[Machine] A camel belonging to Al-Bara' ibn 'Azib entered a man's garden and caused damage. The Messenger of Allah ﷺ ruled that people should protect their wealth during the day and their livestock at night, and likewise (continue to do so)  

البيهقي:١٧٦٨٢ – أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ الْمَرْوَزِيُّ ثنا عَبْدُ الرَّزَّاقِ أنبأ مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ عَنْ أَبِيهِ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْ فَقَضَى رَسُولُ اللهِ ﷺ عَلَى أَهْلِ الْأَمْوَالِ حِفْظُهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي حِفْظُهَا بِاللَّيْلِ وَكَذَلِكَ  

رَوَاهُ جَمَاعَةٌ عَنْ عَبْدِ الرَّزَّاقِ وَخَالَفَهُ وُهَيْبٌ وَأَبُو مَسْعُودٍ الزَّجَّاجُ عَنْ مَعْمَرٍ فَلَمْ يَقُولَا عَنْ أَبِيهِ

أبو داود:٣٥٦٩ – حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ الْمَرْوَزِيُّ حَدَّثَنَا عَبْدُ الرَّزَّاقِ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ عَنْ أَبِيهِ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْهُ عَلَيْهِمْ فَقَضَى رَسُولُ اللَّهِ ﷺ عَلَى أَهْلِ الأَمْوَالِ حِفْظَهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ  

malik:36-48 – Yaḥyá > Mālik > Ibn Shihāb > Ḥarām b. Saʿd b. Muḥayyiṣah

Yahya related to me from Malik from Ibn Shihab from Haram ibn Sad ibn Muhayyisa that a female camel of al-Bara ibn Azib entered the garden of a man and it did some damage to it. The Messenger of Allah ﷺ gave a judgement that the people of the garden were responsible for guarding it in the day, and the owner of the animals was liable for what the animals destroyed at night.  

مالك:٣٦-٤٨ – حَدَّثَنِي يَحْيَى عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ حَرَامِ بْنِ سَعْدِ بْنِ مُحَيِّصَةَ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْ فِيهِ فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ وَأَنَّ مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا
