[Machine] "There were three things that used to be repeated during the time of the Messenger of Allah ﷺ, until they became just one. He said, 'Yes'."
أَنَّ ثَلَاثًا كُنَّ يُرْدَدْنَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ إِلَى وَاحِدَةٍ قَالَ «نَعَمْ»
[Machine] "There were three things that used to be repeated during the time of the Messenger of Allah ﷺ, until they became just one. He said, 'Yes'."
أَنَّ ثَلَاثًا كُنَّ يُرْدَدْنَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ إِلَى وَاحِدَةٍ قَالَ «نَعَمْ»
Verily the people have begun to hasten in the matter in which they are required to observe respite. So if we had imposed this upon them, and he imposed it upon them. (Using translation from Muslim 1472a)
«كَانَ الطَّلَاقُ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ وَأَبِي بَكْرٍ وَسَنَتَيْنِ مِنْ خِلَافَةِ عُمَرَ طَلَاقُ الثَّلَاثِ وَاحِدَةٌ» فَقَالَ عُمَرُ «إِنَّ النَّاسَ قَدِ اسْتَعْجَلُوا فِي أَمْرٍ كَانَتْ لَهُمْ فِيهِ أَنَاةٌ فَلَوْ أَمْضَيْنَاهُ عَلَيْهِمْ فَأَمْضَاهُ عَلَيْهِمْ»
The Prophet ﷺ said: Allah did not make anything lawful more abominable to Him than divorce. (Using translation from Abū Dāʾūd 2177)
قَالَ رَسُولُ اللَّهِ ﷺ «مَا أَحَلَّ اللَّهُ شَيْئًا أَبْغَضَ إِلَيْهِ مِنَ الطَّلَاقِ»
The Prophet ﷺ said: Anyone who incites a woman against her husband or a slave against his master is not one of us. (Using translation from Abū Dāʾūd 2175)
قَالَ رَسُولُ اللَّهِ ﷺ «لَيْسَ مِنَّا مَنْ خَبَّبَ امْرَأَةً عَلَى زَوْجِهَا أَوْ عَبْدًا عَلَى سَيِّدِهِ»
[Machine] "When the Prophet ﷺ divorced Hafsah, he was commanded to reconcile with her, so he reconciled with her."
«لَمَّا طَلَّقَ النَّبِيُّ ﷺ حَفْصَةَ أُمِرَ أَنْ يُرَاجِعَهَا فَرَاجَعَهَا»
The Prophet ﷺ divorced Hafsah, but he took her back in marriage. (Using translation from Abū Dāʾūd 2283)
«أَنَّ رَسُولَ اللَّهِ ﷺ طَلَّقَ حَفْصَةَ ثُمَّ رَاجَعَهَا»
A woman was my wife and I loved her, but Umar hated her. He said to me: Divorce her, but I refused. Umar then went to the Prophet ﷺ and mentioned that to him. The Prophet ﷺ said: Divorce her. (Using translation from Abū Dāʾūd 5138)
كَانَتْ تَحْتِي امْرَأَةٌ أُحِبُّهَا وَكَانَ عُمَرُ يَكْرَهُهَا فَقَالَ عُمَرُ طَلِّقْهَا فَأَبَيْتُ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «أَطِعْ أَبَاكَ وَطَلِّقْهَا» فَطَلَّقْتُهَا
[Machine] Indeed, my mother has always stood by me until I got married. And she told me to divorce her, but she insisted on that alone. So, I said, "I am not the one who orders you to disobey your mother nor am I the one who orders you to divorce your wife, except that if you wish, I can inform you of what I heard from the Messenger of Allah ﷺ saying, 'The parent is the middle gate of Paradise, so guard that gate if you wish or leave it.'"
إِنَّ أُمِّي لَمْ تَزَلْ بِي حَتَّى تَزَوَّجْتُ وَإِنَّهَا تَأْمُرُنِي بِطَلَاقِهَا وَقَدْ أَبَتْ عَلَيَّ إِلَّا ذَاكَ فَقَالَ مَا أَنَا بِالَّذِي آمُرُكَ أَنْ تَعُقَّ وَالِدَتَكَ وَلَا أَنَا الَّذِي آمُرُكَ أَنْ تُطَلِّقَ امْرَأَتَكَ غَيْرَ أَنَّكَ إِنْ شِئْتَ حَدَّثْتُكَ بِمَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ يَقُولُ «الْوَالِدُ أَوْسَطُ أَبْوَابِ الْجَنَّةِ فَحَافِظْ عَلَى ذَلِكَ الْبَابِ إِنْ شِئْتَ أَوْ أَضِعْهُ»
The Prophet ﷺ said: There are three things which, whether undertaken seriously or in jest, are treated as serious: Marriage, divorce and taking back a wife (after a divorce which is not final) (Using translation from Abū Dāʾūd 2194)
عَنْ رَسُولِ اللَّهِ ﷺ سَمِعَهُ يَقُولُ «ثَلَاثٌ جِدُّهُنَّ جِدٌّ وَهَزْلُهُنَّ جِدٌّ النِّكَاحُ وَالطَّلَاقُ وَالرَّجْعَةُ»
Allah has forgiven for me my nation their mistakes and forgetfulness, and what they are forced to do." (Using translation from Ibn Mājah 2043)
قَالَ رَسُولُ اللَّهِ ﷺ «تَجَاوَزَ اللَّهُ عَنْ أُمَّتِي الْخَطَأَ وَالنِّسْيَانَ وَمَا اسْتُكْرِهُوا عَلَيْهِ»
"Aishah told me that the Messenger of Allah ﷺ said: 'There is no divorce and no manumission at the time of coercion.' " (Using translation from Ibn Mājah 2046)
أَنَّهَا سَمِعَتْ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا طَلَاقَ وَلَا عَتَاقَ فِي إِغْلَاقٍ»
[Machine] About the Prophet ﷺ it is narrated that he said, "There is no divorce or manumission in constraint." This is the statement of Naeem, the companion of Munaakir.
عَنِ النَّبِيِّ ﷺ قَالَ «لَا طَلَاقَ وَلَا عَتَاقَ فِي إِغْلَاقٍ» نعيم صاحب مناكير
that the Messenger of said: 'Shall I not tell you of a borrowed billy goat.” They said: “Yes, O Messenger of!” He said: “He is Muhallil. May curse the Muhallil and the Muhallal lahu.” (Using translation from Ibn Mājah 1936)
قَالَ رَسُولُ اللَّهِ ﷺ «أَلَا أُخْبِرُكُمْ بِالتَّيْسِ الْمُسْتَعَارِ؟» قَالُوا بَلَى يَا رَسُولَ اللَّهِ قَالَ «هُوَ الْمُحِلُّ فَلَعَنَ اللَّهُ الْمُحِلَّ وَالْمُحَلَّلَ لَهُ» ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ «لَعَنِ اللَّهُ الْمُحِلَّ وَالْمُحَلَّلَ لَهُ»

قَالَ رَسُولُ اللَّهِ ﷺ «أَلَا أُخْبِرُكُمْ بِالتَّيْسِ الْمُسْتَعَارِ؟» قَالُوا بَلَى يَا رَسُولَ اللَّهِ قَالَ «هُوَ الْمُحِلُّ» ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ «لَعَنَ اللَّهُ الْمُحِلَّ وَالْمُحَلَّلَ لَهُ»
[Machine] About a man who divorced his wife three times, and then his brother married her without any conspiracy from him in order to make her permissible for his brother. Does she become permissible for the first husband? He said, "No, marriage is a desire. We used to consider this as a form of licentiousness during the time of the Prophet Muhammad ﷺ."
عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَهَا أَخٌ لَهُ مِنْ غَيْرِ مُؤَامَرَةٍ مِنْهُ لِيُحِلَّهَا لِأَخِيهِ هَلْ تَحِلُّ لِلْأَوَّلِ؟ قَالَ «لَا الْإِنْكَاحُ رَغْبَةٌ كُنَّا نَعُدُّ هَذَا سِفَاحًا عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ»
[Machine] "He divorced his wife on the command of the Messenger of Allah ﷺ . So I asked the Prophet ﷺ about it, and he said, 'What did you intend by that?' I said, 'I intended to divorce her once.' He said, 'By Allah?'" I said, 'By Allah.' He said, 'Then it is as you intended.'"
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ قَالَ فَسَأَلْتُ النَّبِيَّ ﷺ عَنْ ذَلِكَ فَقَالَ «مَا أَرَدْتَ بِذَلِكَ؟» قَالَ أَرَدْتُ بِهِ وَاحِدَةً قَالَ «آللَّهِ؟» قَالَ اللَّهِ قَالَ «فَهُوَ مَا أَرَدْتَ»
[Machine] That Rukanah bin Abd Yazeed divorced his wife Suhaymah al-Batta, then he came to the Messenger of Allah ﷺ and said, "I have divorced my wife Suhaymah al-Batta, and by Allah, I only intended to divorce her once." The Messenger of Allah ﷺ returned her to him. Then he divorced her a second time during the time of Umar, and a third time during the time of Uthman. This narration has been verified as authentic because Imam Shafi'i has mastered and memorized it from the Ahl al-Bayt (family of the Prophet). As-Sa'ib bin Abd Yazeed, the father of Shafi'i bin As-Sa'ib, is the brother of Rukanah bin Abd Yazeed. Muhammad bin Ali bin Shafi'i, the uncle of Shafi'i, is the prominent scholar of the Quraysh tribe during his time. Adh-Dhahabi remained silent about it in his summary.
أَنَّ رُكَانَةَ بْنَ عَبْدِ يَزِيدَ طَلَّقَ امْرَأَتَهُ سُهَيْمَةَ الْبَتَّةَ ثُمَّ أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنِّي طَلَّقْتُ امْرَأَتِي سُهَيْمَةَ الْبَتَّةَ وَوَاللَّهِ مَا أَرَدْتُ إِلَّا وَاحِدَةً «فَرَدَّهَا إِلَيْهِ رَسُولُ اللَّهِ ﷺ» فَطَلَّقَهَا الثَّانِيَةَ فِي زَمَنِ عُمَرَ وَالثَّالِثَةَ فِي زَمَنِ عُثْمَانَ «قَدْ صَحَّ الْحَدِيثُ بِهَذِهِ الرِّوَايَةِ فَإِنَّ الْإِمَامَ الشَّافِعِيَّ قَدْ أَتْقَنَهُ وَحَفِظَهُ عَنْ أَهْلِ بَيْتِهِ وَالسَّائِبُ بْنُ عَبْدِ يَزِيدَ أَبُو الشَّافِعِ بْنُ السَّائِبِ وَهُوَ أَخُو رُكَانَةَ بْنِ عَبْدِ يَزِيدَ وَمُحَمَّدُ بْنُ عَلِيِّ بْنِ شَافِعٍ عَمُّ الشَّافِعِيِّ شَيْخُ قُرَيْشٍ فِي عَصْرِهِ» سكت عنه الذهبي في التلخيص
The Prophet ﷺ said: If any woman asks her husband for divorce without some strong reason, the odour of Paradise will be forbidden to her. (Using translation from Abū Dāʾūd 2226)
قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا الطَّلَاقَ مِنْ غَيْرِ بَأْسٍ حَرَّمَ اللَّهُ عَلَيْهَا أَنْ تُرِيحَ رَائِحَةَ الْجَنَّةَ»
A woman embraced Islam during the time of the Messenger of Allah ﷺ; she then married. Her (former) husband then came to the Prophet ﷺ and said: Messenger of Allah, I have already embraced Islam, and she had the knowledge about my Islam. The Messenger of Allah ﷺ took her away from her latter husband and restored her to her former husband. (Using translation from Abū Dāʾūd 2239)
أَسْلَمَتِ امْرَأَةٌ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَتَزَوَّجَتْ فَجَاءَ زَوْجُهَا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنِّي قَدْ أَسْلَمْتُ مَعَهَا وَعَلِمَتْ بِإِسْلَامِي مَعَهَا «فَنَزَعَهَا رَسُولُ اللَّهِ ﷺ مِنْ زَوْجِهَا الْآخَرَ وَرَدَّهَا إِلَى زَوْجِهَا الْأَوَّلِ»
"The Prophet returned his daughter Zainab to Abul-As bin Ar-Rabi after six years in the first marriage without renewing the marriage." (Using translation from Tirmidhī 1143)
«رَدَّ النَّبِيُّ ﷺ ابْنَتَهُ زَيْنَبَ عَلَى زَوْجِهَا أَبِي الْعَاصِ بْنِ الرَّبِيعِ بِالنِّكَاحِ الْأَوَّلِ وَلَمْ يُحْدِثْ شَيْئًا» صحيح
[Machine] Narrated Aisha, the wife of the Prophet ﷺ : When the Messenger of Allah ﷺ arrived in Madinah, his daughter Zainab came out of Makkah with her maternal cousin, Kinanah bin Kinanah. They came in the course of her maternal uncle, Hibbar bin Aswad, stabbing her camel with his spear until he made it fall down and she had a miscarriage and shed the placenta. Banu Hashim and Banu Umayyah argued about her custody. Banu Umayyah said: We have more right to her, as she was under their guardianship, Habbar bin Aswad. She was with Hind bint Utbah bin Rabi'ah; she said to her: Hind, this is because of your father. The Messenger of Allah ﷺ said to Zaid bin Harithah: Why don't you go and bring Zainab to me? He replied: Yes, O Messenger of Allah. He took the ring of the Messenger of Allah ﷺ and went along. As the shepherd went along with it and then asked him: Whose sheep are these? He replied: They belong to Zainab bint Muhammad. He moved on for a while and then said to him: Do you allow me to give you something in return for her which you would not tell to anyone? He replied in the affirmative. He gave him the ring and then the shepherd realized who he was. When he reached there, she recognized him and said: Who gave you this? He said: A man. She said: Where did you leave him? He said: At such and such place. When it was night, she went to him, and when she came to him, he said: Mount behind me, and she replied: No, but you mount behind me. He mounted behind her and she came riding. The Prophet ﷺ used to say to her: "She is the best of my daughters, but it is unfortunate that she has been afflicted with divorce." (Al-Asbahani said: Before the verse "Call them by [the names of] their fathers" [Quran 33:5] was revealed)
عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ رَسُولَ اللَّهِ ﷺ لَمَّا قَدِمَ الْمَدِينَةَ خَرَجَتِ ابْنَتُهُ زَيْنَبُ مِنْ مَكَّةَ مَعَ كِنَانَةَ أَوِ ابْنِ كِنَانَةَ فَخَرَجُوا فِي أَثَرِهَا فَأَدْرَكَهَا هَبَّارُ بْنُ الْأَسْوَدِ فَلَمْ يَزَلْ يَطْعَنُ بَعِيرَهَا بِرُمْحِهِ حَتَّى صَرَعَهَا وَأَلْقَتْ مَا فِي بَطْنِهَا وَأُهْرِيقَتْ دَمًا فَاشْتَجَرَ فِيهَا بَنُو هَاشِمٍ وَبَنُو أُمَيَّةَ فَقَالَتْ بَنُو أُمَيَّةَ نَحْنُ أَحَقُّ بِهَا وَكَانَتْ تَحْتَ ابْنِ عَمِّهِمْ أَبِي الْعَاصِ فَكَانَتْ عِنْدَ هِنْدِ بِنْتِ عُتْبَةَ بْنِ رَبِيعَةَ فَكَانَتْ تَقُولُ لَهَا هِنْدٌ هَذَا بِسَبَبِ أَبِيكِ فَقَالَ رَسُولُ اللَّهِ ﷺ لِزَيْدِ بْنِ حَارِثَةَ «أَلَا تَنْطَلِقُ تَجِيئَنِي بِزَيْنَبَ؟» قَالَ بَلَى يَا رَسُولَ اللَّهِ قَالَ «فَخُذْ خَاتَمِي» فَأَعْطَاهُ إِيَّاهُ فَانْطَلَقَ زَيْدٌ وَبَرَّكَ بَعِيرَهُ فَلَمْ يَزَلْ يَتَلَطَّفُ حَتَّى لَقِيَ رَاعِيًا فَقَالَ لِمَنْ تَرْعَى؟ فَقَالَ لِأَبِي الْعَاصِ فَقَالَ فَلِمَنْ هَذِهِ الْأَغْنَامُ؟ قَالَ لِزَيْنَبَ بِنْتِ مُحَمَّدٍ فَسَارَ مَعَهُ شَيْئًا ثُمَّ قَالَ لَهُ هَلْ لَكَ أَنْ أُعْطِيَكَ شَيْئًا تُعْطِيَهُ إِيَّاهَا وَلَا تَذْكُرْهُ لِأَحَدٍ؟ قَالَ نَعَمْ فَأَعْطَاهُ الْخَاتَمَ فَانْطَلَقَ الرَّاعِي فَأَدْخَلَ غَنَمَهُ وَأَعْطَاهَا الْخَاتَمَ فَعَرَفَتْهُ فَقَالَتْ مَنْ أَعْطَاكَ هَذَا؟ قَالَ رَجُلٌ قَالَتْ فَأَيْنَ تَرَكْتَهُ؟ قَالَ بِمَكَانِ كَذَا وَكَذَا قَالَ فَسَكَتَتْ حَتَّى إِذَا كَانَ اللَّيْلُ خَرَجَتْ إِلَيْهِ فَلَمَّا جَاءَتْهُ قَالَ لَهَا ارْكَبِي بَيْنَ يَدَيَّ عَلَى بَعِيرِهِ قَالَتْ لَا وَلَكِنِ ارْكَبْ أَنْتَ بَيْنَ يَدَيَّ فَرَكِبَ وَرَكِبَتْ وَرَاءَهُ حَتَّى أَتَتْ فَكَانَ رَسُولُ اللَّهِ ﷺ يَقُولُ «هِيَ أَفْضَلُ بَنَاتِي أُصِيبَتْ فِيَّ» فَبَلَغَ ذَلِكَ عَلِيَّ بْنَ الْحُسَيْنِ فَانْطَلَقَ إِلَى عُرْوَةَ فَقَالَ مَا حَدِيثٌ بَلَغَنِي عَنْكَ تُحَدِّثُهُ تَنْتَقِصُ فِيهِ حَقَّ فَاطِمَةَ؟ فَقَالَ «وَاللَّهِ مَا أُحِبُّ أَنَّ لِيَ مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ وَإِنِّي أَنْتَقِصُ فَاطِمَةَ حَقًّا هُوَ لَهَا وَأَمَّا بَعْدُ فَلَكَ أَنْ لَا أُحَدِّثَ بِهِ أَبَدًا» قَالَ عُرْوَةُ وَإِنَّمَا كَانَ هَذَا قَبْلَ نُزُولِ آيَةِ {ادْعُوهُمْ لِآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ} [الأحزاب 5]
[Machine] When Hilal ibn Umayyah threw his wife, it was said to him, "By Allah, the Messenger of Allah ﷺ will whip you with eighty lashes." He said, "Allah is more just than that, to strike me with eighty lashes. He knew that I saw until I became certain, and I heard until I became convinced. No, by Allah, he will never strike me." Then the verse of curse was revealed, so the Messenger of Allah ﷺ called for both of them when the verse was revealed and he said, "Allah knows that one of you is lying. Is there any repentance from either of you?" Hilal said, "By Allah, I am telling the truth." Then the Messenger of Allah ﷺ said, "Swear by Allah, the One who there is no god but Him, that you are telling the truth." He said that four times, and if he was lying, the curse of Allah would be upon him. Then the Messenger of Allah ﷺ said, "Stop at the fifth time, as it is binding." So, she swore and said it four times, "By Allah, the One who there is no god but Him, he is one of the liars." And if she was telling the truth, then the anger of Allah would be upon her. So the Messenger of Allah ﷺ said, "Stop at the fifth time, as it is binding." Then she hesitated and was inclined to confess. Then she said, "I do not want to expose my people." So the Messenger of Allah ﷺ said, "If she comes with it, it should be a black dye that darkens the eyes, with black pupils, thickly outlined, with lashes that curve upwards. Then it is for the one who was accused, Hilal ibn Umayyah. And if she comes with it in yellow color, then it should be cut with spots. Then it is for Hilal ibn Umayyah." So they brought it in the description of rebellion. Ayub said, and Muhammad ibn Sirin said, "The man who informed Hilal ibn Umayyah's wife was Shurayk ibn Sahma, who was the brother of Bara' ibn Malik, the brother of Anas ibn Malik from his mother. His mother was black. And Shurayk used to stay at Hilal's house and be with him."
