٤٢۔ كِتَابُ الْحُدُودِ ص ٢

[Machine] A man used to visit the Prophet ﷺ, and a man enchanted him with magic. So, the Prophet ﷺ had a knot (tied) for him and put it in a well belonging to a man from the Ansar. Two angels came to him and one of them sat at his head and the other at his feet. The one of them said: "Do you know what the cure for him is?" The other one said: "Yes, it is to undo the knot." He said: "Who did it?" They said: "Such and such person did it." He said: "And what is in the well?" They said: "There is a waterskin in it." He asked: "Where is it?" They replied: "It is in the bottom of the well." The Prophet ﷺ said: "What would you advise us (to do)?" They said: "Let someone go down into the well and take it out." The Prophet ﷺ sent a man to bring it. So, the waterskin was taken out and the knot was untied from it.

كَانَ رَجُلٌ يَدْخُلُ عَلَى النَّبِيِّ ﷺ فَسَحَرَهُ رَجُلٌ فَعَقَدَ لَهُ عُقَدًا فَوَضَعَهُ وَطَرَحَهُ فِي بِئْرِ رَجُلٍ مِنَ الْأَنْصَارِ فَأَتَاهُ مَلَكَانِ يَعُودَانِهِ فَقَعَدَ أَحَدُهُمَا عِنْدَ رَأْسِهِ وَقَعَدَ الْآخَرُ عِنْدَ رِجْلَيْهِ فَقَالَ أَحَدُهُمَا أَتَدْرِي مَا وَجَعُهُ؟ قَالَ فُلَانٌ الَّذِي كَانَ يَدْخُلُ عَلَيْهِ عَقَدَ لَهُ عُقَدًا فَأَلْقَاهُ فِي بِئْرِ فُلَانٍ الْأَنْصَارِيِّ فَلَوْ أَرْسَلَ إِلَيْهِ رَجُلًا فَأَخَذَ مِنْهُ الْعُقَدَ فَوَجَدَ الْمَاءَ قَدِ اصْفَرَّ قَالَ «وَأَخَذَ الْعُقَدَ فَحَلَّهَا فِيهَا» قَالَ «فَكَانَ الرَّجُلُ بَعْدُ يَدْخُلُ عَلَى النَّبِيِّ ﷺ فَلَمْ يَذْكُرْ لَهُ شَيْئًا مِنْهُ وَلَمْ يُعَاتِبْهُ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ

[Machine] "An emir from among the emirs of Kufa summoned a magician who played tricks in front of the people. Jundub approached him with his sword and attacked him. When the people saw this, they dispersed. Jundub said, 'O people, you are not safe. I only intended to reach the magician.' The emir then took him and imprisoned him. Salman heard about this and said, 'How terrible is what they have done. It is not proper for him, being an Imam who is followed, to summon a magician who plays tricks in front of him. It is not right for him to rebuke his emir with a sword.' Al-Dhahabi remained silent about it in his summary."

أَنَّ أَمِيرًا مِنْ أُمَرَاءِ الْكُوفَةِ دَعَا سَاحِرًا يَلْعَبُ بَيْنَ يَدَيِ النَّاسِ فَبَلَغَ جُنْدُبًا فَأَقْبَلَ بِسَيْفِهِ وَاشْتَمَلَ عَلَيْهِ فَلَمَّا رَآهُ ضَرَبَهُ بِسَيْفِهِ فَتَفَرَّقَ النَّاسُ عَنْهُ فَقَالَ أَيُّهَا النَّاسُ لَنْ تُرَاعُوا إِنَّمَا أَرَدْتُ السَّاحِرَ فَأَخَذَهُ الْأَمِيرُ فَحَبَسَهُ فَبَلَغَ ذَلِكَ سَلْمَانَ فَقَالَ «بِئْسَ مَا صَنَعَا لَمْ يَكُنْ يَنْبَغِي لِهَذَا وَهُوَ إِمَامٌ يُؤْتَمُّ بِهِ يَدْعُو سَاحِرًا يَلْعَبُ بَيْنَ يَدَيْهِ وَلَا يَنْبَغِي لِهَذَا أَنْ يُعَاتِبَ أَمِيرَهُ بِالسَّيْفِ» سكت عنه الذهبي في التلخيص

[Machine] The Prophet ﷺ said to Ma'iz ibn Malik, "Woe to you! Perhaps you kissed or touched or winked or looked." Ma'iz replied, "No." The Prophet asked, "Did you do it?" He answered, "Yes." At that point, the Prophet ordered that he be stoned.

أَنَّ النَّبِيَّ ﷺ قَالَ لِمَاعِزِ بْنِ مَالِكٍ «وَيْحَكَ لَعَلَّكَ قَبَّلْتَ أَوْ لَمَسْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ» قَالَ لَا قَالَ «أَفَعَلْتَهَا؟» قَالَ نَعَمْ فَعِنْدَ ذَلِكَ أَمَرَ بِرَجْمِهِ  

«هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ» وَقَدْ رَوَاهُ الْحَكَمُ بْنُ أَبَانَ عَنْ عِكْرِمَةَ بِزِيَادَاتِ أَلْفَاظٍذا في البخاري

[Machine] A goat came to a Muslim man and said, "I have committed a grave sin, what should I do?" The man told him to go to the Messenger of Allah ﷺ and seek forgiveness. So the goat went to the Messenger of Allah ﷺ and informed him. The Messenger of Allah ﷺ disliked his words or said that he disliked what he said. Then the Messenger of Allah ﷺ asked those who were with him, "Has anyone been affected by this?" Ibn Abbas said, "I looked at the people to indicate them, but none of them turned towards me." So the Messenger of Allah ﷺ said to him, "Perhaps you accepted it?" He replied, "No." The Prophet ﷺ said, "So you touched it?" He replied, "No." The Prophet ﷺ said, "Then did you do something with it while you were not supposed to?" He replied, "Yes." The Prophet ﷺ said, "Then stone him." While he was being stoned, the man who consulted the goat threw a bone at him. The goat dodged it and turned towards him saying, "May Allah fight you! You saw me, and now you are stoning me."  

الحاكم:٨٠٧٧كَمَا حَدَّثَنَاهُ بَكْرُ بْنُ مُحَمَّدِ بْنِ حَمْدَانَ الْمَرْوَزِيُّ ثَنَا عَبْدُ الصَّمَدِ بْنُ الْفَضْلِ ثَنَا حَفْصُ بْنُ عُمَرَ الْعَدَنِيُّ ثَنَا الْحَكَمُ بْنُ أَبَانَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ

أَنَّ مَاعِزًا جَاءَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً فَمَا تَأْمُرُنِي؟ فَقَالَ لَهُ الرَّجُلُ اذْهَبْ إِلَى رَسُولِ اللَّهِ ﷺ يَسْتَغْفِرُ لَكَ فَأَتَى مَاعِزٌ رَسُولَ اللَّهِ ﷺ فَأَخْبَرَهُ فَكَرِهَ رَسُولُ اللَّهِ ﷺ كَلَامَهُ أَوْ قَالَ قَوْلَهُ ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ لِمَنْ كَانَ مَعَهُ «أَبِصَاحِبِكُمْ مَسٌّ؟» قَالَ ابْنُ عَبَّاسٍ فَنَظَرْتُ إِلَى الْقَوْمِ لِأُشِيرَ عَلَيْهِمْ فَلَمْ يَلْتَفِتْ إِلَيَّ مِنْهُمْ أَحَدٌ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «لَعَلَّكَ قَبَّلْتَهَا» قَالَ لَا قَالَ النَّبِيُّ ﷺ «فَمَسَسْتَهَا» قَالَ لَا قَالَ «فَفَعَلْتَ بِهَا وَلَمْ تُكَنِّ؟» قَالَ نَعَمْ قَالَ «فَارْجُمُوهُ» قَالَ فَبَيْنَا هُوَ يُرْجَمُ إِذْ رَمَاهُ الرَّجُلُ الَّذِي جَاءَهُ مَاعِزٌ يَسْتَشِيرُهُ رَمَاهُ بِعَظْمٍ فَخَرَّ مَاعِزٌ فَالْتَفَتَ إِلَيْهِ فَقَالَ لَهُ مَاعِزٌ قَاتَلَكَ اللَّهُ إِذْ رَأَيْتَنِي ثُمَّ أَنْتَ الْآنَ تَرْجُمُنِيحفص بن عمران العدني ضعفوه

