"A grandmother - the mother of a mother, or the mother of a father - came to Abu Bakr and she said: 'a son of my son' - or, 'a son of my daughter died, and I have been informed that there is a right ( from the wealth) for me in the Book.' So Abu Bakr said: 'I do not find that there is a right for you in the Book, and I have not heard that the Messenger of Allah ﷺ judged anything for you. I shall ask the people.' So, Al-Mughirah bin Shu'bah testified that the Messenger of Allah ﷺ gave her (case) a sixth. He said: 'And who heard that along with you?' He said: 'Muhammad bin Maslamah.'" He said: "So he gave her a sixth. Then the other grandmother who was left behind came to 'Umar." Sufyan said: "And Ma'mar said to me in addition, from Az-Zuhri - and I do not remember it to be from Az-Zuhri, rather I remember it to be from Ma'mar - that 'Umar said: 'If the two of you are together then it is for both of you, and whichever of you is alone with it (the sixth), then it is for her.'"  

جَاءَتِ الْجَدَّةُ أُمُّ الأُمِّ أَوْ أُمُّ الأَبِ إِلَى أَبِي بَكْرٍ فَقَالَتْ إِنَّ ابْنَ ابْنِي أَوِ ابْنَ بِنْتِي مَاتَ وَقَدْ أُخْبِرْتُ أَنَّ لِي فِي كِتَابِ اللَّهِ حَقًّا فَقَالَ أَبُو بَكْرٍ مَا أَجِدُ لَكِ فِي الْكِتَابِ مِنْ حَقٍّ وَمَا سَمِعْتُ رَسُولَ اللَّهِ ﷺ قَضَى لَكِ بِشَيْءٍ وَسَأَسْأَلُ النَّاسَ قَالَ فَسَأَلَ فَشَهِدَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَّ رَسُولَ اللَّهِ ﷺ أَعْطَاهَا السُّدُسَ قَالَ وَمَنْ سَمِعَ ذَلِكَ مَعَكَ قَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ قَالَ فَأَعْطَاهَا السُّدُسَ ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى الَّتِي تُخَالِفُهَا إِلَى عُمَرَ قَالَ سُفْيَانُ وَزَادَنِي فِيهِ مَعْمَرٌ عَنِ الزُّهْرِيِّ وَلَمْ أَحْفَظْهُ عَنِ الزُّهْرِيِّ وَلَكِنْ حَفِظْتُهُ مِنْ مَعْمَرٍ أَنَّ عُمَرَ قَالَ إِنِ اجْتَمَعْتُمَا فَهُوَ لَكُمَا وَأَيَّتُكُمَا انْفَرَدَتْ بِهِ فَهُوَ لَهَا  

“A grandmother came to Abu Bakr Siddiq and asked him for her inheritance. Abu Bakr said to her: ‘You have nothing according to the Book of Allah, and I don’t know of anything for you according to the Book of Allah, and I don’t know of anything for you according to the Sunnah of the Messenger of Allah ﷺ. Go back until I ask the people.’ So he asked the people and Al-Mughirah bin Shu’bah said: ‘I was present with the Messenger of Allah ﷺ and he gave her (the grandmother) one sixth.’ Abu Bakr said: ‘Is there anyone else with you (who will corroborate what you say)?’ Muhammad bin Maslamah Al-Ansari stood up and said something like what Mughirah bin Shu’bah had said. So Abu Bakr applied it in her case.”  

جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ لَهَا أَبُو بَكْرٍ مَا لَكِ فِي كِتَابِ اللَّهِ شَىْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللَّهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللَّهِ ﷺ أَعْطَاهَا السُّدُسَ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى مِنْ قِبَلِ الأَبِ إِلَى عُمَرَ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ شَىْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلاَّ لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَاكِ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا  

[Machine] Abu Bakr's grandmother, the mother of his father or the mother of his mother, came to him and said, "My son's son or my daughter's son has passed away and I was informed that I have a share. What is it for me?" Abu Bakr replied, "I did not hear the Messenger of Allah ﷺ saying anything about this, but I will ask the people." After performing the Dhuhr prayer, Abu Bakr asked, "Which one of you heard the Messenger of Allah ﷺ saying something about the grandmother?" Al-Mughirah bin Shu'bah replied, "I heard him saying, 'He gave her one-sixth.'" Abu Bakr asked, "Does anyone else know this except you?" Muhammad bin Muslimah said, "Yes, he is truthful." So Abu Bakr gave her one-sixth. Then another woman with a similar case came to Umar and said, "I do not know what I have heard from the Messenger of Allah ﷺ about this, but I will ask the people." They informed her with the narration of Al-Mughirah bin Shu'bah and Muhammad bin Muslimah. Umar said, "If any one of you had a share by herself, she should have one-sixth, but if both of you share together, then it is between you."  

