I came to the Messenger of Allah ﷺ as he was encamping at Batha. He said to me: Did you intend to perform Hajj? I said: Yes. He again said: With what intention have you entered into the state of Ihram (for Ifrad, Qiran or Tamattu'). I said: I pronounced Talbiya (I have entered into the state of Ihram ) with that very aim with which the Messenger of Allah ﷺ is pronouncing Talbiya. He (the Holy Prophet) said; You have done well. Then circumambulate the House and run between al-Safa' and al-Marwa' and put off Ihram (as you have not brought the sacrificial animals along with you). So I circumambulated the House, and ran between al-Safa' and al-Marwa' and then came to a woman of the tribe of Qais and she rid my head of the lice. I again put on Ihram for Hajj. and continued giving religious verdict (according to this practice) till during the Caliphate of Umar (Allah be pleased with him) when a person said to him: Abu Musa, or Abdullah b. Qais, exercise restraint in delivering some religious verdict of yours, for you do not know what has been introduced after you by the Commander of the Believers in the rites (of Hajj). Thereupon he said: 0 people, whom we gave the religious verdict (concerning putting off Ihram ) they should wait, for the Commander of the Believers is about to come to you, and you should follow him. Umar (Allah be pleased with him) then came and I made a mention of it to him. whereupon he said: If we abide by the Book of Allah (we find) the Book of Allah has commanded us to complete the (. Hajj and 'Umra), and if we abide by the Sunnah of Messenger of Allah ﷺ, we find that Messenger of Allah ﷺ did not put off Ihram till the sacrificial animal was brought to its end (till it was sacrificed).  

قَدِمْتُ عَلَى رَسُولِ اللَّهِ ﷺ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ لِي أَحَجَجْتَ فَقُلْتُ نَعَمْ فَقَالَ بِمَ أَهْلَلْتَ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلاَلٍ كَإِهْلاَلِ النَّبِيِّ ﷺ قَالَ فَقَدْ أَحْسَنْتَ طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ وَأَحِلَّ قَالَ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ بَنِي قَيْسٍ فَفَلَتْ رَأْسِي ثُمَّ أَهْلَلْتُ بِالْحَجِّ قَالَ فَكُنْتُ أُفْتِي بِهِ النَّاسَ حَتَّى كَانَ فِي خِلاَفَةِ عُمَرَ ؓ فَقَالَ لَهُ رَجُلٌ يَا أَبَا مُوسَى أَوْ يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ رُوَيْدَكَ بَعْضَ فُتْيَاكَ فَإِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدَكَ فَقَالَ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فُتْيَا فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَائْتَمُّوا قَالَ فَقَدِمَ عُمَرُ ؓ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّ كِتَابَ اللَّهِ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ رَسُولِ اللَّهِ ﷺ فَإِنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْىُ مَحِلَّهُ  

I came to the Messenger of Allah ﷺ and he was encamping at Batha. He (the Holy Prophet) said: With what purpose have you entered into the state of Ihram? I said: I have entered into the state of Ihram in accordance with the Ihram of Allah's Apostle ﷺ. He said: Have you brought sacrificial animals along with you? I said: No. whereupon he said: Then circumambulate the House and run between al-Safa' and al-Marwa and put off Ihram. So I circumambulated the House, ran between al-Safa' and al-Marwa, and then came to a woman of my tribe. She combed and washed my head. I used to give religious verdict (according to the above mentioned command of the Holy Prophet) during the Caliphate of Abu Bakr and also during that of 'Umar. And it was during the Hajj season that a person came to me and said: You (perhaps) do not know what the Commander of the Believers has introduced in the rites (of Hajj). I said: 0 people, those whom we have given religious verdict about a certain thing should wait, for the Commander of the Believers is about to arrive among you, so follow him. When the Commander of the Believers arrived, I said: What is this that you have introduced in the rites (of Hajj)? -where upon he said: If we abide by the Book of Allah (we find) that there Allah, Exalted and Majestic, has said: Complete Hajj and 'Umra for Allah." And if we abide by the Sunnah of our Apostle ﷺ (we find) that the Messenger of Allah (May peace be upon him) did not put off Ihram till he had sacrificed the animals.  

قَدِمْتُ عَلَى رَسُولِ اللَّهِ ﷺ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ بِمَ أَهْلَلْتَ قَالَ قُلْتُ أَهْلَلْتُ بِإِهْلاَلِ النَّبِيِّ ﷺ قَالَ هَلْ سُقْتَ مِنْ هَدْىٍ قُلْتُ لاَ قَالَ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ فِي إِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ فَإِنِّي لَقَائِمٌ بِالْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ فَقُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ بِشَىْءٍ فَلْيَتَّئِدْ فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَائْتَمُّوا فَلَمَّا قَدِمَ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا هَذَا الَّذِي أَحْدَثْتَ فِي شَأْنِ النُّسُكِ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّ اللَّهَ ﷻ قَالَ { وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا عَلَيْهِ الصَّلاَةُ وَالسَّلاَمُ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْىَ  

"I came to the Messenger of Allah when he was in Al-Batha', and he said: 'For what have you entered Ihram?' I said: 'I have entered Ihram for that for which the Proper had entered Ihram,' He said: 'Have you brought a hadi (sacrifical animal)?' I said: 'No.' He said: 'Then circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, then exit Ihram, so I circumambulated the House and (performed Sa i) between As-Safa and Al-Marwah, then went to a woman of my people and she combed and washed my hair, I used to issue Fatwas to the people based on that, during the Khilafah of Abu Bakr and 'Umar. Then one day during Hajj season a man came to me and said: 'You do not know what the commander of the Believers has introduced concerning the rites. I said: O people, whoever heard our heard our Fatwa, let him not rush to follow it, for the commander of the Believers! Is coming to you, and you should follow him. When he came, I said: O Commander of the Believers! What is this that you have introduced concerning the rites? He said: If we follow the Book of Allah, then Allah, the Mighty and Sublime, says: 'And complete the Hajj and 'Umrah for Allah. And if we follow the sunnah of our Prophet then our Prophet did not exit Ihram until he had slaughtered the Hadi (sacrificial animal) (sahih)

I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice.  

قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ بِمَ أَهْلَلْتَ؟ قُلْتُ بِإِهْلالٍ كَإِهْلالِ النَّبِيِّ ﷺ فَقَالَ هَلْ سُقْتَ مِنْ هَدْيٍ؟ قُلْتُ لَا قَالَ طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَّطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ بِإِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ فَإِنِّي لَقَائِمٌ فِي الْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ فَقُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فُتْيَا فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَاْئتَمُّوا فَلَمَّا قَدِمَ قُلْتُ مَا هَذَا الَّذِي قَدْ أَحْدَثْتَ فِي شَأْنِ النُّسُكِ؟ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللهِ فَإِنَّ اللهَ قَالَ {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} [البقرة 196] وَإِنْ نَأْخُذْبِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ  

[Machine] The Messenger of Allah ﷺ sent me to my tribe's land. When the Hajj season came, the Messenger of Allah ﷺ performed Hajj and I also performed Hajj. I went to him while he was at Al-Abtah and he asked me, "How did you perform the Ihram, O Abdullah ibn Qais?" I said, "Labbaik (Here I am), responding to your call for Hajj, just like the Hajj of the Messenger of Allah ﷺ ." He said, "You have done well." Then he asked, "Did you offer a sacrifice?" I said, "No, I did not." He said, "Go and perform Tawaf around the Kaaba and between Safa and Marwa, then shave or trim your hair." So, I did as he commanded and visited a woman from my tribe. She washed my head with Hithmi (a type of plant) and then I performed Ihram for Hajj on the day of Tarwiyah. I continued to give people fatwas (religious rulings) according to what the Messenger of Allah ﷺ commanded me, until he passed away. Then, it was the time of Abu Bakr, then the time of Umar. While I was standing at the Black Stone or Al-Maqam, giving people fatwas according to what the Messenger of Allah ﷺ commanded me, a man came to me, approached me, and said, "Do not rush in giving your fatwas, for the Commander of the Believers (Umar) has introduced something new in the rituals." I said to the people, "Whoever I have given a fatwa concerning the rituals before, should pay attention. The Commander of the Believers is coming, so wait for him to arrive." Umar then came and I said to him, "O Commander of the Believers, did you introduce something new in the rituals?" He replied, "Yes, if we follow the Book of Allah, it commands us to complete the Hajj. And if we follow the Sunnah of our Prophet ﷺ , he did not shave or trim his hair until he sacrificed (his animal)."  

بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى أَرْضِ قَوْمِي فَلَمَّا حَضَرَ الْحَجُّ حَجَّ رَسُولُ اللهِ ﷺ وَحَجَجْتُ فَقَدِمْتُ عَلَيْهِ وَهُوَ نَازِلٌ بِالْأَبْطَحِ فَقَالَ لِي بِمَ أَهْلَلْتَ يَا عَبْدَ اللهِ بْنَ قَيْسٍ؟ قَالَ قُلْتُ لَبَّيْكَ بِحَجٍّ كَحَجِّ رَسُولِ اللهِ ﷺ قَالَ أَحْسَنْتَ ثُمَّ قَالَ هَلْ سُقْتَ هَدْيًا؟ فَقُلْتُ مَا فَعَلْتُ فَقَالَ لِي اذْهَبْ فَطُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ احْلِلْ فَانْطَلَقْتُ فَفَعَلْتُ مَا أَمَرَنِي وَأَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَغَسَلَتْ رَأْسِي بِالْخِطْمِيِّ وَفَلَّتْهُ ثُمَّ أَهْلَلْتُ بِالْحَجِّ يَوْمَ التَّرْوِيَةِ فَمَا زِلْتُ أُفْتِي النَّاسَ بِالَّذِي أَمَرَنِي رَسُولُ اللهِ ﷺ حَتَّى تُوُفِّيَ ثُمَّ زَمَنَ أَبِي بَكْرٍ ثُمَّ زَمَنَ عُمَرَ فَبَيْنَا أَنَا قَائِمٌ عِنْدَ الْحَجَرِ الْأَسْوَدِ أَوِ الْمَقَامِ أُفْتِي النَّاسَ بِالَّذِي أَمَرَنِي بِهِ رَسُولُ اللهِ ﷺ إِذْ أَتَانِي رَجُلٌ فَسَارَّنِي فَقَالَ لَا تَعْجَلْ بِفُتْيَاكَ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَدْ أَحْدَثَ فِي الْمَنَاسِكِ شَيْئًافَقُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فِي الْمَنَاسِكِ شَيْئًا فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ فَبِهِ فَائْتَمُّوا قَالَ فَقَدِمَ عُمَرُ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ أَحْدَثْتَ فِي الْمَنَاسِكِ شَيْئًا؟ قَالَ نَعَمْ إِنْ نَأْخُذَ بِكِتَابِ اللهِ ﷻ فَإِنَّهُ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذَ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّهُ لَمْ يَحْلِلْ حَتَّى نَحَرَ الْهَدْيَ

He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice. لِي النَّبِيُّ ﷺ بِمَ أَهْلَلْتَ؟ قَالَ قُلْتُ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ فَقَالَ هَلْ مَعَكَ مِنْ هَدْيٍ؟ قَالَ قُلْتُ يَعْنِي لَا قَالَ فَأَمَرَنِي فَطُفْتُ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْ رَأْسِي وَغَسَلَتْهُ ثُمَّ أَحْلَلْتُ فَلَمَّا كَانَ يَوْمُ التَّرْوِيَةِ أَهْلَلْتُ بِالْحَجِّ قَالَ فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ إِمَارَةَ أَبِي بَكْرٍ وَعُمَرَ فَبَيْنَا أَنَا وَاقِفٌ فِي سُوقِ الْمَوْسِمِ إِذْ جَاءَ رَجُلٌ فَسَارَّنِي فَقَالَ إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ قَالَ قُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فِي شَيْءٍ فَلْيَتَّئِدْ فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا قَالَ فَقَالَ لِي إِنْ نَأْخُذْ بِكِتَابِ اللهِ تَعَالَى فَإِنَّهُ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ  