لَمَّا قَذَفَ هِلَالُ بْنُ أُمَيَّةَ امْرَأَتَهُ قِيلَ لَهُ وَاللَّهِ لَيَجْلِدَنَّكَ رَسُولُ اللَّهِ ﷺ ثَمَانِينَ جَلْدَةً قَالَ اللَّهُ أَعْدَلُ مِنْ ذَلِكَ أَنْ يَضْرِبَنِي ثَمَانِينَ جَلْدَةً وَقَدْ عَلِمَ أَنِّي رَأَيْتُ حَتَّىَ اسْتَيْقَنْتُ وَسَمِعْتُ حَتَّىَ اسْتَثْبَتُّ لَا وَاللَّهِ لَا يَضْرِبُنِي أَبَدًا فَنَزَلَتْ آيَةُ الْمُلَاعَنَةِ فَدَعَا بِهِمَا رَسُولُ اللَّهِ ﷺ حِينَ نَزَلَتِ الْآيَةُ فَقَالَ «اللَّهُ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ» فَقَالَ هِلَالٌ وَاللَّهِ إِنِّي لَصَادِقٌ فَقَالَ «احْلِفْ بِاللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنِّي لَصَادِقٌ» يَقُولُ ذَلِكَ أَرْبَعَ مَرَّاتٍ فَإِنْ كُنْتُ كَاذِبًا فَعَلَيَّ لَعْنَةُ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قِفُوهُ عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ» فَحَلَفَتْ ثُمَّ قَالَتْ أَرْبَعًا وَاللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَإِنْ كَانَ صَادِقًا فَعَلَيْهَا غَضَبُ اللَّهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قِفُوهَا عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ فَرَدَّدَتْ وَهَمَّتْ بِالِاعْتِرَافِ» ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنْ جَاءَتْ بِهِ أَكْحَلَ أَدْعَجَ سَابِغَ الْأَلْيَتَيْنِ أَلَفَّ الْفَخِذَيْنِ حَدْلَجَ السَّاقَيْنِ فَهُوَ لِلَّذِي رُمِيَتْ بِهِ وَإِنْ جَاءَتْ بِهِ أَصْفَرَ قَصِفًا سَبِطًا فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ» فَجَاءَتْ بِهِ عَلَى الصِّفَةِ الْبَغِيِّ قَالَ أَيُّوبُ وَقَالَ مُحَمَّدُ بْنُ سِيرِينَ «كَانَ الرَّجُلُ الَّذِي بَلَغَهَا هِلَالُ بْنُ أُمَيَّةَ شَرِيكَ بْنَ سَحْمَاءَ وَكَانَ أَخَا الْبَرَاءِ بْنِ مَالِكٍ أَخِي أَنَسِ بْنِ مَالِكٍ لِأُمِّهِ وَكَانَتْ أُمُّهُ سَوْدَاءَ وَكَانَ شَرِيكٌ يَأْوِي إِلَى مَنْزِلِ هِلَالٍ وَيَكُونُ عِنْدَهُ»
AbuHurayrah heard the Messenger of Allah ﷺ say when the verse about invoking curses came down: Any woman who brings to her family one who does not belong to it has nothing to do with Allah (i.e. expects no mercy from Allah), and Allah will not bring her into His Paradise. Allah, the Exalted, will veil Himself from any man who disowns his child when he looks at him, and disgrace him in the presence of all creatures, first and last. أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ لَمَّا نَزَلَتْ آيَةُ الْمُلَاعَنَةِ قَالَ النَّبِيُّ ﷺ «أَيُّمَا امْرَأَةٍ دَخَّلَتْ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ فَلَيْسَتْ مِنَ اللَّهِ فِي شَيْءٍ وَلَنْ يُدْخِلَهَا اللَّهُ جَنَّتَهُ وَأَيُّمَا رَجُلٍ جَحَدَ وَلَدَهُ وَهُوَ يَنْظُرُ إِلَيْهِ احْتَجَبَ اللَّهُ مِنْهُ وَفَضَحَهُ عَلَى رُءُوسِ الْخَلَائِقِ مِنَ الْأَوَّلِينَ وَالْآخِرِينَ»
“I was a man who had an issue with intercourse with a women that none other than me had. When (the month of) Ramadan entered, I pronounced Zihar upon my wife (to last) until the end of Ramadan, fearing that I might have an encounter with her during the night, and I would continue doing that until daylight came upon me, and I would not be able to stop. One night while she was serving me, something of her became exposed for me, so I rushed myself upon her. When the morning came I went to my people to inform them about what happened to me. I said: ‘Accompany me to the Messenger of Allah to inform him about my case.’ They said: ‘No by Allah! We shall not do that, we feat that something will be revealed about us in the Qur’an, or the Messenger of Allah might say something about us, the disgrace of which will remain upon us. But you do and do whatever you want.’” He said: “So I left and I went to the Messenger of Allah, and informed him of my case. He said: ‘You are the one who did that?” I said: ‘I am the one.’ He said: ‘You are the one who did that?” I said: ‘I am the one.’ He said: ‘You are the one who did that?” I said: ‘I am the one, it is before you, so give me Allah’s judgment, for I shall be patient with that.’ He said: ‘Free a slave.’” He said: “I struck the sides of my neck with me hands, and said: ‘No by the One Who sent you with the Truth! I possess nothing besides it.’ He said: ‘Then fast for two months’ I said: ‘O Messenger of Allah! Did this occur to me other than when I was fasting?’ He said: ‘Then feed sixty poor people.’ I said: ‘By the One Who sent you with the Truth! We have spent these nights of ours hungry without an evening meal.’ He said: ‘Go to the one with the charity from Banu Ruzaiq, tell him to give it to you, then feed a Wasq of it, on your behalf, to sixty poor people. Then help yourself and your dependants with the remainder of it.’” He said: “I returned to my people and said: ‘I found dejection and bad ideas with you, and I found liberalness and blessing with the Messenger of Allah. He ordered me to take your charity, so give it to me.’ So they gave it to me.” (Using translation from Tirmidhī 3299)
كُنْتُ امْرَأًً قَدْ أُوتِيتُ مِنْ جِمَاعِ النِّسَاءِ مَا لَمْ يُؤْتَ غَيْرِي فَلَمَّا دَخَلَ رَمَضَانُ ظَاهَرْتُ مِنِ امْرَأَتِي مَخَافَةَ أَنْ أُصِيبَ مِنْهَا شَيْئًا فِي بَعْضِ اللَّيْلِ وَأَتَتَابَعَ مِنْ ذَلِكَ وَلَا أَسْتَطِيعُ أَنْ أَنْزِعَ حَتَّى يُدْرِكَنِي الصُّبْحُ فَبَيْنَمَا هِيَ ذَاتَ لَيْلَةٍ تَخْدُمُنِي إِذَا انْكَشَفَ لِي مِنْهَا شَيْءٌ فَوَثَبْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى قَوْمِي فَأَخْبَرْتُهُمْ خَبَرِي فَقُلْتُ انْطَلِقُوا مَعِي إِلَى رَسُولِ اللَّهِ ﷺ فَقَالُوا لَا وَاللَّهِ لَا نَذْهَبُ مَعَكَ نَخَافُ أَنْ يَنْزِلَ فِينَا قُرْآنٌ وَيَقُولُ فِينَا رَسُولُ اللَّهِ ﷺ مَقَالَةً يَبْقَى عَلَيْنَا عَارُهَا فَاذْهَبْ أَنْتَ فَاصْنَعْ مَا بَدَا لَكَ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَأَخْبَرْتُهُ خَبَرِي فَقَالَ «أَنْتَ ذَاكَ؟» فَقُلْتُ أَنَا ذَاكَ فَاقْضِ فِي حُكْمِ اللَّهِ فَإِنِّي صَابِرٌ مُحْتَسِبٌ قَالَ «أَعْتِقْ رَقَبَةً» فَضَرَبْتُ صَفْحَةَ عُنُقِ رَقَبَتِي بِيَدِي فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ غَيْرَهَا قَالَ «صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ» فَقُلْتُ يَا رَسُولَ اللَّهِ وَهَلْ أَصَابَنِي مَا أَصَابَنِي إِلَّا فِي الصِّيَامِ قَالَ «فَأَطْعِمْ سِتِّينَ مِسْكِينًا» قُلْتُ يَا رَسُولَ اللَّهِ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا هَذِهِ وَحْشًا مَا نَجِدُ عَشَاءً قَالَ «انْطَلِقْ إِلَى صَاحِبِ الصَّدَقَةِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ فَأَطْعِمْ مِنْهَا وَسْقًا سِتِّينَ مِسْكِينًا وَاسْتَعِنْ بِسَائِرِهَا عَلَى عِيَالِكَ» فَأَتَيْتُ قَوْمِي فَقُلْتُ وَجَدْتُ عِنْدَكُمُ الضِّيقَ «»
[Machine] Salman ibn Sakhrah Al-Ansari made his wife on him like the back of his mother, then he mentioned the narration in the same way as him, "This is a valid chain according to the conditions of the two scholars, and they did not exclude it" according to the conditions of Bukhari and Muslim.
