I came to the Prophet ﷺ at Al-Batha' while his camel was kneeling down and he asked me, "Have you intended to perform the Hajj?" I replied in the affirmative. He asked me, 'With what intention have you assumed Ihram?" I replied, "I have assumed Ihram with the same intention as that of the Prophet. He said, "You have done well. Perform the Tawaf of the Kaʿba and (the Sai) between As-Safa and Al- Marwa and then finish the Ihram." So, I performed the Tawaf around the Kaʿba and the Sai) between As-Safa and Al-Marwa and then went to a woman of the tribe of Qais who cleaned my head from lice. Later I assumed the Ihram for Hajj. I used to give the verdict of doing the same till the caliphate of ʿUmar who said, "If you follow the Holy Book then it orders you to remain in the state of Ihram till you finish from Hajj, if you follow the Prophet ﷺ then he did not finish his Ihram till the Hadi (sacrifice) had reached its place of slaughtering (Hajj-al-Qiran).

The Prophet ﷺ sent me to some people in Yemen and when I returned, I found him at Al-Batha. He asked me, "With what intention have you assumed Ihram (i.e. for Hajj or for Umra or for both?") I replied, "I have assumed Ihram with an intention like that of the Prophet." He asked, "Have you a Hadi with you?" I replied in the negative. He ordered me to perform Tawaf round the Kaʿba and between Safa and Marwa and then to finish my Ihram. I did so and went to a woman from my tribe who combed my hair or washed my head. Then, when ʿUmar came (i.e. became Caliph) he said, "If we follow Allah's Book, it orders us to complete Hajj and Umra; as Allah says: "Perform the Hajj and Umra for Allah." (2.196). And if we follow the tradition of the Prophet ﷺ who did not finish his Ihram till he sacrificed his Hadi."

I came upon Messenger of Allah ﷺ when he was at Al-Batha. He asked me, "Have you intended to perform the Hajj?" I replied in the affirmative. He asked, "For what have you assumed lhram?" I replied," I have assumed Ihram with the same intention as that of the Prophet ﷺ ." The Prophet ﷺ said, "You have done well! Go and perform Tawaf round the Kaʿba and between Safa and Marwa." Then I went to one of the women of Bani Qais and she took out lice from my head. Later, I assumed the Ihram for Hajj. So, I used to give this verdict to the people till the caliphate of ʿUmar. When I told him about it, he said, "If we take (follow) the Holy Book, then it orders us to complete Hajj and ʿUmra (Hajj-at- Tamattuʿ) and if we follow the tradition of Messenger of Allah ﷺ then Messenger of Allah ﷺ did not finish his lhram till the Hadi had reached its destination (had been slaughtered). I came to the Prophet ﷺ at a place called Al-Batha'. The Prophet ﷺ said, "Did you assume the Ihram for Hajj?" I said, "Yes," He said, "How did you express your intention (for performing Hajj)? " I said, "Labbaik (i.e. I am ready) to assume the Ihram with the same intention as that of Messenger of Allah ﷺ." The Prophet said, "Perform the Tawaf around the Kaʿba and between Safa and Marwa, and then finish your Ihram." So I performed the Tawaf around the Kaʿba and between Safa and Marwa and then I came to a woman from the tribe of Qais who removed the lice from my head.

I came to the Messenger of Allah ﷺ as he was encamping at Batha. He said to me: Did you intend to perform Hajj? I said: Yes. He again said: With what intention have you entered into the state of Ihram (for Ifrad, Qiran or Tamattu'). I said: I pronounced Talbiya (I have entered into the state of Ihram ) with that very aim with which the Messenger of Allah ﷺ is pronouncing Talbiya. He (the Holy Prophet) said; You have done well. Then circumambulate the House and run between al-Safa' and al-Marwa' and put off Ihram (as you have not brought the sacrificial animals along with you). So I circumambulated the House, and ran between al-Safa' and al-Marwa' and then came to a woman of the tribe of Qais and she rid my head of the lice. I again put on Ihram for Hajj. and continued giving religious verdict (according to this practice) till during the Caliphate of Umar (Allah be pleased with him) when a person said to him: Abu Musa, or Abdullah b. Qais, exercise restraint in delivering some religious verdict of yours, for you do not know what has been introduced after you by the Commander of the Believers in the rites (of Hajj). Thereupon he said: 0 people, whom we gave the religious verdict (concerning putting off Ihram ) they should wait, for the Commander of the Believers is about to come to you, and you should follow him. Umar (Allah be pleased with him) then came and I made a mention of it to him. whereupon he said: If we abide by the Book of Allah (we find) the Book of Allah has commanded us to complete the (. Hajj and 'Umra), and if we abide by the Sunnah of Messenger of Allah ﷺ, we find that Messenger of Allah ﷺ did not put off Ihram till the sacrificial animal was brought to its end (till it was sacrificed).

"I came from Yemen and the Prophet had stopped in Al-Batha at the time to Hajj. He asked: 'Have you performed Hajj?' I said: 'Yes, He said: 'What did you say?' I said; 'Labbaika bi ihlal ka ihlal in-nabiy (Here I am (O Allah, entering Ihram for that for which the Prophet entered Ihram). He said 'Circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, and exit Ihram.' Then I went to a woman who combed my hair. I started to issue Fatwas to the people based on that. Then during the Khilafah of 'Umar, a man said to me: 'O abu Musa, withhold some of our Fatwas from us, for you do not know what the Commander of the Believers has introduced into the rites after you.''' Abu Musa said: "O people, O people, whoever heard our Fatwa,let him not rush to follow it, for the Commander of the Believers is coming to your and you should follow him.: 'Umar said: "If we follow the Book of Allah, then indeed He commands us to complete Hajj and 'Umrah, and the Messenger of Allah did not exit Ihram until the Hadi had reached its place."

أَبُو مُوسَى أَقْبَلْتُ مِنَ الْيَمَنِ وَالنَّبِيُّ ﷺ مُنِيخٌ بِالْبَطْحَاءِ حَيْثُ حَجَّ فَقَالَ أَحَجَجْتَ قُلْتُ نَعَمْ قَالَ كَيْفَ قُلْتَ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلاَلٍ كَإِهْلاَلِ النَّبِيِّ ﷺ قَالَ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ وَأَحِلَّ فَفَعَلْتُ ثُمَّ أَتَيْتُ امْرَأَةً فَفَلَتْ رَأْسِي فَجَعَلْتُ أُفْتِي النَّاسَ بِذَلِكَ حَتَّى كَانَ فِي خِلاَفَةِ عُمَرَ فَقَالَ لَهُ رَجُلٌ يَا أَبَا مُوسَى رُوَيْدَكَ بَعْضَ فُتْيَاكَ فَإِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدَكَ قَالَ أَبُو مُوسَى يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ وَقَالَ عُمَرُ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّهُ يَأْمُرُنَا بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ النَّبِيِّ ﷺ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْىُ مَحِلَّهُ

I came to the Messenger of Allah ﷺ when he was in al-Bathaʿ and he said: ʿWhat did you enter ihram for?ʿ I said: I have entered ihram for the same as the Prophet ﷺ did. He said: ʿHave you brought a sacrificial animal?ʿ I said: No. He said: “Circumambulate the House and go between as-Safa and al-Marwah, then exit ihraam.” So I circumambulated the House and went between as-Safa and al-Marwah, then I went to a woman of my people and she combed my hair and washed my head. I used to give fatwas on that basis during the caliphate of Abu Bakr and ‘Umar. During one season when I was performing Hajj, a man came to me and said: You do not know the latest fatwa of Ameer al-Muʿmineen concerning the Hajj. I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice.

