I came upon Messenger of Allah ﷺ when he was at Al-Batha. He asked me, "Have you intended to perform the Hajj?" I replied in the affirmative. He asked, "For what have you assumed lhram?" I replied," I have assumed Ihram with the same intention as that of the Prophet ﷺ ." The Prophet ﷺ said, "You have done well! Go and perform Tawaf round the Kaʿba and between Safa and Marwa." Then I went to one of the women of Bani Qais and she took out lice from my head. Later, I assumed the Ihram for Hajj. So, I used to give this verdict to the people till the caliphate of ʿUmar. When I told him about it, he said, "If we take (follow) the Holy Book, then it orders us to complete Hajj and ʿUmra (Hajj-at- Tamattuʿ) and if we follow the tradition of Messenger of Allah ﷺ then Messenger of Allah ﷺ did not finish his lhram till the Hadi had reached its destination (had been slaughtered). (i.e. Hajj-al-Qiran). (See Hadith No. 630)  

قَدِمْتُ عَلَى رَسُولِ اللَّهِ ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ أَحَجَجْتَ قُلْتُ نَعَمْ قَالَ بِمَا أَهْلَلْتَ قُلْتُ لَبَّيْكَ بِإِهْلاَلٍ كَإِهْلاَلِ النَّبِيِّ ﷺ قَالَ أَحْسَنْتَ انْطَلِقْ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ نِسَاءِ بَنِي قَيْسٍ فَفَلَتْ رَأْسِي ثُمَّ أَهْلَلْتُ بِالْحَجِّ فَكُنْتُ أُفْتِي بِهِ النَّاسَ حَتَّى خِلاَفَةِ عُمَرَ ؓ فَذَكَرْتُهُ لَهُ فَقَالَ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّهُ يَأْمُرُنَا بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ رَسُولِ اللَّهِ ﷺ فَإِنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْىُ مَحِلَّهُ  

I came to the Prophet ﷺ at Al-Batha' while his camel was kneeling down and he asked me, "Have you intended to perform the Hajj?" I replied in the affirmative. He asked me, 'With what intention have you assumed Ihram?" I replied, "I have assumed Ihram with the same intention as that of the Prophet. He said, "You have done well. Perform the Tawaf of the Kaʿba and (the Sai) between As-Safa and Al- Marwa and then finish the Ihram." So, I performed the Tawaf around the Kaʿba and the Sai) between As-Safa and Al-Marwa and then went to a woman of the tribe of Qais who cleaned my head from lice. Later I assumed the Ihram for Hajj. I used to give the verdict of doing the same till the caliphate of ʿUmar who said, "If you follow the Holy Book then it orders you to remain in the state of Ihram till you finish from Hajj, if you follow the Prophet ﷺ then he did not finish his Ihram till the Hadi (sacrifice) had reached its place of slaughtering (Hajj-al-Qiran).  

عَنْ أَبِي مُوسَى الأَشْعَرِيِّ ؓ قَالَ قَدِمْتُ عَلَى النَّبِيِّ ﷺ بِالْبَطْحَاءِ وَهُوَ مُنِيخٌ فَقَالَ أَحَجَجْتَ قُلْتُ نَعَمْ قَالَ بِمَا أَهْلَلْتَ قُلْتُ لَبَّيْكَ بِإِهْلاَلٍ كَإِهْلاَلِ النَّبِيِّ ﷺ قَالَ أَحْسَنْتَ طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَحِلَّ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَيْسٍ فَفَلَتْ رَأْسِي ثُمَّ أَهْلَلْتُ بِالْحَجِّ فَكُنْتُ أُفْتِي بِهِ حَتَّى كَانَ فِي خِلاَفَةِ عُمَرَ فَقَالَ إِنْ أَخَذْنَا بِكِتَابِ اللَّهِ فَإِنَّهُ يَأْمُرُنَا بِالتَّمَامِ وَإِنْ أَخَذْنَا بِقَوْلِ النَّبِيِّ ﷺ فَإِنَّهُ لَمْ يَحِلَّ حَتَّى يَبْلُغَ الْهَدْىُ مَحِلَّهُ  