أَنَّ سَلْمَانَ بْنَ صَخْرٍ الْأَنْصَارِيَّ جَعَلَ امْرَأَتَهُ عَلَيْهِ كَظَهْرِ أُمِّهِ ثُمَّ ذَكَرَ الْحَدِيثَ بِنَحْوِهِ مِنْهُ «هَذَا إِسْنَادٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ» على شرط البخاري ومسلم
[Machine] A man came to the Prophet ﷺ while it was apparent that he had engaged in intimacy with his wife. The man confessed, saying, "O Messenger of Allah, I engaged in intimacy with my wife before performing the ritual purification." The Prophet ﷺ asked, "What led you to do this? May Allah have mercy on you?" The man replied, "I saw her ankle bracelet in the moonlight." The Prophet ﷺ then advised him, "Do not approach her until you have fulfilled the command of Allah, the Exalted." This hadith is witnessed by Isma'il bin Muslim from 'Amr bin Dinar, and the two prominent scholars, Isma'il bin Muslim and Al-Hakam bin Aban, have never been disputed except that Al-Hakam bin Aban is considered truthful while the authenticity of Isma'il bin Muslim is questioned by Al-'Adani.
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ وَقَدْ ظَاهَرَ مِنِ امْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي ظَاهَرْتُ مِنِ امْرَأَتِي فَوَقَعَتْ عَلَيْهَا مِنْ قَبْلَ أَنْ أُكَفِّرَ قَالَ «وَمَا حَمَلَكَ عَلَى ذَلِكَ يَرْحَمُكَ اللَّهُ؟» قَالَ رَأَيْتُ خَلْخَالَهَا فِي ضَوْءِ الْقَمَرِ قَالَ «فَلَا تَقْرَبْهَا حَتَّى تَفْعَلَ مَا أَمَرَ اللَّهُ تَعَالَى» شَاهِدُهُ حَدِيثُ إِسْمَاعِيلَ بْنِ مُسْلِمٍ عَنْ عَمْرِو بْنِ دِينَارٍ «وَلَمْ يَحْتَجَّ الشَّيْخَانِ بِإِسْمَاعِيلَ وَلَا بِالْحَكَمِ بْنِ أَبَانَ إِلَّا أَنَّ الْحَكَمَ بْنَ أَبَانَ صَدُوقٌ» العدني غير ثقة
[Machine] A man appeared from his wife and saw her ankle bracelet in the moonlight, which amazed him. He then fell upon her and went to the Prophet ﷺ and mentioned it to him. The Prophet ﷺ said, "Allah, the Mighty and Majestic, said [to His angels] before they interacted with one another [sexually], "Hold back until they can be purified."' The man said, "That happened for us." The Messenger of Allah ﷺ then said, "Hold back until you are purified."
أَنَّ رَجُلًا ظَاهَرَ مِنِ امْرَأَتِهِ فَرَأَى خَلْخَالَهَا فِي ضَوْءِ الْقَمَرِ فَأَعْجَبَهُ فَوَقَعَ عَلَيْهَا فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ قَالَ اللَّهُ ﷻ {مِنْ قَبْلِ أَنْ يَتَمَاسَّا} [المجادلة 3] فَقَالَ قَدْ كَانَ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمْسِكْ حَتَّى تُكَفِّرَ» إسماعيل واه
[Machine] I heard the Prophet (pbuh) saying, "There is no divorce for the one who does not possess and no emancipation for the one who does not possess."
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «لَا طَلَاقَ لِمَنْ لَمْ يَمْلِكْ وَلَا عَتَاقَ لِمَنْ لَمْ يَمْلِكْ»
[Machine] The Messenger of Allah ﷺ said, "There is no divorce before marriage." Saheeh.
قَالَ رَسُولُ اللَّهِ ﷺ «لَا طَلَاقَ قَبْلَ النِّكَاحِ» صحيح
[Machine] "Allah Almighty says, 'O you who have believed, when you marry believing women and then divorce them before having sexual relations with them'" [Surah Al-Ahzab 49]. And He did not say, 'when you divorce believing women and then marry them again.'"
اللَّهُ ﷻ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ} [الأحزاب 49] وَلَمْ يَقُلْ إِذَا طَلَّقْتُمُ الْمُؤْمِنَاتِ ثُمَّ نَكِحْتُمُوهُنَّ
[Machine] From the Prophet ﷺ, he said, "The divorce of a slave woman is two divorces, and the recitation of it is two menstruation periods." Abu Asim said, "So I mentioned it to Muzahir ibn Aslam, and I said to him, 'Tell me as Ibn Jurayj told you.' So Muzahir narrated to me from Al-Qasim, from Aisha, from the Prophet ﷺ, he said, 'The divorce of a slave woman is two divorces, and the recitation of it is two menstruation periods,' just as Muzahir ibn Aslam had narrated it. Sheikhs from the people of Basra have not mentioned it with any criticism. So the hadith is authentic, and no one from our earlier scholars has rejected it, although there is a contradictory narration from Ibn Abbas narrated."
عَنِ النَّبِيِّ ﷺ قَالَ «طَلَاقُ الْأَمَةِ تَطْلِيقَتَانِ وَقَرْؤُهَا حَيْضَتَانِ» قَالَ أَبُو عَاصِمٍ فَذَكَرْتُهُ لِمُظَاهِرِ بْنِ أَسْلَمَ فَقُلْتُ حَدِّثْنِي كَمَا حَدَّثْتَ ابْنَ جُرَيْجٍ فَحَدَّثَنِي مُظَاهِرٌ عَنِ الْقَاسِمِ عَنْ عَائِشَةَ عَنِ النَّبِيِّ ﷺ قَالَ «طَلَاقُ الْأَمَةِ تَطْلِيقَتَانِ وَقَرْؤُهَا حَيْضَتَانِ» مِثْلُ مَا حَدَّثَهُ مُظَاهِرُ بْنُ أَسْلَمَ شَيْخٌ مِنْ أَهْلِ الْبَصْرَةِ لَمْ يَذْكُرْهُ أَحَدٌ مِنْ مُتَقَدِّمِي مَشَايِخِنَا بِجَرْحٍ فَإِذَا الْحَدِيثُ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ وَقَدْ رُوِيَ عَنِ ابْنِ عَبَّاسٍ حَدِيثٌ يُعَارِضُهُ صحيح
Abu Hasan, a client of Banu Nawfal asked Ibn Abbas: A slave had a wife who was a slave-girl. He divorced her by two pronouncements. Afterwards both of them were freed. Is it permissible for him to ask her in marriage again? He said: Yes. This is a decision given by the Messenger of Allah ﷺ. (Using translation from Abū Dāʾūd 2187)
«نَعَمْ قَضَى بِذَلِكَ رَسُولُ اللَّهِ ﷺ»يعارضه حديث علي
I asked Ayyub: Do you know anyone who narrates the tradition narrated by Al-Hasan about uttering the words (addressing wife). "Your matter is in your hand"? He replied: No, except something similar transmitted by Qatadah from Kathir, the client of Samurah, from AbuSalamah on the authority of AbuHurayrah from the Prophet ﷺ. Ayyub said: Kathir then came to us; so I asked him (about this matter). He replied: I never narrated it. I mentioned it to Qatadah who said: Yes (he narrated it) but he forgot. قُلْتُ لِأَيُّوبَ هَلْ تَعْلَمُ أَحَدًا يَقُولُ بِقَوْلِ الْحَسَنِ فِي أَمْرِكَ بِيَدِكِ أَنَّهُ ثَلَاثٌ؟ فَقَالَ لَا إِلَّا شَيْءٌ حَدَّثَنَا بِهِ قَتَادَةُ عَنْ كَثِيرٍ مَوْلَى عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ بِنَحْوِهِ قَالَ أَيُّوبُ فَقَدِمَ عَلَيْنَا كَثِيرٌ فَسَأَلَهُ فَقَالَ مَا حَدَّثْتُ بِهَذَا قَطُّ فَذَكَرْتُهُ لِقَتَادَةَ فَقَالَ «بَلَى وَلَكِنْ قَدْ نَسِيَ»
[Machine] That a woman named Thabit ibn Qays divorced him, so the Prophet ﷺ made her waiting period as her menstrual cycle.
أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ اخْتَلَعَتْ مِنْهُ «فَجَعَلَ النَّبِيُّ ﷺ عِدَّتَهَا حَيْضَةً»
[Machine] That a woman named Thabit ibn Qays divorced him, "so the Prophet ﷺ made her waiting period be her menstruation."
أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ اخْتَلَعَتْ مِنْهُ «فَجَعَلَ النَّبِيُّ ﷺ عِدَّتَهَا حَيْضَةً»
[Machine] To free my slave, I asked the Prophet ﷺ , and he ordered me to free the man before the woman.
أَنْ تُعْتِقَ مَمْلُوكِينَ زَوْجًا فَسَأَلْتِ النَّبِيَّ ﷺ «فَأَمَرَهَا أَنْ تَبْدَأَ بِالرَّجُلِ قَبْلَ الْمَرْأَةِ»
My daughter; she is weaned or about to wean. Rafi' said: My daughter. The Prophet ﷺ said to him: Be seated on a side. And he said to her: Be seated on a side. He then seated the girl between them, and said to them: Call her. The girl inclined to her mother. The Prophet ﷺ said: O Allah! guide her. The daughter then inclined to her father, and he took her. (Using translation from Abū Dāʾūd 2244)
أَنْ تُسْلِمَ فَأَتَتِ النَّبِيَّ ﷺ فَقَالَتِ ابْنَتِي فَطِيمٌ وَقَالَ رَافِعٌ ابْنَتِي فَقَالَ النَّبِيُّ ﷺ لِرَافِعٍ «اقْعُدْ نَاحِيَةً» وَقَالَ لِامْرَأَتِهِ «اقْعُدِي نَاحِيَةً» فَقَالَ وَأَقْعَدَ الصِّبْيَةَ بَيْنَهُمَا ثُمَّ قَالَ «ادْعُوَاهَا» فَمَالَتِ الصِّبْيَةُ إِلَى أُمِّهَا فَقَالَ النَّبِيُّ ﷺ «اللَّهُمَّ اهْدِهَا» فَمَالَتْ إِلَى أَبِيهَا فَأَخَذَهَا
[Machine] I was sitting with the Prophet ﷺ when a man from the people of Yemen came to him and said, "Indeed, three men from the people of Yemen came to 'Ali, disputing with him regarding a child. They agreed upon a woman in a state of purity, but both of them claimed it was their child." He said to both of them, "Is the child good for this one?" They both said, "No." Then he said to both of them, "Is the child good for this one?" They both said, "No." He repeated this question three times, and they both responded "No" each time. Then he said, "You are partners in disputing. I will decide between you. Whoever agrees, the child belongs to him, and the other party will pay two-thirds of the blood money." So, he decided between them and made it for the one who agreed. The Messenger of Allah ﷺ laughed until his molars were exposed, or he said, "His canines were exposed." The two elderly men agreed not to use the method of Al-Ajlh bin 'Abdullah Al-Kindi and they only had one narration from 'Abdullah bin Buraidah. Three trustworthy narrators also reported that same Hadith. Therefore, this Hadith is authentic and they did not exclude it." This is the authentic narration of this Hadith.
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ إِذْ جَاءَهُ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ إِنَّ ثَلَاثَةً مِنْ أَهْلِ الْيَمَنِ أَتَوْا عَلِيًّا يَخْتَصِمُونَ إِلَيْهِ فِي وَلَدٍ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَقَالَ لِلِاثْنَيْنِ مِنْهُمَا طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ لِلِاثْنَيْنِ طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ لِلِاثْنَيْنِ طِيبَا بِالْوَلَدِ لِهَذَا فَقَالَا لَا ثُمَّ قَالَ أَنْتُمْ شُرَكَاءُ مُتَشَاكِسُونَ إِنِّي مُقْرِعٌ بَيْنَكُمْ فَمَنْ قَرَعَ فَلَهُ الْوَلَدُ وَعَلَيْهِ لِصَاحِبَيْهِ ثُلُثَا الدِّيَةِ فَأَقْرَعَ بَيْنَهُمْ فَجَعَلَهُ لِمَنْ قَرَعَ فَضَحِكَ رَسُولُ اللَّهِ ﷺ حَتَّى بَدَتْ أَضْرَاسُهُ أَوْ قَالَ نَوَاجِذُهُ «قَدِ اتَّفَقَ الشَّيْخَانِ عَلَى تَرْكِ الِاحْتِجَاجِ بِالْأَجْلَحِ بْنِ عَبْدِ اللَّهِ الْكِنْدِيِّ وَإِنَّمَا نَقِمَا عَلَيْهِ حَدِيثًا وَاحِدًا لِعَبْدِ اللَّهِ بْنِ بُرَيْدَةَ وَقَدْ تَابَعَهُ عَلَى ذَلِكَ الْحَدِيثِ ثَلَاثَةٌ مِنَ الثِّقَاتِ فَهَذَا الْحَدِيثُ إِذًا صَحِيحٌ وَلَمْ يُخَرِّجَاهُ» هذا الحديث إذا صحيح
A woman said: Messenger of Allah, my womb is a vessel to this son of mine, my breasts, a water-skin for him, and my lap a guard for him, yet his father has divorced me, and wants to take him away from me. The Messenger of Allah ﷺ said: You have more right to him as long as you do not marry. (Using translation from Abū Dāʾūd 2276)
يَا رَسُولَ اللَّهِ ابْنِي هَذَا كَانَ بَطْنِي لَهُ وِعَاءً وَثَدْيِي لَهُ سِقَاءً وَحِجْرِي لَهُ حِوَاءً وَإِنَّ أَبَاهُ طَلَّقَنِي وَأَرَادَ أَنْ يَنْزِعَهُ عَنِّي قَالَ لَهَا رَسُولُ اللَّهِ ﷺ «أَنْتِ أَحَقُّ بِهِ مَا لَمْ تَنْكِحِي»
Jabir said “My maternal aunt was divorced by three pronouncements and she went out to cut down fruit from her palm trees. A man met her and forbade her (to go out). So she went to the Prophet ﷺ and mentioned it to him. He said “Go out, and cut down fruit from your palm trees for perhaps you may give alms (sadaqah) or do an act of kindness. طُلِّقَتْ خَالَتِي ثَلَاثًا فَخَرَجَتْ تَجُذُّ نَخْلًا لَهَا فَلَقِيَهَا رَجُلٌ فَنَهَاهَا فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ «اخْرُجِي فَجُذِّي لَعَلَّكِ أَنْ تَصَّدَّقِي مِنْهُ أَوْ تَفْعَلِي خَيْرًا»
"I came to the Prophet and mentioned moving to (join) my family." She told him about her situation. She said: "He allowed me, then, when I turned to leave, he called me back and said: 'Stay with your family until the term prescribed is fulfilled.'" (Using translation from Nasāʾī 3530)
أَنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْلَاجٍ لَهُ فَقُتِلَ بِطَرَفِ الْقَدُومِ قَالَ حَمَّادٌ وَهُوَ مَوْضِعُ مَاءٍ قَالَتْ فَأَتَيْتُ النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ مِنْ حَالِي وَذَكَرْتُ لَهُ النُّقْلَةَ إِلَى إِخْوَتِي قَالَتْ فَرَخَّصَ لِي فَلَمَّا جَاوَزْتُ نَادَانِي فَقَالَ «امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» سكت عنه الذهبي في التلخيص
[Machine] She heard Furay'ah bint Malik, the sister of Abu Sa'id al-Khudri, say: "My husband went out in search of camels for him to graze, and while he was returning, they killed him. They came and informed me of his death while I was in a spacious house belonging to my family. I went to the Messenger of Allah ﷺ and said: 'My husband's death was announced to me while I was in a spacious house belonging to my family, and he left no provision or wealth for me. I have no place to live, and if I were to go to my brothers and family, they would treat me kindly and support me in some matters.' He said: 'Stay in the house where you were informed of your husband's death until the appointed time.' So she stayed there for four months and ten nights. Then 'Uthman bin 'Affan sent for her and I went to him and spoke to him, and he took care of her."
أَنَّهَا سَمِعَتْ فُرَيْعَةَ بِنْتَ مَالِكٍ أُخْتَ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَتْ خَرَجَ زَوْجِي فِي طَلَبِ أَعْبُدٍ لَهُ فَأَدْرَكَهُمْ بِطَرَفِ الْقَدُومِ فَقَتَلُوهُ فَأَتَانِي نَعْيُهُ وَأَنَا فِي دَارٍ شَاسِعَةٍ مِنْ دُورِ أَهْلِي فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ فَقُلْتُ إِنَّهُ أَتَانِي نَعْيُ زَوْجِي وَأَنَا فِي دَارٍ شَاسِعَةٍ مِنْ دُورِ أَهْلِي وَلَمْ يَدَعْ لِي نَفَقَةً وَلَا مَالًا وَلَيْسَ الْمَسْكَنُ لِي وَلَوْ تَحَوَّلْتُ إِلَى إِخْوَتِي وَأَهْلِي كَانَ أَرْفَقَ بِي فِي بَعْضِ شَأْنِي فَقَالَ «تَحَوَّلِي» فَلَمَّا خَرَجْتُ إِلَى الْمَسْجِدِ أَوِ الْحُجْرَةِ دَعَانِي أَوْ أَمَرَ بِي فَدُعِيتُ لَهُ فَقَالَ «امْكُثِي فِي الْبَيْتِ الَّذِي أَتَاكَ فِيهِ نَعْيُ زَوْجِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» فَاعْتَدَّتْ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَأَرْسَلَ عُثْمَانُ بْنُ عَفَّانَ إِلَيَّ فَأَتَيْتُهُ فَحَدَّثْتُهُ فَأَخَذَ بِهِ
[Machine] She said: "I have been divorced by a woman who stayed for twenty-three nights, then she became pregnant and came to the Prophet ﷺ and mentioned that to him. He said to her, 'Get married.'"
أَنَّهَا قَالَتْ طُلِّقَتِ امْرَأَةٌ فَمَكَثَتْ ثَلَاثًا وَعِشْرِينَ لَيْلَةً فَوَضَعْتُ حَمْلَهَا ثُمَّ أَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ لَهَا «تَزَوَّجِي»
[Machine] To Zubayr, O Abu Abdullah, take me back with a divorce", she said, and this was when she found out about the divorce. He said, "What good is it for me to divorce you with a single divorce, then take you back?" She said, "I find myself in need of that." He said, "So he divorced her with a single divorce, then he left and she said to her servant, "Close the doors." So she put a servant girl there. Then Zubayr came and he was given the good news. He said, "The daughter of my father, Mu'ayt, has plotted against me." Then he went out to the Prophet Muhammad ﷺ and informed him about it, so he made it clear to him."
لِلزُّبَيْرِ يَا أَبَا عَبْدِ اللَّهِ رَوِّحْنِي بِتَطْلِيقَةٍ قَالَتْ وَذَلِكَ حِينَ وَجَدَتِ الطَّلْقَ قَالَ وَمَا يَنْفَعُكِ أَنْ أُطَلِّقَكِ تَطْلِيقَةً وَاحِدَةً ثُمَّ أُرَاجِعَكَ؟ قَالَتْ إِنِّي أَجِدُنِي أَسْتَرْوِحُ إِلَى ذَلِكَ قَالَ فَطَلَّقَهَا تَطْلِيقَةً وَاحِدَةً ثُمَّ خَرَجَ فَقَالَتْ لِجَارِيَتِهَا أَغْلِقِي الْأَبْوَابَ قَالَ فَوَضَعَتْ جَارِيَةً فَقَالَ فَأَتَى الزُّبَيْرُ فَبُشِّرَ بِهَا فَقَالَ مَكَرَتْ بِي ابْنَةُ أَبِي مُعَيْطٍ ثُمَّ خَرَجَ إِلَى رَسُولِ اللَّهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ «فَأَبَانَهَا مِنْهُ»
"Do not corrupt the Sunnah of our Prophet Muhammad ﷺ. The waiting period of an Umm Walad is four months and ten (days)." (Using translation from Ibn Mājah 2083)
«لَا تُلَبِّسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا مُحَمَّدٍ ﷺ فِي أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا عِدَّتُهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا»
[Machine] I heard the Messenger of Allah ﷺ say, "While I was sleeping, two men came to me and took me by the arm. They brought me to a rugged mountain and told me to climb. I said, "I cannot." They said, "We will make it easy for you." So, I climbed until I reached the top of the mountain. Then, I heard extremely loud voices. I asked, "What are these voices?" They said, "These are the cries of the people of Hellfire." Then, they took me further and I saw people hanging by their ankles, with their mouths torn and bleeding. I asked, "Who are these people?" They said, "These are the ones who break their fast before it is time." Then, they took me to a group of people who were bloated and disfigured, with the worst smell emanating from them. I asked, "Who are these people?" They said, "These are the adulterers and fornicators." Then, they took me to a group of women whose breasts were being torn apart by snakes. I asked, "What is wrong with these women?" They said, "These are the women who withhold milk from their children." Then, they took me to a place where young boys were playing between two rivers. I asked, "Who are these boys?" They said, "These are the young believers." Then, I was honored with another honor, and I saw three people drinking from a cup of wine. I asked, "Who are these people?" They said, "These are Ja'far ibn Abi Talib, Zaid ibn Harithah, and Abdullah ibn Rawahah." Then, I was honored with another honor, and I saw three more people. I asked, "Who are these people?" They said, "These are Ibrahim, Musa, and Isa (peace be upon them), they are waiting for you."