21. Book of Divorce
٢١۔ كِتَابُ الطَّلَاقِ
Al-Arif ibn ad-Daylami said: We went to Wathilah ibn al-Asqa and said to him: Tell us a tradition which has not addition or omission. He became angry and replied: One of you recites when his copy of a Qur'an is hung up in his house, and he makes additions and omissions. We said: All we mean is a tradition you have heard from the Messenger of Allah ﷺ. He said: We went to the Prophet ﷺ about a friend of ours who deserved. Hell for murder. He said: Emancipate a slave on his behalf; Allah will set free from Hell a member of the body for every member of his. (Using translation from Abū Dāʾūd 3964)
حَدِّثْنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللَّهِ ﷺ لَيْسَ فِيهِ زِيَادَةٌ وَلَا نُقْصَانُ فَغَضِبَ وَقَالَ إِنَّ مُصْحَفَ أَحَدِكُمْ مُعَلَّقٌ فِي بَيْتِهِ وَهُوَ يَزِيدُ وَيَنْقُصُ قَالَ فَقُلْنَا لَيْسَ هَذَا أَرَدْنَا أَرَدْنَا أَنْ تُحَدِّثَنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللَّهِ ﷺ قَالَ أَتَيْنَا رَسُولَ اللَّهِ ﷺ فِي صَاحِبٍ لَنَا قَدْ أَوْجَبَ يَعْنِي النَّارَ فَقَالَ «أَعْتِقُوا عَنْهُ يُعْتِقْ اللَّهُ بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنْهُ مِنَ النَّارِ» عَرِيفٌ هَذَا لَقَبٌ لِعَبْدِ اللَّهِ بْنِ الدَّيْلَمِيِّ صحيح
[Machine] This sheikh told me, I mean, Wathilah, I said, "What did he tell you?" He said, "He told me that I was sitting with the Messenger of Allah ﷺ in the Battle of Tabuk when some people from the Bani Sulaym came to him and said, 'O Messenger of Allah, our companion has vowed to free a slave.' The Messenger of Allah ﷺ said, 'Free him, for Allah will free every limb of his from the Fire.' Thus, the narration of Wathilah became authentic according to the conditions of the two sheikhs, and Muslim also recorded it in his narration of Abu Hurairah's words: 'The freeing of a Muslim slave will free a Muslim limb from the Fire.'"
حَدَّثَنِي هَذَا الشَّيْخُ يَعْنِي وَاثِلَةَ قُلْتُ مَا حَدَّثَكَ؟ فَقَالَ حَدَّثَنِي كُنْتُ جَالِسًا مَعَ رَسُولِ اللَّهِ ﷺ فِي غَزْوَةِ تَبُوكَ فَأَتَاهُ نَفَرٌ مِنْ بَنِي سُلَيْمٍ فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ صَاحِبَنَا قَدْ أَوْجَبَ قَالَ رَسُولُ اللَّهِ ﷺ «أَعْتِقُوا عَنْهُ يُعْتِقِ اللَّهُ بِكُلِّ عُضْوٍ مِنْهَا عُضْوًا مِنْهُ مِنَ النَّارِ» فَصَارَ حَدِيثُ وَاثِلَةَ بِهَذِهِ الرِّوَايَاتِ صَحِيحًا عَلَى شَرْطِ الشَّيْخَيْنِ وَقَدْ أَخْرَجَ مُسْلِمٌ مِنْ حَدِيثِ أَبِي هُرَيْرَةَ لَفْظَهُ فِي عِتْقِ امْرِئٍ مُسْلِمٍ امْرَءًا مُسْلِمًا صحيح
[Machine] The Messenger of Allah ﷺ heard saying, "Whoever frees a Muslim, his emancipation from the fire will be by every organ, one organ for another." Abd al-A'la (this is also Abdullah ibn Dailami) is undoubtedly in agreement with what we have said in the report.
سَمِعَ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ أَعْتَقَ مُسْلِمًا كَانَ فِكَاكَهُ مِنَ النَّارِ بِكُلِّ عُضْوٍ مِنْ هَذَا عُضْوًا مِنْ هَذَا» عَبْدُ الْأَعْلَى هَذَا أَيْضًا هُوَ عَبْدُ اللَّهِ بْنُ الدَّيْلَمِيِّ بِلَا شَكَّ فِيهِ كَمَا قُلْنَاهُ فِي عَرِيفٍ
"My brother willed a portion of his wealth to me. So I met Abu Ad-Darda and said: 'My brother has willed a portion of his wealth to me, so where do you suggest that I should give it- to the poor, the needy, or the Mujahidin in Allah's Cause?' He said: 'As for me, then I would not consider them equal to the Mujahidin. I heard the Messenger of Allah ﷺ saying: "The parable of the one who frees a slave at the time of his death is that of the one who gives a gift when he is satisfied (fulfilled his needs)." أَوْصَى إِلَيَّ أَخِي بِطَائِفَةٍ مِنْ مَالِهِ فَلَقِيتُ أَبَا الدَّرْدَاءِ فَقُلْتُ إِنَّ أَخِي قَدْ أَوْصَى إِلَيَّ بِطَائِفَةٍ مِنْ مَالِهِ فَأَيْنَ أَضَعُهُ؟ فِي الْفُقَرَاءِ أَوِ الْمَسَاكِينِ أَوِ الْمُهَاجِرِينَ؟ فَقَالَ أَمَّا أَنَا فَلَوْ كُنْتُ لَمْ أَعْدِلْ بِالْمُجَاهِدِينَ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ «مَثَلُ الَّذِي يُعْتِقُ عِنْدَ الْمَوْتِ كَمَثَلِ الَّذِي يُهْدِي إِذَا شَبِعَ» هَذَا لَفْظُ حَدِيثِ الثَّوْرِيِّ
I had a slave girl and I set her free. When the Prophet ﷺ entered upon me, I informed him (of this). He said : May Allah give reward for it; if you had given her to your maternal uncles, it would have increased your reward (Using translation from Abū Dāʾūd 1690)
أَعْتَقْتُ جَارِيَةً لِي فَدَخَلَ عَلَيَّ النَّبِيُّ ﷺ فَأَخْبَرْتُهُ بِعِتْقِهَا فَقَالَ «أَمَا إِنَّكِ لَوْ كُنْتِ أَعْطَيْتِهَا أَخْوَالَكِ كَانَ أَعْظَمَ لِأَجْرِكِ»
[Machine] The Messenger of Allah ﷺ said to Abu Bakr As-Siddiq, and Saad was a slave to him, and the Messenger of Allah ﷺ was pleased with his service. So the Messenger of Allah ﷺ said to him, "O Abu Bakr, free Saad." Abu Bakr replied, "O Messenger of Allah, we have no one but him." The Messenger of Allah ﷺ said, "Are men coming to you? Are men coming to you?"
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لِأَبِي بَكْرٍ الصِّدِّيقِ وَكَانَ سَعْدٌ مَمْلُوكًا لَهُ وَكَانَ رَسُولُ اللَّهِ ﷺ يُعْجِبُهُ خِدْمَتُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «يَا أَبَا بَكْرٍ أَعْتِقْ سَعْدًا» فَقَالَ يَا رَسُولَ اللَّهِ مَا لَنَا غَيْرُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَتَتْكَ الرِّجَالُ أَتَتْكَ الرِّجَالُ»
[Machine] "To me, Umm Salamah, I set you free and I stipulate that you serve the Messenger of Allah ﷺ for as long as you live." I said, "If you hadn't stipulated on me, I wouldn't have left the service of the Messenger of Allah ﷺ as long as I live." He said, "So, she freed me and stipulated on me to serve the Messenger of Allah ﷺ for as long as I live."
لِي أُمُّ سَلَمَةَ أُعْتِقُكَ وَأَشْتَرِطُ عَلَيْكَ أَنْ تَخْدُمَ رَسُولَ اللَّهِ ﷺ مَا عِشْتَ قَالَ قُلْتُ «لَوْ أَنَّكِ لَمْ تَشْتَرِطِي عَلَيَّ مَا فَارَقْتُ رَسُولَ اللَّهِ ﷺ مَا عِشْتُ» قَالَ «فَأَعْتَقَتْنِي وَاشْتَرَطَتْ عَلَيَّ أَنْ أَخْدُمَ رَسُولَ اللَّهِ ﷺ مَا عِشْتُ»
[Machine] About my son, O Messenger of Allah? He said, "Yes."
