20. Penalty for Drinking Intoxicants
٢٠۔ كِتَابُ الْحَدِّ فِي الْخَمْرِ
[Machine] "Stand up, O Hasan, and whip him! And what are you and this (person) for other than yourself?" He said, "Rather, I am weak and feeble, and I am unable." "Stand up, O Abdullah ibn Ja'far, and whip him," he said. So he began to whip him and Ali kept count until it reached forty, then he said, "Hold the whip of the Prophet of Allah ﷺ , Abu Bakr forty (lashes), and complete it eighty with Umar, and each (lash) is a Sunnah."
«قُمْ يَا حَسَنُ فَاجْلِدْهُ وَفِيمَ أَنْتَ وَهَذَا وَلِّ غَيْرُكَ» قَالَ بَلْ ضَعُفْتُ وَوَهَنْتُ وَعَجَزْتُ قُمْ يَا عَبْدَ اللهِ بْنَ جَعْفَرٍ فَاجْلِدْهُ قَالَ فَجَعَلَ يَجْلِدُهُ وَعَلِيٌّ يَعُدُّ حَتَّى بَلَغَ أَرْبَعِينَ فَقَالَ أَمْسِكْ جَلَدَ نَبِيُّ اللهِ ﷺ وَأَبُو بَكْرٍ أَرْبَعِينَ وَكَمَّلَهَا عُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ
“When Walid bin ʿUqbah was brought to ʿUthman, they had testified against him. He said to 'Ali: 'You are close to your uncle's son, so carry out the legal punishment on him.' So 'Ali whipped him. He said: 'The Messenger of Allah ﷺ gave forty lashes, and Abu Bakr gave forty lashes, and 'Umar gave eighty all are Sunnah.'” (Using translation from Ibn Mājah 2571)
قَالَ عَلِيٌّ «جَلَدَ النَّبِيُّ ﷺ أَرْبَعِينَ وَأَبُو بَكْرٍ أَرْبَعِينَ وَعُمَرُ ثَمَانِينَ وَكُلٌّ سُنَّةٌ»
If I carried out the hadd punishment on a man and he died, I would not feel upset, except in the case of khamr; if (such a man) died, I would pay the diyah (to his family) because the Messenger of Allah ﷺ did not prescribe it (did not specify a particular number of lashes). قَالَ عَلِيٌّ مَا مِنْ رَجُلٍ أَقَمْتُ عَلَيْهِ حَدًّا فَمَاتَ فَأَجِدُ فِي نَفْسِي إِلَّا الْخَمْرَ فَإِنَّهُ إِنْ مَاتَ فِيهِ وَدَيْتُهُ أَنَّ رَسُولَ اللهِ ﷺ «لَمْ يَسُنَّهُ»
[Machine] I heard Ali say, "Whoever we establish a limit for and they die as a result of it, they do not have any compensation except for the one we have struck in the matter of alcohol, as it is something we have created."
سَمِعْتُ عَلِيًّا يَقُولُ «مَنْ أَقَمْنَا عَلَيْهِ حَدًّا فَمَاتَ مِنْهُ فَلَا دِيَةَ لَهُ إِلَّا مَنْ ضَرَبْنَاهُ فِي الْخَمْرِ فَإِنَّمَا هُوَ شَيْءٌ صَنَعْنَاهُ»
20.2 [Machine] The variety of words used by narrators to report the story of Qatadah from Anas.
٢٠۔٢ ذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ قَتَادَةَ عَنْ أَنَسٍ
[Machine] That the Messenger of Allah ﷺ once said, "A man was brought to me who had consumed alcohol, so I struck him with two palm branches about forty times."
أَنَّ رَسُولَ اللهِ ﷺ «أُتِيَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَضَرَبَهُ بِجَرِيدَتَيْنِ نَحْوًا مِنْ أَرْبَعِينَ»
[Machine] "The Messenger of Allah ﷺ was presented with a man who had consumed alcohol, so he struck him with two palm branches about forty times."
«أُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ قَدْ شَرِبَ خَمْرًا فَضَرَبَهُ بِجَرِيدَتَيْنِ نَحْوًا مِنْ أَرْبَعِينَ»
The mildest punishment (for drinking) is eighty (stripes) and 'Umar their prescribed this punishment. (Using translation from Muslim 1706a)
أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَجَلَدَهُ بِجَرِيدَتَيْنِ نَحْوًا مِنْ أَرْبَعِينَ وَفَعَلَهُ أَبُو بَكْرٍ فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَخَفُّ الْحُدُودِ ثَمَانُونَ فَأَمَرَ بِهِ عُمَرُ
[Machine] The Messenger of Allah, ﷺ , was brought a man who had consumed alcohol, so he struck him with sandals about forty times. Then Abu Bakr was brought, and he did the same. Then Umar was brought, and he mentioned something similar.
«أُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَضَرَبَهُ بِالنِّعَالِ نَحْوًا مِنْ أَرْبَعِينَ» ثُمَّ أُتِيَ بِهِ أَبُو بَكْرٍ فَصَنَعَ مِثْلَ ذَلِكَ ثُمَّ أُتِيَ عُمَرُ فَذَكَرَ نَحْوَهُ
[Machine] That the Messenger of Allah ﷺ used to whip with a whip made of palm fibers and sandals.
أَنَّ رَسُولَ اللهِ ﷺ «جَلَدَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ»
[Machine] I heard Saib bin Yazid saying, "We were in the time of the Prophet ﷺ , Abu Bakr, and part of Umar's era until some people transgressed in it, meaning in drinking alcohol, so they were beaten forty lashes and they did not repent, so they were beaten eighty [lashes]."
سَمِعْتُ السَّائِبَ بْنَ يَزِيدَ يَقُولُ «كُنَّا فِي زَمَنِ النَّبِيِّ ﷺ وَأَبِي بَكْرٍ وَبَعْضِ زَمَانِ عُمَرَ حَتَّى عَتَوْا فِيهَا يَعْنِي فِي الْخَمْرِ فَجَلَدَهُمْ أَرْبَعِينَ فَلَمْ يَنْكُلُوا فَجَلَدَ ثَمَانِينَ»
We used to strike the drunks with our hands, shoes, clothes (by twisting it into the shape of lashes) during the lifetime of the Prophet, Abu Bakr and the early part of ʿUmar's caliphate. But during the last period of ʿUmar's caliphate, he used to give the drunk forty lashes; and when drunks became mischievous and disobedient, he used to scourge them eighty lashes. «كُنَّا نُؤْتَى بِالشَّارِبِ فِي عَهْدِ رَسُولِ اللهِ ﷺ وَعَهْدِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمَارَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَأَرْدِيَتِنَا وَنِعَالِنَا حَتَّى كَانَ وَسَطَ إِمَارَةِ عُمَرَ فَجَلَدَ فِيهَا أَرْبَعِينَ حَتَّى إِذَا عَتَوْا وَفَسَقُوا جُلِدَ فِيهَا ثَمَانِينَ»
[Machine] "We used to be given the beard during the time of the Messenger of Allah ﷺ , and during the caliphate of Abu Bakr, and a part of the caliphate of Umar. So we would go to him and strike it with our hands, shoes, and garments."
«كُنَّا نُؤْتَى بِالشَّارِبِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَفِي إِمْرَةِ أَبِي بَكْرٍ وَصَدْرًا مِنْ إِمْرَةِ عُمَرَ فَنَقُومُ إِلَيْهِ فَنَضْرِبُهُ بِأَيْدِينَا وَنِعَالِنَا وَأَرْدِيَتِنَا»
[Machine] I saw the Messenger of Allah ﷺ on the day of Hunayn asking about the whereabouts of Khalid, so they brought a drunken man. The Messenger of Allah ﷺ ordered those who were with him to strike him with what was in their hands, and the Messenger of Allah ﷺ threw dust on him. When Abu Bakr was brought a drunken man was brought, he refrained from striking him as he had been struck that day, so he only struck him forty times.
