29. Farming
٢٩۔ كِتَابُ الْمُزَارَعَةِ
[Machine] The Messenger of Allah ﷺ said, "Whoever cuts down a lotus tree, Allah will strike his head with fire." And Abu Al-Hasan Ali ibn Muhammad Al-Muqri narrated to us that Al-Hasan ibn Muhammad ibn Ishaq informed us that Yusuf ibn Ya'qub Al-Qadi narrated to us that Nasr ibn Ali mentioned it in a similar narration to that of Abu Dawood, except that he said it was narrated from Ibn Jubayr ibn Mut'im, from Abdullah ibn Hubshiyy, from the Prophet ﷺ.
قَالَ رَسُولُ اللهِ ﷺ مَنْ قَطَعَ سِدْرَةً صَوَّبَ اللهُ رَأْسَهُ فِي النَّارِ 11759 وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ الْقَاضِي ثنا نَصْرُ بْنُ عَلِيٍّ فَذَكَرَهُ بِنَحْوِ رِوَايَةِ أَبِي دَاوُدَ غَيْرَ أَنَّهُ قَالَ عَنِ ابْنِ جُبَيْرِ بْنِ مُطْعِمٍ عَنْ عَبْدِ اللهِ بْنِ حُبْشِيٍّ عَنِ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah ﷺ said, "Whoever cuts down a lote tree, Allah will make him enter his head into the Fire." Abu Abdullah said, Abu Ali al-Hafiz wrote it down from the hadith of Mas'adah, but it has not been confirmed and it is a mistake. And indeed,
قَالَ رَسُولُ اللهِ ﷺ مَنْ قَطَعَ سِدْرَةً صَوَّبَ اللهُ رَأْسَهُ فِي النَّارِ قَالَ أَبُو عَبْدِ اللهِ قَالَ أَبُو عَلِيٍّ الْحَافِظُ هَكَذَا كَتَبْنَاهُ مِنْ حَدِيثِ مَسْعَدَةَ وَلَمْ يُتَابَعْ عَلَيْهِ وَهُوَ خَطَأٌ وَإِنَّمَا
[Machine] Urwa had cut a Sidra tree that was in a wall, so he made a door for the wall that seemed as if a man from Thaqif, Amr ibn Aws, had made it.
أَنَّ عُرْوَةَ قَطَعَ سِدْرَةً كَانَتْ فِي حَائِطٍ فَجَعَلَ بَابًا لِحَائِطٍ يُشْبِهُ أَنْ يَكُونَ الرَّجُلُ مِنْ ثِقِيفٍ عَمْرَو بْنَ أَوْسٍ
[Machine] The Messenger of Allah, ﷺ , said: "Indeed, those who cut the sidr tree will have Allah pour molten lead onto their heads in the fire. This is Abu Uthman, he is Muhammad ibn Sharik Al-Makki, and this is what is transmitted from him, sent."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ الَّذِينَ يَقْطَعُونَ السِّدْرَ يَصُبُّهُمُ اللهُ عَلَى رُءُوسِهِمْ فِي النَّارِ صَبًّا أَبُو عُثْمَانَ هَذَا هُوَ مُحَمَّدُ بْنُ شَرِيكٍ الْمَكِّيُّ وَهَذَا هُوَ الْمَحْفُوظُ عَنْهُ مُرْسَلًا
[Machine] The Messenger of Allah, ﷺ , said: "Indeed, those who cut down the Sidr tree will be poured with molten brass upon their heads in the Fire." Abu Abdullah Al-Hafiz informed us, Abu Ali Al-Hafiz informed us, Al-Husayn ibn Idris Al-Ansari informed us, and Al-Qasim ibn Abi Shaybah mentioned it. Abu Ali said: "I do not recall who he learned it from, but they discussed it, meaning Al-Qasim and Al-Mahfuzh. The narration is from Abu Ahmad Al-Zubayri and those who followed his narration from Muhammad ibn Sharik, from Amr ibn Dinar, from Amr ibn Aws, from Urwah, that the Messenger of Allah, ﷺ , said it as a command."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ الَّذِينَ يَقْطَعُونَ السِّدْرَ يُصَبُّونَ فِي النَّارِ عَلَى رُءُوسِهِمْ صَبًّا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو عَلِيٍّ الْحَافِظُ ثنا الْحُسَيْنُ بْنُ إِدْرِيسَ الْأَنْصَارِيُّ ثنا الْقَاسِمُ بْنُ أَبِي شَيْبَةَ فَذَكَرَهُ قَالَ أَبُو عَلِيٍّ مَا أُرَاهُ حَفِظَهُ عَنْ وَكِيعٍ وَقَدْ تَكَلَّمُوا فِيهِ يَعْنِي الْقَاسِمَ وَالْمَحْفُوظُ رِوَايَةُ أَبِي أَحْمَدَ الزُّبَيْرِيِّ وَمَنْ تَابَعَهُ عَلَى رِوَايَتِهِ عَنْ مُحَمَّدِ بْنِ شَرِيكٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ عَمْرِو بْنِ أَوْسٍ عَنْ عُرْوَةَ أَنَّ رَسُولَ اللهِ ﷺ مُرْسَلًا
