An ally of Bani Zuhra who took part in the battle of Badr with the Prophet, that he said, "O Allah's Apostle! If I meet an unbeliever and we have a fight, and he strikes my hand with the sword and cuts it off, and then takes refuge from me under a tree, and says, 'I have surrendered to Allah (i.e. embraced Islam),' may I kill him after he has said so?" Messenger of Allah ﷺ said, "Do not kill him." Al- Miqdad said, "But O Messenger of Allah ﷺ! He had chopped off one of my hands and he said that after he had cut it off. May I kill him?" The Prophet ﷺ said. "Do not kill him for if you kill him, he would be in the position in which you had been before you kill him, and you would be in the position in which he was before he said the sentence." The Prophet ﷺ also said to Al-Miqdad, "If a faithful believer conceals his faith (Islam) from the disbelievers, and then when he declares his Islam, you kill him, (you will be sinful). Remember that you were also concealing your faith (Islam) at Mecca before."

وَكَانَ شَهِدَ بَدْرًا مَعَ النَّبِيِّ ﷺ أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ إِنْ لَقِيتُ كَافِرًا فَاقْتَتَلْنَا فَضَرَبَ يَدِي بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لاَذَ بِشَجَرَةٍ وَقَالَ أَسْلَمْتُ لِلَّهِ آقْتُلُهُ بَعْدَ أَنْ قَالَهَا قَالَ رَسُولُ اللَّهِ ﷺ لاَ تَقْتُلْهُ قَالَ يَا رَسُولَ اللَّهِ فَإِنَّهُ طَرَحَ إِحْدَى يَدَىَّ ثُمَّ قَالَ بَعْدَ مَا قَطَعَهَا آقْتُلُهُ قَالَ لاَ تَقْتُلْهُ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَأَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ وَقَالَ حَبِيبُ بْنُ أَبِي عَمْرَةَ عَنْ سَعِيدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ النَّبِيُّ ﷺ لِلْمِقْدَادِ إِذَا كَانَ رَجُلٌ مُؤْمِنٌ يُخْفِي إِيمَانَهُ مَعَ قَوْمٍ كُفَّارٍ فَأَظْهَرَ إِيمَانَهُ فَقَتَلْتَهُ فَكَذَلِكَ كُنْتَ أَنْتَ تُخْفِي إِيمَانَكَ بِمَكَّةَ مِنْ قَبْلُ

That Al-Miqdad bin ʿAmr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Messenger of Allah ﷺ told him that he said to Messenger of Allah ﷺ, "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Messenger of Allah ﷺ, after he had said this?" Messenger of Allah ﷺ said, "You should not kill him." Al- Miqdad said, "O Messenger of Allah ﷺ! But he had cut off one of my two hands, and then he had uttered those words?" Messenger of Allah ﷺ replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words."

If I encountered a person amongst the infidels (in the battlefield) and he attacked me and struck me and cut off one of my hands with the sword. Then he (in order to protect himself from me) took shelter of a tree and said: I become Muslim for Allah's sake. Messenger of Allah, can I kill him after he had uttered this? The Messenger of Allah ﷺ said: Do not kill him. I (the narrator) said: Messenger of Allah, he cut off my hand and uttered this after amputating it; should I then kill him? The Messenger of Allah ﷺ said: Don't kill him, for I you kill him, verily he would be in a position where you had been before killing him and verily you would be in a position where he had been before uttering (kalima).

Al Miqdad bin Al Aswad reported that he said “Apostle of Allaah ﷺ tell me if I meet a man who is a disbeliever and he fights with me and cuts off one hand of mine with the sword and then takes refuge by a tree and says “I embraced Islam for Allah’s sake. Should I kill him, Apostle of Allaah ﷺ after he uttered it (the credo of Islam)? The Apostle of Allaah ﷺ said “Do not kill him”. I said “Apostle of Allaah ﷺ, he cut off my hand. The Apostle of Allaah ﷺ said, Do not kill him. I f you kill him, he will become like you before you kill him and you will become like him before he uttered his credo which he has uttered now.