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ بَيْنَا أَنَا نَائِمٌ إِذْ أَتَانِي رَجُلَانِ فَأَخَذَا بِضَبْعِي فَأَتَيَا بِي جَبَلًا وَعْرًا فَقَالَا لِي اصْعَدْ فَقُلْتُ إِنِّي لَا أُطِيقُ فَقَالَا إِنَّا سَنُسَهِّلُهُ لَكَ فَصَعِدْتُ حَتَّى كُنْتُ فِي سَوَاءِ الْجَبَلِ إِذَا أَنَا بِأَصْوَاتٍ شَدِيدَةٍ قُلْتُ مَا هَذِهِ الْأَصْوَاتُ؟ قَالُوا هَذَا هُوَ عُوَاءُ أَهْلِ النَّارِ ثُمَّ انْطَلَقَ بِي فَإِذَا بِقَوْمٍ مُعَلَّقِينَ بِعَرَاقِيبِهِمْ مُشَقَّقَةً أَشْدَاقُهُمْ تَسِيلُ أَشْدَاقُهُمْ دَمًا فَقُلْتُ مَا هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ الَّذِينَ يُفْطِرُونَ قَبْلَ تَحِلَّةِ صَوْمِهِمْ ثُمَّ انْطَلِقَا بِي فَإِذَا بِقَوْمٍ أَشَدِّ شَيْءٍ انْتِفَاخًا وَأَنْتَنِهِ رِيحًا وَأَسْوَئِهِ مَنْظَرًا فَقُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ الزَّانُونَ وَالزَّوَانِي ثُمَّ انْطَلَقَ بِي فَإِذَا أَنَا بِنِسَاءٍ تَنْهَشُ ثَدْيَهُنَّ الْحَيَّاتُ فَقُلْتُ مَا بَالُ هَؤُلَاءِ؟ فَقَالَ هَؤُلَاءِ اللَّوَاتِي يَمْنَعْنَ أَوْلَادَهُنَّ أَلْبَانَهُنَّ ثُمَّ انْطَلَقَ بِي فَإِذَا بِغِلْمَانٍ يَلْعَبُونَ بَيْنَ نَهْرَيْنِ فَقُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ ذَرَارِيُّ الْمُؤْمِنِينَ ثُمَّ شَرَفَ لِي شَرَفٌ فَإِذَا أَنَا بِثَلَاثَةِ نَفَرٍ يَشْرَبُونَ مِنْ خَمْرٍ لَهُمْ قُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ هَؤُلَاءِ جَعْفَرُ بْنُ أَبِي طَالِبٍ وَزَيْدُ بْنُ حَارِثَةَ وَعَبْدُ اللَّهِ بْنُ رَوَاحَةَ ثُمَّ شَرَفَ لِي شَرَفٌ آخَرُ فَإِذَا أَنَا بِثَلَاثَةِ نَفَرٍ قُلْتُ مَنْ هَؤُلَاءِ؟ قَالَ إِبْرَاهِيمُ وَمُوسَى وَعِيسَى عَلَيْهِمُ السَّلَامُ يَنْتَظِرُونَكَ
[Machine] That he refused to breastfeed from her, so the Messenger of Allah ﷺ was called upon and he spat in it and moistened it with a date and named him Muhammad, and said, "Raise him, for Allah is his provider." So I came to him on the first, second, and third days, and there was an Arab woman asking about Thabit bin Qais, so I said, "What do you want from him? I am Thabit." She said, "I saw in my dream that I was breastfeeding a son for him, whose name is said to be Muhammad." So he said, "I am Thabit, and this is my son Muhammad." He said, "Indeed, his mother's shield gets filled with milk from him."
أَنْ لَا تُلْبِنَهُ مِنْ لَبَنِهَا فَدَعَا بِهِ رَسُولُ اللَّهِ ﷺ فَبَزَقَ فِي فِيهِ وَحَنَّكَهُ بِتَمْرَةِ عَجْوَةٍ وَسَمَّاهُ مُحَمَّدًا وَقَالَ «اخْتَلِفْ بِهِ فَإِنَّ اللَّهَ رَازِقُهُ» فَأَتَيْتُهُ الْيَوْمَ الْأَوَّلَ وَالثَّانِي وَالثَّالِثَ فَإِذَا امْرَأَةٌ مِنَ الْعَرَبِ تَسْأَلُ عَنْ ثَابِتِ بْنِ قَيْسٍ فَقُلْتُ مَا تُرِيدِينَ مِنْهُ؟ أَنَا ثَابِتٌ فَقَالَتْ أُرِيتُ فِي مَنَامِي هَذِهِ كَأَنِّي أُرْضِعُ ابْنًا لَهُ يُقَالُ لَهُ مُحَمَّدٌ فَقَالَ فَأَنَا ثَابِتٌ وَهَذَا ابْنِي مُحَمَّدٌ قَالَ وَإِنَّ دِرْعَهَا يَتَعَصَّرُ مِنْ لَبَنِهَا
Ibn ‘Abbas said “The following verse abrogated the rule of passing her waiting period with her people. A year’s maintenance and residence. She may pass her waiting period now anywhere she wishes. ‘Ata said “If she wishes she can pass her waiting period with the people of her husband and live in the house left by her husband by will. Or she may shift if she wishes according to the pronouncement of Allah the Exalted. But if they leave (the residence) there is no blame on you for what they do. Ata’ said “Then the verses regarding inheritance were revealed. The commandment for living in a house (for one year) was repealed. She may pass her waiting period wherever she wishes. (Using translation from Abū Dāʾūd 2301)
عَطَاءٌ إِنْ شَاءَتِ اعْتَدَّتْ عِنْدَ أَهْلِهَا وَسَكَنَتْ فِي وَصِيَّتِهَا وَإِنْ شَاءَتْ خَرَجَتْ لِقَوْلِ اللَّهِ تَعَالَى {فَلَا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ} [البقرة 234] قَالَ عَطَاءٌ «ثُمَّ جَاءَ الْمِيرَاثُ فَنَسَخَ السُّكْنَى فَتَعْتَدُّ حَيْثُ شَاءَتْ»
Musaykah, a slave-girl of some Ansari, came and said: My master forces me to commit fornication. Thereupon the following verse was revealed: "But force not your maids to prostitution (when they desire chastity)." (Using translation from Abū Dāʾūd 2311)
إِنَّ سَيِّدِي يُكْرِهُنِي عَلَى الْبِغَاءِ فَنَزَلَ فِي ذَلِكَ {وَلَا تُكْرِهُوا فَتَيَاتِكُمْ عَلَى الْبِغَاءِ} [النور 33]
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a slave, Allah will free from every limb of his body a limb from the Fire."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أَعْتَقَ رَقَبَةً فَكَّ اللَّهُ بِكُلِّ عُضْوٍ مِنْ أَعْضَائِهِ عُضْوًا مِنْ أَعْضَائِهِ مِنَ النَّارِ»