[Machine] I met a sheikh from Thaqif who had ruined his garden. So I said, "Why don't you cut it down? For the Messenger of Allah ﷺ said, 'Do not cut down a Lote tree except for a reason.' " He said, "I heard the Messenger of Allah ﷺ saying, 'Whoever cuts down a Lote tree without a valid reason, they will be showered with a punishment.' So I dislike cutting it down whether it is from my garden or from someone else's." This is another version of the narration from Amr ibn Aws, aside from his narration from Urwah, if Ibrahim ibn Yazid has preserved it.
أَدْرَكْتُ شَيْخًا مِنْ ثَقِيفٍ قَدْ أَفْسَدَ السِّدْرُ زَرْعَهُ فَقُلْتُ أَلَا تَقْطَعُهُ؛ فَإِنَّ رَسُولَ اللهِ ﷺ قَالَ إِلَّا مِنْ زَرْعٍ ؟ فَقَالَ أَنَا سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ قَطَعَ السِّدْرَ إِلَّا مِنْ زَرْعٍ صُبَّ عَلَيْهِ الْعَذَابُ صَبًّا فَأَنَا أَكْرَهُ أَنْ أَقْطَعَهُ مِنَ الزَّرْعِ وَمِنْ غَيْرِهِ فَهَذَا إِسْنَادٌ آخَرُ لِعَمْرِو بْنِ أَوْسٍ سِوَى رِوَايَتِهِ عَنْ عُرْوَةَ إِنْ كَانَ حَفِظَهُ إِبْرَاهِيمُ بْنُ يَزِيدَ
[Machine] The Messenger of Allah ﷺ said, "Go out and give the call to prayer to the people from Allah, not from His Messenger. May Allah curse the one who cuts off the sidra tree." Our sheikh mentioned this in the book "Gharā'ib al-Shuyūkh." Abu Abdullah al-Hafiz informed us that Abu al-Husayn ibn Ali al-Hafiz narrated to us that Muhammad ibn Imran ibn Khuzaymah al-Dinawari informed him that Abu Bakr narrated to him that Abu Ubayd al-Makhzumi Sa'id ibn Abd al-Rahman narrated to him that Hisham ibn Sulayman narrated to him from Ibn Jurayj that Ibrahim ibn Yazid al-Makki narrated to him from Amr ibn Dinar from Hasan ibn Muhammad from his father from Ali, who mentioned it. Abu Ali said, "This is what the sheikh and Ibn Jurayj said in his isnad, but they are unclear." Ibrahim ibn Munther also narrated it from Hisham ibn Sulayman from Ibrahim ibn Yazid, but he did not mention Ibn Jurayj in his isnad, and that is the correct version. Ali ibn Thabit also narrated it from Ibrahim ibn Yazid from Amr ibn Dinar from Muhammad ibn Ali through a mursal chain. Ali ibn Hisham ibn al-Barid narrated it from Ibrahim al-Khawzi from Amr ibn Dinar and Sulayman al-Ahwal from Amr ibn Shuayb from his father from his grandfather from Amr ibn Aws al-Thaqafi from the Prophet ﷺ . He said, "Except for a tree of sown crops." Abu Ali al-Hafiz said that the hadith of Ibrahim ibn Yazid is shaky, and Ibrahim is weak. The sheikh also said that it was narrated by al-Muthanna ibn al-Sabbah from Amr from Abu Ja'far.