جَاءَتْ إِلَى أَبِي بَكْرٍ جَدَّةٌ أُمُّ أَبٍ أَوْ أُمُّ أُمٍّ فَقَالَتْ إِنَّ ابْنَ ابْنِي أَوِ ابْنَ ابْنَتِي تُوُفِّيَ وَبَلَغَنِي أَنَّ لِي نَصِيبًا فَمَا لِي؟ فَقَالَ أَبُو بَكْرٍ مَا سَمِعْتُ رَسُولَ اللَّهِ ﷺ قَالَ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَلَمَّا صَلَّى الظُّهْرَ فقَالَ أَيُّكُمْ سَمِعَ رَسُولَ اللَّهِ ﷺ قَالَ فِي الْجَدَّةِ شَيْئًا؟ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ أَنَا قَالَ مَاذَا؟ قَالَ «أَعْطَاهَا رَسُولُ اللَّهِ ﷺ سُدُسًا» قَالَ أَيَعْلَمُ ذَاكَ أَحَدٌ غَيْرُكَ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ صَدَقَ فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ فَجَاءَتْ إِلَى عُمَرَ مِثْلُهَا فَقَالَ مَا أَدْرِي مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ فِيهَا شَيْئًا وَسَأَسْأَلُ النَّاسَ فَحَدَّثُوهُ بِحَدِيثِ الْمُغِيرَةِ بْنِ شُعْبَةَ وَمُحَمَّدِ بْنِ مَسْلَمَةَ فَقَالَ عُمَرُ «أَيُّكُمَا خَلَتْ بِهِ فَلَهَا السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فَهُوَ بَيْنَكُمَا»  

“A grandmother came to Abu Bakr Siddiq and asked him for her inheritance. أَنَّهُ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ مِنْ شَيْءٍ وَمَا أَعْلَمُ لَكِ فِي سُنَّةِ رَسُولِ اللَّهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ «حَضَرْتُ رَسُولَ اللَّهِ ﷺ أَعْطَاهَا السُّدُسَ» فَقَالَ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَ لَهَا أَبُو بَكْرٍ السُّدُسَ ثُمَّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ مِنْ شَيْءٍ وَمَا كَانَ الْقَضَاءُ الَّذِي قَضَى بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا  

A grandmother came to AbuBakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah ﷺ Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shu'bah said: I had been present with the Messenger of Allah ﷺ when he gave grandmother a sixth. AbuBakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shu'bah had said. So AbuBakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all. (Using translation from Abū Dāʾūd 2894)   

جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ لَهَا أَبُو بَكْرٍ ؓ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا السُّدُسَ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ؓ ثُمَّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قَضَى بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَاكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا  

"عَنْ قَبِيصَةَ بْنِ ذُوئَيبٍ، قَالَ: جَاءَتِ الْجَدَّةُ إِلَى أَبِى بَكْرٍ تَطلُبُ مِيرَاثَهَا مِن ابْنِ ابْنِهَا أَوْ مِن ابْنِ بِنْتِهَا، فَقَالَ أَبُو بَكْرٍ: مَا أَجِدُ لَكِ في الْكِتَابِ شَيْئًا، وَمَا سَمِعْتُ رَسُولَ الله ﷺ يَقْضِى لَكِ بِشَىْءٍ وَسَأسْألُ النَّاسَ الْعَشِيَّةَ، فَلَمَّا صَلَّى الظُّهْرَ أَقْبَلَ عَلَى النَّاسِ فَقَالَ: إِنَّ الْجَدَّةَ أَتَتْنِى تَسْأَلُنِى مِيرَاثَهَا من ابْنِ ابْنِها أَوِ ابْنِ ابْنَتِهَا وَإنِّى لَمْ أَجِدْ لَهَا في الْكِتَابِ شَيْئًا، وَلَمْ أَسْمَعْ النَّبِىَّ ﷺ يَقْضى لَهَا بِشَىْءٍ، فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ الله ﷺ فِيهَا شَيْئًا، فَقَامَ الْمغِيرَةُ بْنُ شُعْبَةَ فَقَالَ: شَهِدْتُ رَسُولَ الله ﷺ يقضى لَهَا

بالسدس، فَقَالَ: مَنْ مَعَكَ يَشْهَدُ؟ فَشَهِدَ مُحَمَّدُ بْنُ سَلَمَةَ، فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ، فَلَمَّا كَانَ خِلَافَةُ عُمَرَ جَاءَتْهُ الْجَدَّةُ الَّتِى تُخَالِفُهَا فَقَالَ عُمَرُ: إِنَّمَا كانَ الْقَضَاءُ في غَيْرِكِ وَلَكِنْ إِذَا اجْتَمَعْتُمَا، فَالسُّدُسُ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِه فَهُوَ لَهَا".