I came to the Messenger of Allah ﷺ and he was encamping at Batha. He (the Holy Prophet) said: With what purpose have you entered into the state of Ihram? I said: I have entered into the state of Ihram in accordance with the Ihram of Allah's Apostle ﷺ. He said: Have you brought sacrificial animals along with you? I said: No. whereupon he said: Then circumambulate the House and run between al-Safa' and al-Marwa and put off Ihram. So I circumambulated the House, ran between al-Safa' and al-Marwa, and then came to a woman of my tribe. She combed and washed my head. I used to give religious verdict (according to the above mentioned command of the Holy Prophet) during the Caliphate of Abu Bakr and also during that of 'Umar. And it was during the Hajj season that a person came to me and said: You (perhaps) do not know what the Commander of the Believers has introduced in the rites (of Hajj). I said: 0 people, those whom we have given religious verdict about a certain thing should wait, for the Commander of the Believers is about to arrive among you, so follow him. When the Commander of the Believers arrived, I said: What is this that you have introduced in the rites (of Hajj)? -where upon he said: If we abide by the Book of Allah (we find) that there Allah, Exalted and Majestic, has said: Complete Hajj and 'Umra for Allah." And if we abide by the Sunnah of our Apostle ﷺ (we find) that the Messenger of Allah (May peace be upon him) did not put off Ihram till he had sacrificed the animals.  

قَدِمْتُ عَلَى رَسُولِ اللَّهِ ﷺ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ بِمَ أَهْلَلْتَ قَالَ قُلْتُ أَهْلَلْتُ بِإِهْلاَلِ النَّبِيِّ ﷺ قَالَ هَلْ سُقْتَ مِنْ هَدْىٍ قُلْتُ لاَ قَالَ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ فِي إِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ فَإِنِّي لَقَائِمٌ بِالْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ فَقُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ بِشَىْءٍ فَلْيَتَّئِدْ فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَائْتَمُّوا فَلَمَّا قَدِمَ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا هَذَا الَّذِي أَحْدَثْتَ فِي شَأْنِ النُّسُكِ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّ اللَّهَ ﷻ قَالَ { وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا عَلَيْهِ الصَّلاَةُ وَالسَّلاَمُ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْىَ  

"I came to the Messenger of Allah when he was in Al-Batha', and he said: 'For what have you entered Ihram?' I said: 'I have entered Ihram for that for which the Proper had entered Ihram,' He said: 'Have you brought a hadi (sacrifical animal)?' I said: 'No.' He said: 'Then circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, then exit Ihram, so I circumambulated the House and (performed Sa i) between As-Safa and Al-Marwah, then went to a woman of my people and she combed and washed my hair, I used to issue Fatwas to the people based on that, during the Khilafah of Abu Bakr and 'Umar. Then one day during Hajj season a man came to me and said: 'You do not know what the commander of the Believers has introduced concerning the rites. I said: O people, whoever heard our heard our Fatwa, let him not rush to follow it, for the commander of the Believers! Is coming to you, and you should follow him. When he came, I said: O Commander of the Believers! What is this that you have introduced concerning the rites? He said: If we follow the Book of Allah, then Allah, the Mighty and Sublime, says: 'And complete the Hajj and 'Umrah for Allah. And if we follow the sunnah of our Prophet then our Prophet did not exit Ihram until he had slaughtered the Hadi (sacrificial animal) (sahih)  

قَدِمْتُ عَلَى رَسُولِ اللَّهِ ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ بِمَا أَهْلَلْتَ قُلْتُ أَهْلَلْتُ بِإِهْلاَلِ النَّبِيِّ ﷺ قَالَ هَلْ سُقْتَ مِنْ هَدْىٍ قُلْتُ لاَ قَالَ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ فِي إِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ وَإِنِّي لَقَائِمٌ بِالْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ قُلْتُ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ بِشَىْءٍ فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ فَلَمَّا قَدِمَ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا هَذَا الَّذِي أَحْدَثْتَ فِي شَأْنِ النُّسُكِ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ ﷻ فَإِنَّ اللَّهَ ﷻ قَالَ { وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ } وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّ نَبِيَّنَا ﷺ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْىَ  

