[Machine] That the drinkers used to be beaten during the time of the Messenger of Allah ﷺ with hands, shoes, and sticks until the Messenger of Allah ﷺ died. And they were more in number during the caliphate of Abu Bakr than during the time of the Messenger of Allah ﷺ . Abu Bakr said, "If we set a punishment for them, it should be similar to what they used to be beaten during the time of the Messenger of Allah ﷺ ." So Abu Bakr used to flog them forty times until he died, and Umar, after him, also flogged them forty times until a man from the early Migrants who had consumed alcohol was brought to him, and he ordered him to be flogged. The man said, "Why don't you flog me when there is the Book of Allah between you and me?" Umar said, "Which verses of the Book of Allah do you find that I shouldn't flog you?" The man said to him, "Verily, Allah said in His Book, 'There is no sin upon those who believe and do righteous deeds for what they have consumed'." Umar said, "I am one of those who believe and do righteous deeds, then repent, believe again, then repent, and do good." I witnessed Badr, Uhud, the Trench, and the Conquest of Mecca with the Messenger of Allah ﷺ ." Umar said, "Why don't you respond to what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who came before, and as evidence against those who came after. The excuse for those who came before is that they met Allah before alcohol was prohibited for them, and it is evidence against those who came after, because Allah said, 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan.' Then he also recited another verse, 'Indeed, those who believe and do righteous deeds and establish prayer and give zakah will have their reward with their Lord, and there will be no fear concerning them, nor will they grieve.' So if he is from those who believe and do righteous deeds, and establish prayer and give zakah, then Allah has forbidden him from drinking alcohol." Umar said, "You have spoken the truth, so what do you all think?" Ali said, "Indeed, when he drinks, he becomes intoxicated, and when he is intoxicated, he fabricates lies, and upon the fabricator are eighty lashes." So Umar ordered him to be flogged eighty times.

Abu Bakr said, "If we appoint a punishment for them, it should be milder than what they used to be struck with during the time of the Messenger of Allah ﷺ." So Abu Bakr flogged them forty lashes until they died. Then Umar succeeded him and flogged them likewise until a man from the early emigrants came, and he had drunk. Umar ordered that he should be flogged, so the man asked, "Why are you flogging me while the Book of Allah ﷻ is between me and you?" Umar asked, "In which verse of the Book of Allah do you find that I should not flog you?" The man replied, "Indeed, Allah ﷻ says in His book: 'There is no sin upon those who believe and do righteous deeds for what they have eaten' (Al-Ma'idah 5:93). I am among those who believe and do righteous deeds, then fear and believe, then fear and do good. I accompanied the Messenger of Allah ﷺ in Badr, Hudaybiyyah, and the Battle of the Trench." Umar asked, "Don't you respond to what he says?" Ibn Abbas said, "These verses were revealed as an excuse for those who passed away, and as an argument against those who remained. Allah ﷻ says: 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan' (Al-Ma'idah 5:90). Then he recited until he reached the other verse: 'There is no sin upon those who believe and do righteous deeds for what they have eaten when they fear Allah and believe and do righteous deeds, then fear Allah and believe, then fear Allah and do good' (Al-Ma'idah 5:93). Indeed, Allah ﷻ has forbidden the consumption of alcohol." Umar said, "You have spoken the truth. What do you all think?" Ali said, "We believe that if he drinks, he becomes intoxicated, and if he is intoxicated, he raves, and if he raves, he fabricates, and for the fabricator, there are eighty lashes." Abu Bakr said, 'If we imposed this punishment on them, it would exceed what they were beaten during the time of the Messenger of Allah ﷺ .' So Abu Bakr whipped them forty times until they died. Then it happened in the time of Umar after them, and he whipped them likewise forty times until a man from the early emigrants came and drank. Umar ordered that he be whipped, and he said, 'Why are you whipping me? Between me and you is the Book of Allah.' Umar asked him, 'In which verse of the Book of Allah do you find that I should not whip you?' He said, 'Indeed, Allah the Almighty says in His Book, "There is no sin upon those who believe and do righteous deeds for what they have eaten" (Surah Al-Ma'idah, 5:93). I am a witness with the Messenger of Allah ﷺ at Badr, Uhud, the Trench, and the Marites.'" Umair said: "Why don't you respond to what he is saying?" Ibn Abbas said: "These verses were revealed as an excuse for those before and a proof against those who come after. It was an excuse for those before because they met Allah before prohibition was imposed upon them, and it was a proof against those who come after because Allah the Almighty says, 'O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan' (Surah Al-Ma'idah, 5:90). If it is from those who believe and do righteous deeds and they fear Allah and excel in good, then indeed Allah has forbidden them from drinking intoxicants." Umair said: "So what do you see?" Ali ibn Abi Talib said: "We see that if he drinks and becomes intoxicated, he is lashed. And if he is intoxicated and behaves foolishly, he is beaten. And the one who behaves foolishly is penalized with eighty lashes. So Umar ordered that he be whipped eighty times." 17544 This was narrated to us by Ali ibn Abi Abdullah Al-Hafiz, narrated to us by Abdullah ibn Ja'far Al-Farisi, narrated to us by Ya'qub ibn Sufyan, narrated to us by Sa'id ibn Kathir ibn 'Ufair, who narrated to me Yahya ibn Fuleih, from Thawr ibn Zaid, from Ikrimah, from Ibn Abbas, that they used to beat the drinkers during the time of the Messenger of Allah ﷺ with their hands, sandals, and sticks until the Messenger of Allah ﷺ passed away. Then he mentioned the hadith in detail."