رَأَيْتُ رَسُولَ اللهِ ﷺ يَوْمَ حُنَيْنٍ يَسْأَلُ عَنْ مَنْزِلِ خَالِدٍ فَأُتِيَ بِسَكْرَانَ «فَأَمَرَ رَسُولُ اللهِ ﷺ مَنْ كَانَ عِنْدَهُ أَنْ يَضْرِبُوهُ بِمَا فِي أَيْدِيهِمْ وَحَثَا رَسُولُ اللهِ ﷺ التُّرَابَ عَلَيْهِ فَلَمَّا كَانَ أَبُو بَكْرٍ أُتِيَ بِسَكْرَانَ فَتَوَخَّى الَّذِي كَانَ مِنْ ضَرْبِهِمْ يَوْمَئِذٍ فَضَرَبَ أَرْبَعِينَ»
[Machine] He ﷺ attended when the Messenger of Allah ﷺ was wiping the dust off their faces.
أَنَّهُ «حَضَرَ رَسُولَ اللهِ ﷺ حِينَ كَانَ يَحْثِي فِي وُجُوهِهِمُ التُّرَابَ»
[Machine] The Messenger of Allah ﷺ was brought a prisoner on the day of Hunayn. He had dust on his face, so his companions struck him with their sandals and whatever they had in their hands, until he said to them, "Stop." They stopped and the Messenger of Allah ﷺ passed away. This is the tradition, as reported by Abu Abdullah Al-Rahman. And this is more correct than what came before.
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِشَارِبٍ يَوْمَ حُنَيْنٍ فَحَثَى فِي وَجْهِهِ التُّرَابَ ثُمَّ أَمَرَ أَصْحَابَهُ فَضَرَبُوهُ بِنِعَالِهِمْ وَبِمَا كَانَ فِي أَيْدِيهِمْ حَتَّى قَالَ لَهُمْ «ارْفَعُوا» فَرَفَعُوا فَتُوُفِّيَ رَسُولُ اللهِ ﷺ وَتِلْكَ سُنَّةٌ قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَهَذَا أَوْلَى بِالصَّوَابِ مِنَ الَّذِي قَبْلَهُ
[Machine] The Messenger of Allah ﷺ was brought a drunken man, and he said, "Strike him." So they struck him with their sandals.
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ سَكْرَانَ فَقَالَ «اضْرِبُوهُ فَضَرَبُوهُ بِنِعَالِهِمْ»
[Machine] "The Messenger of Allah ﷺ said, 'Stand up and strike him.' So the people stood up and struck him with their sandals."
رَسُولُ اللهِ ﷺ «قُومُوا إِلَيْهِ فَاضْرِبُوهُ» فَقَامَ النَّاسُ فَضَرَبُوهُ بِنِعَالِهِمْ
[Machine] The Prophet ﷺ was handed a prisoner on the day of Hunayn, so the Messenger of Allah ﷺ said, "Stand up and strike him." So the people stood up and struck him with their sandals.