"I came from Yemen and the Prophet had stopped in Al-Batha at the time to Hajj. He asked: 'Have you performed Hajj?' I said: 'Yes, He said: 'What did you say?' I said; 'Labbaika bi ihlal ka ihlal in-nabiy (Here I am (O Allah, entering Ihram for that for which the Prophet entered Ihram). He said 'Circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, and exit Ihram.' Then I went to a woman who combed my hair. I started to issue Fatwas to the people based on that. Then during the Khilafah of 'Umar, a man said to me: 'O abu Musa, withhold some of our Fatwas from us, for you do not know what the Commander of the Believers has introduced into the rites after you.''' Abu Musa said: "O people, O people, whoever heard our Fatwa,let him not rush to follow it, for the Commander of the Believers is coming to your and you should follow him.: 'Umar said: "If we follow the Book of Allah, then indeed He commands us to complete Hajj and 'Umrah, and the Messenger of Allah did not exit Ihram until the Hadi had reached its place."  

أَبُو مُوسَى أَقْبَلْتُ مِنَ الْيَمَنِ وَالنَّبِيُّ ﷺ مُنِيخٌ بِالْبَطْحَاءِ حَيْثُ حَجَّ فَقَالَ أَحَجَجْتَ قُلْتُ نَعَمْ قَالَ كَيْفَ قُلْتَ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلاَلٍ كَإِهْلاَلِ النَّبِيِّ ﷺ قَالَ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ وَأَحِلَّ فَفَعَلْتُ ثُمَّ أَتَيْتُ امْرَأَةً فَفَلَتْ رَأْسِي فَجَعَلْتُ أُفْتِي النَّاسَ بِذَلِكَ حَتَّى كَانَ فِي خِلاَفَةِ عُمَرَ فَقَالَ لَهُ رَجُلٌ يَا أَبَا مُوسَى رُوَيْدَكَ بَعْضَ فُتْيَاكَ فَإِنَّكَ لاَ تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدَكَ قَالَ أَبُو مُوسَى يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ وَقَالَ عُمَرُ إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّهُ يَأْمُرُنَا بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ النَّبِيِّ ﷺ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْىُ مَحِلَّهُ

I used to give fatwas on that basis during the caliphate of Abu Bakr and ‘Umar. During one season when I was performing Hajj, a man came to me and said: You do not know the latest fatwa of Ameer al-Muʿmineen concerning the Hajj. I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice.

لِي النَّبِيُّ ﷺ بِمَ أَهْلَلْتَ؟ قَالَ قُلْتُ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ فَقَالَ هَلْ مَعَكَ مِنْ هَدْيٍ؟ قَالَ قُلْتُ يَعْنِي لَا قَالَ فَأَمَرَنِي فَطُفْتُ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْ رَأْسِي وَغَسَلَتْهُ ثُمَّ أَحْلَلْتُ فَلَمَّا كَانَ يَوْمُ التَّرْوِيَةِ أَهْلَلْتُ بِالْحَجِّ قَالَ فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ إِمَارَةَ أَبِي بَكْرٍ وَعُمَرَ فَبَيْنَا أَنَا وَاقِفٌ فِي سُوقِ الْمَوْسِمِ إِذْ جَاءَ رَجُلٌ فَسَارَّنِي فَقَالَ إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ قَالَ قُلْتُ أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فِي شَيْءٍ فَلْيَتَّئِدْ فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا قَالَ فَقَالَ لِي إِنْ نَأْخُذْ بِكِتَابِ اللهِ تَعَالَى فَإِنَّهُ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ  

