48. Suckling
٤٨۔ كِتَابُ الرَّضَاعِ
فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَأَعْرَضَ وَتَبَسَّمَ النَّبِيُّ ﷺ وَقَالَ وَكَيْفَ وَقَدْ قِيلَ
إِنِّي قَدْ أَرْضَعْتُكُمَا فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ إِنِّي تَزَوَّجْتُ فُلَانَةَ بِنْتَ فُلَانٍ فَجَاءَتْنَا امْرَأَةٌ سَوْدَاءُ فَقَالَتْ إِنِّي قَدْ أَرْضَعْتُكُمَا وَهِيَ كَاذِبَةٌ فَأَعْرَضَ عَنِّي فَجِئْتُهُ مِنْ قِبَلِ وَجْهِهِ فَقُلْتُ إِنَّهَا كَاذِبَةٌ فَقَالَ وَكَيْفَ وَقَدْ زَعَمَتْ أَنَّهَا قَدْ أَرْضَعَتْكُمَا دَعْهَا عَنْكَ
[Machine] He married Umm Yahya bint Abi Ahad and a black slave girl came and said, "I breastfed both of you." I mentioned this to the Messenger of Allah ﷺ , but he turned away from me. So I left, but then I mentioned it to him again and he said, "How can that be when she claims to have breastfed both of you?" He prohibited me from doing so. This is the wording of the hadith of Yahya bin Sa'id.
أَنَّهُ تَزَوَّجَ أُمَّ يَحْيَى بِنْتَ أَبِي أَهَابٍ فَجَاءَتْ أَمَةٌ سَوْدَاءٌ فَقَالَتْ قَدْ أَرْضَعْتُكُمَا فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَأَعْرَضَ عَنِّي فَتَنَحَّيْتُ ثُمَّ ذَكَرْتُهُ لَهُ فَقَالَ كَيْفَ وَقَدْ زَعَمَتْ أَنَّهَا قَدْ أَرْضَعَتْكُمَا فَنَهَاهُ عَنْهَا لَفْظُ حَدِيثِ يَحْيَى بْنِ سَعِيدٍ
[Machine] "I came to the Prophet ﷺ and mentioned that to him, but he turned away. So I moved away and mentioned it to him again. He said to me, 'How can that be when it has been claimed that she breastfed both of you?' Ash-Shafi'i said his turning away is similar to not having seen her as a witness who could have testified, and his saying 'How can that be when it has been claimed that she breastfed both of you?' is similar to him disliking to live with her, even though it has been said to him that she is his sister through breastfeeding. And this is the meaning of what we have said: that he left her out of aversion, not ruling."
فَجِئْتُ إِلَى النَّبِيِّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَأَعْرَضَ فَتَنَحَّيْتُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ لَهُ كَيْفَ وَقَدْ زَعَمَتْ أَنَّهَا أَرْضَعَتْكُمَا قَالَ الشَّافِعِيُّ إِعْرَاضُهُ ﷺ يُشْبِهُ أَنْ يَكُونَ لَمْ يَرَهَا شَهَادَةً تُلْزِمُهُ وَقَوْلُهُ كَيْفَ وَقَدْ زَعَمَتْ أَنَّهَا أَرْضَعَتْكُمَا يُشْبِهُ أَنْ يَكُونَ كَرِهَ لَهُ أَنْ يُقِيمَ مَعَهَا وَقَدْ قِيلَ لَهُ إِنَّهَا أُخْتُهُ مِنَ الرَّضَاعَةِ وَهَذَا مَعْنَى مَا قُلْنَا مِنْ أَنْ يَتْرُكَهَا وَرَعًا لَا حُكْمًا
[Machine] Your wife is not needed in this message and it is sent from another source.
دُونَكَ امْرَأَتَكَ هَذَا مُرْسَلٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ
[Machine] It is not permissible for women to be less than four.
لَا تَجُوزُ مِنَ النِّسَاءِ أَقَلُّ مِنْ أَرْبَعٍ
[Machine] A man or a woman, this is a weak chain of narration that does not establish proof. Muhammad ibn Uthaymeen is accused of lying, and Ibn Baylaman is weak and there is a disagreement about his text. Some say it is like this, and some say it is a man and a woman, and some say it is a man and two women. And Allah knows best.
رَجُلٌ أَوِ امْرَأَةٌ فَهَذَا إِسْنَادٌ ضَعِيفٌ لَا تَقُومُ بِمِثْلِهِ الْحُجَّةُ مُحَمَّدُ بْنُ عُثَيْمٍ يُرْمَى بِالْكَذِبِ وَابْنُ الْبَيْلَمَانِيِّ ضَعِيفٌ وَقَدِ اخْتُلِفَ عَلَيْهِ فِي مَتْنِهِ فَقِيلَ هَكَذَا وَقِيلَ رَجُلٌ وَامْرَأَةٌ وَقِيلَ رَجُلٌ وَامْرَأَتَانِ وَاللهُ أَعْلَمُ