أُتِيَ النَّبِيُّ ﷺ بِشَارِبٍ يَوْمَ حُنَيْنٍ فَقَالَ رَسُولُ اللهِ ﷺ «قُومُوا فَاضْرِبُوهُ» فَقَامَ النَّاسُ فَضَرَبُوهُ بِنِعَالِهِمْ
When a man who had drunk wine was brought to the Messenger of Allah ﷺ, he said: Beat him. Abu Hurairah said: Some struck him with their hands, some with their garment. When he turned his face, some people said: Allah put you shame! The Messenger of Allah ﷺ said: Do not say like that and help the devil to get power over him. (Using translation from Abū Dāʾūd 4477)
أَبُو هُرَيْرَةَ إِنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ قَدْ شَرِبَ فَقَالَ رَسُولُ اللهِ ﷺ «اضْرِبُوهُ» فَمِنَّا الضَّارِبُ بِيَدِهِ وَالضَّارِبُ بِنَعْلِهِ وَالضَّارِبُ بِثَوْبِهِ فَلَمَّا انْصَرَفَ قَالَ بَعْضُ الْقَوْمِ أَخْزَاكَ اللهُ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقُولُوا هَكَذَا لَا تُعِينُوا عَلَيْهِ الشَّيْطَانَ وَلَكِنْ قُولُوا رَحِمَكَ اللهُ»
[Machine] That the drinkers used to be beaten during the time of the Messenger of Allah ﷺ with hands, shoes, and sticks until the Messenger of Allah ﷺ died. And they were more in number during the caliphate of Abu Bakr than during the time of the Messenger of Allah ﷺ . Abu Bakr said, "If we set a punishment for them, it should be similar to what they used to be beaten during the time of the Messenger of Allah ﷺ ." So Abu Bakr used to flog them forty times until he died, and Umar, after him, also flogged them forty times until a man from the early Migrants who had consumed alcohol was brought to him, and he ordered him to be flogged. The man said, "Why don't you flog me when there is the Book of Allah between you and me?" Umar said, "Which verses of the Book of Allah do you find that I shouldn't flog you?" The man said to him, "Verily, Allah said in His Book, 'There is no sin upon those who believe and do righteous deeds for what they have consumed'." Umar said, "I am one of those who believe and do righteous deeds, then repent, believe again, then repent, and do good." I witnessed Badr, Uhud, the Trench, and the Conquest of Mecca with the Messenger of Allah ﷺ ." Umar said, "Why don't you respond to what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who came before, and as evidence against those who came after. The excuse for those who came before is that they met Allah before alcohol was prohibited for them, and it is evidence against those who came after, because Allah said, 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan.' Then he also recited another verse, 'Indeed, those who believe and do righteous deeds and establish prayer and give zakah will have their reward with their Lord, and there will be no fear concerning them, nor will they grieve.' So if he is from those who believe and do righteous deeds, and establish prayer and give zakah, then Allah has forbidden him from drinking alcohol." Umar said, "You have spoken the truth, so what do you all think?" Ali said, "Indeed, when he drinks, he becomes intoxicated, and when he is intoxicated, he fabricates lies, and upon the fabricator are eighty lashes." So Umar ordered him to be flogged eighty times.
