the Messenger of Allah ruled that for a fetus which is killed in the mother's womb, a male or female slave be given (as Diyah). The one against whom he passed this ruling said: "How can I pay blood money for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked." The Messenger of Allah said: "This is one of the soothsayers."'

Two ladies (had a fight) and one of them hit the other with a stone on the ʿAbdomen and caused her to abort. The Prophet ﷺ judged that the victim be given either a slave or a female slave (as blood-money). Narrated Ibn Shihab: Saʿid bin Al-Musayyab said, "Messenger of Allah ﷺ judged that in case of child killed in the womb of its mother, the offender should give the mother a slave or a female slave in recompense The offender said, How can I be fined for killing one who neither ate nor drank, neither spoke nor cried: a case like that should be denied ' On that Messenger of Allah ﷺ said 'He is one of the brothers of the foretellers

The one against whom this verdict was passed said: ' Should we pay blood money for one who neither ate, drunk, shouted, nor cried, (at the moment of birth)? One such as this should be overlooked .' Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab that the Messenger of Allah ﷺ gave a judgement that the compensation for a foetus killed in its mother's womb was a slave or slave-girl of fair complexion and excellence. The one against whom the judgement was given said, "Why should I pay damages for that which did not drink or eat or speak or make any cry. The like of that is nothing." The Messenger of Allah ﷺ said, "This is only one of the brothers of the diviners." He disapproved of the rhyming speech of the man's declaration.