[Machine] I was sitting with the messenger of Allah ﷺ when Al-Aslamy Ma'iz ibn Malik came and said, "O messenger of Allah, I have committed adultery and I want to be purified." The prophet ﷺ told him, "Go back." He went back and came to him for a second time, and the messenger of Allah ﷺ asked his people about him. They praised him and spoke well of his intelligence and religion. He came to the prophet ﷺ for a third time and the prophet ﷺ asked his people about him again, and they spoke well of him. He came to him for a fourth time and the prophet ﷺ asked them about him again, and they spoke similarly. The prophet ﷺ then ordered them to dig a pit for him up to his chest and then ordered him to be stoned.  

الحاكم:٨٠٧٨حَدَّثَنَا أَبُو النَّضْرِ الْفَقِيهُ وَأَبُو الْحَسَنِ أَحْمَدُ بْنُ مُحَمَّدٍ الْعَنَزِيُّ قَالَا ثَنَا مُعَاذُ بْنُ نَجْدَةَ الْقُرَشِيُّ ثَنَا خَلَّادُ بْنُ يَحْيَى ثَنَا بَشِيرُ بْنُ الْمُهَاجِرِ عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ قَالَ

كُنْتُ جَالِسًا عِنْدَ رَسُولِ اللَّهِ ﷺ فَجَاءَ الْأَسْلَمِيُّ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» فَرَجَعَ حَتَّى أَتَاهُ الثَّالِثَةَ فَأَتَى رَسُولُ اللَّهِ ﷺ قَوْمَهُ فَسَأَلَهُمْ فَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ فَقَالَ «كَيْفَ عَقْلُهُ؟ هَلْ بِهِ جُنُونٌ؟» قَالُوا لَا وَاللَّهِ وَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ فِي عَقْلِهِ وَدِينِهِ وَأَتَاهُ الرَّابِعَةَ فَسَأَلَهُمْ عَنْهُ فَقَالُوا لَهُ مِثْلَ ذَلِكَ فَأَمَرَهُمْ فَحَفَرُوا لَهُ حُفْرَةً إِلَى صَدْرِهِ ثُمَّ رَجَمُوهُ  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ عَلَى شَرْطِ مُسْلِمٍ فَقَدِ احْتَجَّ بِبَشِيرِ بْنِ مُهَاجِرٍ» سكت عنه الذهبي في التلخيص

[Machine] "A man named Ma'iz ibn Malik came to the Prophet ﷺ and confessed that he had committed a grave sin. The Prophet ﷺ turned him away repeatedly, but Ma'iz kept asking the people if there was any punishment for him. They replied that there was no punishment for him except that he had involved himself in something that he should not have and the punishment for this was to be executed. The Prophet ﷺ then ordered them to take him to the outskirts of the city and they did not dig a pit for him or tie him up, but rather they threw him with stones, bones and clods of earth until he died. After that, the Prophet ﷺ delivered a sermon and praised and thanked Allah. He then said, 'Why is it that when we launch an attack and someone among us remains behind with our families, he is not like a wet nurse who takes care of the young ones of a goat?' He further added, 'Indeed, I am not to have sexual relations with any of them. However, I apply it (the prescribed punishment) to them.' He did not curse him or ask forgiveness for him."  

الحاكم:٨٠٧٩أَخْبَرَنَا مُحَمَّدُ بْنُ يَعْقُوبَ الشَّيْبَانِيُّ ثَنَا يَحْيَى بْنُ مُحَمَّدِ بْنِ يَحْيَى الذُّهْلِيُّ ثَنَا مُسَدَّدٌ ثَنَا يَزِيدُ بْنُ زُرَيْعٍ ثَنَا دَاوُدُ بْنُ أَبِي هِنْدٍ عَنْ أَبِي نَضْرَةَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ

أَنَّ مَاعِزَ بْنَ مَالِكٍ أَتَى النَّبِيَّ ﷺ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً فَرَدَّهُ النَّبِيُّ ﷺ مِرَارًا فَسَأَلَ قَوْمَهُ «أَبِهِ بَأْسٌ؟» فَقَالُوا مَا بِهِ بَأْسٌ إِلَّا أَنَّهُ أَتَى أَمْرًا لَا يَرَى أَنْ يُخْرِجَهُ مِنْهُ إِلَّا أَنْ يُقَامَ عَلَيْهِ الْحَدُّ قَالَ فَأَمَرَنَا فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ قَالَ فَلَمْ نَحْفِرْ لَهُ وَلَمْ نُوَثِّقْهُ فَرَمَيْنَاهُ بِخَزَفٍ وَعِظَامٍ وَجَنْدَلٍ فَاسْتَكَنَّ فَسَعَى فَاشْتَدَدْنَا خَلْفَهُ فَأَتَى الْحَرَّةَ فَانْتَصَبَ لَنَا فَرَمَيْنَاهُ بِحَلَامِيذِهَا حَتَّى سَكَنَ فَقَامَ النَّبِيُّ ﷺ مِنَ الْعَشِيِّ خَطِيبًا فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ فَقَالَ «أَمَّا بَعْدُ فَمَا بَالُ أَقْوَامٍ إِذَا غَزَوْنَا فَتَخَلَّفَ أَحَدُهُمْ فِي عِيَالِنَا لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ أَمَا إِنِّي عَلَيَّ لَا أُوتَى بِأَحَدٍ مِنْهُمْ فَعَلَ ذَلِكَ إِلَّا نَكَّلْتُ بِهِ» قَالَ فَلَمْ يَسُبَّهُ وَلَمْ يَسْتَغْفِرْ لَهُ  

«هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ» على شرط النسائي ومسلم

[Machine] The Messenger of Allah ﷺ said, "Oh Hazal, if you covered it (i.e., your private parts) with your garment, it would be better for you." Shu'bah said, Yahya mentioned this hadith in a gathering where Yazid bin Nuaim bin Hazal was present, and Yazid said, "This is true and it is a saying of my grandfather."  

الحاكم:٨٠٨٠حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثَنَا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ ثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ ثَنَا شُعْبَةُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنِ ابْنِ الْهَزَّالِ عَنْ أَبِيهِ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ» قَالَ شُعْبَةُ قَالَ يَحْيَى فَذَكَرْتُ هَذَا الْحَدِيثَ بِمَجْلِسٍ فِيهِ يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ فَقَالَ يَزِيدُ «هَذَا الْحَقُّ حَقٌّ وَهُوَ حَدِيثُ جَدِّي»  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» وَقَدْ تَفَرَّدَ بِهَذِهِ الزِّيَادَةِ أَبُو دَاوُدَ عَنْ شُعْبَةَصحيح

[Machine] The Prophet ﷺ was told, "Indeed, a goat, when it found the touch of rocks and death, ran away." He then said, "Wouldn't you have left it alone?"  