قَالَ رَسُولُ اللهِ ﷺ اخْرُجْ فَأَذِّنْ فِي النَّاسِ مِنَ اللهِ لَا مِنْ رَسُولِهِ لَعَنَ اللهُ قَاطِعَ السِّدْرَةِ هَكَذَا قَالَهُ شَيْخُنَا فِي غَرَائِبِ الشُّيُوخِ 11766 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْحُسَيْنِ بْنُ عَلِيٍّ الْحَافِظُ ثنا مُحَمَّدُ بْنُ عِمْرَانَ بْنِ خُزَيْمَةَ الدِّينَوَرِيُّ أَبُو بَكْرٍ ثنا أَبُو عُبَيْدٍ الْمَخْزُومِيُّ سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ ثنا هِشَامُ بْنُ سُلَيْمَانَ عَنِ ابْنِ جُرَيْجٍ حَدَّثَنِي إِبْرَاهِيمُ بْنُ يَزِيدَ الْمَكِّيُّ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ عَلِيٍّ فَذَكَرَهُ قَالَ أَبُو عَلِيٍّ هَكَذَا قَالَ لَنَا هَذَا الشَّيْخُ وَابْنُ جُرَيْجٍ فِي إِسْنَادِهِ وَهْمٌ وَرَوَاهُ إِبْرَاهِيمُ بْنُ الْمُنْذِرِ عَنْ هِشَامِ بْنِ سُلَيْمَانَ عَنْ إِبْرَاهِيمَ بْنِ يَزِيدَ وَلَمْ يَذْكُرِ ابْنَ جُرَيْجٍ فِي إِسْنَادِهِ وَهُوَ الصَّوَابُ وَرَوَاهُ عَلِيُّ بْنُ ثَابِتٍ عَنْ إِبْرَاهِيمَ بْنِ يَزِيدَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ مُرْسَلًا وَرَوَاهُ عَلِيُّ بْنُ هِشَامِ بْنِ الْبَرِيدِ عَنْ إِبْرَاهِيمَ الْخُوزِيِّ عَنْ عَمْرِو بْنِ دِينَارٍ وَسُلَيْمَانَ الْأَحْوَلِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ عَمْرِو بْنِ أَوْسٍ الثَّقَفِيِّ عَنِ النَّبِيِّ ﷺ وَقَالَ إِلَّا مِنْ زَرْعٍ قَالَ أَبُو عَلِيٍّ الْحَافِظُ حَدِيثُ إِبْرَاهِيمَ بْنِ يَزِيدَ مُضْطَرِبٌ وَإِبْرَاهِيمُ ضَعِيفٌ قَالَ الشَّيْخُ وَرَوَاهُ الْمُثَنَّى بْنُ الصَّبَّاحِ عَنْ عَمْرٍو عَنْ أَبِي جَعْفَرٍ
[Machine] The Prophet ﷺ said to Ali during his illness, in which he died, "Come out, O Ali, and say regarding Allah, not regarding the Messenger of Allah, 'May Allah curse whoever cuts the sidr tree.'" Imam Ahmad (may Allah have mercy on him) said, "All of that is disconnected and weak, except for the hadith of Ibn Juraij, for I do not know if Sa'eed heard it from Abdullah ibn Habashi or not. It is possible that he heard it. And Allah knows best." And it was narrated with another connected chain, if it is preserved.
قَالَ النَّبِيُّ ﷺ لِعَلِيٍّ فِي مَرَضِهِ الَّذِي مَاتَ فِيهِ اخْرُجْ يَا عَلِيُّ فَقُلْ عَنِ اللهِ لَا عَنْ رَسُولِ اللهِ لَعَنَ اللهُ مَنْ يَقْطَعُ السِّدْرَ قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ كُلُّ ذَلِكَ مُنْقَطِعٌ وَضَعِيفٌ إِلَّا حَدِيثَ ابْنِ جُرَيْجٍ فَإِنِّي لَا أَدْرِي هَلْ سَمِعَ سَعِيدٌ مِنْ عَبْدِ اللهِ بْنِ حَبَشِيٍّ أَمْ لَا وَيُحْتَمَلُ أَنْ يَكُونَ سَمِعَهُ وَاللهُ أَعْلَمُ وَرُوِيَ بِإِسْنَادٍ آخَرَ مَوْصُولًا إِنْ كَانَ مَحْفُوظًا
[Machine] The Messenger of Allah ﷺ said: "The one who cuts down the Sidr tree, Allah will straighten his head in the fire."
