[AI] I came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, tomorrow we will encounter the enemy without any duration (weapons) with us." The Messenger of Allah ﷺ said, "Show me or hasten what spills blood and the name of Allah is mentioned upon it, so eat what is not a tooth or a nail." I will inform you about that. As for the tooth, it is a bone, and as for the nail, it is the duration (weapon) of the Abyssinians. The people (companions) proceeded quickly, so hasten. They obtained from the spoils of war, and the Messenger of Allah ﷺ was among the last people. They set up pots, and the Messenger of Allah ﷺ passed by the pots, so he ordered them, and they were filled. He distributed it among them. He balanced a camel with ten shiahs (portion) and called for a camel from the camels of the people, and they did not have horses with them. A man threw an arrow at it, and Allah seized it. The Prophet ﷺ said, "Indeed, this camel has her babies like the offspring of wild animals. When he does this with it, do likewise with it."

(When the Prophet came) he ordered the pots to be upset and then he distributed the animals (of the booty), regarding ten sheep as equal to one camel. One of the camels fled and the people ran after it till they were exhausted. At that time there were few horses. A man threw an arrow at the camel, and Allah stopped the camel with it. The Prophet ﷺ said, "Some of these animals are like wild animals, so if you lose control over one of these animals, treat it in this way (i.e. shoot it with an arrow)." Before distributing them among the soldiers my grandfather said, "We may meet the enemies in the future and have no knives; can we slaughter the animals with reeds?" The Prophet ﷺ said, "Use whatever causes blood to flow, and eat the animals if the name of Allah has been mentioned on slaughtering them. Do not slaughter with teeth or fingernails and I will tell you why: It is because teeth are bones (i.e. cannot cut properly) and fingernails are the tools used by the Ethiopians (whom we should not imitate for they are infidels).

My grandfather, Rafiʿ bin Khadij said, "We were in the valley of Dhul-Hulaifa of Tuhama in the company of the Prophet ﷺ and had some camels and sheep (of the booty). The people hurried (in slaughtering the animals) and put their meat in the pots and started cooking. Messenger of Allah ﷺ came and ordered them to upset the pots, and distributed the booty considering one camel as equal to ten sheep. One of the camels fled and the people had only a few horses, so they got worried. (The camel was chased and) a man slopped the camel by throwing an arrow at it. Messenger of Allah ﷺ said, 'Some of these animals are untamed like wild animals, so if anyone of them went out of your control, then you should treat it as you have done now.' " My grandfather said, "O Messenger of Allah ﷺ! We fear that we may meet our enemy tomorrow and we have no knives, could we slaughter the animals with reeds?" The Prophet ﷺ said, "Yes, or you can use what would make blood flow (slaughter) and you can eat what is slaughtered and the Name of Allah is mentioned at the time of slaughtering. But don't use teeth or fingernails (in slaughtering). I will tell you why, as for teeth, they are bones, and fingernails are used by Ethiopians for slaughtering. (See Hadith 668)

(When he came) he ordered that the cooking pots should be upset and then he distributed the booty (amongst the people) regarding ten sheep as equal to one camel then a camel fled and the people chased it till they got tired, as they had a few horses (for chasing it). So a man threw an arrow at it and caused it to stop (with Allah's Permission). On that the Prophet ﷺ said, 'Some of these animals behave like wild beasts, so, if any animal flee from you, deal with it in the same way." My grandfather asked (the Prophet ﷺ ), "We hope (or are afraid) that we may meet the enemy tomorrow and we have no knives. Can we slaughter our animals with canes?" Messenger of Allah ﷺ replied, "If the instrument used for killing causes the animal to bleed profusely and if Allah's Name is mentioned on killing it, then eat its meat (i.e. it is lawful) but won't use a tooth or a nail and I am telling you the reason: A tooth is a bone (and slaughtering with a bone is forbidden ), and a nail is the slaughtering instrument of the Ethiopians."

Then he distributed the animals, regarding ten sheep as equal to one camel. One of the camels ran away and there were a few horses with the people. They chased the camel but they got tired, whereupon a man shot it with an arrow whereby Allah stopped it. The Prophet ﷺ said, "Among these animals some are as wild as wild beasts, so if one of them runs away from you, treat it in this way." I said. "We hope, or we are afraid that tomorrow we will meet the enemy and we have no knives, shall we slaughter (our animals) with canes?" that he said, "O Messenger of Allah ﷺ! We have no knife." The Prophet ﷺ said, "if the killing tool causes blood to gush out, and if Allah's Name is mentioned, eat (of the slaughtered animal). But do not slaughter with a nail or a tooth, for the nail is the knife of Ethiopians and a tooth is a bone." Suddenly a camel ran away and it was stopped (with an arrow). The Prophet ﷺ then said, "Of these camels there are some which are as wild as wild beasts; so if one of them runs away from you and you cannot catch it, treat it in this manner (i.e. shoot it with an arrow).

I said, "O Messenger of Allah ﷺ! We are going to face the enemy tomorrow and we do not have knives." He said, "Hurry up (in killing the animal). If the killing tool causes blood to flow out, and if Allah's Name is mentioned, eat (of the slaughtered animal). But do not slaughter with a tooth or a nail. I will tell you why: As for the tooth, it is a bone; and as for the nail, it is the knife of Ethiopians." Then we got some camels and sheep as war booty, and one of those camels ran away, whereupon a man shot it with an arrow and stopped it. Messenger of Allah ﷺ said, "Of these camels there are some which are as wild as wild beasts, so if one of them (runs away and) makes you tired, treat it in this manner."

قُلْتُ يَا رَسُولَ اللَّهِ إِنَّا لاَقُو الْعَدُوِّ غَدًا وَلَيْسَتْ مَعَنَا مُدًى فَقَالَ اعْجَلْ أَوْ أَرِنْ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللَّهِ فَكُلْ لَيْسَ السِّنَّ وَالظُّفُرَ وَسَأُحَدِّثُكَ أَمَّا السِّنُّ فَعَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشَةِ وَأَصَبْنَا نَهْبَ إِبِلٍ وَغَنَمٍ فَنَدَّ مِنْهَا بَعِيرٌ فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللَّهِ ﷺ إِنَّ لِهَذِهِ الإِبِلِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ فَإِذَا غَلَبَكُمْ مِنْهَا شَىْءٌ فَافْعَلُوا بِهِ هَكَذَا

I said to the Prophet, "We will be facing the enemy tomorrow and we have no knives (for slaughtering)' He said, "If you slaughter the animal with anything that causes its blood to flow out, and if Allah's Name is mentioned on slaughtering it, eat of it, unless the killing instrument is a tooth or nail. I will tell you why: As for the tooth, it is a bone; and as for the nail, it is the knife of Ethiopians." The quick ones among the people got the war booty while the Prophet ﷺ was behind the people. So they placed the cooking pots on the fire, but the Prophet ﷺ ordered the cooking pots to be turned upside down. Then he distributed (the war booty) among them, considering one camel as equal to ten sheep. Then a camel belonging to the first party of people ran away and they had no horses with them, so a man shot it with an arrow whereby Allah stopped it. The Prophet ﷺ said, "Of these animals there are some which are as wild as wild beasts. So, if anyone of them runs away like this, do like this (shoot it with an arrow).

While we were with the Prophet. on a journey, one of the camels ran away. A man shot it with an arrow and stopped it. The Prophet ﷺ said, "Of these camels some are as wild as wild beasts, so if one of them runs away and you cannot catch it, then do like this (shoot it with an arrow)." I said, "O Allah's Apostle! Sometimes when we are in battles or on a journey we want to slaughter (animals) but we have no knives." He said, "Listen! If you slaughter the animal with anything that causes its blood to flow out, and if Allah's Name is mentioned on slaughtering it, eat of it, provided that the slaughtering instrument is not a tooth or a nail, as the tooth is a bone and the nail is the knife of Ethiopians."

Thereupon Messenger of Allah ﷺ said: Make haste or be careful (in making arrangements for procuring knives) which would let the blood flow (and along with it) the name of Allah is also to be recited. Then eat, but not the tooth or nail. And I am going to tell you why it is not permissible to slaughter the animal with the help of tooth and bone; and as for the nail. it is a bone, and the bone is the knife of Abyssinians. He (the narrator) said: There fell to our lot as spoils of war camels and goats, and one of the camels among them became wild. A person (amongst usl struck It with an arrow which brought it under control. whereupon Messenger of Allah ﷺ said: This camel became wild like wild animals, so if you find any animal getting wild, you do the same with that

I came to the Messenger of Allah ﷺ and said: Messenger of Allah, we shall meet the enemy tomorrow and we have no knives with us. May we kill with a sharp-edged white stone (flint) and with splinter of a staff ? The Messenger of Allah ﷺ said: Hasten in slaughtering it. When Allah's name is mentioned you may eat what is killed by anything which causes the blood to flow except tooth and claw. I shall tell you about it. The tooth is a bone, and the claw is the knife of Abyssinians. Some people hastened and went forward, they made haste and got booty, while the Messenger of Allah ﷺ was in the rear and they setup cooking pots. The Messenger of Allah ﷺ passed by over the cooking pots. He ordered to turn them over. He then divided (the spoils of war) between them, and gave them a camel for ten goats in equation. One of the camels of the people ran away, and they had no horses with them at that time. A man shot an arrow at it, and Allah prevented it from escaping. The Prophet ﷺ said: Among animals (i.e. camels) there are some which bolt like wild animals ; so when any of them does so, do with it like this.

A man shot and arrow at it and stopped it. He (the Prophet) said; 'Some of these animals - or 'these camels'- 'are untamed like wild animals, so if one of them goes out of your control, do the same."' (Sahih )

[AI] He said, "O Messenger of Allah, we will meet the enemy tomorrow and we do not have a spear." He said, "What is forbidding from drinking its blood and mentioning the name of Allah over it? So eat, for its teeth and nails are not it. And I will tell you about its teeth, they are bones, and about its nails, they are like the hooves of a horse." The Messenger of Allah ﷺ acquired spoils, and a camel from it was taken away, so they pursued it but could not catch it. Then a man from the people shot an arrow at it and hit it, so he restrained it. The Messenger of Allah ﷺ said, "Indeed, for these camels or sheep there are offspring like the offspring of wild animals. So when something defeats you from it, do this." He said, "The Prophet ﷺ used to allocate ten from the spoils to the she-camel." Shu'bah said, "And my most knowledgeable opinion is that I have heard this wording from Sa'id and he used to allocate ten from the spoils to the she-camel. And Sufyan narrated from him, and Muhammad and I have heard this wording from Sufyan."

أحمد:١٧٢٦١حَدَّثَنَا يَحْيَى عَنْ سُفْيَانَ قَالَ حَدَّثَنِي أَبِي عَنْ عَبَايَةَ بْنِ رِفَاعَةَ بْنِ رَافِعِ بْنِ خَدِيجٍ عَنْ جَدِّهِ رَافِعِ بْنِ خَدِيجٍ قَالَ

قُلْتُ يَا رَسُولَ اللهِ إِنَّا لَاقُو الْعَدُوِّ غَدًا وَلَيْسَتْ مَعَنَا مُدًى؟ قَالَ أَعْجِلْ أَوْ أَرِنْ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللهِ عَلَيْهِ فَكُلْ لَيْسَ السِّنَّ وَالظُّفُرَ وَسَأُحَدِّثُكَ أَمَّا السِّنُّ فَعَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشِ قَالَ وَأَصْبَنَا نَهْبَ إِبِلٍ وَغَنَمٍ فَنَدَّ مِنْهَا بَعِيرٌ فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ لَهَذِهِ الْإِبِلِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ فَإِذَا غَلَبَكُمْ مِنْهَا شَيْءٌ فَافْعَلُوا بِهِ هَكَذَا

My grandfather, Rafiʿ bin Khadij said, "We were in the valley of Dhul-Hulaifa of Tuhama in the company of the Prophet ﷺ and had some camels and sheep (of the booty). The people hurried (in slaughtering the animals) and put their meat in the pots and started cooking. Messenger of Allah ﷺ came and ordered them to upset the pots, and distributed the booty considering one camel as equal to ten sheep. One of the camels fled and the people had only a few horses, so they got worried. (The camel was chased and) a man slopped the camel by throwing an arrow at it. Messenger of Allah ﷺ said, 'Some of these animals are untamed like wild animals, so if anyone of them went out of your control, then you should treat it as you have done now.' " My grandfather said, "O Messenger of Allah ﷺ! We fear that we may meet our enemy tomorrow and we have no knives, could we slaughter the animals with reeds?" The Prophet ﷺ said, "Yes, or you can use what would make blood flow (slaughter) and you can eat what is slaughtered and the Name of Allah is mentioned at the time of slaughtering. But don't use teeth or fingernails (in slaughtering). I will tell you why, as for teeth, they are bones, and fingernails are used by Ethiopians for slaughtering. كُنَّا مَعَ النَّبِيِّ ﷺ بِذِي الْحُلَيْفَةِ مِنْ تِهَامَةَ فَأَصَبْنَا غَنَمًا وَإِبِلًا قَالَ فَعَجَّلَ الْقَوْمُ فَأَغْلَوْا بِهَا الْقُدُورَ فَجَاءَ النَّبِيُّ ﷺ فَأَمَرَ بِهَا فَأُكْفِئَتْ ثُمَّ قَالَ عَدْلُ عَشْرَةٍ مِنَ الْغَنَمِ بِجَزُورٍ قَالَ ثُمَّ إِنَّ بَعِيرًا نَدَّ وَلَيْسَ فِي الْقَوْمِ إِلَّا خَيْلٌ يَسِيرَةٌ فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ لِهَذِهِ الْبَهَائِمِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ فَمَا غَلَبَكُمْ مِنْهَا فَاصْنَعُوا بِهِ هَكَذَا قَالَ فَقَالَ رَافِعُ بْنُ خَدِيجٍ إِنَّا لَنَرْجُو أوْ إِنَّا لَنَخَافُ أَنْ نَلْقَى الْعَدُوَّ غَدًا وَلَيْسَ مَعَنَا مُدًى أَفَنَذْبَحُ بِالْقَصَبِ؟ قَالَ أَعْجِلْ أَوْ أَرِنْ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللهِ عَلَيْهِ فَكُلْ لَيْسَ السِّنَّ وَالظُّفُرَ وَسَأُحَدِّثُكُمْ عَنْ ذَلِكَ أَمَّا السِّنُّ فَعَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشَةِ

Messenger of Allah, we are going to encounter the enemy tomorrow, but we have no knives with us. Thereupon Messenger of Allah ﷺ said: Make haste or be careful (in making arrangements for procuring knives) which would let the blood flow (and along with it) the name of Allah is also to be recited. Then eat, but not the tooth or nail. And I am going to tell you why it is not permissible to slaughter the animal with the help of tooth and bone; and as for the nail. it is a bone, and the bone is the knife of Abyssinians. He (the narrator) said: There fell to our lot as spoils of war camels and goats, and one of the camels among them became wild. A person (amongst usl struck It with an arrow which brought it under control. whereupon Messenger of Allah ﷺ said: This camel became wild like wild animals, so if you find any animal getting wild, you do the same with that (Using translation from Muslim 1968a)

malik:47-2Mālik > Ibn Shihāb > ʿUrwah b. al-Zubayr

Yahya related to me from Malik from Ibn Shihab from Urwa ibn az- Zubayr that A'isha, the wife of the Prophet ﷺ said, "The Messenger of Allah ﷺ did not have to choose between two matters, but that he chose the easier of them as long as it was not a wrong action. If it was a wrong action, he was the furthest of people from it. The Messenger of Allah ﷺ did not take revenge for himself unless the limits of Allah were violated. Then he took revenge for it for Allah."

مالك:٤٧-٢وَحَدَّثَنِي عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ

عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ مَا خُيِّرَ رَسُولُ اللَّهِ ﷺ فِي أَمْرَيْنِ قَطُّ إِلاَّ أَخَذَ أَيْسَرَهُمَا مَا لَمْ يَكُنْ إِثْمًا فَإِنْ كَانَ إِثْمًا كَانَ أَبْعَدَ النَّاسِ مِنْهُ وَمَا انْتَقَمَ رَسُولُ اللَّهِ ﷺ لِنَفْسِهِ إِلاَّ أَنْ تُنْتَهَكَ حُرْمَةُ اللَّهِ فَيَنْتَقِمُ لِلَّهِ بِهَا

[AI] "Indeed, the Prophet ﷺ said, 'Any woman who is married without the permission of her guardian, her marriage is invalid, and she is entitled to her dowry as long as she has received any part of it. If they dispute, the ruler is the guardian of one who has no guardian.' Ibn Jurayj said, 'I met al-Zuhri and asked him about it, but he did not know it well, and he praised Sulayman ibn Musa.' Ahmad ibn Hanbal said, 'Indeed, Ibn Jurayj has written books, and this is not mentioned in his books, meaning the narration of Ibn 'Ulayyah from Ibn Jurayj.' I heard Abu al-Abbas Muhammad ibn Ya'qub say, 'I heard al-Abbas ibn Muhammad al-Duri say, 'I heard Yahya ibn Ma'in say about the hadith 'There is no marriage except with a guardian,' which Ibn Jurayj narrates, so I said to him, 'Indeed, Ibn 'Ulayyah says this.' Ibn Jurayj said, 'I asked al-Zuhri about it, and he said, 'I do not remember it well.' Yahya ibn Ma'in said, 'No one says this except Ibn 'Ulayyah, and Ibn 'Ulayyah only presented the books of Ibn Jurayj to 'Abd al-Majid ibn 'Abd al-Aziz ibn Abi Rawwad, who corrected them for him, but he did not exert himself to preserve the hadith.'"

قَالَ الْحَاكِمُ «رَجَعْنَا إِلَى الْأَصْلِ الَّذِي لَمْ يَسَعِ الشَّيْخَيْنِ إِخْلَاءُ الصَّحِيحَيْنِ عَنْهُ وَهُوَ حَدِيثُ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةِ عَنْ أَبِي مُوسَى»

ذِكْرُ الْبَيَانِ بِأَنَّ أَكْلَ مَا ذُبِحَ بِغَيْرِ الْحَدِيدِ، وَذُكِرَ اسْمُ اللَّهِ عَلَيْهِ جَائِزٌ أَكْلُهُ خَلَا السِّنِّ وَالظُّفُرِ

My grandfather, Rafiʿ said, "We were in the company of the Prophet ﷺ at DhulHulaifa, and the people suffered from hunger. We got some camels and sheep (as booty) and the Prophet ﷺ was still behind the people. They hurried and put the cooking pots on the fire. (When he came) he ordered that the cooking pots should be upset and then he distributed the booty (amongst the people) regarding ten sheep as equal to one camel then a camel fled and the people chased it till they got tired, as they had a few horses (for chasing it). So a man threw an arrow at it and caused it to stop (with Allah's Permission). On that the Prophet ﷺ said, 'Some of these animals behave like wild beasts, so, if any animal flee from you, deal with it in the same way." My grandfather asked (the Prophet ﷺ ), "We hope (or are afraid) that we may meet the enemy tomorrow and we have no knives. Can we slaughter our animals with canes?" Messenger of Allah ﷺ replied, "If the instrument used for killing causes the animal to bleed profusely and if Allah's Name is mentioned on killing it, then eat its meat (i.e. it is lawful) but won't use a tooth or a nail and I am telling you the reason: A tooth is a bone (and slaughtering with a bone is forbidden ), and a nail is the slaughtering instrument of the Ethiopians." ابن حبّان:٥٨٨٦أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ سَعِيدِ بْنِ مَسْرُوقٍ عَنْ عَبَايَةَ بْنِ رِفَاعَةَ بْنِ رَافِعِ بْنِ خَدِيجٍ عَنْ جَدِّهِ رَافِعِ بْنِ خَدِيجٍ قَالَ

كُنَّا مَعَ النَّبِيِّ ﷺ بِذِي الْحُلَيْفَةِ فَأَصَابَ النَّاسَ جُوعٌ وَأَصَبْنَا إِبِلًا وَغَنَمًا وَكَانَ رَسُولُ اللَّهِ ﷺ فِي أُخْرَيَاتِ النَّاسِ فَعَجِلُوا فَذَبَحُوا وَنَصَبُوا الْقُدُورَ فَرَجَعَ إِلَيْهِمْ رَسُولُ اللَّهِ ﷺ فَأَمَرَ بِالْقُدُورِ فَأُكْفِئَتْ ثُمَّ قَسَمَ فَعَدَلَ عَشْرًا مِنَ الْغَنَمِ بِبَعِيرٍ فَنَدَّ مِنْهَا بَعِيرٌ وَكَانَ فِي الْقَوْمِ خَيْلٌ يَسِيرَةٌ فَطَلَبُوهُ فَأَعْيَاهُمْ فَأَهْوَى إِلَيْهِ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ هَذِهِ الْبَهَائِمَ لَهَا أَوَابِدُ كَأَوَابِدِ الْوحُوشِ فَمَا نَدَّ عَلَيْكُمْ مِنْهَا فَاصْنَعُوا بِهِ هَكَذَا» وَقَالَ جَدِّي إِنَّا نَرْجُو أَنْ نَلْقَى غَدًا عَدُوًّا وَلَيْسَ مَعَنَا مُدًى فَنَذْبَحُ بِالْقُضُبِ فَقَالَ ﷺ «مَا أَنْهَرَ الدَّمُ وَذُكِرَ اسْمُ اللَّهِ عَلَيْهِ فَكُلْ لَيْسَ السِّنَّ وَالظُّفُرَ وَسَأُحَدِّثُكُمْ عَنْ ذَلِكَ أَمَا السِّنُّ فَعَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشَةِ»

[AI] We were with the Messenger of Allah ﷺ at Dhul Khalifah from Tihama when the people obtained camels and sheep, and they hurried and overcooked the pots. The Messenger of Allah ﷺ came to them and ordered the pots to be reduced, so they were evenly distributed and ten sheep were exchanged for one goat. We also slaughtered a camel and a man threw an arrow at it, so the Messenger of Allah ﷺ confiscated it. He said, "These animals have offspring like the offspring of wild beasts, so whatever you have left, do this with it." Then Rafa' ibn Khadij approached him and said, "O Messenger of Allah, we fear or hope for an encounter with the enemy, and we do not have meat that can be preserved. Should we slaughter the camels?" The Messenger of Allah ﷺ said, "If the blood is drained and the name of Allah is mentioned upon it, then eat. Do not eat the teeth or the hooves. I will tell you about this. As for the teeth, they are bones, and as for the hooves, they are the length of an Abyssinian span." Rafa' added, "Then a sick camel fell into a well in the city, so it was taken out by drawing water from it. 'Umar took a piece from it worth a dirham."

كُنَّا مَعَ رَسُولِ اللهِ ﷺ بِذِي الْخَلِيفَةِ مِنْ تِهَامَةَ فَأَصَابَ الْقَوْمُ إِبِلًا وَغَنَمًا فَعَجِلُوا فَأَغْلَوْا بِهِ الْقُدُورَ فَانْتَهَى إِلَيْهِمْ رَسُولُ اللهِ ﷺ فَأَمَرَ بِالْقُدُورِ فَكُفِئَتْ فَعَدَلَ عَشَرَةً مِنَ الْغَنَمِ بِجَزُورٍ قَالَ وَنَدَّ مِنْهَا بَعِيرٌ فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ لِهَذِهِ الْبَهَائِمِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ فَمَا غَلَبَكُمْ مِنْهَا فَاصْنَعُوا بِهِ هَكَذَا» ثُمَّ أَتَاهُ رَافِعُ بْنُ خَدِيجٍ فَقَالَ يَا رَسُولَ اللهِ إِنَّا نَخَافُ أَوْ نَرْجُو أَنْ نَلْقَى الْعَدُوَّ وَلَيْسَ مَعَنَا مُدًى أَفَنَذْبَحُ بِالْقَصَبِ؟ فَقَالَ رَسُولُ اللهِ ﷺ مَا أَنْهَرَ الدَّمَ وَذُكِرَ عَلَيْهِ اسْمُ اللهِ فَكُلُوا لَيْسَ السِّنَّ وَالظُّفُرَ وَسَأُحَدِّثُكُمْ عَنْ ذَلِكَ أَمَّا السِّنُّ فَعَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشِ قَالَ رَافِعٌ ثُمَّ إِنَّ نَاضِحًا تَرَدَّى فِي بِئْرٍ بِالْمَدِينَةِ فَذُكِّيَ مِنْ قِبَلِ شَاكِتَلِهِ يَعْنِي خَاصِرَتَهُ فَأَخَذَ مِنْهُ عُمَرُ عَشِيرًا بِدِرْهَمٍ

The Messenger of Allah ﷺ obtained some camels as spoils of war, so a man from the people threw an arrow hitting it, and he killed it. So the Messenger of Allah ﷺ confiscated it and said, "Indeed, these camels have (many) descendants, like the descendants of the wild animals. So when something from them defeats you, do this." He said, "And the Prophet ﷺ used to distribute one-tenth of the booty in sheep, by means of a camel." And Muhammad narrated to me, and I had also heard from Sufyan, this letter (the Harf)

The Messenger of Allah ﷺ came to them and commanded for the pots to be piled up and they were filled with the meat. Then he divided ten sheep for one camel. Among the people, there was a camel that got tired and they sought it, so a man shot it with an arrow and captured it. The Messenger of Allah ﷺ said, "Indeed, these animals have owners, just like wild animals have owners. What is taken from them is for you to use in this way." We said, "We fear or hope that we might encounter the enemy tomorrow and we don't have any means. Should we slaughter it with a piece of wood?" He said, "As long as the blood is drained and the name of Allah is mentioned upon it, then everything except for the teeth and the hoofs can be eaten. I will inform you about that. As for the teeth, they are bones and as for the hoofs, they are the measurement of a Habasha adornment."

The Prophet ﷺ said, "Indeed, this camel has offspring, just like a wild animal. If any of them overpowers you, do the same to them." Then my grandfather said, "O Messenger of Allah, we are afraid that we will encounter the polytheists tomorrow, and we do not have enough provisions." The Messenger of Allah ﷺ said, "Do not slaughter any animal without mentioning the name of Allah, and eat everything except the spinal cord and the nail (of the animal). I will tell you about what to do in that case. As for the bone, it is a piece of meat, and as for the nail, it is a discard of the Habashiyyah."

"I said: 'O Messenger of Allah, we are going to meet the enemy tomorrow, and we do not have any knives.' He said: 'If the blood is shed and the name of Allah is mentioned, then eat, unlike (it is slaughtered) with teeth or nails." Then the Messenger of Allah got some spoils of war and a camel ran away. A man shot and arrow at it and stopped it. He (the Prophet) said; 'Some of these animals - or 'these camels'- 'are untamed like wild animals, so if one of them goes out of your control, do the same."' I said, "O Messenger of Allah ﷺ! We are going to face the enemy tomorrow and we do not have knives." He said, "Hurry up (in killing the animal). If the killing tool causes blood to flow out, and if Allah's Name is mentioned, eat (of the slaughtered animal). But do not slaughter with a tooth or a nail. I will tell you why: As for the tooth, it is a bone; and as for the nail, it is the knife of Ethiopians." Then we got some camels and sheep as war booty, and one of those camels ran away, whereupon a man shot it with an arrow and stopped it. Messenger of Allah ﷺ said, "Of these camels there are some which are as wild as wild beasts, so if one of them (runs away and) makes you tired, treat it in this manner." Abu Abdullah Al-Hafith informed us, that Abu Al-Abbas Muhammad bin Ya'qub informed us, that Abbas Ad-Duri said, "I heard Yahya bin Ma'in saying, 'Sinan bin Rabee'ah reported from Hammad bin Zaid, and he is not strong.'" Abu Abdullah Ar-Rahman As-Salami informed us, that Abu Saeed Al-Khallal informed us, that Abu Al-Qasim Al-Baghawi informed us, that Mahmoud bin Ghaylan informed us, that Al-Nadr bin Shumayl informed us, that Ibn Awn was mentioned to him, and he said, "The people criticized him." Then the tongues of the people started slandering him. And with this chain of narrators, Mahmoud bin Ghaylan informed us, that Shu'bah said, "Shahr bin Hawshab accompanied a man from the people of Sham, and he stole his clothing." Abu Abdullah Al-Hafith informed us, that I am Abu Al-Abbas Muhammad bin Ya'qub, Shahr bin Hawshab sold his religion for clothing. So who will trust the reciters after you, O Shahr?" Abu Bakr Ahmed bin Muhammad Al-Faqih informed us, that Ali bin Umar Al-Hafith informed us, that Da'lj bin Ahmad said, "I asked Musa bin Harun about this Hadith, and he said, 'There is nothing in it from Shahr bin Hawshab, and the Hadith regarding its authenticity is doubtful.'" Ibn Khuzaymah said, "And Muhammad ibn Aslam narrated to us from Ubaidullah ibn Musa, who narrated from Isra'il with this chain of narration, mentioning it in the same way. The Shaykh said, "And this addition in this hadith I did not find except in the narration of Ibn Khuzaymah, who is an Imam, and I saw it in an old copy of Ibn Khuzaymah's book that does not have this addition, then it was added in another handwriting in its margin. It is most likely that it was added to his book without his knowledge. Allah knows best. And Imam Abu Uthman al-Saabuni informed us that I, Abu Tahir Muhammad ibn al-Fadl ibn Muhammad ibn Ishaq ibn Khuzaymah, narrated from my grandfather, who mentioned it without this addition in the hadith. رَوَاهُ شَرِيكٌ وَعَبَّادُ بْنُ الْعَوَّامِ عَنْ حُصَيْنِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى عَنْ عَبْدِ اللهِ بْنِ زَيْدٍ قَالَ اسْتَشَارَ رَسُولُ اللهِ ﷺ النَّاسَ فِي الْأَذَانِ فَذَكَرَ الْحَدِيثَ وَقَالَ فِيهِ فَأَذَّنَ مَثْنَى مَثْنَى ثُمَّ قَعَدَ قَعْدَةً ثُمَّ أَقَامَ مَثْنَى مَثْنَى 1978 وَأَخْبَرَنَا أَبُو الْحَسَنِ الْمُقْرِئُ ثنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا حُصَيْنُ بْنُ نُمَيْرٍ فَذَكَرَهُوَكَذَلِكَ رَوَاهُ جَمَاعَةٌ ابْنُ فُضَيْلٍ وَغَيْرُهُ عَنِ الْأَعْمَشِ عَنْ عَمْرِو بْنِ مُرَّةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَالْحَدِيثُ مَعَ الِاخْتِلَافِ فِي إِسْنَادِهِ مُرْسَلٌ لِأَنَّ عَبْدَ الرَّحْمَنِ بْنَ أَبِي لَيْلَى لَمْ يُدْرِكْ مُعَاذًا وَلَا عَبْدَ اللهِ بْنَ زَيْدٍ وَلَمْ يُسَمِّ مَنْ حَدَّثَهُ عَنْهُمَا وَلَا عَنْ أَحَدِهِمَا أَخْبَرَنَا أَبُو بَكْرِ بْنُ عَلِيٍّ الْحَافِظُ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ قَالَ قَالَ مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ عَبْدُ الرَّحْمَنِ بْنُ أَبِي لَيْلَى لَمْ يَسْمَعْ مِنْ مُعَاذِ بْنِ جَبَلٍ وَلَا مِنْ عَبْدِ اللهِ بْنِ زَيْدِ بْنِ عَبْدِ رَبِّهِ صَاحِبِ الْأَذَانِ فَغَيَرُ جَائِزٍ أَنْ يُحْتَجَّ بِخَبَرٍ غَيْرِ ثَابِتٍ عَلَى أَخْبَارٍ ثَابِتَةٍ قَالَ الشَّيْخُ وَقَدْ رُوِيَ فِي هَذَا الْبَابِ أَخْبَارٌ مِنْ أَوْجُهٍ أُخَرَ كُلُّهَا ضَعِيفَةٌ قَدْ بَيَّنْتُ ضَعْفَهَا فِي الْخِلَافِيَّاتِ وَأَمْثَلُ إِسْنَادٍ رُوِيَ فِي تَثْنِيَةِ الْإِقَامَةِ حَدِيثُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَهُوَ إِنْ صَحَّ فَكُلُّ أَذَانٍ رَوَى ثُنَائِيَّةً فَهُوَ بَعْدَ رُؤْيَا عَبْدِ اللهِ بْنِ زَيْدٍ فَيَكُونُ أَوْلَى مِمَّا رُوِيَ فِي رُؤْيَاهُ مَعَ الِاخْتِلَافِ فِي كَيْفِيَّةِ رُؤْيَاهُ فِي الْإِقَامَةِ فَالْمَدَنِيُّونَ يَرْوُونَهَا مُفْرَدَةً وَالْكُوفِيُّونَ يَرْوُونَهَا مَثْنَى مَثْنَى وَإِسْنَادُ الْمَدَنِيِّينَ مَوْصُولٌ وَإِسْنَادُ الْكُوفِيِّينَ مُرْسَلٌ وَمَعَ مَوْصُولِ الْمَدَنِيِّينَ مُرْسَلُ سَعِيدِ بْنِ الْمُسَيِّبِ وَهُوَ أَصَحُّ التَّابِعِينَ إِرْسَالًا ثُمَّ مَا رُوِّينَا مِنَ الْأَمْرِ بِالْإِفْرَادِ بَعْدَهُ وَفِعْلُ أَهْلِ الْحَرَمَيْنِ وَبِاللهِ التَّوْفِيقُ

[AI] Abdullah ibn Umar and Abu Hurairah reported that they heard the Messenger of Allah ﷺ saying while standing on the steps of his pulpit, "A time will come when some people will stop attending Friday prayers, or Allah will seal their hearts, and they will become among the heedless."

[AI] I went to the Messenger of Allah ﷺ and embraced Islam. Then I said, "O Messenger of Allah, make something for my people that they can embrace Islam with from their wealth." So the Messenger of Allah ﷺ did so and appointed me to collect it from them. Abu Bakr also appointed me, then Umar appointed me. Saad was one of the people of Sura, and I spoke to my people about honey and said to them, "It is a form of charity because there is no good in a fruit that is not purified." They asked, "How much?" I said, "One tenth." So I took one tenth from them and went to Umar bin Khattab and informed him. Umar took it and sold it, and then placed its price in the charities of the Muslims.

I said, "You should return it to him or I will inform the Messenger of Allah ﷺ about it." He said, "We will not return it to him." I said, "Fine." So we gathered with the Messenger of Allah ﷺ and I narrated to him the story of Madadi and what Khalid did. The Messenger of Allah ﷺ said, "O Khalid, what prompted you to do what you did?" Khalid said, "O Messenger of Allah, I increased it." The Messenger of Allah ﷺ said, "O Khalid, return to him what you took from him." Awf said, "I said to you, O Khalid, did I not warn you?" The Messenger of Allah ﷺ asked, "What happened?" So I informed him. The Messenger of Allah ﷺ became angry and said, "O Khalid, do not return it to him. Are you leaving my commanders for you, the elite of their affairs, while they face difficulties?"

البيهقي:١٢٧٨٣وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ حَدَّثَنِي صَفْوَانُ عَنْ عَمْرٍو عَنْ عَبْدِ الرَّحْمَنِ بْنِ جُبَيْرِ بْنِ نُفَيْرٍ عَنْ أَبِيهِ عَنْ عَوْفِ بْنِ مَالِكٍ الْأَشْجَعِيِّ قَالَ خَرَجْتُ مَعَ زَيْدِ بْنِ حَارِثَةَ فِي غَزْوَةِ مُؤْتَةَ وَرَافَقَنِي مَدَدِيٌّ مِنْ أَهْلِ الْيَمَنِ لَيْسَ مَعَهُ غَيْرُ سَيْفِهِ فَجَزَرَ رَجُلٌ مِنَ الْمُسْلِمِينَ جَزُورًا فَسَأَلَهُ الْمَدَدِيُّ طَائِفَةً مِنْ جِلْدِهِ فَأَعْطَاهُ إِيَّاهُ فَاتَّخَذَهُ كَهَيْئَةِ الدَّرَقِ وَمَضَيْنَا فَلَقِينَا جُمُوعَ الرُّومِ وَفِيهِمْ رَجُلٌ عَلَى فَرَسٍ لَهُ أَشْقَرَ عَلَيْهِ سَرْجٌ مُذَهَّبٌ وَسِلَاحٌ مُذَهَّبٌ فَجَعَلَ الرُّومِيُّ يَفْرِي بِالْمُسْلِمِينَ وَقَعَدَ لَهُ الْمَدَدِيُّ خَلْفَ صَخْرَةٍ فَمَرَّ بِهِ الرُّومِيُّ فَعَرْقَبَ فَرَسَهُ فَخَّرَّ وَعَلَاهُ فَقَتَلَهُ وَحَازَ فَرَسَهُ وَسِلَاحَهُ فَلَمَّا فَتَحَ اللهُ ﷻ لِلْمُسْلِمِينَ بَعَثَ إِلَيْهِ خَالِدُ بْنُ الْوَلِيدِ فَأَخَذَ مِنَ السَّلَبِ قَالَ عَوْفٌ فَأَتَيْتُهُ فَقُلْتُ يَا خَالِدُ أَمَا عَلِمْتَ

أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالسَّلَبِ لِلْقَاتِلِ؟ قَالَ بَلَى وَلَكِنِّي اسْتَكْثَرْتُهُ قُلْتُ لَتَرُدَّنَّهُ إِلَيْهِ أَوْ لَأُعَرِّفَنَّكَهَا عِنْدَ رَسُولِ اللهِ ﷺ قَالَ لَنْ نَرُدَّ عَلَيْهِ قَالَ عَوْفٌ فَاجْتَمَعْنَا عِنْدَ رَسُولِ اللهِ ﷺ فَقَصَصْتُ عَلَيْهِ قِصَّةَ الْمَدَدِيِّ وَمَا فَعَلَ خَالِدٌ فَقَالَ رَسُولُ اللهِ ﷺ يَا خَالِدُ مَا حَمَلَكَ عَلَى مَا صَنَعْتَ؟ قََالَ يَا رَسُولَ اللهِ اسْتَكْثَرْتُهُ فَقَالَ رَسُولُ اللهِ ﷺ يَا خَالِد رُدَّ عَلَيْهِ مَا أَخَذْتَ مِنْهُ قَالَ عَوْفٌ فَقُلْتُ دُونَكَ يَا خَالِدُ أَلَمْ أَفِ لَكَ؟ فَقَالَ رَسُولُ اللهِ ﷺ وَمَا ذَاكَ؟ فَأَخْبَرْتُهُ قَالَ فَغَضِبَ رَسُولُ اللهِ ﷺ فَقَالَ يَا خَالِدُ لَا تَرُدَّ عَلَيْهِ هَلْ أَنْتُمْ تَارِكُو لِي أُمَرَائِي لَكُمْ صَفْوَةُ أَمْرِهِمْ وَعَلَيْهِمْ كَدَرُهُ؟

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ زُهَيْرِ بْنِ حَرْبٍ عَنِ الْوَلِيدِ بْنِ مُسْلِمٍ 12784 أَخْبَرَنَا أَبُو عَلِيٍّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا الْوَلِيدُ قَالَ سَأَلْتُ ثَوْرًا عَنْ هَذَا الْحَدِيثِ فَحَدَّثَنِي عَنْ خَالِدِ بْنِ مَعْدَانَ عَنْ جُبَيْرِ بْنِ نُفَيْرٍ عَنْ عَوْفِ بْنِ مَالِكٍ الْأَشْجَعِيِّ نَحْوَهُ 12785 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ أنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ح قَالَ وَأَخْبَرَنِي مُحَمَّدُ بْنُ أَحْمَدَ بْنِ إِسْمَاعِيلَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا عَلِيُّ بْنُ سَهْلٍ الرَّمْلِيُّ قَالَا ثنا الْوَلِيدُ بْنُ مُسْلِمٍ عَنْ صَفْوَانَ بْنِ عَمْرٍو عَنْ عَبْدِ الرَّحْمَنِ بْنِ جُبَيْرِ بْنِ نُفَيْرٍ عَنْ أَبِيهِ عَنْ عَوْفِ بْنِ مَالِكٍ أَنَّ رَسُولَ اللهِ ﷺ لَمْ يَكُنْ يُخَمِّسُ السَّلَبَ وَأَنَّ مَدَدِيًّا كَانَ رَفِيقًا لَهُمْ فِي غَزْوَةِ مُؤْتَةَ فَذَكَرَ الْحَدِيثَ بِالْإِسْنَادَيْنِ جَمِيعًا بِمَعْنَاهُ

And the Messenger of Allah ﷺ did not seek revenge for himself unless the sanctity of Allah was violated, so he would take revenge for the sake of Allah. 13284 And Abu Abdullah Al-Hafiz informed us, Ali ibn Isa informed us, Musa ibn Muhammad Al-Dhuhli informed us, Yahya ibn Yahya said: I read it to Malik, and he mentioned it except that he did not mention his saying "so he would take revenge for the sake of Allah."

[AI] We said, "O Messenger of Allah, we will encounter the enemy tomorrow without provisions." He said, "What prohibits one from drinking blood and mentioning the name of Allah? Eat, for neither teeth nor nails are considered provisions." As for teeth, they are bones, and as for nails, they are like the bark of the Abyssinian tree." He narrated that the Messenger of Allah ﷺ acquired spoils, so a man tried to take a camel from it, but he was unable to control it. So, a man struck it with an arrow, disabling it. The Messenger of Allah ﷺ held it and said, "Indeed, these camels are either continuously pregnant or have long horns, similar to wild animals. So, what is your concern about them? Deal with them in this manner." Then he threw a camel into a well, and they were unable to slaughter it except by leaning it on its side. Ibn 'Umar bought a camel from it for two dirhams, and Abu 'Abdullah and Abu Sa'id mentioned it in al-Fawaid as a means of sustenance.

[AI] We were with the Messenger of Allah, ﷺ , in Dhi al-Hulayfah from Tihamah, and the people were hungry. They slaughtered camels and sheep. The Messenger of Allah, ﷺ , came to them when the pots were set up. The Messenger of Allah, ﷺ , ordered the pots, and they were filled. Then he divided them among the people, giving each group ten sheep for one camel. A person threw an arrow at a camel from the people’s camels; the people did not have anything but a few horses. The Messenger of Allah, ﷺ , held the arrow and said, "Indeed, these camels have young ones, like those of wild animals. So whatever you have left of them, do this with it." Abu Dawud narrated this hadith from Rifa'ah. We said, "O Messenger of Allah, we will face the enemy tomorrow, and we do not have anything to oil our bows with. Shall we slaughter the camels (for that purpose)?" The Messenger of Allah, ﷺ , said, "As for the blood, it is not disliked, and if you mention the name of Allah (i.e., saying Bismillah) over it, then eat (the meat of) whatever is left of them, except for the bones and the hooves." Then he told us about something. As for the bones, they are firewood, and as for the hooves, they are provided to the Abyssinians.