الحاكم:٨٠٨١أَخْبَرَنَا أَبُو مُحَمَّدٍ أَحْمَدُ بْنُ عَبْدِ اللَّهِ الْمُزَنِيُّ ثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ سُلَيْمَانَ الْحَضْرَمِيُّ ثَنَا عَلِيُّ بْنُ سَعِيدِ بْنِ مَسْرُوقٍ الْكِنْدِيُّ ثَنَا يَحْيَى بْنُ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ عَنْ مُحَمَّدِ بْنِ عَمْرٍو عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ

قِيلَ لِلنَّبِيِّ ﷺ إِنَّ مَاعِزًا حِينَ وَجَدَ مَسَّ الْحِجَارَةِ وَالْمَوْتِ فَرَّ فَقَالَ «هَلَّا تَرَكْتُمُوهُ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ على شرط مسلم

[Machine] Ma'iz ibn Malik came to the Prophet ﷺ and said, "O Messenger of Allah! I have committed adultery, so establish the punishment prescribed in the Book of Allah for me." The Prophet turned away from him four times, but each time Ma'iz persisted in his confession. At the fourth time, the Prophet ﷺ said, "Go and stone him." When the stones touched him, Ma'iz became agitated, and in extreme pain. Then, Abdullah ibn Unais emerged from the outskirts and threw a piece of a donkey's thigh on him, causing him to die. The people stoned him until he was killed. The incident was later mentioned to the Prophet ﷺ, who mentioned Ma'iz's escape and said, "Why did you not leave him alone? Perhaps he would have repented and Allah would have accepted his repentance."

جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللَّهِ فَأَعْرَضَ عَنْهُ حَتَّى جَاءَ أَرْبَعَ مَرَّاتٍ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» فَلَمَّا مَسَّتْهُ الْحِجَارَةُ جَزِعَ فَاشْتَدَّ قَالَ فَخَرَجَ عَبْدُ اللَّهِ بْنُ أُنَيْسٍ مِنْ بَادِيَتِهِ فَرَمَاهُ بِوَظِيفِ حِمَارٍ فَصَرَعَهُ وَرَمَاهُ النَّاسُ حَتَّى قَتَلُوهُ فَذَكِرَ لِلنَّبِيِّ ﷺ فِرَارُهُ فَقَالَ «هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ وَيَتُوبُ اللَّهُ عَلَيْهِ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

[Machine] A woman from Ghamid came to the Prophet ﷺ , so I said to her, "You have started menstruating." He said, "Go away." So she left and then returned and said, "Perhaps you want to treat me as you treated Ma'iz ibn Malik. By Allah, I am pregnant." He said, "Go away until you give birth." Then she came back with the baby wrapped in a piece of cloth and said, "I have given birth." He ordered for her to be purified. She said, "Go away until you wean him." So she left and then came back with the baby in her hand, holding a piece of bread. She said, "I have weaned him." He ordered for her to be stoned. This narration was reported by Ibrahim ibn Maymun al-Sa'igh from Abu Zubair from Jabir. Al-Dhahabi remained silent about it in the summary.

أَتَتِ امْرَأَةٌ مِنْ غَامِدٍ النَّبِيِّ ﷺ فَقُلْتُ قَدْ فَجَرْتُ فَقَالَ «اذْهَبِي» فَذَهَبَتْ ثُمَّ رَجَعَتْ فَقَالَتْ لَعَلَّكَ تُرِيدُ أَنْ تَصْنَعَ بِي كَمَا صَنَعْتَ بِمَاعِزِ بْنِ مَالِكٍ وَاللَّهِ إِنِّي لَحُبْلَى فَقَالَ «اذْهَبِي حَتَّى تَلِدِينَ» ثُمَّ جَاءَتْ بِهِ فِي خِرْقَةٍ فَقَالَتْ قَدْ وَلَدْتُ فَطَهِّرْنِي قَالَ «اذْهَبِي حَتَّى تَفْطِمِيهِ» فَذَهَبَتْ ثُمَّ جَاءَتْ بِهِ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ قَدْ فَطَمَتْهُ فَأَمَرَ بِرَجْمِهَا وَقَدْ رَوَاهُ إِبْرَاهِيمُ بْنُ مَيْمُونٍ الصَّائِغُ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍسكت عنه الذهبي في التلخيص

[Machine] A woman approached the Prophet ﷺ and said, "I have committed adultery, so impose the punishment on me." He told her, "Go and come back after you have given birth." When she gave birth, she came to him again and said, "I have committed adultery, so impose the punishment on me." He once again told her to go and breastfeed her child. After she had weaned her child, she came to him again and said, "O Messenger of Allah, I have committed adultery, so impose the punishment on me." He asked, "Who will take care of your child?" A man stood up and said, "I will take care of her child." The Messenger of Allah ﷺ ordered her to be stoned.

أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي قَدْ زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «انْطَلِقِي فَضَعِي مَا فِي بَطْنِكِ» فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا أَتَتْهُ فَقَالَتْ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «انْطَلِقِي حَتَّى تَفْطِمِي وَلَدَكِ» فَلَمَّا فَطَمَتْ وَلَدَهَا جَاءَتْ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «هَاتِي مَنْ يَكْفُلُ وَلَدَكِ» فَقَامَ رَجُلٌ فَقَالَ أَنَا أَكْفُلُ وَلَدَهَا فَرَجَمَهَا رَسُولُ اللَّهِ ﷺ وَسَلَّمَ  

«هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ وَقَدْ رَوَى مَالِكُ بْنُ أَنَسٍ فِي الْمُوَطَّأِ حَدِيثَ الْمَرْجُومَةِ بِإِسْنَادٍ أَخْشَى عَلَيْهِ الْإِرْسَالَ» سكت عنه الذهبي في التلخيص

[Machine] A woman came to the Messenger of Allah ﷺ and said, "I have committed adultery and I am pregnant." The Messenger of Allah ﷺ told her, "Go and give birth." She left and when she gave birth, she came back to him. He told her, "Go and breastfeed the baby." After she breastfed the baby, she came back to him. He told her, "Go and entrust the baby to someone." When she entrusted the baby, she came back to him and he imposed the punishment on her.

أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللَّهِ ﷺ فَقَالَتْ إِنَّهَا زَنَتْ وَهِيَ حُبْلَى فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «اذْهَبِي حَتَّى تَضَعِي» فَذَهَبْتُ فَلَمَّا وَضَعَتْ جَاءَتْهُ فَقَالَ «اذْهَبِي حَتَّى تُرْضِعِيهِ» فَلَمَّا أَرْضَعَتْهُ جَاءَتْهُ فَقَالَ «اذْهَبِي حَتَّى تَسْتَوْدِعِيهِ» فَلَمَّا اسْتَوْدَعَتْهُ جَاءَتْهُ فَأَقَامَ عَلَيْهَا الْحَدَّ  

«هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ إِنْ كَانَ يَزِيدُ بْنُ طَلْحَةَ التَّيْمِيُّ أَدْرَكَ النَّبِيَّ ﷺ مَالِكُ بْنُ أَنَسٍ الْحَكَمُ فِي حَدِيثِ الْمَدَنِيِّينَ» على شرط البخاري ومسلم إن كان يزيد التيمي أدرك النبي ﷺ

[Machine] She was told to be whipped one hundred times, then he ordered for her to be stoned. Ali took a stone and threw it at her, and he did not miss the base of her ear, causing her to fall down. The people stoned her until they killed her. Then he said, "I whipped her as commanded in the book of Allah the Most High, and stoned her according to the Sunnah."

يُقَالُ لَهَا شُرَاحَةُ فَجَلَدَهَا مِائَةً ثُمَّ أَمَرَ بِرَجْمِهَا فَأَخَذَ عَلِيٌّ آجُرَّةً فَرَمَاهَا بِهَا فَمَا أَخْطَأَ أَصْلَ أُذُنِهَا مِنْهَا فَصَرَعَهَا فَرَجَمَهَا النَّاسُ حَتَّى قَتَلُوهَا ثُمَّ قَالَ جَلَدْتُهَا بِكِتَابِ اللَّهِ تَعَالَى وَرَجَمْتُهَا بِالسُّنَّةِ  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ وَكَانَ الشَّعْبِيُّ يَذْكُرُ أَنَّهُ شَهِدَ رَجْمَ شُرَاحَةَ وَيَقُولُ إِنَّهُ لَا يَحْفَظُ عَنْ أَمِيرِ الْمُؤْمِنِينَ غَيْرَ ذَلِكَ» سكت عنه الذهبي في التلخيص

[Machine] I saw him with white hair and beard. It was said, "Do you remember anything about him?" He said, "Yes, I remember that he was lashed on Thursday and stoned on Friday." He said, "I lashed her with the Book of Allah and stoned her with the practice of the Messenger of Allah ﷺ." And this is a sound chain of narration, although there is disagreement in the first link of the chain about whether Abdullah ibn Mas'ud heard it from his father or not, it is still considered sound.

رَأَيْتُهُ أَبْيَضَ الرَّأْسِ وَاللِّحْيَةِ قِيلَ فَهَلْ تَذْكُرُ عَنْهُ شَيْئًا؟ قَالَ نَعَمْ أَذْكُرُ أَنَّهُ جَلْدَ شُرَاحَةَ يَوْمَ الْخَمِيسِ وَرَجَمَهَا يَوْمَ الْجُمُعَةِ فَقَالَ «جَلَدْتُهَا بِكِتَابِ اللَّهِ وَرَجَمْتُهَا بِسُنَّةِ رَسُولِ اللَّهِ ﷺ» وَهَذَا إِسْنَادٌ صَحِيحٌ وَإِنْ كَانَ فِي الْإِسْنَادِ الْأَوَّلِ الْخِلَافُ فِي سَمَاعِ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ مِنْ أَبِيهِ صحيح

[Machine] "The Messenger of Allah ﷺ was brought a Jewish man and a Jewish woman who had committed adultery and had been married. They asked him to judge between them, so he judged them by stoning. He stoned them in front of the mosque in Bani Ghanm. When he found that the stones were hurting her, he bent down to protect her from the stones. It was one of the miracles that Allah bestowed upon his Messenger ﷺ, that he stood up to protect her from the stones."

«أُتِيَ رَسُولُ اللَّهِ ﷺ بِيَهُودِيٍّ وَيَهُودِيَّةٍ قَدْ زَنَيَا وَقَدْ أُحْصِنَا فَسَأَلُوهُ أَنْ يَحْكُمَ فِيهِمَا فَحَكَمَ فِيهِمَا بِالرَّجْمِ فَرَجَمَهُمَا فِي قُبُلِ الْمَسْجِدِ فِي بَنِي غَنْمٍ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ قَامَ إِلَى صَاحَبْتِهِ فَحَنَى عَلَيْهَا لِيَقِيَهَا مَسَّ الْحِجَارَةِ وَكَانَ مِمَّا صَنَعَ اللَّهُ لِرَسُولِهِ ﷺ قِيَامَهُ إِلَيْهَا لِيَقِيَهَا الْحِجَارَةَ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ وَلَعَلَّ مُتَوَهِّمًا مِنْ غَيْرِ أَهْلِ الصَّنْعَةِ يَتَوَهَّمَ أَنَّ إِسْمَاعِيلَ الشَّيْبَانِيَّ هَذَا مَجْهُولٌ وَلَيْسَ كَذَلِكَ فَقَدْ رَوَى عَنْهُ عَمْرُو بْنُ دِينَارٍ الْأَثْرَمُ

الحاكم:٨٠٨٩كَمَا حَدَّثَنَا أَبُو زَكَرِيَّا الْعَنْبَرِيُّ ثَنَا مُحَمَّدُ بْنُ عَبْدِ السَّلَامِ ثَنَا يَحْيَى بْنُ يَحْيَى أَنْبَأَ سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ قَالَ بِعْتُ مَا فِي رُءُوسِ نَخْلِي مِائَةَ وَسْقٍ إِنْ زَادَ فَلَهُمْ وَإِنْ نَقَصَ فَعَلَيْهِمْ فَسَأَلْتُ ابْنَ عُمَرَ فَقَالَ

«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ ذَلِكَ إِلَّا أَنَّهُ رَخَّصَ فِي الْعَرَايَا» سكت عنه الذهبي في التلخيص

The Prophet ﷺ said: about a man who had (unlawful) intercourse with his wife's slave girl: If she made her lawful for him, he will be flogged one hundred lashes; if she did not make her lawful for him, I shall stone him. (Using translation from Abū Dāʾūd 4459)  

الحاكم:٨٠٩٠أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ الْحَسَنِ الْقَاضِي بِهَمْدَانَ ثَنَا إِبْرَاهِيمُ بْنُ الْحُسَيْنِ ثَنَا آدَمُ بْنُ أَبِي إِيَاسٍ ثَنَا شُعْبَةُ عَنْ أَبِي بِشْرٍ عَنْ خَالِدِ بْنِ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ

عَنِ النَّبِيِّ ﷺ فِي الرَّجُلِ أَتَى جَارِيَةَ امْرَأَتِهِ قَالَ «إِنْ كَانَتْ حَلَّلَتْهَا لَهُ جُلِدَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

[Machine] "The Messenger of Allah ﷺ said, 'Whoever opposes his religion among the Muslims, then kill him. And if a slave says, "I bear witness that there is no god but Allah, and Muhammad is His slave and Messenger," then there is no way for us except to carry out his rights if he deserves to be punished.'"  

الحاكم:٨٠٩١أَخْبَرَنَا بَكْرُ بْنُ مُحَمَّدِ بْنِ حَمْدَانَ الصَّيْرَفِي بِمَرْوَ ثَنَا عَبْدُ الصَّمَدِ بْنُ الْفَضْلِ ثَنَا حَفْصُ بْنُ عُمَرَ الْعَدَنِيُّ ثَنَا الْحَكَمُ بْنُ أَبَانَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ يُخَالِفْ دِينَهُ مِنَ الْمُسْلِمِينَ فَاقْتُلُوهُ وَإِذَا قَالَ الْعَبْدُ أَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ فَلَا سَبِيلَ لَنَا إِلَيْهِ إِلَّا بِحَقِّهِ إِذَا أَصَابَ أَنْ يُقَامَ عَلَيْهِ مَا هُوَ عَلَيْهِ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ العدني هالك

[Machine] "There was a man from the Ansar who accepted Islam, then he apostatized and followed disbelief. Then he regretted his actions and sent a message to his people asking them to inquire from the Messenger of Allah ﷺ if he could still repent. Allah revealed the verses from Surah Al Imran, starting from 'How shall Allah guide a people who disbelieved after their belief and had witnessed that the Messenger is true and clear signs had come to them...' (3:86) until 'Except for those who repent after that and correct themselves. For indeed, Allah is Forgiving and Merciful' (3:89). His people then approached him and he accepted Islam."  

