وَعُقُوقُ الْوَالِدَيْنِ وَقَتْلُ النَّفْسِ وَالْيَمِينُ الْغَمُوسُ»
His father - who was one of the Companions of the Prophet [SAW] - told him: "A man said: 'O Messenger of Allah, what are the major sins?' He said: 'They are seven; the most grievous of which are associating others with Allah, killing a soul unlawfully and fleeing (from the battlefield) on the day of the march.'" It is abridged. أَنَّهُ حَدَّثَهُ أَبُوهُ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَنَّ رَجُلًا قَالَ يَا رَسُولَ اللهِ مَا الْكَبَائِرُ؟ قَالَ «هُنَّ تِسْعٌ أَعْظَمُهُنَّ إِشْرَاكٌ بِاللهِ وَقَتْلُ نَفْسٍ بِغَيْرِ حَقٍّ وَفِرَارٌ يَوْمَ الزَّحْفِ» مُخْتَصَرٌ
7.4 [Machine] Mentioning the greatest sin and the disagreement of Yahya and Abdul Rahman regarding a hadith reported by Wail from Abdullah in it
٧۔٤ ذِكْرُ أَعْظَمِ الذَّنْبِ، وَاخْتِلَافُ يَحْيَى وَعَبْدِ الرَّحْمَنِ عَلَى سُفْيَانَ فِي حَدِيثِ وَاصِلٍ عَنْ أَبِي وَائِلٍ عَنْ عَبْدِ اللهِ فِيهِ
"I said: 'O Messenger of Allah, which sin is the most grievous?' He said: 'Setting up a rival to Allah while it is He that has created you.' I said: 'Then what?' He said: 'Killing your child for fear that he may eat with you.' I said: 'Then what?' He said: 'Committing adultery with your neighbor's wife.'" (Using translation from Nasāʾī 4013)
قُلْتُ يَا رَسُولَ اللهِ أَيُّ الذَّنْبِ أَعْظَمُ؟ قَالَ «أَنْ تَجْعَلَ لِلَّهِ نِدًّا وَهُوَ خَلَقَكَ» قُلْتُ ثُمَّ مَاذَا؟ قَالَ «أَنْ تَقْتُلَ وَلَدًا خَشْيَةَ أَنْ يَعْنِي يَطْعَمَ مَعَكَ» قُلْتُ ثُمَّ مَاذَا؟ قَالَ «أَنْ تُزَانِيَ بِحَلِيلَةِ جَارِكَ»
"I said: 'O Messenger of Allah, which sin is the most grievous?' He said: 'Setting up a rival to Allah while it is He that has created you.' I said: 'Then what?' He said: 'Killing your child for fear that he may eat with you.' I said: 'Then what?' He said: 'Committing adultery with your neighbor's wife.'" (Using translation from Nasāʾī 4013)
قُلْتُ يَا رَسُولَ اللهِ أَيُّ الذَّنْبِ أَعْظَمُ؟ قَالَ «أَنْ تَجْعَلَ لِلَّهِ نِدًّا وَهُوَ خَلَقَكَ» قُلْتُ ثُمَّ أَيٌّ؟ قَالَ «ثُمَّ أَنْ تَقْتُلَ وَلَدَكَ مِنْ أَجْلِ أَنْ يَطْعَمَ مَعَكَ» قُلْتُ ثُمَّ أَيٌّ؟ قَالَ «أَنْ تُزَانِيَ بِحَلِيلَةِ جَارِكَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ
"I asked the Messenger of Allah [SAW], which sin is most grievous?" He said: "Shirk, setting up a rival to Allah, committing adultery with your neighbor's wife, and killing your child for fear of poverty, and that he may eat with you." Then 'Abdullah recited the Verse: "And those who invoke not any other Ilah (god) along with Allah." (Using translation from Nasāʾī 4015)
سَأَلْتُ رَسُولَ اللهِ ﷺ أَيُّ الذَّنْبِ أَعْظَمُ؟ قَالَ «الشِّرْكُ أَنْ تَجْعَلَ لِلَّهِ نِدًا وَأَنْ تُزَانِي حَلِيلَةَ جَارِكَ وَأَنْ تَقْتُلَ وَلَدَكَ خَشْيَةَ الْفَقْرِ أَنْ يَأْكُلَ مَعْكَ» ثُمَّ قَرَأَ عَبْدُ اللهِ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِى حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَلَا يَزْنُونَ} قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ لَا نَعْلَمُ أَنَّ أَحَدًا تَابَعَ يَزِيدَ عَلَيْهِ
7.5 [Machine] Mentioning what is permissible with the blood of a Muslim
٧۔٥ ذِكْرُ مَا يَحِلُّ بِهِ دَمُ الْمُسْلِمِ
Messenger of Allah ﷺ stood up and said: By Him besides Whom there is no god but He, the blood of a Muslim who bears the testimony that there is no god but Allah, and I am His Messenger, may be lawfully shed only in case of three persons: the one who abandons Islam, and deserts the community [Ahmad, one of the narrators, is doubtful whether the Prophet ﷺ used the word li'l-jama'ah or al-jama'ah), and the married adulterer, and life for life. قَالَ رَسُولُ اللهِ ﷺ وَالَّذِي لَا إِلَهَ غَيْرُهُ لَا يَحِلُّ دَمُ رَجُلٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ إِلَّا ثَلَاثَةُ نَفَرٍ التَّارِكُ لِلْإِسْلَامِ مُفَارِقُ الْجَمَاعَةِ وَالثَّيِّبُ الزَّانِي وَالنَّفْسُ بِالنَّفْسِ قَالَ الْأَعْمَشُ فَحَدَّثْتُ بِهِ إِبْرَاهِيمَ فَحَدَّثَنِي عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ بِمِثْلِهِ
