"قُلتُ: يَا رَسُولَ الله؛ أَنَنْزِلُ فِى دَارِكَ بِمَكَّةَ؟ قَالَ: وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ؟ وَكَان عَقِيلٌ ورِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٍ، وَلَمْ يَرِثْهُ جَعْفَرٌ، وَلَا عَلِىٌّ شَيْئًا، لأنَّهُمَا كَانَا مُسْلِمَيْنِ، وَكَانَ طَالِبٍ وَعَقِيلٌ كَافِرَيْنِ".

Collected by Bukhārī, Muslim, Ibn Mājah, Ḥākim, Ibn Ḥibbān, Nasāʾī's Kubrá, BayhaqīI asked, "O Messenger of Allah ﷺ! Where will you stay in Mecca? Will you stay in your house in Mecca?" He replied, "Has ʿAqil left any property or house?" ʿAqil along with Talib had inherited the property of Abu Talib. Jafar and ʿAli did not inherit anything as they were Muslims and the other two were non-believers. ʿUmar bin Al-Khattab used to say, "A believer cannot inherit (anything from an) infidel." Ibn Shihab, (a sub-narrator) said, "They (ʿUmar and others) derived the above verdict from Allah's Statement: "Verily! those who believed and Emigrated and strove with their life And property in Allah's Cause, And those who helped (the emigrants) And gave them their places to live in, These are (all) allies to one another." (8.72)
أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ أَيْنَ تَنْزِلُ فِي دَارِكَ بِمَكَّةَ فَقَالَ وَهَلْ تَرَكَ عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْهُ جَعْفَرٌ وَلاَ عَلِيٌّ ؓ شَيْئًا لأَنَّهُمَا كَانَا مُسْلِمَيْنِ وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ فَكَانَ عُمَرُ بْنُ الْخَطَّابِ ؓ يَقُولُ لاَ يَرِثُ الْمُؤْمِنُ الْكَافِرَ قَالَ ابْنُ شِهَابٍ وَكَانُوا يَتَأَوَّلُونَ قَوْلَ اللَّهِ تَعَالَى {إِنَّ الَّذِينَ آمَنُوا وَهَاجَرُوا وَجَاهَدُوا بِأَمْوَالِهِمْ وَأَنْفُسِهِمْ فِي سَبِيلِ اللَّهِ وَالَّذِينَ آوَوْا وَنَصَرُوا أُولَئِكَ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ} الآيَةَ
Will you stay in your house at Mecca (which you abandoned at the time of migration)? Thereupon he said: Has 'Aqil left for as any land or house? And 'Aqil and Talib became the Inheritors of Abu Talib's (property), and neither Ja'far nor 'Ali inherited anything from him, for both (Ja'far and 'Ali) were Muslims whereas 'Aqil and Talib were non-Muslims.

[AI] He said, "O Messenger of Allah, do you descend to your house in Mecca?" He said, "Has anyone left for us any land or property?" And Aqeel inherited from Abu Talib and neither Ali nor Jafar have inherited him because they were both Muslims. "The two sheikhs used this hadith as evidence." It is narrated by them.

[AI] He said, "O Messenger of Allah, do you descend in your house in Mecca?" He replied, "Do we have a cousin from a Dar or a Durr?" He said, "Aqil inherited Abu Talib, him and Talib, and they were not inherited by Ja'far or Ali; because they were Muslims and Aqil and Talib were disbelievers because of that. That is why Umar ibn al-Khattab used to say, 'The believer does not inherit the disbeliever', the words of Abu Amr's hadith."