الحاكم:٨٠٩٢أَخْبَرَنَا مُحَمَّدُ بْنُ عَلِيِّ بْنِ دُحَيْمٍ الشَّيْبَانِيُّ بِالْكُوفَةِ ثَنَا أَحْمَدُ بْنُ حَازِمِ بْنِ أَبِي غَرَزَةَ عَنْ عُمَرَ بْنِ حَفْصِ بْنِ غِيَاثٍ ثَنَا أَبِي عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ

«كَانَ رَجُلٌ مِنَ الْأَنْصَارِ أَسْلَمَ ثُمَّ ارْتَدَّ وَلَحِقَ بِالشِّرْكِ ثُمَّ نَدِمَ فَأَرْسَلَ إِلَى قَوْمِهِ أَنْ سَلُوا رَسُولَ اللَّهِ ﷺ هَلْ لِي مِنْ تَوْبَةٍ؟» قَالَ فَنَزَلَتْ {كَيْفَ يَهْدِي اللَّهُ قَوْمًا كَفَرُوا بَعْدَ إِيمَانِهِمْ وَشَهِدُوا أَنَّ الرَّسُولَ حَقٌّ وَجَاءَهُمُ الْبَيِّنَاتُ} [آل عمران 86] إِلَى قَوْلِهِ {إِلَّا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ} [آل عمران 89] قَالَ «فَأَقْبَلَ إِلَيْهِ قَوْمُهُ فَأَسْلَمَ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

[Machine] About Furat ibn Hayyan, he was a confidant of Abu Sufyan and an ally. The Messenger of Allah ﷺ ordered his killing, so he passed by a group of Ansar (Helpers) and said: "I am a Muslim." The Messenger of Allah ﷺ said, "Certainly, among you are men whose faithfulness is stronger than their own selves. Among them is Furat ibn Hayyan."

عَنِ الْفُرَاتِ بْنِ حَيَّانَ وَكَانَ عَيْنًا لِأَبِي سُفْيَانَ وَحَلِيفًا وَكَانَ رَسُولُ اللَّهِ ﷺ قَدْ أَمَرَ بِقَتْلِهِ فَمَرَّ عَلَى حَلْقَةٍ مِنَ الْأَنْصَارِ فَقَالَ إِنِّي مُسْلِمٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ مِنْكُمْ رِجَالًا نَكِلُهُمْ إِلَى إِيمَانِهِمْ مِنْهُمُ الْفُرَاتُ بْنُ حَيَّانَ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

Qurayzah and Nadir (were two Jewish tribes). An-Nadir were nobler than Qurayzah. When a man of Qurayzah killed a man of an-Nadir, he would be killed. But if a man of an-Nadir killed a man of Qurayzah, a hundred wasq of dates would be paid as blood-money. When Prophethood was bestowed upon the Prophet ﷺ, a man of an-Nadir killed a man of Qurayzah. They said: Give him to us, we shall kill him. They replied: We have the Prophet ﷺ between you and us. So they came to him. Thereupon the following verse was revealed: "If thou judge, judge in equity between them." "In equity" means life for a life. The following verse was then revealed: "Do they seek of a judgment of (the days) ignorance?" Abu Dawud said: Quraizah and al-Nadir were the descendants of Harun the Prophet (peace be upon him) (Using translation from Abū Dāʾūd 4494)

كَانَتْ قُرَيْظَةُ وَالنَّضِيرُ وَكَانَ مِنْ أَشْرَافِ قُرَيْظَةَ فَكَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلًا مِنَ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلًا مِنْ قُرَيْظَةَ قَالُوا ادْفَعُوهُ إِلَيْنَا نَقْتُلُهُ فَقَالُوا بَيْنَنَا وَبَيْنَكُمُ النَّبِيُّ ﷺ فَأَتَوْهُ فَنَزَلَتْ {وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ} [المائدة 42] النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ {أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ} [المائدة 50]  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» صحيح

[Machine] On the authority of the Prophet ﷺ , he said: "The blood of a Muslim is not lawful except in three instances: a married person committing adultery, who should be stoned to death; a person who intentionally kills another person, who should be killed in retaliation; and a person who renounces their religion and separates from the Muslim community."

عَنِ النَّبِيِّ ﷺ قَالَ لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلَّا فِي ثَلَاثِ خِصَالٍ زَانٍ مِحْصَنٍ فَيُرْجَمُ وَالرَّجُلُ يَقْتُلُ مُتَعَمِّدًا فَيُقْتَلُ بِهِ وَيُصْلَبُ أَوْ يُنْفَى مِنَ الْأَرْضِ  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ» على شرط البخاري ومسلم

[Machine] "That the Prophet ﷺ made his followers beautiful in appearance because they made the eyes of the shepherds beautiful."

«أَنَّ النَّبِيَّ ﷺ إِنَّمَا سَمَلَ أَعْيُنَ الْعُرَنِيِّينَ لِأَنَّهُمْ سَمَلُوا أَعْيُنَ الرِّعَاءِ»

[Machine] Yahya bin Abdullah narrated, and he mentioned with his chain of narration something similar to it.

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» ذا في مسلم

“Whoever kills his slave, we will kill him, and whoever mutilates (his slave) we will mutilate him.” (Using translation from Ibn Mājah 2663)

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَ عَبْدَهُ جَدَعْنَاهُ»  

قَالَ الْحَاكِمُ «أَنَا أَخْشَى أَنَّ عُثْمَانَ بْنَ الْهَيْثَمِ أَرَادَ الْإِسْنَادَ الْأَوَّلَ كَمَا رَوَاهُ يَزِيدُ بْنُ هَارُونَ وَاللَّهُ أَعْلَمُ»

[Machine] The Messenger of Allah ﷺ said, "Whoever honorably treats his servant, we will honorably treat him twice."  

الحاكم:٨١٠٠فَحَدَّثَنَا أَبُو زَكَرِيَّا يَحْيَى بْنُ مُحَمَّدٍ الْعَنْبَرِيُّ ثَنَا إِبْرَاهِيمُ بْنُ أَبِي طَالِبٍ ثَنَا بُنْدَارٌ ثَنَا مُعَاذُ بْنُ هِشَامٍ حَدَّثَنِي أَبِي عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ سَمُرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أَخْصَى عَبْدَهُ أَخْصَيْنَاهُ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

[Machine] Indeed my master accused me and he made me sit on the fire until my vagina was burned. Umar asked, "Did you witness this?" She said, "No." Umar asked, "Did you confess anything to him?" She said, "No." Umar said, "I hold you responsible for it." When Umar saw the man, he asked, "Should you be punished with the punishment of Allah?" He replied, "O Amir al-Mu'minin, I accused her in my own self." Umar asked, "Did you witness this on her?" The man replied, "No." Umar asked, "Did she confess it to you?" He replied, "No." Umar said, "By the One in Whose hand is my soul, if I had not heard the Messenger of Allah ﷺ say, 'A slave should not be punished for the sins of their master, nor should a child be punished for the sins of their parents,' I would have killed you because of her." Then he publicly lashed him a hundred times and said, "Go, you are free for the sake of Allah, and you are the possession of Allah and His Messenger." Abu Salih said that Layth commented, "This action was done."  

الحاكم:٨١٠١أَخْبَرَنَا أَبُو النَّضْرِ مُحَمَّدُ بْنُ مُحَمَّدٍ الْفَقِيهُ وَأَبُو إِسْحَاقَ إِبْرَاهِيمُ بْنُ إِسْمَاعِيلَ الْقَارِئُ قَالَا ثَنَا عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ حَدَّثَنِي اللَّيْثُ بْنُ سَعْدٍ عَنْ عُمَرَ بْنِ عِيسَى الْقُرَشِيِّ ثُمَّ الْأَسَدِيِّ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ عَنِ ابْنِ عَبَّاسٍ قَالَ جَاءَتْ جَارِيَةٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَتْ

إِنَّ سَيِّدِي اتَّهَمَنِي فَأَقْعَدَنِي عَلَى النَّارِ حَتَّى احْتَرَقَ فَرْجِي فَقَالَ عُمَرُ هَلْ رَأَى ذَلِكَ عَلَيْكِ؟ قَالَتْ لَا قَالَ فَاعْتَرَفْتِ لَهُ بِشَيْءٍ؟ قَالَتْ لَا قَالَ عُمَرُ عَلَيَّ بِهِ فَلَمَّا رَأَى عُمَرُ الرَّجُلَ قَالَ أَتُعَذَّبُ بِعَذَابِ اللَّهِ؟ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اتَّهَمْتُهَا فِي نَفْسِهَا قَالَ رَأَيْتَ ذَلِكَ عَلَيْهَا؟ قَالَ الرَّجُلُ لَا قَالَ فَاعْتَرَفَتْ لَكَ بِذَلِكَ؟ قَالَ لَا قَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ لَمْ أَسْمَعْ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُقَادُ مَمْلُوكٌ مِنْ مَالِكِهِ وَلَا وَلَدٌ مِنْ وَالِدِهِ» لَأَقَدْتُهَا مِنْكَ فَبَرَّزَهُ وَضَرَبَهُ مِائَةَ سَوْطٍ ثُمَّ قَالَ اذْهَبِي فَأَنْتِ حُرَّةٌ لِوَجْهِ اللَّهِ وَأَنْتِ مَوْلَاةُ اللَّهِ وَرَسُولِهِ قَالَ أَبُو صَالِحٍ قَالَ اللَّيْثُ «هَذَا مَعْمُولٌ بِهِ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ وَلَهُ شَاهِدَانِ صحيح
hakim:8102Abū Jaʿfar b. Duḥaym > Aḥmad b. Ḥāzim b. Abū Gharazah > Mālik b. Ismāʿīl > Abū Shihāb ʿAbd Rabbih b. Nāfiʿ > Ḥamzah al-Jazarī > ʿAmr b. Dīnār > Ibn ʿUmar

[Machine] The Messenger of Allah, peace be upon him, said: "Whoever compares his servant to (another) is free and he is the slave of Allah and His messenger." Hamza Al-Nasibi provides the hadith.  

الحاكم:٨١٠٢أَخْبَرَنَاهُ أَبُو جَعْفَرِ بْنُ دُحَيْمٍ ثَنَا أَحْمَدُ بْنُ حَازِمِ بْنِ أَبِي غَرَزَةَ ثَنَا مَالِكُ بْنُ إِسْمَاعِيلَ ثَنَا أَبُو شِهَابٍ عَبْدُ رَبِّهِ بْنُ نَافِعٍ عَنْ حَمْزَةَ الْجَزَرِيِّ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ مَثَّلَ بِعَبْدِهِ فَهُوَ حُرٌّ وَهُوَ مَوْلَى اللَّهِ وَرَسُولِهِ» حمزة هو النصيبي يضع الحديث

[Machine] Walidah, a Swaidi woman, was slapped, which made her very angry. She had never been so angry before. She said, "May the curse of Allah be upon you, except for the sacredness of her face. I have seen myself as the seventh of seven from the Bani Muqarrin tribe. We have only one servant, and he slapped her, our youngest. The Messenger of Allah, peace be upon him, ordered us to set her free." It is authentic.  

الحاكم:٨١٠٣وَأَخْبَرَنَا أَبُو جَعْفَرِ بْنُ دُحَيْمٍ ثَنَا أَحْمَدُ بْنُ حَازِمٍ ثَنَا عَاصِمُ بْنُ يُوسُفَ الْيَرْبُوعِيُّ ثَنَا عَبْثَرُ بْنُ قَاسِمٍ ثَنَا حُصَيْنٌ عَنْ هِلَالِ بْنِ يِسَافٍ قَالَ كُنَّا نُزُولًا فِي دَارِ سُوَيْدِ بْنِ مُقَرِّنٍ وَمَعَنَا شَيْخٌ حَدِيدٌ جَاهِلٌ فَلَا أَدْرِي مَا قَالَتْ

وَلِيدَةُ سُوَيْدٍ فَلَطَمَهَا فَغَضِبَ مِنْ ذَلِكَ غَضَبًا مَا غَضِبَ مِثْلَهُ قَطُّ قَالَ «عَجَزَ عَلَيْكَ إِلَّا حُرُّ وَجْهِهَا لَقَدْ رَأَيْتُنِي سَابِعَ سَبْعَةٍ مِنْ بَنِي مُقَرِّنٍ مَا لَنَا إِلَّا خَادِمٌ وَاحِدٌ فَلَطَمَهَا أَصْغَرُنَا فَأَمَرَنَا رَسُولُ اللَّهِ ﷺ أَنْ نُعْتِقَهَا» صحيح

[Machine] The Messenger of Allah ﷺ said, "A child should not be punished for the actions of his parents, and the punishment of prescribed limits should not be carried out in mosques." Al-Dhahabi remained silent about summarizing it.

قَالَ رَسُولُ اللَّهِ ﷺ «لَا يُقَادُ وَلَدٌ مِنْ وَالِدِهِ وَلَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ» سكت عنه الذهبي في التلخيص

[Machine] It means: "That the Prophet ﷺ traveled and immigrated [to Medina], and that Abu Bakr traveled and immigrated [with him], and that Umar traveled and immigrated [as well]."

«أَنَّ النَّبِيَّ ﷺ ضَرَبَ وَغَرَّبَ» وَأَنَّ أَبَا بَكْرٍ ضَرَبَ وَغَرَّبَ «وَأَنَّ عُمَرَ ضَرَبَ وَغَرَّبَ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم

ʿAli (ؓ )addressed us and said: O people, carry out the hadd punishments on your slaves, both those who have been married and those who have not been married, for a slave woman of the Messenger of Allah ﷺ committed zina and the Messenger of Allah ﷺ ordered me to carry out the hadd Punishment on her. I went to her and found that she was still bleeding following childbirth, and I was afraid that if I flogged her she would die So I went to the Messenger of Allah ﷺ and told him about that, and he said: “You have done well.” (Using translation from Aḥmad 1341)

يَا أَيُّهَا النَّاسُ أَقِيمُوا الْحُدُودَ عَلَى أَرِقَّائِكُمْ مَنْ أُحْصِنَ مِنْهُنَّ وَمَنْ لَمْ يُحْصِنْ فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ ﷺ زَنَتْ فَأَمَرَنِي رَسُولُ اللَّهِ ﷺ أَنْ أَجْلِدَهَا فَأَتَيْتُهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا وَأَنْ تَمُوتَ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «أَحْسَنْتَ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ على شرط مسلم

[Machine] I heard the Messenger of Allah ﷺ saying, "No one should be whipped with more than ten lashes, except in cases prescribed by the limits set by Allah the Almighty."  

الحاكم:٨١٠٧حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ ثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الْأَشَجِّ حَدَّثَهُ قَالَ بَيْنَا أَنَا جَالِسٌ عِنْدَ سُلَيْمَانَ بْنِ يَسَارٍ إِذْ دَخَلَ عَبْدُ الرَّحْمَنِ بْنُ جَابِرٍ فَحَدَّثَ سُلَيْمَانَ بْنَ يَسَارٍ فَقَالَ حَدَّثَنِي عَبْدُ الرَّحْمَنِ بْنُ جَابِرٍ أَنَّ أَبَاهُ حَدَّثَهُ أَنَّهُ سَمِعَ أَبَا بُرْدَةَ الْأَنْصَارِيَّ يَقُولُ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُجْلَدُ فَوْقَ عَشْرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللَّهِ تَعَالَى»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم

[Machine] He visited his aunt and she invited him to a meal. The servant girl was slow, so she said, "Don't you hurry, O adulteress!" 'Amr said, "Glory be to Allah! You have said something great. Have you looked at it through adultery?" She said, "No, I swear by Allah." 'Amr said, "Verily, I heard the Messenger of Allah ﷺ say, 'Any woman who says to her servant son, "O adulteress," and she has not looked at her with adultery, her child will be flogged by her on the Day of Resurrection. For there is no limit for them (the children) in this world.'"  