أَنَّ الشُّرَّابَ كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ بِالْأَيْدِي وَالنِّعَالِ وَالْعِصِيِّ حَتَّى تُوُفِّيَ رَسُولُ اللهِ ﷺ وَكَانُوا فِي خِلَافَةِ أَبِي بَكْرٍ أَكْثَرَ مِنْهُمْ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَقَالَ أَبُو بَكْرٍ لَوْ فَرَضْنَا لَهُمْ حَدًّا فَتَوَخَّى نَحْوَ مَا كَانُوا يُضْرَبُونَ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَكَانَ أَبُو بَكْرٍ يَجْلِدُهُمْ أَرْبَعِينَ حَتَّى تُوُفِّيَ ثُمَّ كَانَ عُمَرُ بَعْدُ فَجَلَدَهُمْ كَذَلِكَ أَرْبَعِينَ حَتَّى أُتِيَ بِرَجُلٍ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ قَدْ شَرِبَ فَأَمَرَ بِهِ أَنْ يُجْلَدَ فَقَالَ لَمْ تَجْلِدْنِي بَيْنِي وَبَيْنَكَ كِتَابُ اللهِ قَالَ عُمَرُ وَأَيُّ كِتَابِ اللهِ تَجِدُ أَنْ لَا أَجْلِدَكَ؟ قَالَ لَهُ إِنَّ اللهَ يَقُولُ فِي كِتَابِهِ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا} [المائدة 93] الْآيَةَ فَأَنَا مِنَ الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا شَهِدْتُ مَعَ رَسُولِ اللهِ ﷺ بَدْرًا وَأُحُدًا وَالْخَنْدَقَ وَالْمَشَاهِدَ فَقَالَ عُمَرُ أَلَا تَرُدُّونَ عَلَيْهِ مَا يَقُولُ؟ فَقَالَ ابْنُ عَبَّاسٍ إِنَّ هَؤُلَاءِ الْآيَاتِ أُنْزِلْنَ عُذْرًا لِلْمَاضِينَ وَحُجَّةً عَلَى الْبَاقِينَ فَعُذْرُ الْمَاضِينَ بِأَنَّهُمْ لَقُوا اللهَ قَبْلَ أَنْ تُحَرَّمَ عَلَيْهِمُ الْخَمْرُ وَحُجَّةٌ عَلَى الْبَاقِينَ؛ لِأَنَّ اللهَ يَقُولُ {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ} [المائدة 90] الْآيَةَ ثُمَّ قَرَأَ أَيْضًا الْآيَةَ الْأُخْرَى فَإِنْ كَانَ مِنَ {الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ ثُمَّ اتَّقَوْا وَآمَنُوا ثُمَّ اتَّقَوْا وَأَحْسَنُوا} فَإِنَّ اللهَ قَدْ نَهَاهُ أَنْ يَشْرَبَ الْخَمْرَ فَقَالَ عُمَرُ صَدَقْتَ فَمَا تَرَوْنَ؟ فَقَالَ عَلِيٌّ إِنَّهُ إِذَا شَرِبَ سَكِرَ وَإِذَا سَكِرَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى وَعَلَى الْمُفْتَرِي ثَمَانُونَ جَلْدَةً فَأَمَرَ عُمَرُ فَجُلِدَ ثَمَانِينَ
20.3 [Machine] The establishment of the limit on those who drink alcohol based on interpretation
٢٠۔٣ إِقَامَةُ الْحَدِّ عَلَى مَنْ شَرِبَ الْخَمْرَ عَلَى التَّأْوِيلِ
[Machine] "For Allah says, 'There is no sin upon those who believe and do righteous deeds for what they have eaten when they feared Allah and believed and did good deeds.' (Al-Ma'idah 93) And I am one of them, that is, from the early emigrants and from the people of Badr and Uhud. So he said to the people, 'Answer the man.' And they remained silent. Then he said to Ibn Abbas, 'Answer him.' So he said, 'Verily, it was only revealed as an excuse for those who drank it before it was prohibited.' And He revealed, 'Indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan, so avoid it.' (Al-Ma'idah 90) It is a proof against the rest. Then he asked the one who was with him about the punishment for it, so Ali ibn Abi Talib said, 'If a person drinks this, then he invents [a lie], so flog him eighty lashes.'"