[Machine] I came to the Prophet ﷺ while he was throwing pebbles at the pillars during the Hajj. He asked me, "Have you performed Hajj?" I replied, "Yes." He then asked, "How did you perform the ritual of Ihram?" I said, "I made the intention of Ihram at the same time as the Prophet Muhammad ﷺ did." He said, "You have done well. Now go and perform Tawaf around the Kaaba, then go to Safa and Marwa, and then come out of the state of Ihram." He said, "I performed Tawaf around the Kaaba, went to Safa and Marwa, and then I went to visit a woman from the Banu Qays tribe. She began to touch my hair, and I started giving religious rulings to people based on this interaction. A man said to me, 'O Abdullah bin Qays, take it easy and be cautious with some of your rulings, for you do not know what instructions the Commander of the Believers has brought regarding the rituals after you.' So, I said, 'O people, whoever we have given a religious ruling, let them be cautious, for the Commander of the Believers is coming to you with instructions. Therefore, complete your rituals.' When he arrived, I went to him and mentioned what happened. He said, 'If we follow the Book of Allah, then the Book of Allah instructs us to complete the rituals. If we follow the Sunnah of the Messenger of Allah ﷺ, then the Messenger of Allah ﷺ did not exit the state of Ihram until the sacrificial animal reached its designated place.'"  

أَتَيْتُ رَسُولَ اللَّهِ ﷺ حِينَ حَجَّ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ لِي «أَحَجَجْتَ؟» قُلْتُ نَعَمْ قَالَ «كَيْفَ أَهْلَلْتَ؟» قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ «أَحْسَنْتَ اذْهَبْ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ» قَالَ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ نِسَاءِ بَنِي قَيْسٍ فَجَعَلَتْ تَفْلِي رَأْسِي فَجَعَلْتُ أُفْتِي النَّاسَ بِذَلِكَ فَقَالَ لِي رَجُلٌ يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ رُوَيْدًا بَعْضَ فُتْيَاكَ فَإِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدَكَ فَقُلْتُ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فُتْيَا فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا فَلَمَّا قَدِمَ أَتَيْتُهُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّ كِتَابَ اللَّهِ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ رَسُولِ اللَّهِ ﷺ فَإِنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ»  

I came to the Messenger of Allah ﷺ when he was in al-Bathaʿ and he said: ʿWhat did you enter ihram for?ʿ I said: I have entered ihram for the same as the Prophet ﷺ did. He said: ʿHave you brought a sacrificial animal?ʿ I said: No. He said: “Circumambulate the House and go between as-Safa and al-Marwah, then exit ihraam.” So I circumambulated the House and went between as-Safa and al-Marwah, then I went to a woman of my people and she combed my hair and washed my head. I used to give fatwas on that basis during the caliphate of Abu Bakr and ‘Umar. During one season when I was performing Hajj, a man came to me and said: You do not know the latest fatwa of Ameer al-Muʿmineen concerning the Hajj. I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ «بِمَ أَهْلَلْتَ؟» قُلْتُ أَهْلَلْتُ بِإِهْلَالِ النَّبِيِّ ﷺ فَقَالَ «هَلْ سُقْتَ مِنْ هَدْيٍ؟» قُلْتُ لَا قَالَ «طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ» فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ فِي إِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ وَإِنِّي لَقَائِمٌ بِالْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ قُلْتُ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ بِشَيْءٍ فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ فَلَمَّا قَدِمَ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا هَذَا الَّذِي أَحْدَثْتَ فِي شَأْنِ النُّسُكِ؟ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللهِ فَإِنَّ اللهَ قَالَ {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} [البقرة 196] وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ  