Hajj and 'Umra), and if we abide by the Sunnah of Messenger of Allah ﷺ, we find that Messenger of Allah ﷺ did not put off Ihram till the sacrificial animal was brought to its end (till it was sacrificed). قَدِمْتُ عَلَى النَّبِيِّ ﷺ وَهُوَ مُنِيخٌ بِالْأَبْطَحِ فَقَالَ لِي أَحَجَجْتَ؟ قُلْتُ نَعَمْ قَالَ فَبِمَ أَهْلَلْتَ؟ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ قَدْ أَحْسَنْتَ قَالَ طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ قَالَ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ بَنِي قَيْسٍ فَفَلَّتْ رَأْسِي ثُمَّ أَهْلَلْتُ بِالْحَجِّ قَالَ فَكُنْتُ أُفْتِي بِهِ النَّاسَحَتَّى كَانَ خِلَافَةُ عُمَرَ فَقَالَ رَجُلٌ يَا أَبَا مُوسَى أَوْ يَا عَبْدَ اللهِ بْنَ قَيْسٍ رُوَيْدَكَ بَعْضَ فُتْيَاكَ؛ فَإِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ بَعْدَكَ قَالَ فَقَالَ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فُتْيَا فَلْيَتَّئِدْ؛ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا قَالَ فَقَدِمَ عُمَرُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ إِنْ نَأْخُذْ بِكِتَابِ اللهِ فَإِنَّ كِتَابَ اللهِ تَعَالَى يَأْمُرُنَا بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ رَسُولِ اللهِ ﷺ فَإِنَّ رَسُولَ اللهِ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ

[Machine] I came to the Prophet ﷺ while he was throwing pebbles at the pillars during the Hajj. He asked me, "Have you performed Hajj?" I replied, "Yes." He then asked, "How did you perform the ritual of Ihram?" I said, "I made the intention of Ihram at the same time as the Prophet Muhammad ﷺ did." He said, "You have done well. Now go and perform Tawaf around the Kaaba, then go to Safa and Marwa, and then come out of the state of Ihram." He said, "I performed Tawaf around the Kaaba, went to Safa and Marwa, and then I went to visit a woman from the Banu Qays tribe. She began to touch my hair, and I started giving religious rulings to people based on this interaction. A man said to me, 'O Abdullah bin Qays, take it easy and be cautious with some of your rulings, for you do not know what instructions the Commander of the Believers has brought regarding the rituals after you.' So, I said, 'O people, whoever we have given a religious ruling, let them be cautious, for the Commander of the Believers is coming to you with instructions. Therefore, complete your rituals.' When he arrived, I went to him and mentioned what happened. He said, 'If we follow the Book of Allah, then the Book of Allah instructs us to complete the rituals. If we follow the Sunnah of the Messenger of Allah ﷺ, then the Messenger of Allah ﷺ did not exit the state of Ihram until the sacrificial animal reached its designated place.'"

I came to the Messenger of Allah ﷺ when he was in al-Bathaʿ and he said: ʿWhat did you enter ihram for?ʿ I said: I have entered ihram for the same as the Prophet ﷺ did. He said: ʿHave you brought a sacrificial animal?ʿ I said: No. He said: “Circumambulate the House and go between as-Safa and al-Marwah, then exit ihraam.” So I circumambulated the House and went between as-Safa and al-Marwah, then I went to a woman of my people and she combed my hair and washed my head. I used to give fatwas on that basis during the caliphate of Abu Bakr and ‘Umar. During one season when I was performing Hajj, a man came to me and said: You do not know the latest fatwa of Ameer al-Muʿmineen concerning the Hajj. I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice. "I came from Yemen and the Prophet had stopped in Al-Batha at the time to Hajj. He asked: 'Have you performed Hajj?' I said: 'Yes, He said: 'What did you say?' I said; 'Labbaika bi ihlal ka ihlal in-nabiy (Here I am (O Allah, entering Ihram for that for which the Prophet entered Ihram). He said 'Circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, and exit Ihram.' Then I went to a woman who combed my hair. I started to issue Fatwas to the people based on that. Then during the Khilafah of 'Umar, a man said to me: 'O abu Musa, withhold some of our Fatwas from us, for you do not know what the Commander of the Believers has introduced into the rites after you.''' Abu Musa said: "O people, O people, whoever heard our Fatwa,let him not rush to follow it, for the Commander of the Believers is coming to your and you should follow him.: 'Umar said: "If we follow the Book of Allah, then indeed He commands us to complete Hajj and 'Umrah, and the Messenger of Allah did not exit Ihram until the Hadi had reached its place."
