٤٢۔ كِتَابُ الْحُدُودِ ص ٣
The Prophet ﷺ did not prescribe any punishment for drinking wine. Ibn Abbas said: A man who had drunk wine and become intoxicated was found staggering on the road, so he was taken to the Prophet ﷺ. When he was opposite al-Abbas's house, he escaped, and going in to al-Abbas, he grasped hold of him. When that was mentioned to the Prophet ﷺ, he laughed and said: Did he do that? and he gave no command regarding him. Abu Dawud said: This tradition of al-Hasan b. 'Ali has been transmitted only by the people of Medina. (Using translation from Abū Dāʾūd 4476)
«أَنَّ رَسُولَ اللَّهِ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا» قَالَ ابْنُ عَبَّاسٍ شَرِبَ رَجُلٌ فَسَكِرَ فَثَمِلَ فِي الْفَجِّ فَانْطَلَقْنَا بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا حَاذَى بِدَارِ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى الْعَبَّاسِ فَالْتَزَمَهُ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ «أَفَعَلَهَا؟» وَلَمْ يَأْمُرْ فِيهِ بِشَيْءٍ
When An-Nuaman or his son was brought in a state of drunkenness, Messenger of Allah ﷺ ordered all those who were present in the house to beat him. I was one of those who beat him. We beat him with shoes and palm-leaf stalks. (Using translation from Bukhārī 2316)
«جِيءَ بِالنُّعَيْمَانِ أَوْ بِابْنِ النُّعَيْمَانِ شَارِبًا فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبَهُ» قَالَ «وَكُنْتُ أَنَا فِيمَنْ ضَرَبَهُ فَضَرَبْنَاهُ بِالنِّعَالِ وَالْجَرِيدِ»
[Machine] "The Prophet ﷺ ordered for Nu'aiman to be brought, and those in the house began hitting him with their hands and sandals. I was among those who hit him, according to the conditions of Bukhari and Muslim."
«جِيءَ بِالنُّعَيْمَانِ فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ فِي الْبَيْتِ فَضَرَبُوهُ بِالْأَيْدِي وَالنِّعَالِ» وَكُنْتُ فِيمَنْ ضَرَبَهُعلى شرط البخاري ومسلم
[Machine] "The mustache was presented during the time of the Prophet Muhammad ﷺ, and during the caliphate of Abu Bakr, and part of the caliphate of Umar. We would go to it and strike it with our hands, sandals, and cloaks until it became red from the caliphate of Umar. He would then lash it forty times until it became damaged and split into eighty pieces."
«كَانَ يُؤْتَى بِالشَّارِبِ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ وَفِي إِمْرَةِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمْرَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَنِعَالِنَا وَأَرْدِيَتِنَا حَتَّى كَانَ صَدْرًا مِنْ إِمَارَةِ عُمَرَ فَجَلَدَ فِيهَا أَرْبَعِينَ حَتَّى إِذَا عَاثُوا فِيهَا وَفَسَقُوا جَلْدَ فِيهَا ثَمَانِينَ»
[Machine] The Prophet ﷺ was brought a man with a long beard, and he said, "Stand up to him and strike him." So they stood up to him and hit him with their sandals.
أُتِيَ النَّبِيُّ ﷺ بِشَارِبٍ فَقَالَ «قُومُوا إِلَيْهِ فَاضْرِبُوهُ» فَقَامُوا إِلَيْهِ فَخَفَقُوهُ بِنِعَالِهِمْ
[Machine] I do not drink grape wine after the Prophet ﷺ was brought some Nabidh. He said: "O Messenger of Allah, I did not drink alcohol, but I drank Nabidh made from raisins and dates mixed with water." He then ordered for it to be brought and shook it with his hands and hit it with his sandals. He prohibited the use of raisins, dates, and the Nabidh container."
لَا أَشْرَبُ نَبِيذَ الْجَرِّ بَعْدَ إِذْ أُتِيَ النَّبِيُّ ﷺ بِنَشْوَانَ فَقَالَ يَا رَسُولَ اللَّهِ مَا شَرِبْتُ خَمْرًا لَكِنِّي شَرِبْتُ نَبِيذَ زَبَيبِ وَتَمْرٍ فِي دُبَّاءَ «فَأَمَرَ بِهِ فَنُهِزَ بِالْأَيْدِي وَخُفِقَ بِالنِّعَالِ وَنَهَى عَنِ الزَّبِيبِ وَالتَّمْرِ وَعَنِ الدُّبَّاءِ»
[Machine] "I saw the Messenger of Allah ﷺ on the day of Hunayn, as he was walking among the people inquiring about the whereabouts of Khalid bin Al-Walid. So, a drunk man was brought to him, and the Messenger of Allah ﷺ ordered those who were with him to strike him with what they had in their hands." He said, "The Messenger of Allah ﷺ then threw dirt on his face." He said, "Then Abu Bakr brought a drunk man." He said, "So, those who were struck on that day by the Messenger of Allah ﷺ were forty, and Umar also struck forty."
«رَأَيْتُ رَسُولَ اللَّهِ ﷺ يَوْمَ حُنَيْنٍ وَهُوَ يَتَخَلَّلُ النَّاسَ يَسْأَلُ عَنْ مَنْزِلِ خَالِدِ بْنِ الْوَلِيدِ فَأُتِيَ بِسَكْرَانَ فَأَمَرَ رَسُولُ اللَّهِ ﷺ مَنْ كَانَ عِنْدَهُ أَنْ يَضْرِبُوهُ بِمَا كَانَ فِي أَيْدِيهِمْ» قَالَ «وَحَثَا رَسُولُ اللَّهِ ﷺ التُّرَابَ فِي وَجْهِهِ» قَالَ «ثُمَّ أُتِيَ أَبُو بَكْرٍ بِسَكْرَانَ» قَالَ «فَتَوَخَّى الَّذِينَ كَانَ مَنْ ضَرْبَهُمْ يَوْمَئِذٍ فَضُرِبَ أَرْبَعِينَ» وَضَرَبَ عُمَرُ أَرْبَعِينَ
[Machine] Ali, we see him when this (person) gets drunk and when this (person) fabricates lies, and upon the liar is eighty (lashes). Then Umar said, "Inform your companion of what he said." Khalid was then flogged eighty times, and Umar was flogged eighty times. When a strong man heavily indulged in drinking was brought to Umar, he would flog him eighty times. And when a weak man, who was prone to making mistakes, was brought to him, he would flog him forty times. Then Uthman was flogged eighty-four times.
عَلِيٌّ نَرَاهُ إِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ فَقَالَ عُمَرُ أَبْلِغْ صَاحِبَكَ مَا قَالَ فَجَلَدَ خَالِدٌ ثَمَانِينَ وَجَلَدَ عُمَرُ ثَمَانِينَ وَكَانَ عُمَرُ إِذَا أُتِيَ بِالرَّجُلِ الْقَوِيِّ الْمُنْهَمِكِ فِي الشَّرَابِ جَلَدَهُ ثَمَانِينَ وَإِذَا أُتِيَ بِالرَّجُلِ الضَّعِيفِ الَّتِي كَانَتْ مِنْهُ الزَّلَّةُ جَلَدَ أَرْبَعِينَ ثُمَّ جَلَدَ عُثْمَانُ ثَمَانِينَ وَأَرْبَعِينَ
[Machine] Indeed, the drunkards used to be whipped during the time of the Messenger of Allah ﷺ with their hands, sandals, and sticks until the Messenger of Allah ﷺ passed away. And during the caliphate of Abu Bakr, there were more of them than during the time of the Messenger of Allah ﷺ. Abu Bakr said, "If we appoint a punishment for them, it should be milder than what they used to be struck with during the time of the Messenger of Allah ﷺ." So Abu Bakr flogged them forty lashes until they died. Then Umar succeeded him and flogged them likewise until a man from the early emigrants came, and he had drunk. Umar ordered that he should be flogged, so the man asked, "Why are you flogging me while the Book of Allah ﷻ is between me and you?" Umar asked, "In which verse of the Book of Allah do you find that I should not flog you?" The man replied, "Indeed, Allah ﷻ says in His book: 'There is no sin upon those who believe and do righteous deeds for what they have eaten' (Al-Ma'idah 5:93). I am among those who believe and do righteous deeds, then fear and believe, then fear and do good. I accompanied the Messenger of Allah ﷺ in Badr, Hudaybiyyah, and the Battle of the Trench." Umar asked, "Don't you respond to what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who passed away, and as an argument against those who remained. Allah ﷻ says: 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan' (Al-Ma'idah 5:90). Then he recited until he reached the other verse: 'There is no sin upon those who believe and do righteous deeds for what they have eaten when they fear Allah and believe and do righteous deeds, then fear Allah and believe, then fear Allah and do good' (Al-Ma'idah 5:93). Indeed, Allah ﷻ has forbidden the consumption of alcohol." Umar said, "You have spoken the truth. What do you all think?" Ali said, "We believe that if he drinks, he becomes intoxicated, and if he is intoxicated, he raves, and if he raves, he fabricates, and for the fabricator, there are eighty lashes." So Umar ordered that he should be flogged eighty times.
إِنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعَصَا حَتَّى تُوُفِّيَ رَسُولُ اللَّهِ ﷺ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ أَكْثَرَ مِنْهُمْ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَقَالَ أَبُو بَكْرٍ لَوْ فَرَضْنَا لَهُمْ حَدًّا فَتَوَخَّى نَحْوًا مِمَّا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَكَانَ أَبُو بَكْرٍ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ قَامَ مِنْ بَعْدِهِ عُمَرُ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينَ الْأَوَّلِينَ وَقَدْ كَانَ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لِمَ تَجْلِدُنَي بَيْنِي وَبَيْنَكَ كِتَابُ اللَّهِ ﷻ فَقَالَ عُمَرُ فِي أَيِّ كِتَابِ اللَّهِ تَجِدُ أَنِّي لَا أَجْلِدُكَ؟ فَقَالَ إِنَّ اللَّهَ تَعَالَى يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ فَأَنَا مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقُوا وَآمَنُوا ثُمَّ اتَّقُوا وَأَحْسِنُوا شَهِدْتُ مَعَ رَسُولِ اللَّهِ ﷺ بَدْرًا وَالْحُدَيْبِيَةَ وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَذِهِ الْآيَاتِ أُنْزِلَتْ عُذْرًا لِلْمَاضِينَ وَحَجَّةً عَلَى الْبَاقِينَ لِأَنَّ اللَّهَ ﷻ يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمِلِ الشَّيْطَانِ} [المائدة 90] ثُمَّ قَرَأَ حَتَّى أَنْفَذَ الْآيَةَ الْأُخْرَى {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا} [المائدة 93] فَإِنَّ اللَّهَ ﷻ قَدْ نَهَى أَنْ يُشْرَبَ الْخَمْرُ فَقَالَ عُمَرُ صَدَقْتَ فَمَاذَا تَرَوْنَ فَقَالَ عَلِيٌّ «نَرَى أَنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذَى وَإِذَا هَذَى افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً» فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ
[Machine] A woman who was a beggar during the pre-Islamic era was approached by a man who extended his hand towards her and flirted with her. She said, "What? Indeed, Allah, the Exalted, has removed polytheism and brought Islam, so he left it and turned away." Then, he kept turning and looking back at her until he hit his face against the wall. He went to the Prophet ﷺ and mentioned this incident to him. The Prophet ﷺ said, "You are a servant whom Allah intends good for. Indeed, when Allah intends good for a servant, He hastens the punishment of his sins. And when He intends evil for him, He holds back the punishment for his sins until he is recompensed on the Day of Resurrection as if he had not committed any sin."
أَنَّ امْرَأَةً كَانَتْ بَغِيًّا فِي الْجَاهِلِيَّةِ مَرَّ بِهَا رَجُلٌ فَبَسَطَ يَدَهُ إِلَيْهَا وَلَاعَبَهَا فَقَالَتْ مَهْ إِنَّ اللَّهَ تَعَالَى ذَهَبَ بِالشِّرْكِ وَجَاءَ بِالْإِسْلَامِ فَتَرَكَهَا وَوَلَّى فَجَعَلَ يَلْتَفِتُ يَنْظُرُ إِلَيْهَا حَتَّى أَصَابَ وَجْهَهُ الْحَائِطُ قَالَ فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ «أَنْتَ عَبْدٌ أَرَادَ اللَّهُ بِكَ خَيْرًا إِنَّ اللَّهَ إِذَا أَرَادَ بِعَبْدٍ خَيْرًا عَجَّلَ لَهُ عُقُوبَةَ ذَنْبِهِ وَإِذَا أَرَادَ شَرًّا أَمْسَكَ عَلَيْهِ الْعُقُوبَةَ بِذَنْبِهِ حَتَّى يُوَافِيَ بِهِ يَوْمَ الْقِيَامَةِ كَأَنَّهُ عَيْرٌ»
[Machine] I was in the city, and a neighbor passed by me, so I took her by her hand and then went to the Prophet ﷺ while he was making a pledge with the people. He said to me, "Are you not the one who had a shirt on yesterday?" I said, "No, O Messenger of Allah, I have returned." So he gave me a pledge.
كُنْتُ بِالْمَدِينَةِ فَمَرَّتْ بِي جَارِيَةٌ فَأَخَذْتُ بِكَشْحِهَا ثُمَّ أَتَيْتُ النَّبِيَّ ﷺ وَهُوَ يُبَايِعُ النَّاسَ فَقَالَ لِي «أَلَسْتَ صَاحِبَ الْجُبَيْذَةِ بِالْأَمْسِ؟» قُلْتُ لَا أَعُودُ يَا رَسُولَ اللَّهِ فَبَايَعَنِي
[Machine] "The Messenger of Allah ﷺ forbade us from spying, but if it becomes apparent to us, we may take action."
«إِنَّ رَسُولَ اللَّهِ ﷺ نَهَانَا عَنِ التَّجَسُّسِ إِنْ يَظْهَرْ لَنَا نَأْخُذْهُ»
[Machine] "Umar took the hand of Abdur Rahman and said, 'Do you know whose house this is?' He replied, 'No.' Umar said, 'This is the house of Rabi'ah ibn Umayyah ibn Khalaf, and they are currently drinking wine. So, what do you see?' Abdur Rahman said, 'I see that we have done what Allah has forbidden. Allah Almighty has forbidden us from spying,' then he recited (And do not spy) [Al-Hujurat: 12]. We have indeed spied.' Umar turned away from them and left them."
عُمَرُ وَأَخَذَ بِيَدِ عَبْدِ الرَّحْمَنِ أَتَدْرِي بَيْتُ مَنْ هَذَا؟ قَالَ لَا قَالَ هَذَا بَيْتُ رَبِيعَةَ بْنِ أُمَيَّةَ بْنِ خَلَفٍ وَهُمُ الْآنَ شَرْبٌ فَمَا تَرَى؟ فَقَالَ عَبْدُ الرَّحْمَنِ أَرَى قَدْ أَتَيْنَا مَا نَهَى اللَّهُ عَنْهُ نَهَانَا اللَّهُ ﷻ فَقَالَ {وَلَا تَجَسَّسُوا} [الحجرات 12] فَقَدْ تَجَسَّسْنَا «فَانْصَرَفَ عُمَرُ عَنْهُمْ وَتَرَكَهُمْ»
The Prophet ﷺ said: When a ruler seeks to make imputations against the people, he corrupts them. (Using translation from Abū Dāʾūd 4889)
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الْأَمِيرَ إِذَا ابْتَغَى الرِّيبَةَ فِي النَّاسِ أَفْسَدَهُمْ» سكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah ﷺ said: "Do not recite poetry in the mosques and the prescribed punishments should not be carried out in them." This was deleted by Al-Dhahabi from the summary.
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا تَنَاشَدُوا الْأَشْعَارَ فِي الْمَسَاجِدِ وَلَا تُقَامُ الْحُدُودُ فِيهَا» حذفه الذهبي من التلخيص
[Machine] The translation of the given Arabic text into English is: "Indeed, the Messenger of Allah ﷺ never cut anything less than the equivalent of eight dirhams in value, whether it be a piece of cloth or a shield, and both were considered to be worth eight dirhams at that time."
«إِنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَقْطَعْ فِي أَقَلَّ مِنْ ثَمَنِ مِجَنِّ جَحْفَةٍ أَوْ تُرْسٍ وَكِلَاهُمَا يَوْمَئِذٍ ذُو ثَمَنٍ»
[Machine] The Messenger of Allah ﷺ said, "May Allah curse the thief, whether he steals an egg or a rope, his hand will be cut off."
قَالَ رَسُولُ اللَّهِ ﷺ «لَعَنَ اللَّهُ السَّارِقَ إِنْ يَسْرِقْ بَيْضَةً قُطِعَتْ يَدُهُ وَإِنْ يَسْرِقْ حَبْلًا قُطِعَتْ يَدُهُ»
[Machine] "The Prophet ﷺ cut open an egg worth twenty dirhams."
«أَنَّ النَّبِيَّ ﷺ قَطَعَ فِي بَيْضَةٍ قِيمَتِهَا عِشْرُونَ دِرْهَمًا»
A similar report was narrated from Ibn 'Abbas. The price of a shield at the time of the Messenger of Allah was estimated to be ten Dirhams. (Using translation from Nasāʾī 4951)
«كَانَ ثَمَنُ الْمِجَنِّ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ يُقَوَّمُ عَشْرَةَ دَرَاهِمَ»
[Machine] "The hand was not severed during the time of the Messenger of Allah ﷺ except in exchange for a slave, and its price at that time was a dinar." I heard Abu Al-Abbas saying, I heard Ar-Rabi' saying, I heard Ash-Shafi'i saying, "This right hand is the son of the woman of Ka'b, and he is not the son of the mother of Ayyman, and he did not meet the Prophet ﷺ ."
«لَمْ يُقْطَعِ الْيَدُ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ إِلَّا فِي ثَمَنِ الْمِجَنِّ وَثَمَنُهُ يَوْمَئِذٍ دِينَارٌ» سَمِعْتُ أَبَا الْعَبَّاسِ يَقُولُ سَمِعْتُ الرَّبِيعَ يَقُولُ سَمِعْتُ الشَّافِعِيَّ يَقُولُ «أَيْمَنُ هَذَا هُوَ ابْنُ امْرَأَةِ كَعْبٍ وَلَيْسَ بِابْنِ أُمِّ أَيْمَنَ وَلَمْ يُدْرِكِ النَّبِيَّ ﷺ»
[Machine] "And Aymen was a man who was known for his goodness. He said, 'The hand of the thief should be cut off for less than the value of a gold coin, and at that time, the value of a gold coin was a dinar.' Aymen, the son of Umm Aymen, the companion and the brother of Usama through his mother, is more noble and prominent than to be attributed to ignorance. It is said about someone unknown, 'He was a man who was known for his goodness.' This statement is only said about someone unknown with uncertain credibility. However, it is reported that Jareer, upon being confronted by Aymen, remained silent, and Adh-Dhahabi did not mention him in his summary."
وَكَانَ أَيْمَنُ رَجُلًا يُذْكَرُ مِنْهُ خَيْرٌ قَالَ «تُقْطَعُ يَدُ السَّارِقِ فِي أَقَلَّ مِنْ ثَمَنِ الْمِجَنِّ وَكَانَ ثَمَنُ الْمِجَنِّ يَوْمَئِذٍ دِينَارًا» فَأَيْمَنُ ابْنُ أُمِّ أَيْمَنَ الصَّحَابِيُّ أَخُو أُسَامَةَ لِأُمِّهِ أَجَلُّ وَأَنْبَلُ أَنْ يُنْسَبَ إِلَى الْجَهَالَةِ فَيُقَالُ كَانَ رَجُلٌ يُذْكَرُ مِنْهُ خَيْرٌ إِنَّمَا يُقَالُ مِثْلُ هَذِهِ اللَّفْظِ لِمَجْهُولٍ لَا يُعْرَفُ بِالصِّحَّةِ عَلَى أَنَّ جَرِيرًا قَدْ أَوْقَفَهُ عَلَى أَيْمَنَ هَذَا وَلَمْ يُسْنِدْهُ سكت عنه الذهبي في التلخيص
[Machine] The Prophet ﷺ brought a woman who had stolen, and she sought refuge with the foster brother of the Messenger of Allah ﷺ . The Prophet ﷺ said, "If she were Fatimah, I would have cut off her hand." So he cut her hand off.
أُتِيَ النَّبِيُّ ﷺ بِامْرَأَةٍ قَدْ سَرَقَتْ فَعَاذَتْ بِرَبِيبِ رَسُولِ اللَّهِ ﷺ فَقَالَ النَّبِيُّ ﷺ «لَوْ كَانَتْ فَاطِمَةَ لَقَطَعْتُ يَدَهَا» فَقَطَعَهَا
[Machine] "My Lord and Messenger, peace be upon him, was Rabeeb ibn Abi Salamah, and indeed it was the Makhzoomiyyah who stole with one of them." The two scholars agreed to exclude the narration of Al-Zuhri from Urwah from Aisha that the Makhzoomiyyah had only sought refuge with Usamah ibn Zaid, and this is the correct (narration). Al-Dhahabi remained silent about it in his summary.
«كَانَ رَبِيبُ رَسُولِ اللَّهِ ﷺ سَلَمَةَ بْنَ أَبِي سَلَمَةَ وَإِنَّمَا عَاذَتِ الْمَخْزُومِيَّةُ الَّتِي سَرَقَتْ بِأَحَدِهِمَا» قَدِ اتَّفَقَ الشَّيْخَانِ عَلَى إِخْرَاجِ حَدِيثِ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ أَنَّ الْمَخْزُومِيَّةَ إِنَّمَا عَاذَتْ بِأُسَامَةَ بْنِ زَيْدٍ وَهُوَ الصَّحِيحُ سكت عنه الذهبي في التلخيص
“When the woman stole the Qatifah from the house of the Messenger of Allah ﷺ, we regarded that as a serious matter. She was a woman from Quraish. So we came to the Prophet ﷺ and spoke to him, and said: 'We will ransom her for forty Uqiyyah.' The Messenger of Allah ﷺ said: 'Purification is better for her.” When we heard the Messenger of Allah ﷺ speak so kindly, we went to Usamah and said: 'Speak to the Messenger of Allah ﷺ .' When the Messenger of Allah ﷺ saw that, he stood up to speak and said: 'How much do you intercede with me concerning one of the legal punishments of Allah (SWT) that has befallen one of the female slaves of Allah (SWT)! By the One in Whose Hand is the soul of Muhammad, if Fatimah the daughter of the Messenger of Allah ﷺ were to do what she has done, Muhammad would cut off her hand.” (Using translation from Ibn Mājah 2548)
لَمَّا سَرَقَتْ تِلْكَ الْمَرْأَةُ الْقَطِيفَةَ مِنْ بَيْتِ رَسُولِ اللَّهِ ﷺ أَعْظَمْنَا ذَلِكَ وَكَانَتِ امْرَأَةً مِنْ قُرَيْشٍ فَجِئْنَا رَسُولَ اللَّهِ ﷺ فَكَلَّمْنَاهُ فَقُلْنَا يَا رَسُولَ اللَّهِ نَحْنُ نَفْدِيهَا بِأَرْبَعِينَ أُوقِيَّةً قَالَ «تَطَّهَّرُ خَيْرٌ لَهَا» فَلَمَّا سَمِعْنَا مِنْ قَوْلِ رَسُولِ اللَّهِ ﷺ أَتَيْنَا أُسَامَةَ بْنَ زَيْدٍ فَقُلْنَا اشْفَعْ لَنَا إِلَى رَسُولِ اللَّهِ ﷺ فِي شَأْنِ هَذِهِ الْمَرْأَةِ نَحْنُ نَفْدِيهَا بِأَرْبَعِينَ أُوقِيَّةً فَلَمَّا رَأَى رَسُولُ اللَّهِ ﷺ جِدَّ النَّاسِ فِي ذَلِكَ قَامَ خَطِيبًا فَقَالَ «يَا أَيُّهَا النَّاسُ مَا إِكْثَارُكُمْ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ وَقَعَ عَلَى أَمَةٍ مِنْ إِمَاءِ اللَّهِ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ لَوْ كَانَتْ فَاطِمَةُ بِنْتُ مُحَمَّدٍ نَزَلَتْ بِالَّذِي بِهِ هَذِهِ الْمَرْأَةُ لَقَطَعَ مُحَمَّدٌ يَدَهَا» قَالَ فَأَيِسَ النَّاسُ وَقَطَعَ رَسُولُ اللَّهِ ﷺ يَدَهَا قَالَ مُحَمَّدُ بْنُ إِسْحَاقَ فَحَدَّثَنِي عَبْدُ اللَّهِ بْنُ أَبِي بَكْرٍ «أَنَّ رَسُولَ اللَّهِ ﷺ بَعْدَ ذَلِكَ كَانَ يَرْحَمُهَا وَيَصِلَهَا»
[Machine] "Safwan ibn Umayyah came to the Prophet ﷺ with a man who had stolen his clothing. Then he said, 'O Messenger of Allah, gift it to me.' The Messenger of Allah ﷺ said, 'Shouldn't you have brought him to us before?'
أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ أَتَى النَّبِيَّ ﷺ بِرَجُلٍ قَدْ سَرَقَ حُلَّةً لَهُ ثُمَّ قَالَ يَا رَسُولَ اللَّهِ هَبْهُ لِي فَقَالَ رَسُولُ اللَّهِ ﷺ «فَهَلَّا قَبْلَ أَنْ تَأْتِيَنَا بِهِ»
"I was sleeping in the Masjid on a Khmaishah of mine that was worth thirty dirhams, and a man came and stole it from me. The man was caught and taken to the Prophet, who ordered that his hand be cut off. I came to him and said: "Will you cut off his hand for the sake of only thirty Dirhams? I will sell it to him on credit." He said:" Why did you not say this before you brought him to me?" (Using translation from Nasāʾī 4883)
كُنْتُ نَائِمًا فِي الْمَسْجِدِ وَعَلَيَّ خَمِيصَةٌ لِي ثَمَنُ ثَلَاثِينَ دِرْهَمًا فَجَاءَ رَجُلٌ فَاخْتَلَسَهَا مِنِّي فَأُخِذَ الرَّجُلُ فَجِيءَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَمَرَ بِهِ أَنْ يُقْطَعَ فَأَتَيْتُهُ فَقُلْتُ أَتَقْطَعُهُ مِنْ أَجْلِ ثَلَاثِينَ دِرْهَمًا؟ أَنَا أَبِيعُهُ وَأَنْسِيهِ ثَمَنَهَا قَالَ «فَهَلَّا كَانَ هَذَا قَبْلَ أَنْ تَأْتِيَنِي بِهِ» سكت عنه الذهبي في التلخيص
[Machine] "The Messenger of Allah ﷺ was brought a thief who had stolen a necklace. They said, 'O Messenger of Allah, this man has stolen.' The Messenger of Allah ﷺ said, 'What made you steal?' The thief said, 'Yes, O Messenger of Allah.' The Messenger of Allah ﷺ said, 'Take him and cut off his hand, then settle the matter and bring him to me.' The hand was cut off, then he was brought to the Messenger of Allah ﷺ who said, 'Repent to Allah.' The thief said, 'I repent to Allah.' The Messenger of Allah ﷺ said, 'Allah has accepted your repentance.'"
أَنَّ رَسُولَ اللَّهِ ﷺ أُتِيَ بِسَارِقٍ قَدْ سَرَقَ شَمْلَةً فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ هَذَا سَرَقَ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا إِخَالُهُ سَرَقَ» فَقَالَ السَّارِقُ بَلَى يَا رَسُولَ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «اذْهَبُوا بِهِ فَاقْطَعُوهُ ثُمَّ احْسِمُوهُ ثُمَّ ايْتُونِي بِهِ» فَقُطِعَ ثُمَّ أُتِيَ بِهِ فَقَالَ «تُبْ إِلَى اللَّهِ» فَقَالَ تُبْتُ إِلَى اللَّهِ فَقَالَ «تَابَ اللَّهُ عَلَيْكَ»
[Machine] A man from Muzaynah came to the Prophet ﷺ and said, "O Messenger of Allah, what do you think about grazing rights in the mountains?" He ﷺ said, "They are like the grazing rights themselves, and there is no punishment on any kind of animal except what is provided by the pasture. If someone exceeds the limit, then there is a fine equal to its value, and there are lashes as a punishment."
أَنَّ رَجُلًا مِنْ مُزَيْنَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ؟ قَالَ «هِيَ مِثْلُهَا وَالنَّكَالُ لَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلَّا مَا آوَاهُ الْمَرَاحُ فَبَلَغَ فِي الْمِجَنِّ فَفِيهِ الْقَطْعُ وَمَا لَمْ يَبْلُغْ ثَمَنَ الْمِجَنِّ فَفِيهِ غَرَامَةُ مِثْلَيْهِ وَجَلَدَاتٌ نَكَالٌ»
[Machine] I heard the Messenger of Allah ﷺ say, "No more than ten lashes should be given for a punishment below the limit set by Allah Almighty."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُجْلَدُ فَوْقَ عَشْرَةِ أَسْوَاطٍ فِيمَا دُونَ حَدٍّ مِنْ حُدُودِ اللَّهِ ﷻ»
[Machine] A man stole during the time of the Prophet Muhammad ﷺ , so he was brought to the Prophet Muhammad ﷺ . He said, "Kill him." They replied, "He only stole." He said, "Then cut off his hand." He stole again, so his hand was cut off. Then he stole during the time of Abu Bakr, so his hand was cut off. He continued to steal and his hands were cut off until his limbs were amputated. Then he stole for the fifth time, so Abu Bakr said, "The Messenger of Allah ﷺ knew about him when he ordered his execution. Take him and kill him." He was handed over to some young men from Quraysh, including Abdullah ibn Zubayr. Abdullah ibn Zubayr said, "Give me the command to execute him." They gave him the command, and whenever he struck him, they would also strike him until they killed him.
أَنَّ رَجُلًا سَرَقَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَقَالَ «اقْتُلُوهُ» فَقَالُوا إِنَّمَا سَرَقَ قَالَ «فَاقْطَعُوهُ» ثُمَّ سَرَقَ أَيْضًا فَقُطِعَ ثُمَّ سَرَقَ عَلَى عَهْدِ أَبِي بَكْرٍ فَقُطِعَ ثُمَّ سَرَقَ فَقُطِعَ حَتَّى قُطِعَتْ قَوَائِمُهُ ثُمَّ سَرَقَ الْخَامِسَةَ فَقَالَ أَبُو بَكْرٍ كَانَ رَسُولُ اللَّهِ ﷺ أَعْلَمَ بِهَذَا حِينَ أَمَرَ بِقَتْلِهِ اذْهَبُوا بِهِ فَاقْتُلُوهُ فَدُفِعَ إِلَى فِتْيَةٍ مِنْ قُرَيْشٍ فِيهِمْ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ فَقَالَ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ أَمِّرُونِي عَلَيْكُمْ فَأَمَّرُوهُ فَكَانَ إِذَا ضَرَبَهُ ضَرَبُوهُ حَتَّى قَتَلُوهُ
[Machine] The Messenger of Allah ﷺ said, "A slave who steals does not have to return what he stole, and there is no punishment for a non-Muslim."
قَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ عَلَى الْعَبْدِ الْآبِقِ إِذَا سَرَقَ قَطْعٌ وَلَا عَلَى الذِّمِّيِّ»
[Machine] I do not remember the first man whom the Messenger of Allah ﷺ ordered to be punished by cutting off his hand. He was brought a thief and he commanded his hand to be cut off. It seemed as if the face of the Messenger of Allah ﷺ was saddened. They said, "O Messenger of Allah, it seems as if you disliked cutting off his hand." He said, "And what prevents me from being reluctant? You should not become assistants to Satan against your brother. It is not appropriate for the Imam, when a limit is reached to him, not to uphold it. Indeed, Allah is Forgiving and he loves forgiveness. They should pardon and forgive. Do you not love for Allah to forgive you? And Allah is forgiving and merciful."