[Machine] The Prophet of Allah ﷺ sent me to Yemen. I met him in the year in which he performed Hajj and he asked me, "O Abu Musa, what did you say when you entered the state of ihram?" I replied, "I said, 'Here I am, O Allah, at Your service, (here I am)!' like the Ihram of the Prophet ﷺ ." He then asked, "Did you offer a sacrificial animal?" I replied, "No." He said, "Then proceed and perform Tawaf around the Kaaba and between Safa and Marwa, then shave your head." So, I went and performed Tawaf around the Kaaba and between Safa and Marwa, and then I approached some women from the family of Qais, meaning his paternal aunts, and they performed the ritual washing on my head. After that, during the caliphate of Umar (may Allah be pleased with him), I arrived as a pilgrim. While I was narrating to the people near the Kaaba what the Messenger of Allah ﷺ had commanded me, a man arrived and said, "Hold on, O man, with your narration, for you do not know what the Commander of the Faithful has introduced in the rituals." So, I said to the people, "Whoever has heard anything should not act upon it until the Commander of the Faithful arrives, and when he arrives, then follow his instructions." When Umar (may Allah be pleased with him) arrived, I said to him, "O Commander of the Faithful, have you introduced any changes in the rituals?" Umar (may Allah be pleased with him) became angry and said, "Indeed, if we were to adopt the Book of Allah alone, Allah has already commanded the completion (of the Hajj rituals), and if we were to follow the Sunnah of the Messenger of Allah ﷺ , our Prophet, it would not be permissible (to introduce changes) until the animal for sacrifice reaches its designated place."  

كَانَ رَسُولُ اللهِ ﷺ بَعَثَنِي إِلَى الْيَمَنِ قَالَ فَوَافَقْتُهُ فِي الْعَامِ الَّذِي حَجَّ فِيهِ فَقَالَ لِي رَسُولُ اللهِ ﷺ يَا أَبَا مُوسَى كَيْفَ قُلْتَ حِينَ أَحْرَمْتَ؟ قَالَ قُلْتُ إِهْلَالٌ كَإِهْلَالِ النَّبِيِّ ﷺ فَقَالَ هَلْ سُقْتَ هَدْيًا؟ قُلْتُ لَا قَالَ فَانْطَلِقْ فَطُفْ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ فَانْطَلَقْتُ فَطُفْتُ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ عَمَدْتُ إِلَى نِسْوَةٍ مِنْ آلِ قَيْسٍ يَعْنِي عَمَّاتِهِ فَمَشَطْنَ رَأْسِي بِالْغُسْلِ فَلَمَّا كَانَ بَعْدَ ذَلِكَ فِي إِمَارَةِ عُمَرَ ؓ قَدِمْتُ حَاجًّا فَبَيْنَا أَنَا أُحَدِّثُ النَّاسَ عِنْدَ الْبَيْتِ بِمَا أَمَرَنِي رَسُولُ اللهِ ﷺ إِذْ قَدِمَ رَجُلٌ فَقَالَ دُونَكَ أَيُّهَا الرَّجُلُ بِحَدِيثِكَ فَإِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ فَقُلْتُ يَا أَيُّهَا النَّاسُ مَنْ سَمِعَ شَيْئًا فَلَا يَأْخُذْ بِهِ حَتَّى يَقْدَمَ أَمِيرُ الْمُؤْمِنِينَ فَبِهِ ائْتَمُّوا فَلَمَّا قَدِمَ عُمَرُ ؓ قُلْتُ لَهُ يَا أَمِيرَ الْمُؤْمِنِينَ أَحَدَثَ فِي النُّسُكِ شَيْءٌ فَغَضِبَ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ مِنْ ذَلِكَ ثُمَّ قَالَ أَجَلْ لَئَنْ نَأْخُذَ بِكِتَابِ اللهِ فَقَدْ أَمَرَ اللهُ بِالتَّمَامِ وَأَنْ نَأْخُذَ بِسُنَّةِ رَسُولِ اللهِ ﷺ نَبِيِّنَا فَإِنَّهُ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ  

