عَلَيْهِ إِنْ قَدَرَ عَلَيْهِ لَيَقْطَعَنَّ يَدَهُ فَأَرْسَلَنِي أَسْأَلُ سَمُرَةَ فَسَأَلْتُهُ فَقَالَ كَانَ نَبِيُّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ فَأَتَيْتُ عِمْرَانَ فَسَأَلْتُهُ فَقَالَ كَانَ نَبِيُّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ وَهَذَا الْحَدِيثُ قَدْ رُوِيَ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ مِنْ غَيْرِ وَجْهٍ وَرَوَاهُ عَنِ الْحَسَنِ غَيْرُ وَاحِدٍ عَنْ عِمْرَانَ وَلَمْ يُدْخِلْ بَيْنَ عِمْرَانَ وَالْحَسَنِ أَحَدًا غَيْرَ قَتَادَةَ
Al-Hayyaj ibn Imran ibn Husayn reported that a slave of Imran ran away. He took a vow to Allah that if he overpowers him, he will cut off his head. He then sent me (to Samurah ibn Jundub) to ask him about this question for him. I came to Samurah ibn Jundub and asked him. He said: The Messenger of Allah ﷺ used to exhort us to give alms (sadaqah) and forbid us to mutilate (a slain). I then came to Imran ibn Husayn and asked him. He said: The Messenger of Allah ﷺ used to exhort us to give alms (sadaqah) and forbid us to mutilate (a slain).
أَنَّ عِمْرَانَ أَبَقَ لَهُ غُلاَمٌ فَجَعَلَ لِلَّهِ عَلَيْهِ لَئِنْ قَدَرَ عَلَيْهِ لَيَقْطَعَنَّ يَدَهُ فَأَرْسَلَنِي لأَسْأَلَ لَهُ فَأَتَيْتُ سَمُرَةَ بْنَ جُنْدَبٍ فَسَأَلْتُهُ فَقَالَ كَانَ نَبِيُّ اللَّهِ ﷺ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ فَأَتَيْتُ عِمْرَانَ بْنَ حُصَيْنٍ فَسَأَلْتُهُ فَقَالَ كَانَ رَسُولُ اللَّهِ ﷺ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ
[Machine] A father made a vow that if his son survives, he will cut off a part of his hair. When the son survived, he sent me to Imran ibn al-Husayn to ask for clarification. Imran advised me to ask my father to either free his son or to pay compensation for breaking the vow, as the Prophet ﷺ encouraged giving charity and discouraged fulfilling vows through such actions. I then went to Samurah and asked him the same question. He gave a similar response, which was narrated by Ma'mar, Hammam, and Qatadah from Al-Hasan, and Hiyaj from Sa'id ibn Abi Arubah. However, Sa'id ibn Abi Arubah and Hammam ibn Yahya held a different opinion.
أَنَّ غُلَامًا لِأَبِيهِ أَبَقَ فَجَعَلَ عَلَيْهِ نَذْرًا لَئِنْ قَدَرَ عَلَيْهِ لَيَقْطَعَنَّ مِنْهُ طَابِقًا فَلَمَّا قَدَرَ عَلَيْهِ أَرْسَلَنِي إِلَى عِمْرَانَ بْنِ الْحُصَيْنِ فَسَأَلْتُهُ فَقَالَ عِمْرَانُ مُرْ أَبَاكَ أَنْ يُعْتِقَ غُلَامَهُ أَوْ يُكَفِّرَ عَنْ يَمِينِهِ «فَإِنَّ رَسُولَ اللهِ ﷺ كَانَ يَحُثُّنَا عَلَى الصَّدَقَةِ وَيَنْهَانَا عَنِ الْمُثْلَةِ» فَأَتَيْتُ سَمُرَةَ فَسَأَلْتُهُ فَقَالَ مِثْلَ قَوْلِ عِمْرَانَ هَكَذَا رَوَاهُ مَعْمَرٌ وَهَمَّامٌ وَقَتَادَةُ عَنِ الْحَسَنِ عَنْ هَيَّاجٍ «وَخَالَفَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ وَهَمَّامُ بْنُ يَحْيَى»