إِنِّي لَا أَذْكُرُ أَوَّلَ رَجُلٍ قَطَعَهُ رَسُولُ اللَّهِ ﷺ أُتِيَ بِسَارِقٍ فَأَمَرَ بِقَطْعِهِ فَكَأَنَّمَا أَسِفَ وَجْهُ رَسُولِ اللَّهِ ﷺ فَقَالُوا يَا رَسُولَ اللَّهِ كَأَنَّكَ كَرِهْتَ قَطْعَهُ قَالَ «وَمَا يَمْنَعُنِي لَا تَكُونُوا أَعْوَانًا لِلشَّيْطَانِ عَلَى أَخِيكُمْ إِنَّهُ لَا يَنْبَغِي لِلْإِمَامِ إِذَا انْتَهَى إِلَيْهِ حَدٌّ إِلَّا أَنْ يُقِيمَهُ إِنَّ اللَّهَ عَفُوٌّ يُحِبُّ الْعَفْوَ وَلْيَعْفُوا وَلْيَصْفَحُوا أَلَا تُحِبُّونَ أَنْ يَغْفِرَ اللَّهُ لَكُمْ وَاللَّهُ غَفُورٌ رَحِيمٌ»
The Prophet ﷺ said: Forgive the infliction of prescribed penalties among yourselves, for any prescribed penalty of which I hear must be carried out. (Using translation from Abū Dāʾūd 4376)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «تَعَافَوْا الْحُدُودَ بَيْنَكُمْ فَمَا بَلَغَنِي مِنْ حَدٍّ فَقَدْ وَجَبَ»
[Machine] The Messenger of Allah ﷺ said, "Whoever intercedes beyond the limits set by Allah, then Allah has gone against His own decree." Al-Dhahabi remained silent about it in his summary.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَالَتْ شَفَاعَتُهُ دُونَ حَدٍّ مِنْ حُدُودِ اللَّهِ فَقَدْ ضَادَّ اللَّهَ تَعَالَى فِي أَمْرِهِ» سكت عنه الذهبي في التلخيص
[Machine] "Indeed, the Messenger of Allah ﷺ said, after stoning the pillars, 'Avoid this filth that Allah has prohibited. Whoever is guilty of it should conceal himself with the cover of Allah and repent to Allah, for if he exposes his sin to us, we will apply the punishment prescribed by Allah Almighty, as stated in the Book of Allah.' This is on the condition mentioned in the narrations of Bukhari and Muslim."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ بَعْدَ أَنْ رَجَمَ الْأَسْلَمِيَّ فَقَالَ «اجْتَنِبُوا هَذِهِ الْقَاذُورَةَ الَّتِي نَهَى اللَّهُ عَنْهَا فَمَنْ أَلَمَّ فَلْيَسْتَتِرْ بِسِتْرِ اللَّهِ وَلْيَتُبْ إِلَى اللَّهِ فَإِنَّهُ مَنْ يَبْدُ لَنَا صَفْحَتُهُ نُقِمْ عَلَيْهِ كِتَابَ اللَّهِ تَعَالَى ﷻ» على شرط البخاري ومسلم
[Machine] The Messenger of Allah ﷺ said, "Whoever conceals the faults of his brother in this world, Allah will conceal his faults in this world and the Hereafter. And whoever relieves the distress of a believer, Allah will relieve his distress on the Day of Resurrection. Allah will help His slave as long as the slave helps his brother." This narration is authentic according to the conditions of the two Shaykhs (i.e., Bukhari and Muslim), but they did not include it in their collections.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ سَتَرَ أَخَاهُ فِي الدُّنْيَا سَتَرَهُ اللَّهُ فِي الدُّنْيَا وَالْآخِرَةِ وَمَنْ نَفَّسَ عَنْ أَخِيهِ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا نَفَّسَ اللَّهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَاللَّهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ» هَذَا الْإِسْنَادُ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم
The servant (who conceals) the faults of others in this world, Allah would conceal his faults on the Day of Resurrection. (Using translation from Muslim 2590b)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَسْتُرُ عَبْدٌ عَبْدًا فِي الدُّنْيَا إِلَّا سَتَرَهُ اللَّهُ يَوْمَ الْقِيَامَةِ»
[Machine] "Verily, the Messenger of Allah ﷺ said: There are three acts that I swear by, and the fourth, if I were to swear by it, I would hope that I do not commit sin. Allah does not make a servant of His a target for arrows in Islam like one who is not. And Allah does not allow a servant to have authority in this world, and then give it to someone else on the Day of Resurrection. And a person does not love a people unless he is with them or is one of them. And the fourth act, if I were to swear by it, I would hope that I do not commit sin. Allah does not expose His servant in this world unless He covers him in the Hereafter."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ ثَلَاثٌ أَحْلِفُ عَلَيْهِنَّ وَالرَّابِعُ لَوْ حَلَفْتُ عَلَيْهِ لَرَجَوْتُ أَنْ لَا آثَمَ لَا يَجْعَلُ اللَّهُ عَبْدًا لَهُ سَهْمٌ فِي الْإِسْلَامِ كَمَنْ لَا سَهْمَ لَهُ وَلَا يَتَوَلَّى اللَّهَ عَبْدٌ فِي الدُّنْيَا فَيُوَلِّيَهُ غَيْرَهُ يَوْمَ الْقِيَامَةِ وَلَا يُحِبُّ رَجُلٌ قَوْمًا إِلَّا كَانَ مَعَهُمْ أَوْ مِنْهُمْ وَالرَّابِعَةُ لَوْ حَلَفْتُ عَلَيْهَا لَرَجَوْتُ أَنْ لَا آثَمَ لَا يَسْتُرُ اللَّهُ عَلَى عَبْدٍ فِي الدُّنْيَا إِلَّا سَتَرَ اللَّهُ عَلَيْهِ فِي الْآخِرَةِ قَالَ فَحَدَّثْتُ بِهِ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ فَقَالَ عُمَرُ «إِذَا سَمِعْتُمْ مِثْلَ هَذَا الْحَدِيثِ عَنْ عُرْوَةَ عَنْ عَائِشَةَ عَنْ رَسُولِ اللَّهِ ﷺ فَاحْفَظُوهُ وَاحْتَفِظُوا بِهِ» سكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah ﷺ said, "Whoever sees a fault and conceals it, it is as if he were modestly covering up a buried treasure."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ رَأَى عَوْرَةً فَسَتَرَهَا كَانَ كَمَنِ اسْتَحْيَى مَوْءُودَةً مِنْ قَبْرِهَا»
that the Messenger of Allah ﷺ: "Avert the legal penalties from the Muslims as much as possible, if he has a way out then leave him to his way, for if the Imam makes a mistake in forgiving it would be better than making mistake in punishment." (Using translation from Tirmidhī 1424)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «ادْرَءُوا الْحُدُودَ عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ فَإِنْ وَجَدْتُمْ لِمُسْلِمٍ مَخْرَجًا فَخَلُّوا سَبِيلَهُ فَإِنَّ الْإِمَامَ أَنْ يُخْطِئَ فِي الْعَفْوِ خَيْرٌ مِنْ أَنْ يُخْطِئَ بِالْعُقُوبَةِ»