"عَنْ أَبِى مُوسَى قَالَ: قَدِمْتُ عَلَى رَسُول الله ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ: بِمَ أَهْلَلْتَ؟ قَلْتُ: بِإِهْلَالٍ كَإِهْلَالِ النَّبِىِّ ﷺ فَقَالَ: هَلْ سُقْتَ مِنْ هَدْىٍ؟ قُلْتُ: لَا، قَالَ: طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ، فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ، ثُمَّ أَتَيْتُ امْرأةً مِنْ قَومِى فَمَشَّطَتْنِى وَغَسَلَتْ رَأسِى، فَكُنْتُ أُفْتِى النَّاسَ بِذَلِكَ فِى إِمَارَةِ أَبِى بَكْرٍ وَإِمَارَةِ عُمَرَ، فَإِنَّي لَقَائِمٌ بالْمَوْسِم إِذْ جَاءَنِى رَجُلٌ فَقَالَ: إِنَّكَ لَا تَدْرِى مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ في شَأنِ النُّسُكِ، فَقُلْتُ: أيُّهَا النَّاسُ مَنْ كُنَّا أفْتَيْنَا فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأتَمُّوا فَلَمَّا قَدِمَ قُلْتُ: مَا هَذَا الَّذِى قَدْ أَحْدَثْتَ فِى شَأنِ النُّسُكِ؟ قَالَ: أنْ نَأخُذَ بِكِتَابِ الله، فَإنَّ الله قَالَ: {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} وَأَنْ نَأخُذَ بِسُنَّةِ نَبِيِّنَا، فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْىَ".  

" عن سعيدِ بنِ سفيانَ القَارِى قال: تُوُفِّىَ أخِى وَأَوْصَى بمائة دِينَارٍ في سَبيلِ الله، فدخلتُ على عثمانَ بنِ عفانَ وعنْدَهُ رَجلٌ قاعدٌ وعلىَّ قباءٌ جيبهُ وفروجه مكفوفٌ بحَريرٍ، فلما رآنى ذلك الرجلُ أقبلَ علىَّ يجاذِبُنِى قبائِى ليَخْرِقَهُ، فلما رأى ذلك عثمانُ قالَ: دعِ الرَّجُلَ، فَتَركنِى ثمَّ قالَ: قد عَجِلْتُم، فسألتُ عثمانَ فقُلْتُ: يَا أَميرَ المؤمنين، تُوُفّىَ أَخى وَأَوْصَى بِمائةِ دِينَارٍ فِى سَبِيلِ الله فَمَا تَأمُرُنِى؟ قال: هل سَأَلْتَ أَحَدًا قَبْلي؟ قلتُ: لا، قالَ لئنِ استفتيتَ أحدًا قبلى فأَفْتَاكَ غَيْرَ الَّذِى أفْتَيْتُكَ بِهِ ضَرَبْتُ عُنُقَهُ، إنَّ الله أمَرنا بالإسْلاَمِ فَأسْلَمْنَا كُلُّنَا، فنحن المسلِمُونَ، وَأمَرَنَا بِالْجِهَادِ فَهَاجَرْنَا فَنَحْنُ الْمُهَاجِرُونَ أَهْل الْمَدِينَةِ، ثَمَّ أَمَرنَا بِالْجِهَادِ فَجَاهَدتُمْ فَأَنْتُمُ الْمُجَاهِدُونَ أَهْل الشَّامِ، أَنْفِقْهَا عَلى نَفْسِكَ وَعَلى أَهْلِكَ وَعَلى ذِى الحاجة مِمَّنْ حَوْلَكَ، فإنه لو خَرَجْتَ بِدِرْهَمٍ ثُم اشْتَرَيْتَ بِهِ لَحْمًا فأَكلتَه أنتَ وَأَهْلُكَ كُتِبَ لَكَ بِسَبْعمائَة دِرْهَمٍ فَخَرجْتُ مِن عِنْدِهِ فَسَألْتُ عَنِ الرَّجُلِ الَّذِى يجاذبنى، فقيل: هو علىُّ بنُ أبى طالبٍ، فأتيتُه في منزله فقلتُ: ما رأيتَ منِّى؟ فقال: سمعتُ رسولَ الله ﷺ يقولُ: أوشَكَ أن تَسْتَحِلَّ أُمَّتِى فُرُوجَ النِّسَاء وَالْحَرِيرَ، وَهَذَا أَوَّلُ حَرِيرٍ رَأَيْتُهُ على أحدٍ مِنَ المسْلِمينَ، فَخَرَجْتُ مِنْ عِنْدِهِ فَبِعْتُهُ ".