الحاكم:٨١٠٨أَخْبَرَنَا أَبُو بَكْرِ بْنُ أَبِي دَارِمٍ الْحَافِظُ بِالْكُوفَةِ ثَنَا أَحْمَدُ بْنُ مُوسَى التَّمِيمِيُّ ثَنَا مِنْجَابُ بْنُ الْحَارِثِ ثَنَا عَبْدُ الْمَلِكِ بْنُ هَارُونَ بْنِ عَنْتَرَةَ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ عَمْرِو بْنِ الْعَاصِ

أَنَّهُ زَارَ عَمَّةً لَهُ فَدَعَتْ لَهُ بِطَعَامٍ فَأَبْطَأْتِ الْجَارِيَةُ فَقَالَتْ أَلَا تَسْتَعْجِلِي يَا زَانِيَةُ فَقَالَ عَمْرٌو سُبْحَانَ اللَّهِ لَقَدْ قُلْتِ أَمْرًا عَظِيمًا هَلِ اطَّلَعْتِ عَنْهَا عَلَى زِنًى؟ قَالَتْ لَا وَاللَّهِ فَقَالَ عَمْرٌو إِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَيُّمَا عَبْدٍ أَوِ امْرَأَةٍ قَالَ أَوْ قَالَتْ لِوَلِيدَتِهَا يَا زَانِيَةُ وَلَمْ تَطَّلِعْ مِنْهَا عَلَى زِنَاءٍ جَلَدَتْهَا وَلِيدَتُهَا يَوْمَ الْقِيَامَةِ لِأَنَّهُ لَا حَدَّ لَهُنَّ فِي الدُّنْيَا»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ إِنَّمَا اتَّفَقَا فِي هَذَا الْبَابِ عَلَى حَدِيثِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نُعْمٍ عَنْ أَبِي هُرَيْرَةَ «مَنْ قَذَفَ مَمْلُوكَهُ بِالزِّنَا أُقِيمَ عَلَيْهِ الْحَدُّ يَوْمَ الْقِيَامَةِ» بل عبد الملك بن هارون متروك باتفاق حتى قيل فيه دجال

[Machine] Sahl ibn Saad, the companion of the Messenger of Allah ﷺ , narrated to me that a man who had embraced Islam came to the Prophet ﷺ and said that he had committed fornication with a woman whom he named, and she denied it. So the Prophet ﷺ carried out the prescribed punishment on him and left her. This is an authentic narration and it is also supported by a reliable witness.

حَدَّثَنِي سَهْلُ بْنُ سَعْدٍ صَاحِبُ رَسُولِ اللَّهِ ﷺ «أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّهُ زَنَى بِامْرَأَةٍ سَمَّاهَا وَأَنْكَرَتْ فَحَدَّهُ وَتَرْكَهَا» هَذَا إِسْنَادٌ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ وَشَاهِدُهُ صحيح

A man of Bakr ibn Layth came to the Prophet ﷺ and made confession four times that he had committed fornication with a woman, so he had a hundred lashes administered to him. The man had not been married. He then asked him to produce proof against the woman, and she said: I swear by Allah, Messenger of Allah, that he has lied. Then he was given the punishment of eighty lashes of falsehood. (Using translation from Abū Dāʾūd 4467)  

الحاكم:٨١١٠مَا حَدَّثَنَاهُ مُحَمَّدُ بْنُ صَالِحِ بْنِ هَانِئٍ ثَنَا يَحْيَى بْنُ مُحَمَّدِ بْنِ يَحْيَى ثَنَا مُوسَى بْنُ هَارُونَ الْبُرْدِيُّ ثَنَا هِشَامُ بْنُ يُوسُفَ ثَنَا الْقَاسِمُ بْنُ فَيَّاضٍ الْأَنْبَارِيُّ عَنْ خَلَّادِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَجُلًا مِنْ بَنِي بَكْرِ بْنِ لَيْثٍ أَتَى النَّبِيَّ ﷺ فَأَقَرَّ أَنَّهُ زَنَى بِامْرَأَةٍ أَرْبَعَ مِرَارٍ فَجُلِدَ مِائَةً وَكَانَ بِكْرًا ثُمَّ سَأَلَهُ الْبَيِّنَةَ عَلَى الْمَرْأَةِ فَقَالَتِ الْمَرْأَةُ كَذَبَ وَاللَّهِ يَا رَسُولَ اللَّهِ فَجَلَدَهُ حَدَّ الْفِرْيَةِ ثَمَانِينَ  

«هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ» القاسم بن فياض ضعيف

Hilal bin Umaiya accused his wife before the Prophet ﷺ of committing illegal sexual intercourse with Sharik bin Sahma.' The Prophet ﷺ said, "Produce a proof, or else you would get the legal punishment (by being lashed) on your back." Hilal said, "O Messenger of Allah ﷺ! If anyone of us saw another man over his wife, would he go to search for a proof." The Prophet ﷺ went on saying, "Produce a proof or else you would get the legal punishment (by being lashed) on your back." The Prophet ﷺ then mentioned the narration of Lian (as in the Holy Book). (Surat-al-Nur: 24) (Using translation from Bukhārī 2671)  

الحاكم:٨١١١أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ حَمْدَانَ الْجَلَّابُ بِهَمْدَانَ ثَنَا أَبُو حَاتِمٍ الرَّازِيُّ ثَنَا سَعِيدُ بْنُ الرَّبِيعِ ثَنَا هِشَامُ بْنُ حَسَّانَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ

أَنَّ هِلَالَ بْنَ أُمَيَّةَ قَذَفَ امْرَأَتَهُ عِنْدَ النَّبِيِّ ﷺ بِشَرِيكِ بْنِ سَمْحَاءَ فَقَالَ رَسُولُ اللَّهِ ﷺ «الْبَيِّنَةُ أَوْ حَدٌّ فِي ظَهْرِكَ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخَرِّجَاهُ صحيح

[Machine] Al-Qa'nabi narrated that Ibn Abi Dhi'b narrated from his maternal uncle Al-Harith ibn Abd al-Rahman, who narrated from Abu Salamah, who narrated from Abu Hurayrah that the Prophet Muhammad ﷺ said regarding alcohol, "If anyone drinks it, flog him; if he repeats the offense, flog him again; if he repeats it for a third time, then kill him."

ثَنَا الْقَعْنَبِيُّ ثَنَا ابْنُ أَبِي ذِئْبٍ عَنْ خَالِهِ الْحَارِثِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ فِي الْخَمْرِ «إِنْ شَرِبَهَا فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ»  

هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ «وَفِي الْبَابِ عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ الْبَجَلِيِّ وَعَبْدِ اللَّهِ بْنِ عُمَرَ وَشُرَحْبِيلَ بْنِ أَوْسٍ» وَهَؤُلَاءِ مِنَ الصَّحَابَةِ على شرط البخاري ومسلم

[Machine] The Messenger of Allah ﷺ said, "If someone drinks alcohol, flog him. If he repeats it, flog him again. If he does it a third time, flog him. If he repeats it for the fourth time, kill him." Al-Dhahabi remained silent about this in his summary.  