"There was a household among us called Banu Ubairiq, among whom was a Bishr, a Bushair, and a Mubashshir. Bushair was a hypocrite who would recite poetry reviling the Companions of the Prophet ﷺ then he would attribute it to some of the Arabs. Then he would say: 'So-and-so said this and that [So-and-so said this and that].' So when the Companions of the Prophet ﷺ would hear that poetry, they would say: 'By Allah! No one but this filthy person said this poetry - or as the man said - and they would say: 'Ibn Al-Ubairiq said it.'" He said: "They were a poor and needy household during Jahiliyyah and Islam. The only food the people of Al-Madinah had was dates and barely. When a man was able to, he would import flour from Ash-Sham which he bought and kept for himself. As for his dependants, their only food was dates and barely. So an import arrived from Ash-Sham, and my uncle Rifa'ah bin Zaid bought a load of it, which he put in a storage area he had, where he kept his weapons - his shield and his sword. But it was taken from him from under the house. The storage was broken into and and the food and weapons were taken. In the morning, my uncle Rifa'ah came to me and said: 'O my nephew! We were robbed during the night, our storage was broken into, and our food and weapons are gone.'" He said: "They overheard us in the house, and questioned us, and someone said to us, 'We saw Banu Ubairiq cooking during the night, and it looked like they had some of your food.'" He said: "Banu Ubairiq were saying - while we were questioning them amidst their dwellings - 'By Allah! We do not think the one you are looking for is other than Labid bin Sahl, a man among us who is righteous and accepted Islam.' When Labid heard that, he brandished his sword and said: 'I stole? By Allah! You either prove this theft, or I take to you with this sword.' They said: 'Leave us O man! You are not the one who has it.' So we continued questioning in the dwellings until we had no doubt that they had taken it. So my uncle said to me: 'O my nephew! You should go to the Messenger of Allah ﷺ and tell him about that.'" Qatadah said: "So I went to the Messenger of Allah ﷺ and said: 'A family among us are ill-mannered, and they conspired against my uncle Rifa'ah bin aid. They broken into his storage and took his weapons and his food. We want them to return our weapons, but we have no need for the food.' So the Prophet ﷺ said: 'I will decide about that.' So when Banu Ubairiq heard about that, they brought a man from among them named Usair bin 'Urwah to talk to him about that, and some people form their houses gathered and said: 'O Messenger of Allah! Qatadah bin An-Nu'man and his uncle came came to a family among us who are a people of Islam and righteousness, accusing them of stealing without proof or confirmation.'" Qatadah said: "I went to the Messenger of Allah ﷺ and spoke to him, and he said: 'You went to a family among them known for their Islam and righteousness, and accused them of stealing without confirmation or proof.'" He said: "So I returned wishing that I had lost some of my wealth, and that the Messenger of Allah ﷺ had not been spoke to about that. My uncle Rifa'ah came to me and said: 'O my nephew! What did you do?' So I told him what the Messenger of Allah ﷺ said to me, so he said: 'It is from Allah, Whom we seek help.' It was not long before the Qur'an was revealed: 'Surely, We have sent down to you the Book in truth, that you might judge between men by that which Allah has shown you, so be not a pelader for the treacherous.' That is Banu Ubairiq. 'And seek forgiveness from Allah.' [That is] from what you said to Qatadah. 'Certainly Allah is Oft-Forgiving, Most Merciful. And argue not on behalf of those who deceive themselves. Verily, Allah does not like anyone who is a betrayer, sinner. They may hide from men, but they cannot hide from Allah for He is with them up to His saying: 'Most Merciful.' That is: If you seek Allah's forgiveness then He will forgive you. 'And whoever earns sin, he earns it only against himself...' up to His saying: 'A manifest sin.' Their saying about Labid; 'Had it not been for the grace of Allah and His Mercy upon you...' up to His saying: 'We shall give him a great reward.' (4:105-115)" So when the Qur'an was revealed, the Messenger of Allah ﷺ brought the weapon and returned it to Rifa'ah. Qatadah said: "When the weapon was brought to my uncle - and he was an elderly man with bad sight" or "an elderly weak man" - Abu 'Eisa was in doubt - "in Jahiliyyah, and I thought that he merely had entered into Islam (without real sincerity) but when I brought it to him, he said: 'O my nephew! It is for Allah's cause.' So I knew that his Islam was genuine. When the Qur'an was revealed, Bushair went with the idolaters, staying with Sulafah bint Sa'd bin Sumayyah. So Allah, Most High, revealed: Whoever contradicts and opposes the Messenger after the right path has been shown clearly to him, and follows other than the believers' way, We shall keep him in the path he has chosen, and burn him in Hell - what an evil destination. Verily Allah forgives not associating others with Him, but He forgives what is less than that for whomever He wills. And whoever associates others with Allah, then he has indeed strayed away (4:115-116). "When he went to stay with Sulafah, Hassan bin Thabit lampooned her with verses of poetry. So she took his saddle, put it on her head, then she left with it to cast into the valley. Then she said: 'You gave me the poetry of Hassan - you did not bring me any good.'" كَانَ بَنُو أُبَيْرِقٍ رَهْطًا مِنْ بَنِي ظُفُرٍ وَكَانُوا ثَلَاثَةً بَشِيرٌ وَبِشْرٌ وَمُبَشِّرٌ وَكَانَ بَشِيرٌ يُكْنَى أَبَا طُعْمَةَ وَكَانَ شَاعِرًا وَكَانَ مُنَافِقًا وَكَانَ يَقُولُ الشَّعْرَ يَهْجُو بِهِ أَصْحَابَ رَسُولِ اللَّهِ ﷺ ثُمَّ يَقُولُ قَالَهُ فُلَانٌ فَإِذَا بَلَغَهُمْ ذَلِكَ قَالُوا كَذَبَ عَدُوُّ اللَّهِ مَا قَالَهُ إِلَّا هُوَ فَقَالَ [البحر الكامل] أَوَكُلَّمَا قَالَ الرِّجَالُ قَصِيدَةً ضَمُّوا إِلَيَّ بِأَنْ أُبَيْرِقَ قَالَهَا مُتَخَطِّمِينَ كَأَنَّنِي أَخْشَاهُمُ جَدَعَ الْإِلَهُ أُنُوفَهُمْ فَأَبَانَهَا وَكَانُوا أَهْلَ فَقْرٍ وَحَاجَةٍ فِي الْجَاهِلِيَّةِ وَالْإِسْلَامِ وَكَانَ عَمِّي رِفَاعَةُ بْنُ زَيْدٍ رَجُلًا مُوسِرًا أَدْرَكَهُ الْإِسْلَامُ فَوَاللَّهِ إِنْ كُنْتُ لَأَرَى أَنَّ فِي إِسْلَامِهِ شَيْئًا وَكَانَ إِذَا كَانَ لَهُ يَسَارٌ فَقَدِمَتْ عَلَيْهِ هَذِهِ الضَّافِطَةُ مِنَ السَّدَمِ تَحْمِلُ الدَّرْمَكَ ابْتَاعَ لِنَفْسِهِ مَا يَحِلُّ بِهِ فَأَمَّا الْعِيَالُ فَكَانَ يُقِيتُهُمُ الشَّعِيرَ فَقَدِمَتْ ضَافِطَةٌ وَهُمُ الْأَنْبَاطُ تَحْمِلُ دَرْمَكًا فَابْتَاعَ رِفَاعَةُ حِمْلَيْنِ مِنْ شَعِيرٍ فَجَعَلَهُمَا فِي عُلِّيَّةٍ لَهُ وَكَانَ فِي عُلِّيَّتِهِ دِرْعَانِ لَهُ وَمَا يُصْلِحُهُمَا مِنْ آلَتِهِمَا فَطَرَقَهُ بَشِيرٌ مِنَ اللَّيْلِ فَخَرَقَ الْعُلِّيَّةَ مِنْ ظَهْرِهَا فَأَخَذَ الطَّعَامَ ثُمَّ أَخَذَ السِّلَاحَ فَلَمَّا أَصْبَحَ عَمِّي بَعَثَ إِلَيَّ فَأَتَيْتُهُ فَقَالَ أُغِيرَ عَلَيْنَا هَذِهِ اللَّيْلَةَ فَذُهِبَ بِطَعَامِنَا وَسِلَاحِنَا فَقَالَ بَشِيرٌ وَإِخْوَتُهُ وَاللَّهِ مَا صَاحِبُ مَتَاعِكُمْ إِلَّا لَبِيدُ بْنُ سَهْلٍ لِرَجُلٍ مِنَّا كَانَ ذَا حَسَبٍ وَصَلَاحٍ فَلَمَّا بَلَغَهُ قَالَ أُصْلِتُ وَاللَّهِ بِالسَّيْفِ ثُمَّ قَالَ أَيْ بَنِي الْأُبَيْرِقِ وَأَنَا أَسْرِقُ فَوَاللَّهِ لَيُخَالِطَنَّكُمْ هَذَا السَّيْفُ أَوْ لَتُبَيِّنُنَّ مَنْ صَاحِبُ هَذِهِ السَّرِقَةِ فَقَالُوا انْصَرِفْ عَنَّا فَوَاللَّهِ إِنَّكَ لَبَرِئٌ مِنْ هَذِهِ السَّرِقَةِ فَقَالَ كَلَّا وَقَدْ زَعَمْتُمْ ثُمَّ سَأَلْنَا فِي الدَّارِ وَتَجَسَّسْنَا حَتَّى قِيلَ لَنَا وَاللَّهِ لَقَدِ اسْتَوْقَدَ بَنُو أُبَيْرِقٍ اللَّيْلَةَ وَمَا نَرَاهُ إِلَّا عَلَى طَعَامِكُمْ فَمَا زِلْنَا حَتَّى كِدْنَا نَسْتَيْقِنُ أَنَّهُمْ أَصْحَابُهُ فَجِئْتُ رَسُولَ اللَّهِ ﷺ فَكَلَّمَتْهُ فِيهِمْ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ أَهْلَ بَيْتٍ مِنَّا أَهْلَ جَفَاءٍ وَسَفَهٍ غَدَوْا عَلَى عَمِّي فَخَرَقُوا عُلِّيَّةً لَهُ مِنْ ظَهْرِهَا فَغَدَوْا عَلَى طَعَامٍ وَسِلَاحٍ فَأَمَّا الطَّعَامُ فَلَا حَاجَةَ لَنَا فِيهِ وَأَمَّا السِّلَاحُ فَلْيَرُدَّهُ عَلَيْنَا فَقَالَ رَسُولُ اللَّهِ ﷺ «سَأَنْظُرُ فِي ذَلِكَ» وَكَانَ لَهُمُ ابْنُ عَمٍّ يُقَالُ لَهُ أَسِيرُ بْنُ عُرْوَةَ فَجَمَعَ رِجَالَ قَوْمِهِ ثُمَّ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ رِفَاعَةَ بْنَ زَيْدٍ وَابْنَ أَخِيهِ قَتَادَةَ بْنَ النُّعْمَانِ قَدْ عَمَدَا إِلَى أَهْلِ بَيْتٍ مِنَّا أَهْلَ حَسَبِ وَشَرَفٍ وَصَلَاحٍ يَأْبِنُونَهُمْ بِالْقَبِيحِ وَيَأْبِنُونَهُمْ بِالسَّرِقَةِ بِغَيْرِ بَيِّنَةٍ وَلَا شَهَادَةٍ فَوَضَعَ عِنْدَ رَسُولِ اللَّهِ ﷺ بِلِسَانِهِ مَا شَاءَ ثُمَّ انْصَرَفَ وَجِئْتُ رَسُولَ اللَّهِ ﷺ وَكَلَّمْتُهُ فَجَبَهَنِي جَبْهًا شَدِيدًا وَقَالَ «بِئْسَ مَا صَنَعْتَ وَبِئْسَ مَا مَشَيْتَ فِيهِ عَمَدْتَ إِلَى أَهْلِ بَيْتٍ مِنْكُمْ أَهْلِ حَسَبٍ وَصَلَاحٍ تَرْمِيهِمْ بِالسَّرِقَةِ وَتَأْبِنُهُمْ فِيهَا بِغَيْرِ بَيِّنَةٍ وَلَا تَثَبُّتٍ» فَسَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ مَا أَكْرَهُ فَانْصَرَفْتُ عَنْهُ وَلَوَدِدْتُ أَنِّي خَرَجْتُ مِنْ مَالِي وَلَمْ أُكَلِّمْهُ فَلَمَّا أَنْ رَجَعْتُ إِلَى الدَّارِ أَرْسَلَ إِلَيَّ عَمِّي يَا ابْنَ أَخِي مَا صَنَعْتَ؟ فَقُلْتُ وَاللَّهِ لَوَدِدْتُ أَنِّي خَرَجْتُ مِنْ مَالِي وَلَمْ أُكَلِّمْ رَسُولَ اللَّهِ ﷺ فِيهِ وَايْمُ اللَّهِ لَا أَعُودُ إِلَيْهِ أَبَدًا فَقَالَ اللَّهُ الْمُسْتَعَانُ فَنَزَلَ الْقُرْآنُ {إِنَّا أَنْزَلْنَا إِلَيْكَ الْكِتَابَ بِالْحَقِّ لِتَحْكُمَ بَيْنَ النَّاسِ بِمَا أَرَاكَ اللَّهُ وَلَا تَكُنْ لِلْخَائِنِينَ خَصِيمًا} [النساء 105] أَيْ طُعْمَةَ بْنِ أُبَيْرِقٍ فَقَرَأَ حَتَّى بَلَغَ {ثُمَّ يَرِمْ بِهِ بَرِيئًا} [النساء 112] أَيْ لَبِيدَ بْنَ سَهْلٍ {وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكَ وَرَحْمَتُهُ لَهَمَّتْ طَائِفَةٌ مِنْهُمْ أَنْ يُضِلُّوكَ} [النساء 113] يَعْنِي أَسِيرَ بْنَ عُرْوَةَ وَأَصْحَابَهُ ثُمَّ قَالَ {لَا خَيْرَ فِي كَثِيرٍ مِنْ نَجْوَاهُمْ} [النساء 114] إِلَى قَوْلِهِ {وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ} [النساء 48] أَيًّا كَانَ ذَنْبُهُ دُونَ الشِّرْكِ فَلَمَّا نَزَلَ الْقُرْآنُ هَرَبَ فَلَحِقَ بِمَكَّةَ وَبَعَثَ رَسُولُ اللَّهِ ﷺ إِلَيَّ الدَّرْعَيْنِ وَأَدَاتَهُمَا فَرَدَّهُمَا عَلَى رِفَاعَةَ قَالَ قَتَادَةُ فَلَمَّا جِئْتُهُ بِهِمَا وَمَا مَعَهُمَا قَالَ يَا ابْنَ أَخِي هُمَا فِي سَبِيلِ اللَّهِ ﷻ فَرَجَوْتُ أَنَّ عَمِّي حَسُنَ إِسْلَامُهُ وَكَانَ ظَنِّي بِهِ غَيْرَ ذَلِكَ وَخَرَجَ ابْنُ أُبَيْرِقٍ حَتَّى نَزَلَ عَلَى سَلَّامَةَ بِنْتِ سَعْدِ بْنِ سَهْلٍ أُخْتِ بَنِي عَمْرِو بْنِ عَوْفٍ وَكَانَتْ عِنْدَ طَلْحَةَ بْنِ أَبِي طَلْحَةَ بِمَكَّةَ فَوَقَعَ بِرَسُولِ اللَّهِ ﷺ وَأَصْحَابِهِ يَشْتُمُهُمْ فَرَمَاهُ حَسَّانُ بْنُ ثَابِتٍ بِأَبْيَاتٍ فَقَالَ [البحر الطويل] أَيَا سَارِقَ الدَّرْعَيْنِ إِنْ كُنْتَ ذَاكِرًا بِذِي كَرَمٍ بَيْنَ الرِّجَالِ أُوَادِعُهْ وَقَدْ أَنْزَلْتَهُ بِنْتُ سَعْدٍ فَأَصْبَحَتْ يُنَازِعُهَا جَلْدَ اسْتِهِ وَتُنَازِعُهْ فَهَلَّا أَسِيرًا جِئْتَ جَارَكَ رَاغِبًا إِلَيْهِ وَلَمْ تَعْمَدْ لَهُ فَتُدَافِعُهْ ظَنَنْتُمْ بِأَنْ يَخْفَى الَّذِي قَدْ فَعَلْتُمُ وَفِيكُمْ نَبِيٌّ عِنْدَهُ الْوَحْيُ وَاضِعُهْ فَلَوْلَا رِجَالٌ مِنْكُمُ تَشْتُمُونَهُمْ بِذَاكَ لَقَدْ حَلَّتْ عَلَيْهِ طَوَالِعُهْ فَإِنْ تَذْكُرُوا كَعْبًا إِلَى مَا نَسَبْتُمُ فَهَلْ مِنْ أَدِيمٍ لَيْسَ فِيهِ أَكَارِعُهْ وَجَدْتَهُمُ يَرْجُونَكُمْ قَدْ عَلِمْتُمُ كَمَا الْغَيْثُ يُرْجِيهِ السَّمِينُ وَتَابِعُهْ فَلَمَّا بَلَغَهَا شِعْرُ حَسَّانَ أَخَذَتْ رَحْلَ أُبَيْرِقٍ فَوَضَعَتْهُ عَلَى رَأْسِهَا حَتَّى قَذَفَتْهُ بِالْأَبْطَحِ ثُمَّ حَلَقَتْ وَسَلَقَتْ وَخَرَقَتْ وَخَلَفَتْ إِنْ بِتَّ فِي بَيْتِي لَيْلَةً سَوْدَاءَ أَهْدَيْتَ لِي شِعْرَ حَسَّانَ بْنِ ثَابِتٍ مَا كُنْتَ لِتَنْزِلَ عَلَيَّ بِخَيْرٍ فَلَمَّا أَخْرَجَتْهُ لَحِقَ بِالطَّائِفِ فَدَخَلَ بَيْتًا لَيْسَ فِيهِ أَحَدٌ فَوَقَعَ عَلَيْهِ فَقَتَلَهُ فَجَعَلَتْ قُرَيْشٌ تَقُولُ وَاللَّهِ لَا يُفَارِقُ مُحَمَّدًا أَحَدٌ مِنْ أَصْحَابِهِ فِيهِ خَيْرٌ