الطبراني:١٧٧٨٣حَدَّثَنَا بَكْرُ بْنُ سَهْلٍ ثنا شُعَيْبُ بْنُ يَحْيَى أَنَا اللَّيْثُ ح وَحَدَّثَنَا مُطَّلِبُ بْنُ شُعَيْبٍ الْأَزْدِيُّ ثنا عَبْدُ اللهِ بْنُ صَالِحٍ حَدَّثَنِي اللَّيْثُ حَدَّثَنِي ابْنُ شِهَابٍ عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ عَنْ عُبَيْدِ اللهِ بْنِ عَدِيِّ بْنِ الْخِيَارِ عَنِ الْمِقْدَادِ

أَنَّهُ أَخْبَرَهُ أَنَّهُ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَنِي ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ قَالَ أَسْلَمْتُ لِلَّهِ أَفَأَقْتُلُهُ يَا رَسُولَ اللهِ بَعْدَ أَنْ قَالَهَا؟ قَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ» فَقُلْتُ يَا رَسُولَ اللهِ إِنَّهُ قَطَعَ يَدِي ثُمَّ قَالَ ذَلِكَ بَعْدَ أَنْ قَطَعَهَا أَقْتُلُهُ؟ قَالَ «لَا تَقْتُلْهُ» فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَأَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ تَقُولَ الْكَلِمَةَ الَّتِي قَالَهَا

[Machine] Al-Miqdad said to the Prophet ﷺ, "O Prophet of Allah, what do you think if I meet a disbeliever who fights me and strikes one of my hands with a sword, causing it to be severed, then he seeks refuge from me behind a tree and says, 'I have submitted to Allah (become Muslim).' Should I kill him after he has said, 'O Prophet of Allah?' He replied, 'Do not kill him.' He asked, 'But he cut off my hand and said that after doing so?' The Prophet ﷺ said, 'Do not kill him, for if you kill him, then you will be in the same position as he was before he said the statement, and you were in the same position as he was before he said it.'"

الْمِقْدَادُ لِلنَّبِيِّ ﷺ يَا نَبِيَّ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ وَقَالَ أَسْلَمْتُ لِلَّهِ أَفَأَقْتُلُهُ بَعْدَ أَنْ قَالَهَا يَا نَبِيَّ اللهِ؟ قَالَ «لَا تَقْتُلْهُ» قَالَ إِنَّهُ قَطَعَ يَدِي ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا؟ قَالَ نَبِيُّ اللهِ ﷺ «لَا تَقْتُلْهُ فَإِنَّكَ» إِنْ قَتَلْتَهُ كَانَ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَكُنْتَ أَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ

That Al-Miqdad bin ʿAmr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Messenger of Allah ﷺ told him that he said to Messenger of Allah ﷺ, "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Messenger of Allah ﷺ, after he had said this?" Messenger of Allah ﷺ said, "You should not kill him." Al- Miqdad said, "O Messenger of Allah ﷺ! But he had cut off one of my two hands, and then he had uttered those words?" Messenger of Allah ﷺ replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words." [Machine] "O Messenger of Allah ﷺ , what if I should encounter a disbeliever who wants to fight me and he strikes one of my hands and cuts it off, and then he seeks refuge from me behind a tree and says, 'I have embraced Islam, would I be allowed to kill him, O Messenger of Allah?'. The Messenger of Allah ﷺ said, 'Do not kill him.' He said, 'O Messenger of Allah, he has cut off one of my hands and said that after cutting it off'. The Messenger of Allah ﷺ said, 'If you were to kill him, then you would be in his position before he said the statement that he said, and you would be in the position that you were in before you killed him.'"

يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ قَالَ أَسْلَمْتُ لِلَّهِ أَقْتُلَهُ يَا رَسُولَ اللهِ؟ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ» قَالَ يَا رَسُولَ اللهِ إِنَّهُ قَطَعَ إِحْدَى يَدَيَّ ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا قَالَ رَسُولُ اللهِ ﷺ «فَإِنْ قَتَلْتَهُ فَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ وَهُوَ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ»

[Machine] He informed him that he said, "O Messenger of Allah, what if I encounter a polytheist and he attacks me, hitting one of my hands and cutting it off, and then he seeks refuge from me in a tree and says, 'I have embraced Islam. Will I be allowed to kill him after he says this?' The Messenger of Allah, ﷺ , said, 'Do not kill him after he says that.' The man said, 'O Messenger of Allah, he has already cut off one of my hands and then said this.' The Messenger of Allah, ﷺ , said, 'If you kill him, you will be equal to his status before he said those words, and you will be in the same position as him before he said his statement.'"