عَنِ ابْنِي يَا رَسُولَ اللَّهِ؟ قَالَ «نَعَمْ»
“Whoever becomes the master of a Mahram relative, he becomes free.” (Using translation from Ibn Mājah 2525)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ حُرٌّ» على شرط البخاري ومسلم
"Whoever owns a related Mahram, then he is free." (Using translation from Tirmidhī 1365)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ حُرٌّ» صحيح
The Prophet ﷺ said: The child of adultery is worst of the three. Abu Hurairah said: That I give a flog in the path of Allah (as a charity) is dearer to me than emancipating a child of adultery. (Using translation from Abū Dāʾūd 3963)
قَالَ رَسُولُ اللَّهِ ﷺ «وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ» قَالَ أَبُو هُرَيْرَةَ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ أَنْ أُعْتِقَ وَلَدَ زِنْيَةٍ»
[Machine] The Prophet Muhammad ﷺ said, "The child of adultery is the worst of the three."
قَالَ رَسُولُ اللَّهِ ﷺ «وَلَدَ الزِّنَا شَرُّ الثَّلَاثَةِ»
[Machine] "Narrated by Abu Hurairah, he said: The Messenger of Allah ﷺ said, 'I love to be adorned with a whip in the cause of Allah more than to free the children of adulterers.' And the Messenger of Allah ﷺ said, 'The child of adultery is the worst of the three.' And the dead will be punished by the mourning of the living.' Aisha, may Allah be pleased with her, said, 'Abu Hurairah has misunderstood what he heard and has wrongly interpreted it. As for his saying, 'I love to be adorned with a whip in the cause of Allah more than to free the children of adulterers,' it was revealed when the verse was revealed, 'Then let him attempt the difficult,' (Al-Balad 90:13). It was said, 'O Messenger of Allah, we do not have anything to release except that one of us has a black slave girl who serves and works for him. If we command them, they would commit adultery and bring children, so we would set them free.' The Messenger of Allah ﷺ said, 'I love to be adorned with a whip in the cause of Allah more than to command adultery and then free the children.' Salamah did not confirm this hadith, and Ibn Rahawayh has authenticated and weakened it."
أَنَّ أَبَا هُرَيْرَةَ يَقُولُ إِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا» وَإِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «وَلَدُ الزِّنَا شَرُّ الثَّلَاثَةِ» «وَإِنَّ الْمَيِّتَ يُعَذَّبُ بِبُكَاءِ الْحَيِّ» فَقَالَتْ عَائِشَةُ رَحِمَ اللَّهُ أَبَا هُرَيْرَةَ أَسَاءَ سَمْعًا فَأَسَاءَ إِصَابَةً أَمَّا قَوْلُهُ «لَأَنْ أُمَتَّعَ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ أُعْتِقَ وَلَدَ الزِّنَا» أَنَّهَا لَمَّا نَزَلَتْ {فَلَا اقْتَحَمَ الْعَقَبَةَ وَمَا أَدْرَاكَ مَا الْعَقَبَةُ} [البلد 12] قِيلَ يَا رَسُولَ اللَّهِ مَا عِنْدَنَا مَا نُعْتِقُ إِلَّا أَنَّ أَحَدَنَا لَهُ جَارِيَةٌ سَوْدَاءُ تَخْدُمُهُ وَتَسْعَى عَلَيْهِ فَلَوْ أَمَرْنَاهُنَّ فَزَنَيْنَ فَجِئْنَ بِالْأَوْلَادِ فَأَعْتَقْنَاهُمْ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَأَنْ أُمَتَّعْ بِسَوْطٍ فِي سَبِيلِ اللَّهِ أَحَبُّ إِلَيَّ مِنْ أَنْ آمُرَ بِالزِّنَا ثُمَّ أُعْتِقَ الْوَلَدَ» سلمة لم يحتج به مسلم وقد وثق وضعفه ابن راهويه
[Machine] Indeed, my master accused me and made me sit on fire until my genitals burned. Umar asked her, "Did you witness this happening to her?" She replied, "No." Umar asked, "Did you confess to it?" She said, "No." Umar said, "Then how did you accuse her?" When Umar saw the man, he said, "Are you being punished with the punishment of Allah?" The man replied, "O Commander of the Believers, I accused her in my own self." Umar asked, "Did you witness this happening to her?" The man replied, "No." Umar asked, "Did she confess to it?" He replied, "No." Umar swore by Allah and said, "If I had not heard the Messenger of Allah ﷺ saying, 'A slave should not be punished for the act of his master, nor a parent for the act of his child,' I would have punished you on her behalf." Then Umar ordered the man to be beaten with a hundred lashes and said to the slave girl, "Go, you are free for the sake of Allah. You belong to Allah and His Messenger." Abu Salih said, "Al-Layth said, 'This is the ruling that should be implemented.'"
