٢٨۔ كِتَابُ الْإِجَارَةِ ص ٢
[Machine] The Messenger of Allah ﷺ prohibited the price of a dog and the dowry of a professional female singer. نَهَى رَسُولُ اللهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الزَّمَّارَةِ قَالَ الشَّيْخُ وَيُحْتَمَلُ أَنْ يَكُونَ النَّهْيُ عَنِ كَسْبِهِنَّ إِذَا لَمْ يُعْلَمْ مِنْ أَيْنَ كَسَبْنَهُ عَلَى طَرِيقِ التَّنْزِيهِ؛ خَوْفًا مِنْ مُوَاقَعَةِ الْحَرَامِ وَعَلَى هَذَا يَدُلُّ مَا
Rafi' ibn Rifa'ah came to a meeting of the Ansar and said: The Prophet of Allah ﷺ forbade us (from some things) today, and he mentioned some things. He forbade the earning of a slave-girl except what she earned with her hand. He indicated (some things) with his fingers such as baking, spinning, and ginning. (Using translation from Abū Dāʾūd 3426)
لَقَدْ نَهَانَا رَسُولُ اللهِ ﷺ الْيَوْمَ فَذَكَرَ أَشْيَاءَ وَقَالَ نَهَانَا عَنْ كَسْبِ الْأَمَةِ إِلَّا مَا عَمِلَتْ بِيَدِهَا وَقَالَ هَكَذَا بِأُصْبُعِهِ نَحْوَ الْغَزْلِ وَالْخَبْزِ وَالنَّقْشِ
[Machine] The Messenger of Allah, ﷺ , forbade the gaining of a slave until he knows where he is from, and the rest of this matter is mentioned in the book of expenses; where Ash-Shafi'i mentioned this issue in the chapter of the expenses of slaves.
نَهَى رَسُولُ اللهِ ﷺ عَنْ كَسْبِ الْأَمَةِ حَتَّى يُعْلَمَ مِنْ أَيْنَ هُوَ وَبَقِيَّةُ هَذَا الْبَابِ مَذْكُورٌ فِي كِتَابِ النَّفَقَاتِ؛ حَيْثُ ذَكَرَ الشَّافِعِيُّ هَذِهِ الْمَسْأَلَةَ فِي بَابِ نَفَقَةِ الْمَمَالِيكِ
28.12 [Machine] The earnings of a man and his manual work.
٢٨۔١٢ بَابُ كَسْبِ الرَّجُلِ وَعَمَلِهِ بِيَدَيْهِ
[Machine] The Messenger of Allah ﷺ said, "No one has eaten better food from the descendants of Adam than what he has eaten from the work of his own hands. Indeed, the Prophet of Allah, Dawood, used to eat from the earnings of his own hands."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَا أَكَلَ أَحَدٌ مِنْ بَنِي آدَمَ طَعَامًا خَيْرًا لَهُ مِنْ أَنْ يَأْكُلَ مِنْ عَمَلِ يَدَيْهِ إِنَّ نَبِيَّ اللهِ دَاوُدَ كَانَ يَأْكُلُ مِنْ كَسْبِ يَدَيْهِ
[Machine] And the Messenger of Allah, ﷺ , said: "The Quran was made easy for Dawud, so he used to command his animals to be saddled, and he would recite the Quran before his animal was saddled, and he would not eat except from the work of his own hands."