أَخْبَرَهُ أَنَّهُ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْمُشْرِكِينَ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ وَقَالَ أَسْلَمْتُ لِلَّهِ أَقْتُلُهُ بَعْدَ أَنْ قَالَهَا؟ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ بَعْدَ أَنْ قَالَهَا» قَالَ يَا رَسُولَ اللهِ إِنَّهُ قَطَعَ إِحْدَى يَدَيَّ ثُمَّ قَالَ ذَلِكَ بَعْدَ أَنْ قَطَعَهَا فَقَالَ رَسُولُ اللهِ ﷺ «إِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ»

[Machine] He informed him that Al-Miqdad bin Amr was an ally of Banu Zuhrah and was one of those who witnessed the Battle of Badr with the Messenger of Allah ﷺ . He told him that he said, "O Messenger of Allah, what do you think if I meet a disbeliever and we fight, and I strike one of my hands with a sword and cut it off, then I take shelter behind a tree and say, 'I have surrendered to Allah, O Messenger of Allah, should I kill him after saying that?' The Messenger of Allah ﷺ said, 'Do not kill him, for if you kill him, then he will be in the same position as you were before killing him, and you will be in the same position as he was before saying what he said.'"

If I encountered a person amongst the infidels (in the battlefield) and he attacked me and struck me and cut off one of my hands with the sword. Then he (in order to protect himself from me) took shelter of a tree and said: I become Muslim for Allah's sake. Messenger of Allah, can I kill him after he had uttered this? The Messenger of Allah ﷺ said: Do not kill him. I (the narrator) said: Messenger of Allah, he cut off my hand and uttered this after amputating it; should I then kill him? The Messenger of Allah ﷺ said: Don't kill him, for I you kill him, verily he would be in a position where you had been before killing him and verily you would be in a position where he had been before uttering (kalima). أَنَّهُ أَخْبَرَهُ أَنَّهُ قَالَ يَا رَسُولَ اللهِ «أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَقَاتَلَنِي فَضَرَبَ إِحْدَى يَدَيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ» فَقَالَ «أَسْلَمْتُ لِلَّهِ أَفَأَقْتُلُهُ يَا رَسُولَ اللهِ بَعْدَ أَنْ قَالَهَا؟» قَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ» قَالَ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّهُ قَطَعَ يَدِي ثُمَّ قَالَ ذَلِكَ بَعْدَ أَنْ قَطَعَهَا أَفَأَقْتُلُهُ؟ قَالَ رَسُولُ اللهِ ﷺ «لَا تَقْتُلْهُ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ»

Al Miqdad bin Al Aswad reported that he said “Apostle of Allaah ﷺ tell me if I meet a man who is a disbeliever and he fights with me and cuts off one hand of mine with the sword and then takes refuge by a tree and says “I embraced Islam for Allah’s sake. Should I kill him, Apostle of Allaah ﷺ after he uttered it (the credo of Islam)? The Apostle of Allaah ﷺ said “Do not kill him”. I said “Apostle of Allaah ﷺ, he cut off my hand. The Apostle of Allaah ﷺ said, Do not kill him. I f you kill him, he will become like you before you kill him and you will become like him before he uttered his credo which he has uttered now. البيهقي:١٦٨٢٣أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو بَكْرِ بْنُ أَبِي نَصْرٍ الدَّارَبَرْدِيُّ وَالْحَسَنُ بْنُ حَلِيمٍ بِمَرْوَ قَالَا ثنا أَبُو الْمُوَجِّهِ أنبأ عَبْدَانُ أنبأ عَبْدُ اللهِ هُوَ ابْنُ الْمُبَارَكِ عَنْ يُونُسَ عَنِ الزُّهْرِيِّ قَالَ حَدَّثَنِي عَطَاءُ بْنُ يَزِيدَ اللَّيْثِيُّ ثُمَّ الْجُنْدَعِيُّ أَنَّ عُبَيْدَ اللهِ بْنَ عَدِيِّ بْنِ الْخِيَارِ

أَخْبَرَهُ أَنَّ مِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ وَكَانَ حَلِيفًا لِبَنِي زُهْرَةَ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللهِ ﷺ أَخْبَرَهُ أَنَّهُ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ فَاقْتَتَلْنَا فَضَرَبَ إِحْدَى يَدِيَّ بِالسَّيْفِ فَقَطَعَهَا ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ فَقَالَ أَسْلَمْتُ لِلَّهِ أَقْتُلُهُ يَا رَسُولَ اللهِ بَعْدَ أَنْ قَالَهَا؟ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَقْتُلْهُ قَالَ يَا رَسُولَ اللهِ فَإِنَّهُ قَطَعَ إِحْدَى يَدِيَّ ثُمَّ قَالَ ذَلِكَ بَعْدَمَا قَطَعَهَا أَفَأَقْتُلُهُ؟ فَقَالَ رَسُولُ اللهِ ﷺ لَا تَقْتُلْهُ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ وَأَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ
