On the Authority of his father: A man from Hadramawt and a man of Kindah came to the Messenger of Allah ﷺ. Al-Hadrami said: Messenger of Allah, this (man) took away forcibly from me the land which belongs to my father. Al-Kindi said: It is my land in my possession, and I cultivate it, he has no right to it. The Prophet ﷺ then said to al-Hadrami: Have you any proof ? He said: No. He then said: So for you is his oath. He said: Messenger of Allah, he is liar, he does not care for which he is taking the oath. He does not refrain himself from anything. The Prophet ﷺ said: You will have nothing from him except that. He went to take an oath for him. When he turned his back, the Messenger of Allah ﷺ said: If he takes an oath on the property to take it away by unfair means, he will meet Allah while He is unmindful of him. Messenger of Allah, only this man has appropriated my land which belonged to my father. The one who had came from Kinda contended. This is my land and is in my possession: I cultivate it. There is no right for him in it. The Messenger of Allah said to the Hadramite: Have you any evidence (to support you)? He replied in the negative. He (the Messenger of Allah) said: Then your case is to be decided on his oath. He (the Hadramite) said: Messenger of Allah, he is a liar and cares not what he swears and has no regard for anything. Upon this he (the Messenger of Allah) remarked: For you then there is no other help to it. He (the man from Kinda) set out to take an oath. When he turned his back the Messenger of Allah ﷺ observed: If he took an oath on his property with a view to usurping it, he would certainly meet his Lord in a state that He would turn away from him.

We said : No. he (the Prophet)said: Then he will swear an oath for you . He said: Messenger of Allah, he is a reprobate and he would not care to swear to anything and stick at nothing. He said: That is only your recourse

"A man from Hadramawt and a man from Kindah came to the Prophet ﷺ. The Hadrami said: 'O Messenger of Allah! This person took some land of mine.' The Kindi said:'It is my land, It is in my possession, and he has no right to it.' So the Prophet ﷺ said to the Hadrami:'Do you have proof?' He said: 'No.' He said: 'Then you will have the oath.' He said: 'O Messenger of Allah! This man is a liar, it makes not difference what he takes an oath for, he is not ashamed of doing anything!' He said: 'There is nothing you deserve from him except that.' He said: So the man was left to take an oath for it, and in the meantime, the Messenger of Allah ﷺ said: 'If he takes an oath [for your property] to wrongfully consume it, He will meet Allah while He is angry with him."

جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ إِنَّ هَذَا غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لِأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ النَّبِيُّ ﷺ «أَلَكَ بَيِّنَةٌ؟» قَالَ لَا قَالَ «عَلَيْكَ يَمِينُهُ» قَالَ يَا رَسُولَ اللهِ إِنَّ الرَّجُلَ فَاجِرٌ لَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ قَالَ «لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ» فَانْطَلَقَ لِيَحْلِفَ فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا أَدْبَرَ «أَمَا إِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا لَيَلْقَيَنَّ اللهَ وَهُوَ عَنْهُ مُعْرِضٌ»

[Machine] A man from Hadramaut and a man from Kindah came to the Messenger of Allah ﷺ . The man from Hadramaut said, "O Messenger of Allah, this man has conquered my land, which belonged to my father." The man from Kindah responded, "It is my land, which I am cultivating and he has no right to it." The Messenger of Allah ﷺ asked the man from Hadramaut, "Do you have any evidence?" He replied, "No." The Prophet said, "Then the land is yours." The man from Kindah said, "O Prophet of Allah, he does not care about what he swears upon, and he does not refrain from any wrongdoing." The Prophet said to the man from Hadramaut, "You only have this right." The man from Hadramaut left to gather his evidence and the Messenger of Allah ﷺ said, "If he swears falsely on his wealth, injustly taking it away, then he will face Allah on the Day of Judgment while disregarding it." This is how I found it in my book, and likewise I found it in the book of Muslim, narrated from Ishaq bin Ibrahim and Zuhair bin Harb, from Abu Al-Walid, from Abu Awanah, from Abdul Malik bin Umayr, from Alqamah. This hadith has also been narrated by Uthman bin Sa'id Ad-Darimi, Muhammad bin Al-Husayn bin Abi Al-Hunayn, and Abu Muslim Ibrahim bin Abdullah Al-Kajji, and others, from Abu Al-Walid. They all mentioned in the hadith, "You only have this right." And likewise.  