لَأَنَّ اللهَ يَقُولُ {لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا إِذَا مَا اتَّقَوْا وَآمَنُوا وَعَمِلُوا الصَّالِحَاتِ} [المائدة 93] وَأَنَا مِنْهُمْ أَيْ مِنَ الْمُهَاجِرِينِ الْأَوَّلِينَ وَمِنْ أَهْلِ بَدْرٍ وَأَهْلِ أُحُدٍ فَقَالَ لِلْقَوْمِ أَجِيبُوا الرَّجُلَ فَسَكَتُوا فَقَالَ لِابْنِ عَبَّاسٍ أَجِبْهُ فَقَالَ إِنَّمَا أَنْزَلَهَا عُذْرًا لِمَنْ شَرِبَهَا مِنَ الْمَاضِينَ قَبْلَ أَنْ تُحَرَّمَ وَأَنْزَلَ {إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ} [المائدة 90] مِنْ عَمَلِ الشَّيْطَانِ حُجَّةٌ عَلَى الْبَاقِينَ ثُمَّ سَأَلَ مَنْ عِنْدَهُ عَنِ الْحَدِّ فِيهَا فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ إِنَّهُ إِذَا شَرِبَ هَذِيَ وَإِذَا هَذِيَ افْتَرَى فَاجْلِدُوهُ ثَمَانِينَ
The Prophet ﷺ did not prescribe any punishment for drinking wine. Ibn Abbas said: A man who had drunk wine and become intoxicated was found staggering on the road, so he was taken to the Prophet ﷺ. When he was opposite al-Abbas's house, he escaped, and going in to al-Abbas, he grasped hold of him. When that was mentioned to the Prophet ﷺ, he laughed and said: Did he do that? and he gave no command regarding him. Abu Dawud said: This tradition of al-Hasan b. 'Ali has been transmitted only by the people of Medina. (Using translation from Abū Dāʾūd 4476)

أَنَّ النَّبِيَّ ﷺ لَمْ يُوَقِّتْ فِي الْخَمْرِ حَدًّا فَقَالَ ابْنُ عَبَّاسٍ شَرِبَ رَجُلٌ فَسَكِرَ فَلُقِيَ يَمِيلُ فِي فَجٍّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ ﷺ فَلَمَّا أَنْ حَاذَوْا بِهِ دَارَ الْعَبَّاسِ انْفَلَتَ فَدَخَلَ عَلَى عَبَّاسٍ فَالْتَزَمَهُ مِنْ وَرَائِهِ فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ وَقَالَ أَقَدْ فَعَلَهَا ثُمَّ لَمْ يَأْمُرْ فِيهِ بِشَيْءٍ
20.4 [Machine] The establishment of limits on the drinking of wine
٢٠۔٤ إِقَامَةُ الْحَدِّ عَلَى النَّشْوَانِ مِنَ النَّبِيذِ
[Machine] The Prophet ﷺ was brought a man who appeared drunk. The man said, "I have not drunk wine; I only ate raisins and dates in Dubba'." The Prophet ﷺ shook him by his hands, slapped him with his sandals, and forbade him from mixing raisins and dates.
أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ نَشْوَانَ فَقَالَ إِنِّي لَمْ أَشْرَبْ خَمْرًا إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا فِي دُبَّاءٍ قَالَ «فَبُهِزَ بِالْأَيْدِي وَخُفِقَ بِالنِّعَالِ وَنَهَى عَنِ الزَّبِيبِ وَالتَّمْرِ أَنْ يُخْلَطَا»
[Machine] A man was hit here during the time of the Prophet Muhammad, ﷺ , with shoes on his back forty times.
«ضُرِبَ هُنَا رَجُلٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي الشَّرَابِ بِالنَّعْلَيْنِ أَرْبَعِينَ»
[Machine] The Prophet ﷺ was brought a drunk man and he hit him. Then he asked him, "What did you drink?" He answered, "Wine." The Prophet asked, "What kind of wine?" He answered, "Date wine mixed with raisins." The Prophet said, "Do not mix them, each one is enough on its own."
أُتِيَ النَّبِيُّ ﷺ بِرَجُلٍ سَكْرَانَ فَضَرَبَهُ فَقَالَ لَهُ «أَيُّ شَيْءٍ شَرِبْتَ؟» قَالَ نَبِيذٌ قَالَ «أَيُّ نَبِيذٍ» قَالَ نَبِيذُ تَمْرٍ وَزَبِيبٍ قَالَ «لَا تَخْلِطُوهَا كُلُّ وَاحِدٍ يَكْفِي وَحْدَهُ»
20.5 [Machine] Imposing a limit on the drunkard before they wake up.
٢٠۔٥ إِقَامَةُ الْحَدِّ عَلَى السَّكْرَانِ قَبْلَ أَنْ يُفِيقَ
[Machine] Al-Nu'man was brought while he was intoxicated, and he caused great difficulty for the Prophet ﷺ . So the people in the house were ordered to strike him, and they struck him with sandals and twigs. And I was one of those who struck him.