إِنَّ سَيِّدِي اتَّهَمَنِي فَأَقْعَدَنِي عَلَى النَّارِ حَتَّى احْتَرَقَ فَرْجِي فَقَالَ لَهَا عُمَرُ هَلْ رَأَى ذَلِكَ عَلَيْكِ؟ قَالَتْ لَا قَالَ فَهَلِ اعْتَرَفْتِ لَهُ بِشَيْءٍ؟ قَالَتْ لَا فَقَالَ عُمَرُ عَلَيَّ بِهِ فَلَمَّا رَأَى عُمَرُ الرَّجُلَ قَالَ أَتُعَذِّبُ بِعَذَابِ اللَّهِ؟ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ اتَّهَمْتُهَا فِي نَفْسِي قَالَ رَأَيْتَ ذَلِكَ عَلَيْهَا؟ قَالَ الرَّجُلُ لَا قَالَ فَاعْتَرَفَتْ بِهِ؟ قَالَ لَا قَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَوْ لَمْ أَسْمَعْ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يُقَادُ مَمْلُوكٌ مِنْ مَالِكِهِ وَلَا وَالِدٌ مِنْ وَلَدِهِ» لَأَقَدْتُهَا مِنْكَ فَبَرَّزَهُ وَضَرَبَهُ مِائَةَ سَوْطٍ وَقَالَ لِلْجَارِيَةِ اذْهَبِي فَأَنْتِ حُرَّةٌ لِوَجْهِ اللَّهِ أَنْتِ مَوْلَاةُ اللَّهِ وَرَسُولِهِ قَالَ أَبُو صَالِحٍ قَالَ اللَّيْثُ «وَهَذَا الْقَوْلُ مَعْمُولٌ بِهِ»
[Machine] "A group of captives from Khawlan came and among them was a woman named Aisha who had a slave child from the descendants of Ismael. There was also a group of captives from Yemen who she wanted to set free. However, the Prophet ﷺ forbade her from doing so. Then, a group of captives from Mudar came, and the Prophet believed them to be from the Banu Al-Anbar. He commanded her to set them free. This narration is authentic."
أَنَّ سَبْيًا مِنْ خَوْلَانَ قَدِمَ وَكَانَ عَلَى عَائِشَةَ رَقَبَةٌ مِنْ وَلَدِ إِسْمَاعِيلَ فَقَدِمَ سَبْيٌ مِنَ الْيَمَنِ فَأَرَادَتْ أَنْ تُعْتِقَ مِنْهُمْ «فَنَهَاهَا النَّبِيُّ ﷺ» فَقَدِمَ سَبْيٌ مِنْ مُضَرَ أَحْسِبُهُ قَالَ مِنْ بَنِي الْعَنْبَرِ «فَأَمَرَهَا أَنْ تُعْتِقَ» تَابَعَهُ شُعْبَةُ عَنْ عُبَيْدِ بْنِ الْحَسَنِالحديث صحيح
[Machine] Aisha had a slave from the offspring of Ismail. So the Messenger of Allah, peace be upon him, came to her with captives from the Banu Al-Anbar tribe. The Messenger of Allah, peace be upon him, said to her, "Set free a slave from the Banu Al-Anbar tribe, or from the Banu Lihyan tribe, but do not set free a slave from the Banu Khawlan tribe."
كَانَ عَلَى عَائِشَةَ مُحَرَّرٌ مِنْ وَلَدِ إِسْمَاعِيلَ فَأُتِيَ رَسُولُ اللَّهِ ﷺ بِسَبْيٍ مِنْ بَنِي الْعَنْبَرِ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «أَعْتِقِي مِنْ بَنِي الْعَنْبَرِ أَوْ مِنْ بَنِي لِحْيَانَ وَلَا تَعْتِقِي مِنْ بَنِي الْخَوْلَانِ»