He said, "We captured some camels and sheep, so we used to consider one camel equal to ten sheep, then a camel from it was given to us and we pelted it with stones until we brought it down." He said, "So we asked the Messenger of Allah and he said, 'These camels have glands like the glands of the wild animals, so if something falls from them, use it for that and eat.'"

Some of the women in the house of Maymuna said, "Inform the Messenger of Allah about what he wants to eat." They said, "It is a lizard, O Messenger of Allah." So, the Messenger of Allah raised his hand, and I said, "Is it haram?" He said, "No, but it was not found in my people's land, so I find it repulsive." Khalid said, "So I repeated it and ate it, and the Messenger of Allah observed."

"قَالَ ق: أَنا عَبْدُ اللهِ، أَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ دَاودَ بْنِ سُلَيْمَانَ الصُّوفِىُّ قَالَ: قُرِئَ عَلَى ابْنِ عَلِىٍّ مُحَمَّدِ بْنِ الأَشْعَثِ الْكُوفِىِّ بمِصْرَ وَأَنَا أَسْمَعُ قَالَ: حَدَّثَنِى أَبُو الْحَسَنِ مُوسَى بْنُ إِسْمَاعيلَ بْنِ مُوسَى بْنِ جَعْفَر بْنِ مُحَمَّدِ بْنِ عَلِىِّ بْنِ الْحُسَيْنِ بْنِ عَلِىِّ بْنِ أَبِى طَالبٍ، حَدَّثَنا أَبِى إِسْمَاعيلُ عن أبيه، عن جده جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ، عَنْ جَدِّه عن عَلىِّ بْنِ الْحُسيْنِ، عَنْ أَبيه الْحُسَيْنِ، عَنْ أَبيه عَلِىِّ بْنِ أَبِى طَالِبٍ قَالَ: قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْعَبْدِ مِنَ الْغَنيمَةَ إِلَّا خُرْثِىُّ الْمَتَاعِ وَأَمَانُهُ جَائِزٌ، وَأَمَانُ الْمَرْأَةِ جَائزٌ إِذَا هِىَ أَعْطَت الْقَوْمَ الأَمَانَ، قُلْتُ: إِيرَادُ (ق) لِهَذَا الْحَدِيثِ مِنْ سُنَنِ الأَشْعَثِ، عَنْ أَهْلِ الْبَيْتِ فِيه فَائدَةٌ جَلِيلَةٌ، فَإِنَّ (ق) الْتَزَمَ أَنْ لَا يُخْرِجَ فِى تَصَانِيفِهِ حَدِيثًا يَعْلَمُهُ مَوْضُوعًا، خُصُوصًا أَنَّهُ أَوْرَدَهُ فِى السُّنَنِ الْكُبْرَى الَّتِى هِىَ أَجَلُّ كُتُبِهِ، وَهِىَ عَلَى أَبْوابِ الأَحْكَامِ الَّتِى لَا يُتَسَاهَلُ فِى أَحَادِيثِهَا، وَقَدْ كُنْتُ أَتَوقَّى الأَحَادِيثَ الَّتِى فِى سُنَنِ ابْنِ الأَشْعَثِ لأَنَّهُمْ تَكَلَّمُوا فِيهِ، وَفِيهَا قَالَ الذَّهَبِىُّ فِى الْمِيزَانِ: ومْحَمَّدُ بْنُ مُحَمَّدِ بْنِ الأَشْعَثِ الْكُوفِىُّ

أَبُو الْحَسَنِ نَزِيلُ مِصْرَ، قَالَ عد: كَتَبت عَنْهُ بِهَا جُمْلَةً، ثُمَّ إِنَّهُ أَخْرَجَ إِلَيْنَا نُسْخَةً قَرِيبًا مِنْ أَلْفِ حَدِيث عَنْ إِسْمَاعِيلَ بْنِ مُوسَى بْنِ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ آبَائِهِ بخَطٍّ طَوِىٍّ عامَّتُها مَنَاكِيرُ فَذَكَرْنَا ذَلِكَ للْحُسَيْن بْنِ عَلىِّ بْنِ الْحُسَيْنِ الْعَلَوِىِّ شَيْخِ أَهْلِ الْبَيْتِ بِمِصْرَ فَقَالَ: كانَ مُوسَى هَذَا جَارِى بِالْمَدِينَةِ أَرْبَعِينَ سَنَةً مَا ذَكَرَ قَطُّ أَنَّ عِنْدَهُ رِوَايَةً لَا عَنْ أَبِيهِ وَلَا عَنْ غَيْرِهِ فَمِنَ النُّسْخَةِ "نِعْمَ الفَّصُّ الْبَلُّورُ" وَمِنْهَا "شَرُّ الْبِقَاعِ دُورُ الأُمَرَاءِ الَّذِينَ لَا يقْضُونَ بِالْحَقِّ" وَمِنْهَا "ثَلَاثَةٌ ذَهَبتْ مِنْهُم الرَّحْمَةُ: الصَّيَّادُ والْقَصَّابُ وبَائِعُ الْحَيَوانِ"، وَمِنْهَا: "لَا خَيْلَ أَبْقَىَ مِنَ الدُّهْمِ، وَلَا امْرأَةً كَابْنَةِ الْعَمِّ، ومِنْهَا "اشْتَدَّ غَضَبُ اللهِ عَلَى مَنْ أَرَاقَ دَمِى وآذَانِى فِى عِتْرَتِى"، وَسَاقَ لَهُ عِدَّةَ مَوْضُوعَاتٍ.

قَالَ الْبَيْهَقِىُّ: سَأَلْتُ قَطّ فَقَالَ: إِنَّهُ مِنْ آيَاتِ اللهِ وَضْعَ ذَلِكَ الْكِتَابِ يَعْنِى الْمَعْلُومَاتِ انْتَهَى مَا فِى الْمِيزَانِ، قَالَ الْحَافِظُ ابْنُ حَجَرٍ فِى اللِّسَانِ: وَقَدْ وَقَفْتُ عَلَى بَعْضِ الكِتَابِ الْمَذْكورِ وَسَمَّاهُ السُّنَنَ، وَرَتَّبَهُ عَلَى الأَبْوابِ، وكُلُّهُ لِسَنَدٍ وَاحِدٍ انْتَهى".