أُتِيَ بِالنُّعْمَانِ وَهُوَ سَكْرَانُ فَشَقَّ عَلَى النَّبِيِّ ﷺ مَشَقَّةً شَدِيدَةً «فَأَمَرَ مَنْ كَانَ فِي الْبَيْتِ أَنْ يَضْرِبُوهُ فَضَرَبُوهُ بِالنِّعَالِ وَالْجَرِيدِ فَكُنْتُ فِيمَنْ ضَرَبَهُ»
20.6 [Machine] The ruling on someone who drinks alcohol consecutively
٢٠۔٦ الْحُكْمُ فِيمَنْ يَتَتَابَعُ فِي شُرْبِ الْخَمْرِ
[Machine] The Prophet ﷺ said, "Whoever drinks alcohol, flog him. And if he drinks again, flog him. And if he drinks again, flog him. And if he drinks for the fourth time and mentions a word with a certain meaning, then kill him." 'Asim ibn Bahdalah disagreed with this.
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فَاجْلِدُوهُ ثُمَّ إِذَا شَرِبَ فِي الرَّابِعَةِ وَذَكَرَ كَلِمَةً مَعْنَاهَا فَاقْتُلُوهُ» خَالَفَهُ عَاصِمُ بْنُ بَهْدَلَةَ
“If he gets drunk, then whip him. If he does it again, then whip him. If he does it again, then whip him.' And he said concerning the fourth time: 'If he does it again, then strike his neck (i.e., execute him).' ” (Using translation from Ibn Mājah 2572)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فِي الرَّابِعَةِ فَاضْرِبُوا عُنُقَهُ»
[Machine] I heard the Messenger of Allah ﷺ say, "Whoever drinks alcohol, then whip him. If he repeats, then whip him. If he repeats for the third time, then strike his neck (i.e. kill him).
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فِي الرَّابِعَةِ فَاضْرِبُوا عُنُقَهُ»
[Machine] I heard the Messenger of Allah, ﷺ , say, "If someone drinks alcohol, flog him. If he does it again, flog him. If he does it again, flog him. And if he does it a fourth time, then kill him." And this wording is from 'Amr.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ فَاجْلِدُوهُ ثُمَّ إِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ» وَاللَّفْظُ لِعَمْرٍو
"The Messenger of Allah [SAW] said: 'Whoever drinks Khamr, whip him; then if he drinks (again), whip him; then if he drinks (again), whip him; then if he drinks (again), kill him.'" (Using translation from Nasāʾī 5661)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاقْتُلُوهُ»
"The Messenger of Allah [SAW] said: 'Whoever drinks Khamr, whip him; then if he drinks (again), whip him; then if he drinks (again), whip him; then if he drinks (again), kill him.'" (Using translation from Nasāʾī 5661)
قَالَ رَسُولُ اللهِ ﷺ «إِذَا شَرِبَ الْخَمْرَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ ثُمَّ إِنْ شَرِبَ فَاقْتُلُوهُ»
20.7 [Machine] Copying of Murder
٢٠۔٧ نَسْخُ الْقَتْلِ
[Machine] "If a man drinks, then flog him, and if he repeats it, flog him again, and if he does it a third time, then kill him." So, a man from among us was brought to the Messenger of Allah ﷺ, but he was not killed.
«إِذَا شَرِبَ الرَّجُلُ فَاجْلِدُوهُ فَإِنْ عَادَ فَاجْلِدُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ» فَأُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ مِنَّا فَلَمْ يَقْتُلْهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever drinks alcohol, strike him; then if he does it again, strike him; then if he does it again, strike him. If he does it a fourth time, then kill him." The Messenger of Allah ﷺ struck Nu'ayman four times, and the Muslims saw that the punishment had been implemented and that the killing had been lifted.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ شَرِبَ الْخَمْرَ فَاضْرِبُوهُ فَإِنْ عَادَ فَاضْرِبُوهُ فَإِنْ عَادَ فَاضْرِبُوهُ فَإِنْ عَادَ الرَّابِعَةَ فَاضْرِبُوا عُنُقَهُ» فَضَرَبَ رَسُولُ اللهِ ﷺ نُعَيْمَانَ أَرْبَعَ مَرَّاتٍ فَرَأَى الْمُسْلِمُونَ أَنَّ الْحَدَّ قَدْ وَقَعَ وَأَنَّ الْقَتْلَ قَدْ رُفِعَ