The Messenger of Allah ﷺ said: ʿWhoever commits a sin in this world and is punished therein. Allah is too generous to repeat His punishment of His slave [in the Hereafter], whoever commits a sin in this world and Allah conceals it and pardons him, Allah is too generous to retract His pardon when He has granted it.ʿ (Using translation from Aḥmad 775)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أَذْنَبَ ذَنْبًا فِي الدُّنْيَا فَسَتَرَهُ اللَّهُ عَلَيْهِ وَعَفَا عَنْهُ فَاللَّهُ أَكْرَمُ مِنْ أَنْ يَرْجِعَ فِي شَيْءٍ قَدْ عَفَا عَنْهُ وَسَتَرَهُ وَمَنْ أَذْنَبَ ذَنْبًا فِي الدُّنْيَا فَعُوقِبَ عَلَيْهِ فَاللَّهُ أَعْدَلُ مِنْ أَنْ يُثَنِّيَ عُقُوبَتَهُ عَلَى عَبْدٍ مَرَّتَيْنِ»
[Machine] The Prophet of Allah ﷺ told me: "Whatever difficulty has befallen you [is a result] of what your hands have earned, and He pardons much. "So Allah is more deserving that punishment should befall them and He is more deserving of granting them forgiveness. And whatever Allah has pardoned them in the worldly life, then Allah is more deserving of returning in His forgiveness." Al-Dhahabi remained silent about this in his summarization.
أَخْبَرَنِي نَبِيُّ اللَّهِ ﷺ {مَا أَصَابَكُمْ} [الشورى 30] مِنْ مُصِيبَةٍ فَبِمَا كَسَبَتْ أَيْدِيكُمْ وَيَعْفُو عَنْ كَثِيرٍ «فَاللَّهُ أَكْرَمُ مِنْ أَنْ يُثَنِّيَ عَلَيْهِمُ الْعُقُوبَةَ وَمَا عَفَا اللَّهُ عَنْهُ فِي الدُّنْيَا فَاللَّهُ أَكْرَمُ مِنْ أَنْ يَعُودَ فِي عَفْوِهِ» سكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah, peace be upon him, said: "Whoever commits a sin that Allah has forbidden and then the prescribed punishment is carried out on him, that sin is expiated from him."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَيُّمَا عَبْدٍ أَصَابَ شَيْئًا مِمَّا نَهَى اللَّهُ عَنْهُ ثُمَّ أُقِيمَ عَلَيْهِ حَدُّهُ كُفِّرَ عَنْهُ ذَلِكَ الذَّنْبُ»
[Machine] "What is this?" they said. 'Umar ordered that it be translated. He returned it and went with it to 'Umar and said, "Do you not know that the pen is raised from a madman until he becomes reasonable, from a patient until he recovers, from a sleeper until he wakes up, and from a child until he reaches the age of discernment."
«مَا هَذِهِ؟» قَالُوا أَمَرَ بِهَا عُمَرُ أَنْ تُرْجَمَ قَالَ فَرَدَّهَا وَذَهَبَ مَعَهَا إِلَى عُمَرَ وَقَالَ «أَلَمْ تَعْلَمْ أَنَّ الْقَلَمَ رُفِعَ عَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَعَنِ الْمُبْتَلَى حَتَّى يُفِيقَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ»
[Machine] Umar brought a madwoman who had committed adultery and he wanted to stone her. Ali said to him, "Do you not know that the pen has been lifted from three: the insane person until he regains his sanity, the child until he reaches the age of puberty, and the sleeper until he wakes up?" So, he left her. This hadith has been narrated with a sound chain of transmission from Ali, from the Prophet Muhammad ﷺ .
أُتِيَ عُمَرُ بِامْرَأَةٍ مَجْنُونَةٍ حُبْلَى فَأَرَادَ أَنْ يَرْجُمَهَا فَقَالَ لَهُ عَلِيٌّ أَوَمَا عَلِمْتَ أَنَّ الْقَلَمَ قَدْ رُفِعَ عَنْ ثَلَاثٍ عَنِ الْمَجْنُونِ حَتَّى يَعْقِلَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ «فَخَلَّى عَنْهَا» وَقَدْ رُوِيَ هَذَا الْحَدِيثُ بِإِسْنَادٍ صَحِيحٍ عَنْ عَلِيٍّ عَنِ النَّبِيِّ ﷺ مُسْنَدًا صحيح فيه إرسال
I heard the Messenger of Allah ﷺ say: ʿThe Pen has been lifted from three: from the child until he reaches puberty, from the sleeper until he wakes up and from the insane until he regains his sanity.” (Using translation from Aḥmad 940)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمَعْتُوهِ حَتَّى يَعْقِلَ وَعَنِ الصَّبِيِّ حَتَّى يَشِبَّ
[Machine] "He was with the Prophet ﷺ on a journey, and he lost his way. People split up searching for him, so the Prophet ﷺ said, 'Indeed, the pen has been lifted from three: from the sleeper until he wakes up, from the mentally insane until he regains sanity, and from the child until he reaches puberty.'"
أَنَّهُ كَانَ مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ فَأَدْلَجَ فَتَقَطَّعَ النَّاسُ عَلَيْهِ فَقَالَ النَّبِيُّ ﷺ إِنَّهُ رُفِعَ الْقَلَمُ عَنْ ثَلَاثٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمَعْتُوهِ حَتَّى يَصِحَّ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ
[Machine] "He informed that the companions of the Messenger of Allah ﷺ stripped him on the Day of Quraizah, and they did not see any support flowing from his hair, meaning that his suffering had overwhelmed him, so they spared him from being killed."
أَخْبَرَهُ «أَنَّ أَصْحَابَ رَسُولِ اللَّهِ ﷺ جَرَّدُوهُ يَوْمَ قُرَيْظَةَ فَلَمْ يَرَوِا الْمَوَاسِي جَرَتْ عَلَى شَعْرِهِ يَعْنِي عَانَتَهُ فَتَرَكُوهُ مِنَ الْقَتْلِ»
[Machine] "To kill their fighters and capture their offspring, they complained about me, but they did not find me growing out my hair. Here I am now among you." Last verse of the book of boundaries.
أَنْ تُقْتَلَ مُقَاتِلُهُمْ وَتُسْبَى ذَرَارِيُّهُمْ فَشَكُّوا فِيَّ فَلَمْ يَجِدُونِي أَنْبَتَ الشَّعْرِ فَهَا أَنَا ذَا بَيْنَ أَظْهُرِكُمْ» آخِرُ كِتَابِ الْحُدُودِ