[Machine] I came to the Prophet ﷺ while he was throwing pebbles at the pillars during the Hajj. He asked me, "Have you performed Hajj?" I replied, "Yes." He then asked, "How did you perform the ritual of Ihram?" I said, "I made the intention of Ihram at the same time as the Prophet Muhammad ﷺ did." He said, "You have done well. Now go and perform Tawaf around the Kaaba, then go to Safa and Marwa, and then come out of the state of Ihram." He said, "I performed Tawaf around the Kaaba, went to Safa and Marwa, and then I went to visit a woman from the Banu Qays tribe. She began to touch my hair, and I started giving religious rulings to people based on this interaction. A man said to me, 'O Abdullah bin Qays, take it easy and be cautious with some of your rulings, for you do not know what instructions the Commander of the Believers has brought regarding the rituals after you.' So, I said, 'O people, whoever we have given a religious ruling, let them be cautious, for the Commander of the Believers is coming to you with instructions. Therefore, complete your rituals.' When he arrived, I went to him and mentioned what happened. He said, 'If we follow the Book of Allah, then the Book of Allah instructs us to complete the rituals. If we follow the Sunnah of the Messenger of Allah ﷺ, then the Messenger of Allah ﷺ did not exit the state of Ihram until the sacrificial animal reached its designated place.'"  

أَتَيْتُ رَسُولَ اللَّهِ ﷺ حِينَ حَجَّ وَهُوَ مُنِيخٌ بِالْبَطْحَاءِ فَقَالَ لِي «أَحَجَجْتَ؟» قُلْتُ نَعَمْ قَالَ «كَيْفَ أَهْلَلْتَ؟» قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ «أَحْسَنْتَ اذْهَبْ فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ» قَالَ فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ نِسَاءِ بَنِي قَيْسٍ فَجَعَلَتْ تَفْلِي رَأْسِي فَجَعَلْتُ أُفْتِي النَّاسَ بِذَلِكَ فَقَالَ لِي رَجُلٌ يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ رُوَيْدًا بَعْضَ فُتْيَاكَ فَإِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي النُّسُكِ بَعْدَكَ فَقُلْتُ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فُتْيَا فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا فَلَمَّا قَدِمَ أَتَيْتُهُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «إِنْ نَأْخُذْ بِكِتَابِ اللَّهِ فَإِنَّ كِتَابَ اللَّهِ يَأْمُرُ بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ رَسُولِ اللَّهِ ﷺ فَإِنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ»  

I came to the Messenger of Allah ﷺ when he was in al-Bathaʿ and he said: ʿWhat did you enter ihram for?ʿ I said: I have entered ihram for the same as the Prophet ﷺ did. He said: ʿHave you brought a sacrificial animal?ʿ I said: No. He said: “Circumambulate the House and go between as-Safa and al-Marwah, then exit ihraam.” So I circumambulated the House and went between as-Safa and al-Marwah, then I went to a woman of my people and she combed my hair and washed my head. I used to give fatwas on that basis during the caliphate of Abu Bakr and ‘Umar. During one season when I was performing Hajj, a man came to me and said: You do not know the latest fatwa of Ameer al-Muʿmineen concerning the Hajj. I said: O people, if we gave a fatwa, Ameer al-Muʿmineen is coming to you, so follow him in performing Hajj. When he came I said: What is this thing that you have introduced to the rituals [of Hajj]? He said: We see in the Book of Allah that Allah, may He be exalted, says: ʿAnd perform properly (i.e. all the ceremonies according to the ways of Prophet Muhammad ﷺ, the Hajj and ‘Umrah (i.e. the pilgrimage to Makkah) for Allahʿ [al-Baqarah 2:196], and if we follow the Sunnah of our Prophet ﷺ, he did not exit ihraam until he offered the sacrifice. قَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ «بِمَ أَهْلَلْتَ؟» قُلْتُ أَهْلَلْتُ بِإِهْلَالِ النَّبِيِّ ﷺ فَقَالَ «هَلْ سُقْتَ مِنْ هَدْيٍ؟» قُلْتُ لَا قَالَ «طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ» فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْنِي وَغَسَلَتْ رَأْسِي فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ فِي إِمَارَةِ أَبِي بَكْرٍ وَإِمَارَةِ عُمَرَ وَإِنِّي لَقَائِمٌ بِالْمَوْسِمِ إِذْ جَاءَنِي رَجُلٌ فَقَالَ إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ قُلْتُ يَا أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ بِشَيْءٍ فَلْيَتَّئِدْ فَإِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ فَلَمَّا قَدِمَ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَا هَذَا الَّذِي أَحْدَثْتَ فِي شَأْنِ النُّسُكِ؟ قَالَ إِنْ نَأْخُذْ بِكِتَابِ اللهِ فَإِنَّ اللهَ قَالَ {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} [البقرة 196] وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ  