وَقَالَ رَسُولُ اللهِ ﷺ خُفِّفَ عَلَى دَاوُدَ الْقُرْآنُ فَكَانَ يَأْمُرُ بِدَوَابِّهِ تُسْرَجُ فَكَانَ يَقْرَأُ الْقُرْآنَ مِنْ قَبْلِ أَنَ تُسْرَجَ دَابَّتُهُ وَكَانَ لَا يَأْكُلُ إِلَّا مِنْ عَمَلِ يَدَيْهِ
[Machine] The executioner said, "Pray for me a barber to shave my head twice or three times." I heard the Messenger of Allah ﷺ saying, "I have gifted my aunt a boy hoping that it will be blessed for her. I told her not to give him to a barber, a hairdresser, or a goldsmith." And Abu Ali Al-Rudbary reported to us that Abu Bakr bin Dasa informed us, that Abu Dawood informed us, that Musa bin Ismail informed us, that Hammad informed us, that Muhammad bin Ishaq mentioned it in its meaning or part of it. He said, and Abu Dawood reported to us, that Al-Fadl bin Ya'qub informed us, that Abdul Al-A'la informed us, that Muhammad bin Ishaq told me that Al-Ala bin Abdul Rahman Al-Horqy narrated to me, from Abu Majidah, a man from the tribe of Sahm, from Umar ibn Al-Khattab who said, "I heard the Prophet ﷺ saying, in its meaning, it is carried out to avoid, not to prohibit. As for the income of the barber, it is mentioned in detail in the latter quarter (section) and may Allah grant success."
قَدْ بَلَغَ الْقِصَاصُ ادْعُوا لِي حَجَّامًا يَقْتَصُّ مِنْهُ مَرَّتَيْنِ أَوْ ثَلَاثًا؛ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِنِّي وَهَبْتُ لِخَالَتِي غُلَامًا أَرْجُو أَنْ يُبَارَكَ لَهَا فِيهِ وَقُلْتُ لَهَا لَا تُسَلِّمِيهِ حَجَّامًا وَلَا قَصَّابًا وَلَا صَائِغًا 11694 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا مُوسَى بْنُ إِسْمَاعِيلَ ثنا حَمَّادٌ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ فَذَكَرَهُ بِمَعْنَاهُ أَوْ جُزْءٍ مِنْهُ قَالَ وَثنا أَبُو دَاوُدَ ثنا الْفَضْلُ بْنُ يَعْقُوبَ ثنا عَبْدُ الْأَعْلَى عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ حَدَّثَنِي الْعَلَاءُ بْنُ عَبْدِ الرَّحْمَنِ الْحُرَقِيُّ عَنْ أَبِي مَاجِدَةَ رَجُلٌ مِنْ بَنِي سَهْمٍ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ بِمَعْنَاهُ مَحْمُولٌ عَلَى التَّنْزِيهِ لَا عَلَى التَّحْرِيمِ وَأَمَّا كَسْبُ الْحَجَّامِ فَالْكَلَامُ فِيهِ مَذْكُورٌ فِي الْمُخْتَصَرِ فِي الرُّبُعِ الْأَخِيرِ وَبِاللهِ التَّوْفِيقُ
[Machine] The Messenger of Allah ﷺ said: "Seeking lawful earnings is an obligation that comes after the obligatory acts of worship. Only 'Abbad ibn Kathir al-Ramli mentioned this, and he is weak." Abu Abdullah al-Hafiz informed us, saying: "I read in the handwriting of Abi 'Amr al-Mustamli that I heard Abu Ahmad al-Farra'ah say: I heard Yahya ibn Yahya being asked about the hadith of 'Abbad ibn Kathir regarding seeking lawful earnings. He said: The Messenger of Allah ﷺ said:..." [Note: The rest of the passage is missing and cannot be translated]
قَالَ رَسُولُ اللهِ ﷺ طَلَبُ كَسْبِ الْحَلَالِ فَرِيضَةٌ بَعْدَ الْفَرِيضَةِ تَفَرَّدَ بِهِ عَبَّادُ بْنُ كَثِيرٍ الرَّمْلِيُّ وَهُوَ ضَعِيفٌ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ قَالَ قَرَأْتُ بِخَطِّ أَبِي عَمْرٍو الْمُسْتَمْلِي سَمِعْتُ أَبَا أَحْمَدَ الْفَرَّاءَ يَقُولُ سَمِعْتُ يَحْيَى بْنَ يَحْيَى يُسْأَلُ عَنْ حَدِيثِ عَبَّادِ بْنِ كَثِيرٍ فِي كَسْبِ الْحَلَالِ قَالَ قَالَ رَسُولُ اللهِ ﷺ قَالَ إِنْ كَانَ قَالَهُ