"عَنِ ابنِ عَبَّاسٍ: أن الشُّرَّابَ كَانوا يُضرَبونَ في عَهْدِ رَسولِ اللهِ ﷺ بالأيَدْى والنَّعالِ والعِصِّي حتَّى تُوفِّى رَسُول اللهِ ﷺ فَكانُوا فِى خِلافَةِ أبِى بَكْرٍ أكثَر مِنْهم فِى عَهْد رسولِ اللهِ ﷺ ، فَقَالَ أَبو بَكْرٍ: لَو فَرَضْنَا لَهُم حَدّا، فَتَوفَّى نَحوًا ممَّا كَانُوا يُضْرَبون فِى عَهد رسولِ اللهِ ﷺ ، فَكانَ أبو بَكْرٍ يَجْلِدُهم أرْبعِين حتَّى تُوفِّى ثمِ كَانَ عُمَرُ مِن بعَدهِ فَجلَدهُم كَذَلِكَ أَرْبَعين حتَّى أُتِىَ برجُل مِن المُهاجِرينَ الأوَّلِينَ قَدْ شرِبَ فَأمر به أَنْ يُجْلدَ، فَقَالَ: لِمَ تَجْلِدنى؟ بَيْنِى وَبْينَكَ كِتابُ الله، فَقَالَ عُمَرُ: وفى أى كتابِ اللهِ تَجدُ أن لا أَجْلِدَكَ؟ فَقَالَ لَهُ: إن الله يَقولُ في كتابهِ: {لَيْسَ عَلَى الَّذِينَ آمَنُوا

وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ} (*) الآية. فَأنَا مِن الذَّين آمَنُوا وَعَمِلُوا الصَّالِحاتِ ثَّم اتَّقَوا وآمَنُوا، ثَّم اتَقَوْا وَأَحْسَنُوا، شَهِدتُ مَعَ رسولِ الله ﷺ بَدْرًا وأُحُدًا وَالخندَقَ وَالمَشَاهِدَ، فَقالَ عُمَر: أَلا تَرُدونَ عَلَيْه مَا يقُولُ؟ ، فَقَالَ ابنُ عَبَّاسِ: إنَّ هذِه الآية أُنزِلَتْ عُذْرًا للمَاضين وحُجَّةً عَلَى البَاقِينَ، فَعُذرُ المَاضِين أَنَهم لَقُوا الله قَبْلَ أَنْ تحرّم عليهم الخَمْرُ، وَحُجّةٌ عَلَى البَاقِينَ لأنَّ الله تَعالى يَقُول: {يَاأَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ} (* *) ... الآية ثَّم قَرَأَ حَتى أَنَفَد الآيةَ، فإنْ كَانَ مِنَ الَّذين آمَنُوا وَعِملُوا الصَّالحات ثم اتَّقَوا وآمنوا ثم اتَقَوا وَأحْسنوا. فإنَّ الله قَد نَهَى أَنْ يُشْربَ الخَمْرُ، فقال: صَدَقْتَ، فَما تَرَونَ؟ قَالَ عَلىٌّ: نَرَى أَنَّه إذَا شَرِبَ سَكِرَ، وإذَا سَكِرَ هَذَى، وَإذا هَذَى افْتَرى، وعَلى المُفْترِى ثَمانونَ جلدَةً، فَأمَر عُمَرُ فجُلِدَ ثَمانينَ".