قَالَ رَسُولُ اللهِ ﷺ قَاطِعُ السِّدْرِ يُصَوِّبُ اللهُ رَأْسَهُ فِي النَّارِ
[Machine] Narrated by the Prophet ﷺ : "This is from Allah, not from His Messenger. May Allah curse the one who supports the Sadr tree."
عَنِ النَّبِيِّ ﷺ قَالَ مِنَ اللهِ لَا مِنْ رَسُولِهِ لَعَنَ اللهُ عَاضِدَ السِّدْرِ
[Machine] "Do you see these doors and shutters? They are made of Sidr wood. 'Urwah used to cut it from his land and he said, 'There is no harm in it.' Humaid said, 'O 'Iraqi, you have come to me with an innovation.' I said, 'Innovation is only from you. I have heard someone in Makkah saying that the Messenger of Allah ﷺ invoked curse upon the one who cuts Sidr trees. Abu Dawud said: Then he brought Ma'nahan, and Abu Dawud said: meaning the one who cuts Sidr trees in an open land from which the traveler and the animals take shade, for no legitimate reason. Imam Ahmad (may Allah have mercy on him) said: I have also read in the book of Abu al-Hasan al-'Asimi, according to his narration from Abu 'Abdullah Muhammad ibn Yusuf, from Muhammad ibn Ya'qub ibn al-Faraj, from Abu Thawr, that he said: I asked Abu 'Abdullah al-Shafi'i (may Allah have mercy on him) about cutting Sidr trees. He said: There is nothing wrong with it. It has been narrated from the Prophet ﷺ that he said: "Wash it with water and Sidr." I said: so the Hadith that is narrated about cutting Sidr is to be understood in light of the Hadith that Abu Dawud al-Sijistani (may Allah have mercy on him) transmitted, if its chain of narration is sound, and it includes some points that we have mentioned. We have also narrated from 'Urwah ibn al-Zubair that he used to cut it from his land, and he was one of the narrators of the prohibition, so it may be understood that the prohibition applies specifically, as Abu Dawud (may Allah have mercy on him) said. Allah knows best. I have also read in the book of Abu Sulayman al-Khattabi (may Allah have mercy on him) that Isma'il ibn Yahya al-Muzani (may Allah have mercy on him) was asked about this, and he said: It is a matter of opinion that if someone attacks an open land to cut Sidr trees for a people, or for an orphan, or for someone whom Allah has prohibited to be cut for, and he insists on cutting it, then he deserves what was said to him. So the matter in question was mentioned before the questioner, and the answer was heard, and a similar case was mentioned by Usamah ibn Zaid that the Messenger of Allah ﷺ said: "Riba only applies to the nasi’ah," and he heard the answer but did not hear the question. The Muzani asked permission from the Prophet ﷺ to wash the deceased with water and Sidr, and if it were prohibited, it would not have been permissible to benefit from it. He also said: The leaves of the Sidr tree are like a branch, and the Messenger of Allah ﷺ made equal in what he prohibited cutting from the trees of the Haram, between its leaves and other than it. So when I did not see anyone being forbidden to use Sidr leaves, it indicated that cutting Sidr is permissible."
أَتَرَى هَذِهِ الْأَبْوَابَ وَالْمَصَارِيعَ؟ إِنَّمَا هِيَ مِنْ سِدْرِ عُرْوَةَ كَانَ عُرْوَةُ يَقْطَعُهُ مِنْ أَرْضِهِ وَقَالَ لَا بَأْسَ بِهِ زَادَ حُمَيْدٌ فَقَالَ هِيَ يَا عِرَاقِيُّ جِئْتَنِي بِبِدْعَةٍ قَالَ قُلْتُ إِنَّمَا الْبِدْعَةُ مِنْ قِبَلِكُمْ سَمِعْتُ مَنْ يَقُولُ بِمَكَّةَ لَعَنَ رَسُولُ اللهِ ﷺ مَنْ قَطَعَ السِّدْرَ فَقَالَ أَبُو دَاوُدَ ثُمَّ سَاقَ مَعْنَاهُ قَالَ أَبُو دَاوُدَ يَعْنِي مَنْ قَطَعَ السِّدْرَ فِي فَلَاةٍ يَسْتَظِلُّ بِهَا ابْنُ السَّبِيلِ وَالْبَهَائِمُ عَبَثًا وَظُلْمًا بِغَيْرِ حَقٍّ يَكُونُ لَهُ فِيهَا قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَقَدْ قَرَأْتُ فِي كِتَابِ أَبِي الْحَسَنِ الْعَاصِمِيِّ رِوَايَتَهُ عَنْ أَبِي عَبْدِ اللهِ مُحَمَّدِ بْنِ يُوسُفَ عَنْ مُحَمَّدِ بْنِ يَعْقُوبَ بْنِ الْفَرَجِيِّ عَنْ أَبِي ثَوْرٍ أَنَّهُ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ الشَّافِعِيَّ رَحِمَهُ اللهُ عَنْ قَطْعِ السِّدْرِ فَقَالَ لَا بَأْسَ بِهِ قَدْ رُوِيَ عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ اغْسِلْهُ بِمَاءٍ وَسِدْرٍ قُلْتُ فَالْحَدِيثُ الَّذِي رُوِيَ فِي قَاطِعِ السِّدْرِ يَكُونُ مَحْمُولًا عَلَى مَا حَمَلَهُ عَلَيْهِ أَبُو دَاوُدَ السِّجِسْتَانِيُّ رَحِمَهُ اللهُ إِنْ صَحَّ طَرِيقُهُ فَفِيهِ مِنَ الِاخْتِلَافِ مَا قَدَّمْنَا ذِكْرَهُ وَرُوِّينَا عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ أَنَّهُ كَانَ يَقْطَعُهُ مِنْ أَرْضِهِ وَهُوَ أَحَدُ رُوَاةِ النَّهْيِ فَيُشْبِهُ أَنْ يَكُونَ النَّهْيُ خَاصًّا كَمَا قَالَ أَبُو دَاوُدَ رَحِمَهُ اللهُ وَاللهُ أَعْلَمُ وَقَرَأْتُ فِي كِتَابِ أَبِي سُلَيْمَانَ الْخَطَّابِيِّ رَحِمَهُ اللهُ أَنَّ إِسْمَاعِيلَ بْنَ يَحْيَى الْمُزَنِيَّ رَحِمَهُ اللهُ سُئِلَ عَنْ هَذَا فَقَالَ وَجْهُهُ أَنْ يَكُونَ ﷺ سُئِلَ عَمَّنْ هَجَمَ عَلَى قَطْعِ سِدْرٍ لِقَوْمٍ أَوْ لِيَتِيمٍ أَوْ لِمَنْ حَرَّمَ اللهُ أَنْ يُقْطَعَ عَلَيْهِ فَتَحَامَلَ عَلَيْهِ بِقَطْعِهِ فَاسْتَحَقَّ مَا قَالَهُ فَتَكُونَ الْمَسْأَلَةُ سَبَقَتِ السَّامِعَ فَسَمِعَ الْجَوَابَ وَلَمْ يَسْمَعِ الْمَسْأَلَةَ وَجَعَلَ نَظِيرَهُ حَدِيثَ أُسَامَةَ بْنِ زَيْدٍ أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّمَا الرِّبَا فِي النَّسِيئَةِ فَسَمِعَ الْجَوَابَ وَلَمْ يَسْمَعِ الْمَسْأَلَةَ وَقَدْ قَالَ لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ وَاحْتَجَّ الْمُزَنِيُّ بِمَا احْتَجَّ بِهِ الشَّافِعِيُّ رَحِمَهُمَا اللهُ مِنْ إِجَازَةِ النَّبِيِّ ﷺ أَنْ يُغَسَّلَ الْمَيِّتُ بِالسِّدْرِ وَلَوْ كَانَ حَرَامًا لَمْ يَجُزِ الِانْتِفَاعُ بِهِ قَالَ وَالْوَرَقُ مِنَ السِّدْرِ كَالْغُصْنِ وَقَدْ سَوَّى رَسُولُ اللهِ ﷺ فِيمَا حَرَّمَ قَطْعَهُ مِنْ شَجَرِ الْحَرَمِ بَيْنَ وَرَقِهِ وَبَيْنَ غَيْرِهِ فَلَمَّا لَمْ أَرَ أَحَدًا يُمْنَعُ مِنْ وَرَقِ السِّدْرِ دَلَّ عَلَى جَوَازِ قَطْعِ السِّدْرِ