البيهقي:٢٠٥٠٤أَخْبَرَنَا الْفَقِيهُ أَبُو الْقَاسِمِ عُبَيْدُ اللهِ بْنُ عُمَرَ الْفَامِيُّ بِبَغْدَادَ ثنا أَحْمَدُ بْنُ سَلْمَانَ النَّجَّادُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا عَاصِمُ بْنُ عَلِيٍّ ثنا أَبُو الْأَحْوَصِ عَنْ سِمَاكٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ قَالَ

جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ إِنَّ هَذَا قَدْ غَلَبَنِي عَلَى أَرْضِي قَدْ كَانَتْ لِأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ رَسُولُ اللهِ ﷺ لِلْحَضْرَمِيِّ أَلَكَ بَيِّنَةٌ ؟ قَالَ لَا قَالَ فَلَكَ يَمِينُهُ قَالَ يَا نَبِيَّ اللهِ إِنَّهُ لَيْسَ يُبَالِي مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ عَنْ شَيْءٍ قَالَ لَيْسَ لَكَ إِلَّا ذَلِكَ قَالَ فَانْطَلَقَ بِهِ لِيُحَلِّفَهُ فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا أَدْبَرَ أَمَا لَئِنْ حَلَفَ عَلَى مَالٍ لِيَأْخُذَهُ ظُلْمًا فَلَيَلْقَيَّنَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَنْهُ مُعْرِضٌ هَكَذَا وَجَدْتُهُ فِي كِتَابِي وَكَذَلِكَ وَجَدْتُهُ فِي كِتَابِ مُسْلِمٍ عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ وَزُهَيْرِ بْنِ حَرْبٍ عَنْ أَبِي الْوَلِيدِ عَنْ أَبِي عَوَانَةَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ عَنْ عَلْقَمَةَ وَرَوَاهُ عُثْمَانُ بْنُ سَعِيدٍ الدَّارِمِيُّ وَمُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ أَبِي الْحُنَيْنِ وَأَبُو مُسْلِمٍ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْكَجِّيُّ وَغَيْرُهُمْ عَنْ أَبِي الْوَلِيدِ فَقَالُوا فِي الْحَدِيثِ لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ وَكَذَلِكَ  

رَوَاهُ قُتَيْبَةُ بْنُ سَعِيدٍ وَغَيْرُهُ عَنْ أَبِي الْأَحْوَصِ لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ وَهَذَا لَا يَنْفِي الْحُكْمَ بِالْعِلْمِ وَإِنَّمَا يَنْفِي أَنْ يَكُونَ لَهُ مِنْ جِهَةِ الْمُدَّعَى عَلَيْهِ شَيْءٌ غَيْرُ الْيَمِينِ وَاللهُ أَعْلَمُ

On the Authority of his father: A man from Hadramawt and a man of Kindah came to the Messenger of Allah ﷺ. Al-Hadrami said: Messenger of Allah, this (man) took away forcibly from me the land which belongs to my father. Al-Kindi said: It is my land in my possession, and I cultivate it, he has no right to it. The Prophet ﷺ then said to al-Hadrami: Have you any proof ? He said: No. He then said: So for you is his oath. He said: Messenger of Allah, he is liar, he does not care for which he is taking the oath. He does not refrain himself from anything. The Prophet ﷺ said: You will have nothing from him except that. He went to take an oath for him. When he turned his back, the Messenger of Allah ﷺ said: If he takes an oath on the property to take it away by unfair means, he will meet Allah while He is unmindful of him. البيهقي:٢١٢١٠أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا عُثْمَانُ بْنُ عُمَرَ الضَّبِّيُّ ثنا مُسَدَّدٌ ثنا أَبُو الْأَحْوَصِ ثنا سِمَاكُ بْنُ حَرْبٍ عَنْ عَلْقَمَةَ بْنِ وَائِلِ بْنِ حُجْرٍ عَنْ أَبِيهِ قَالَ