"I came from Yemen and the Prophet had stopped in Al-Batha at the time to Hajj. He asked: 'Have you performed Hajj?' I said: 'Yes, He said: 'What did you say?' I said; 'Labbaika bi ihlal ka ihlal in-nabiy (Here I am (O Allah, entering Ihram for that for which the Prophet entered Ihram). He said 'Circumambulate the House and (perform Sa) between As-Safa and Al-Marwah, and exit Ihram.' Then I went to a woman who combed my hair. I started to issue Fatwas to the people based on that. Then during the Khilafah of 'Umar, a man said to me: 'O abu Musa, withhold some of our Fatwas from us, for you do not know what the Commander of the Believers has introduced into the rites after you.''' Abu Musa said: "O people, O people, whoever heard our Fatwa,let him not rush to follow it, for the Commander of the Believers is coming to your and you should follow him.: 'Umar said: "If we follow the Book of Allah, then indeed He commands us to complete Hajj and 'Umrah, and the Messenger of Allah did not exit Ihram until the Hadi had reached its place." قَالَ أَبُو مُوسَى أَقْبَلْتُ مِنَ الْيَمَنِ وَالنَّبِيُّ ﷺ مُنِيخٌ بِالْبَطْحَاءِ حَيْثُ حَجَّ فَقَالَ «حَجَجْتَ؟» قُلْتُ نَعَمْ قَالَ «كَيْف»؟ قُلْتُ قَالَ قُلْتُ لَبَّيْكَ بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ «فَطُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ» وَأَحَلَّ فَفَعَلْتُ ثُمَّ أَتَيْتُ امْرَأَةً فَفَلَّتْ رَأْسِي فَجَعَلْتُ أُفْتِي النَّاسَ بِذَلِكَ قَالَ قُلْتُ إِنَّ أَمِيرَ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَائْتَمُّوا بِهِ فَقَالَ عُمَرُ إنْ نَأْخُذْ بِكِتَابِ اللهِ فَإِنَّهُ يَأْمُرُنَا بِالتَّمَامِ وَإِنْ نَأْخُذْ بِسُنَّةِ النَّبِيِّ ﷺ فَإِنَّ النَّبِيَّ ﷺ لَمْ يَحِلَّ حَتَّى بَلَغَ الْهَدْيُ مَحِلَّهُ  

"عَنْ أَبِى مُوسَى قَالَ: قَدِمْتُ عَلَى رَسُول الله ﷺ وَهُوَ بِالْبَطْحَاءِ فَقَالَ: بِمَ أَهْلَلْتَ؟ قَلْتُ: بِإِهْلَالٍ كَإِهْلَالِ النَّبِىِّ ﷺ فَقَالَ: هَلْ سُقْتَ مِنْ هَدْىٍ؟ قُلْتُ: لَا، قَالَ: طُفْ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حِلَّ، فَطُفْتُ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ، ثُمَّ أَتَيْتُ امْرأةً مِنْ قَومِى فَمَشَّطَتْنِى وَغَسَلَتْ رَأسِى، فَكُنْتُ أُفْتِى النَّاسَ بِذَلِكَ فِى إِمَارَةِ أَبِى بَكْرٍ وَإِمَارَةِ عُمَرَ، فَإِنَّي لَقَائِمٌ بالْمَوْسِم إِذْ جَاءَنِى رَجُلٌ فَقَالَ: إِنَّكَ لَا تَدْرِى مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ في شَأنِ النُّسُكِ، فَقُلْتُ: أيُّهَا النَّاسُ مَنْ كُنَّا أفْتَيْنَا فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأتَمُّوا فَلَمَّا قَدِمَ قُلْتُ: مَا هَذَا الَّذِى قَدْ أَحْدَثْتَ فِى شَأنِ النُّسُكِ؟ قَالَ: أنْ نَأخُذَ بِكِتَابِ الله، فَإنَّ الله قَالَ: {وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} وَأَنْ نَأخُذَ بِسُنَّةِ نَبِيِّنَا، فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْىَ".