الحاكم:٨١١٣فَأَخْبَرَنَاهُ بَكْرُ بْنُ مُحَمَّدٍ الصَّيْرَفِيُّ بِمَرْوَ ثَنَا عَبْدُ الصَّمَدِ بْنُ الْفَضْلِ ثَنَا مَكِّيُّ بْنُ إِبْرَاهِيمَ ثَنَا دَاوُدُ بْنُ يَزِيدَ عَنْ سِمَاكِ بْنِ حَرْبٍ عَنْ خَالِدِ بْنِ حَزْمٍ عَنْ جَرِيرٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «إِنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» سكت عنه الذهبي في التلخيص

The Prophet ﷺ said: If they (the people) drink wine, flog them, again if they drink it, flog them. Again if they drink it, kill them. (Using translation from Abū Dāʾūd 4482)   

الحاكم:٨١١٤فَحَدَّثْنَاهُ إِبْرَاهِيمُ بْنُ عِصْمَةَ بْنِ إِبْرَاهِيمَ ثَنَا أَبِي ثَنَا يَحْيَى بْنُ يَحْيَى أَنْبَأَ جَرِيرٌ عَنْ مُغِيرَةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نُعْمٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ شَرِبَ فَاجْلِدُوهُ فَإِنْ شَرِبَ فَاجْلِدُوهُ فَإِنْ شَرِبَ فَاقْتُلُوهُ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم
hakim:8115Yaḥyá b. Abū Ṭālib > ʿAbd al-Wahhāb b. ʿAṭāʾ > Saʿīd > Suhayl b. Abū Ṣāliḥ from his father > Abū Hurayrah

[Machine] The Prophet ﷺ said, "Whoever drinks alcohol, whip him. If he drinks again, whip him. If he drinks again, whip him. If he drinks for the fourth time, kill him." This chain of narration is authentic according to the condition of Muslim, and Muslim did not exclude it.  

الحاكم:٨١١٥فَحَدَّثَنَا الْحَسَنُ بْنُ يَعْقُوبَ الْعَدْلُ ثَنَا يَحْيَى بْنُ أَبِي طَالِبٍ ثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ أَنْبَأَ سَعِيدٌ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» وَهَذَا الْإِسْنَادُ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ على شرط مسلم

[Machine] That the Prophet ﷺ said, "Whoever drinks wine, flog him, if he drinks it again, flog him again, if he drinks it again, flog him again, and if he drinks it for the fourth time, kill him." Ma'mar said, "I mentioned this to Muhammad ibn al-Munkadir, and he said, 'This was abandoned after the Prophet ﷺ ordered the punishment of Ibn Nu'aym. He flogged him, then he was brought to him again and he flogged him, then he was brought to him again and he flogged him, then he was brought to him for the fourth time and he flogged him, and nothing more than that was done.'" As for the narration of Mu'awiyah...  

الحاكم:٨١١٦فَحَدَّثَنَا أَبُو زَكَرِيَّا الْعَنْبَرِيُّ ثَنَا أَبُو عَبْدِ اللَّهِ الْبُوشَنْجِيُّ ثَنَا أَحْمَدُ بْنُ حَنْبَلٍ ثَنَا عَبْدُ الرَّزَّاقِ أَنْبَأَ مَعْمَرٌ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» قَالَ مَعْمَرٌ فَحَدَّثْتُ بِهِ مُحَمَّدَ بْنَ الْمُنْكَدِرِ فَقَالَ «قَدْ تُرِكَ ذَلِكَ بَعْدُ أُتِيَ النَّبِيُّ ﷺ بِابْنِ النُّعَيْمَانِ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فَجَلَدَهُ ثُمَّ أُتِيَ بِهِ فِي الرَّابِعَةِ فَجَلَدَهُ وَلَمْ يَزِدْ عَلَى ذَلِكَ» فَأَمَّا حَدِيثُ مُعَاوِيَةَ

[Machine] From Thakwan, from Abu Salih, he praised him and attributed good to him, from Muawiyah, from the Prophet ﷺ who said, "If they drink alcohol, whip them. And if they drink again, whip them. And if they drink again, whip them. And if they drink for the fourth time, kill them." Sahih.  

الحاكم:٨١١٧فَحَدَّثْنَاهُ الْحَسَنُ بْنُ يَعْقُوبَ الْعَدْلُ ثَنَا يَحْيَى بْنُ أَبِي طَالِبٍ ثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ أَنْبَأَ سَعِيدٌ عَنْ عَاصِمِ بْنِ بَهْدَلَةَ

عَنْ ذَكْوَانَ أَبِي صَالِحٍ وَأَثْنَى عَلَيْهِ خَيْرًا عَنْ مُعَاوِيَةَ عَنِ النَّبِيِّ ﷺ قَالَ «إِنْ شَرِبُوا الْخَمْرَ فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا فَاجْلِدُوهُمْ ثُمَّ إِنْ شَرِبُوا الرَّابِعَةَ فَاقْتُلُوهُمْ» صحيح

[Machine] About the Prophet ﷺ, he said: "If any one of you drinks wine, then give him lashes. If he does it again, then give him lashes. If he does it again for the third time, then kill him."  

الحاكم:٨١١٨فَحَدَّثَنَا أَبُو عَبْدِ اللَّهِ الصَّفَّارُ ثَنَا مُحَمَّدُ بْنُ مَسْلَمَةَ ثَنَا يَزِيدُ بْنُ هَارُونَ أَنْبَأَ مُحَمَّدُ بْنُ إِسْحَاقَ عَنِ الزُّهْرِيِّ عَنْ عَمْرِو بْنِ الشَّرِيدِ عَنْ أَبِيهِ

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا شَرِبَ أَحَدُكُمُ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ»  

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ على شرط مسلم

[Machine] "The Prophet ﷺ said regarding alcohol: 'If they drink it, then flog them. If they drink it again, then flog them. If they drink it again, then flog them. And if they drink it again, then kill them on the fourth occasion.' Al-Dhahabi remained silent about it in his summary."

أَنَّ النَّبِيَّ ﷺ قَالَ فِي الْخَمْرِ «إِذَا شَرِبُوهَا فَاجْلِدُوهُمْ ثُمَّ إِذَا شَرِبُوهَا فَاجْلِدُوهُمْ ثُمَّ إِذَا شَرِبُوهَا فَاجْلِدُوهُمْ ثُمَّ إِذَا شَرِبُوهَا فَاقْتُلُوهُمْ عِنْدَ الرَّابِعَةِ» سكت عنه الذهبي في التلخيص

[Machine] I heard a man from the companions of the Prophet ﷺ narrating to Abdul Malik ibn Marwan about wine. The Messenger of Allah ﷺ said about wine, 'If someone drinks it, flog him; if he repeats, flog him again; if he repeats again, flog him again; and if he repeats it for the fourth time, then kill him.' So I heard Abu Ali Al-Hafiz narrating this Hadith to us, and he said at the end, 'This companion is from the people of Sham, and his name is Shurahbil ibn Aws.'

سَمِعْتُ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ يُحَدِّثُ عَبْدَ الْمَلِكِ بْنَ مَرْوَانَ فِي الْخَمْرِ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ فِي الْخَمْرِ «إِنْ شَرِبَهَا فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ» فَسَمِعْتُ أَبَا عَلِيٍّ الْحَافِظَ يُحَدِّثُنَا بِهَذَا الْحَدِيثِ فَقَالَ فِي آخِرِهِ هَذَا الصَّحَابِيُّ مِنْ أَهْلِ الشَّامِ هُوَ شُرَحْبِيلُ بْنُ أَوْسٍ

[Machine] On the authority of Shurahbil ibn Aws, who was among the companions of the Prophet Muhammad ﷺ , the Prophet Muhammad ﷺ said, "When someone drinks alcohol, flog him. If he drinks again, flog him. If he drinks again, flog him. If he drinks for the fourth time, kill him." Ad-Dhahabi did not mention this in his summary.

عَنْ شُرَحْبِيلَ بْنِ أَوْسٍ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ الرَّابِعَةَ فَاقْتُلُوهُ» سكت عنه الذهبي في التلخيص

[Machine] As for the narration from the companions of the Messenger of Allah ﷺ regarding alcohol, it is reported that the Messenger of Allah ﷺ said, "Whoever drinks alcohol, then flog him, and if he repeats it, then flog him, and if he repeats it again, then flog him. If he does it for the fourth time, then kill him."

وَأَمَّا حَدِيثُ النَّضْرِ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ»
